The meeting of the Approval Committee of Noida SEZ was held on 26/09/2013

at 11:30 AM in the Conference Hall of NSEZ, Noida. The meeting was chaired by Shri

Jayant Misra, Development Commissioner, Noida SEZ. Following members were

present:

GIST OF THE MEETING:

Ratification of Minutes of last meeting of the Approval Committee:

The Approval Committee ratified the minutes of the last meeting held on 26/08//2013.

Decisions on Proposals:

1. Proposal of Mis Bergen Technical Services Pvt. Ltd. for Amendment in LOA and

review of performance.

The Approval Committee discussed the agenda note and took following decisions:

(i) The Committee ratified the LOA of the unit for the period from 28/10/2011 to

08/05/2012.

(ii) The Committee decided to consider the request for LOA amendment of the unit

after the receipt of APR for the year 2012-13 from the unit.

(iii) The Committee directed the Dy. Commissioner of Customs, NSEZ to verify

whether the items i.e. Accelerometer, logger exported by the unit are as per

authorised operations allowed in the LOA issued to the unit, and place the

report in the next meeting of the Committee.

2. Proposal of Mis Stable Packaging Pvt. Ltd. for inclusion of Additional items as

The Committee deliberated on the proposal and approved the revised authorised

operations as per agenda note except 'various kind of adhesive powders and chemicals' for

which the unit has been directed to give specific details/nomenclatures for further

consideration.

The Committee also monitored the performance of the unit on the basis of APRs and noted

achievement of positive NFE by the unit as on 31/03/2013.

4. Proposal of MIs Popular Card Technology Pvt. Ltd for inclusion of Additional items in

LOA.

Proposal of MIs Indeutsch Industries (unit-I) for inclusion of additional items in LOA.

The Committee considered and approved inclusion of 'manufacturing of Metallic Ferrules,

Tuffts, Brush Heads, Wooden/Plastic Shafts (Handles) and Metallic Pipe & Tubes"

The Committee deferred the proposal to its next meeting as unit representative did not

come to explain the proposal.

Proposal of MIs Neokraft Global Pvt. Ltd. for inclusion of additional items of

manufacture and trading in LOA.

The Committee deliberated on the proposal and approved inclusion of following items in the

LOA:

Items of Manufacture:

1. Commercial Ughtings.

2. Miscellaneous metal (Plated & coated such as nickel, chrome, brass, copper, zinc &

other antique finish, powder coated etc) products, such as Garden tools, hardware.

3. Miscellaneous types of lamp shades.

Items of Trading:

1. Commercial Ughtings

2. Electrical lightings & signaling equipment for automotive, work lamps, RCL lamps,

LEO based lamps etc.

3. Miscellaneous types of Lamp Shades.

regard to proposed inclusion of "Bathroom fixture & fittings' in LOA, for further

consideration.

6. Proposal for Monitoring of performance of MIs Balaji Universal Tradelink Pvt. Ltd.

(LOA dated 01/11/2007)

The Committee monitored the performance of the unit and directed to realize the pending

export proceeds as per prevailing RBI guidelines. The Committee further empowered the

DC, NSEZ to take appropriate decision on the SCN dated 30/05/2013 issued to the unit.

7. Proposal for review of performance of MIs Jagat Gems & Jewellery.

The Committee deferred the proposal for the next meeting with. the directions to the unit

representative to submit schedule of implementation/revival of production.

8. Proposal for review of performance of MIs. Usha Global Corporation.

On the request from the Committee deferred the review for next meeting.

9. Review of compliance with Pollution control norms by MIs Indeutsch Industries (Plot

No. 39-41) and MIs Nano Electrotech Pvt. Ltd. (SDF: F-3B).

The Committee took note of the compliance made by the above two units. It was informed

by the representative from the UPPCB that the next date of hearing is fixed on 03/11/2013

before the National Green Tribunal on the matter. The Committee therefore decided to

review the case again after 03/11/2013.

10. Proposal for revision of the list of default services approved by the Approval

Committee in the meeting held on 30.07.2013, in terms of Notification No. 12/2013-ST

dated 01.07.2013.

The Approval Committee noted that in order to maintain uniformity in the SEZs across the

country, Department of Commerce, Govt. of India has approved/issued list of default

services containing 58 Services, vide letter no. 12/25/2012-SEZ dated 16th September'

2013, as given below:

After due deliberations, in terms of Notification No. 12/2013-ST dated 01.07.2013, the

Committee gave its approval to the effect that the list of default services as approved by the

Approval Committee in its meeting held on 30107/2013 for the units in Noida SEZ be

substituted by the above list of 58 nos. services. The Committee also decided that all the

proposals of individual units for approval of services received up to 26/09/2013 shall be

accordingly treated as disposed of. However, units may apply afresh for any additional

service(s) which are not contained in the above listed 58 nos. services.

11. Proposal for Transfer of assets of Mis P.C. Impex to Mis J.S. Designer Ltd.

The Committee noted that the office of DC, NSEZ has given the in principle approval to Mis

J.S. Designer Ltd. to take over the assets of MIs P.C. Impex vide letter dt. 17/02/2012.

Now the matter is placed before the Committee as MIs J.S. Designer Ltd. vide its letter dt.

31/08/2013 has deposited transfer charges amounting to Rs. 53,11,3501- and has also

requested to accord permission to take over the assets by it.

After due deliberation, in view of Rule 74Aof SEZ Rules, 2006, the Committee approved

the transfer of the assets of MIs P.C. Impex in favour of MIs J.S. Designer Ltd. subject to

\ fulfilment of exit formalities by MIs P.C. Impex. The Committee extended the validity of

LOA of MIs P.C. Impex up to 31/12/2013 as requested by the unit vide its letter dt.

19/09/2013 to facilitate the exit formalities.

12. Monitoring of APRs/Performance:

The Committee monitored the performance of the following units as per details below:

1. Boeing International Corporation India Pvt. Ltd.: The Committee monitored the

performance of the unit on the basis of APRs and noted achievement of positive

NFE by the unit as on 31/03/2013.

2. Kunal Exports: The Committee monitored the performance of the unit on the basis

of APRs and noted achievement of positive NFE by the unit as on 31/03/2013.

3. Shanta Trading Services: The Committee monitored the performance of the unit on

the basis of APRs and noted achievement of positive NFE by the unit as on

31/03/2013.

Decision on additional agenda items:

1. Proposal of MIs Lakeland Gloves & Safety Apparel Pvt. Ltd. for review of

performance & LOA Renewal

The Committee was informed that the unit is NFE negative on cumulative basis.

Noting that the unit has been issued SCN for being NFE negative and the

adjudication process by DC is in final stage, the Committee extended the LOA

of the unit for next five years, as requested by the unit. The Committee also

directed the unit to submit details of authorized operations it actually wants to

carry out, for further review by the Committee.

2. Proposal for review of performance of MIs Groupe Isource.

The Committee monitored the performance of the unit on the basis of APRs and

noted achievement of positive NFE by the unit as on 31/03/2013.
