ENVIRONMENT PROTECTION ACT 1993Approval of Category B Containers

I, ANDREA KAYE WOODS, Team Leader, Container Deposit Legislation and Delegate of the Environment Protection Authority (‘the Authority’), pursuant to Section 68 of the Environment Protection Act 1993 (SA) (‘the Act’) hereby:Approval of Category B Containers

Approve as Category B Containers, subject to the conditions in subclauses 1, 2, 3 and 4 below, each of the classes of containers identified by reference to the following matters described in the first 4 columns of Schedule 1 of this Notice which are sold in South Australia:

(a) the product which each class of containers shall contain;(b) the size of the containers;(c) the type of containers;(d) the name of the holders of these approvals.

(1) That containers of the class to which the approval relates must bear the refund marking specified by the Authority for containers of that class.The Authority specifies the following refund markings for Category B containers:(i) ‘10c refund at collection depots when sold in S.A.’, or(ii) ‘10c refund at S.A./N.T. collection depots in State/Territory of purchase’.

(2) The holder of the approval must have in place an effective and appropriate waste management arrangement in relation to containers of that class. For the purpose of this approval notice the company named in Column 5 of Schedule 1 of this Notice is the nominated super collector.

(3) In the case of an approval in relation to Category B containers that the waste management arrangement must require the holder of the approval to provide specified super collectors with a declaration in the form determined by the Authority in relation to each sale of such containers by the holder of the approval as soon as practicable after the sale.

(4) The holder of these approvals must ensure that if a sticker bearing the refund marking has been approved, and is applied to the container, then the sticker must not be placed on any portion of the opening mechanism or in any other place that would require complete or partial removal of the sticker before the contents may be consumed.

I, ANDREA KAYE WOODS, Delegate of the Environment Protection Authority (‘the Authority’), pursuant to Section 68 of the Environment Protection Act 1993 (SA) (‘the Act’) hereby revoke the approvals of the classes of Category B containers sold in South Australia as identified by reference to the following matters, which are described in the first 4 columns of Schedule 1 of this Notice:

(a) the product which each class of containers shall contain;(b) the size of the containers;(c) the type of containers; and(d) the name of the holders of these approvals.

These approvals are revoked as the Authority is satisfied that the waste management arrangement between the approval holder and the party named in Column 5 of Schedule 1 of this Notice has been cancelled.

(Amendment No. 27)BY virtue and in pursuance of Section 72 of the Supreme Court Act 1935 and all other enabling powers. We, Judges of the Supreme Court of South Australia, make the following Supreme Court Civil Rules 2006 (Amendment No. 27).

1. These Rules may be cited as the Supreme Court Civil Rules 2006 (Amendment No. 27).

2. The Supreme Court Civil Rules 2006 are amended as set out below.3. The amendments made by these Rules come into effect on 1 October 2014 or the

date of their gazettal, whichever is later.4. Rule 35 is amended by adding at the end of the first sentence to Example 1 to

subrule (2) ‘when the action is proceeding on pleadings and not affidavits under Rule 96’.5. The heading ‘Division 2—Service of originating process’ immediately before Rule

39 is deleted.6. Rule 45 (1) is amended by substituting ‘or’ for ‘and’ at the end of paragraph (b). 7. Rule 160 is amended by substituting ‘copies of written communications and details

of any oral’ for ‘details of any’ at the commencement of paragraph (c) of subrule (5).8. A heading is inserted before the contents of Rule 183A as follows:

‘183A—Service of subpoena in New Zealand’9. A new Rule 259C is inserted after Rule 259B as follows:

‘259C—Judgment against defendant(1) A judgment given in a representative action against a representative

party is, subject to an order of the Court under subrule (2), binding on all persons represented by the representative party.

(2) A person apparently represented, or alleged to have been represented, in a representative action may apply to the Court for a declaration that the person is not bound by the judgment.

(3) The Court may make such a declaration if satisfied that the person was not in fact represented by the representative party.

(4) A judgment given in a representative action may only be enforced against a person represented by the representative party by permission of the Court and, before the Court gives its permission, it must allow the person a reasonable opportunity to make an application under subrule (2).’

(b) the consumption and possession of liquor within the area are authorised for the purposes of these regulations by the Wattle Range Council.

3—Description of area

The area in Millicent, generally known as the Millicent Memorial Swimming Lake and comprising Lot 11 DP 62489 and adjoining land, bounded as follows: commencing at the point at which the south-western boundary of Rendelsham Road meets the north-western boundary of Park Terrace, then south-westerly along that boundary of Park Terrace to the point at which it meets the fence that runs along the south-western boundary of the bitumenised access road immediately to the south-west of the Millicent Memorial Swimming Lake (the access road that runs across Lot 12 DP 62489 approximately 30 metres south-west of and parallel to the north-eastern boundary of Lot 12), then generally north-westerly along the fence and fence line on the south-western boundary of the access road to the south-eastern boundary of Battye Street, then north-easterly along that boundary of Battye Street to the south-western boundary of Rendelsham Road, then south-easterly along that boundary of Rendelsham Road to the point of commencement.

PORT PIRIE REGIONAL COUNCILROADS (OPENING AND CLOSING) ACT 1991Road Opening and Closing—Warnertown

NOTICE is hereby given, pursuant to Section 10 of the Roads (Opening and Closing) Act 1991, that the Port Pirie Regional Council proposes to make a Road Process Order to:

Open as road portion of Section 302 in the Hundred of Napperby more particularly delineated and numbered ‘1’ on the Preliminary Plan No. 14/0028 forming a realignment of Abbatoirs Road; and

Close the whole of South West Terrace and merge with adjoining Section 364 in the Hundred of Napperby, more particularly delineated and lettered ‘A’ on the Preliminary Plan No. 14/0028, in Exchange for land taken for new road ‘1’ above.A copy of the plan and a statement of persons affected are

available for public inspection at the Council Office, 115 Ellen Street, Port Pirie and the Adelaide Office of the Surveyor-General during normal office hours.

Any application for easement or objection must set out the full name, address and details of the submission and must be fully supported by reasons.

The application for easement or objection must be made in writing to the Council, P.O. Box 45, Port Pirie, S.A. 5540 within 28 days of this notice and a copy must be forwarded to the Surveyor-General at G.P.O. Box 1354, Adelaide, S.A. 5001. Where a submission is made, the Council will give notification of a meeting at which the matter will be considered.
