D R A F T . A N O R D I N A N C E TO A M E N D T H E T R A D E S A N D I N D U S T R I E S ( R E G U L A T I O N ) O R D I N A N C E .

B E IT ENACTED by the H i g h Commissioner for Palestine, wi th the advice of the Advisory

"Applicat ion of Ordinance.

C o u n c i l thereof 1. This Ordinance may be cited as the Trades and Industries (Regu­

lat ion) (Amendment) Ordinance, 1945, and shall be read as one wi th the Trades and Industries (Regulat ion) Ordinance, hereinafter re­ferred to as "the p r i n c i p a l Ordinance" .

2. Section 3 of the p r i n c i p a l Ordinance shall be repealed and the fo l lowing section shall be substituted therefor : —

3. This Ordinance shall apply— (a) i n every m u n i c i p a l area i n respect of a l l classi­

fied trades other than those i n respect of which the D i s t r i c t Commissioner of the D i s t r i c t w i t h i n which such m u n i c i p a l area is situated may, by order, declare that i t shall not a p p l y ;

( b ) i n any area, other than a m u n i c i p a l area, to which i t may, by order, be appl ied by the D i s t r i c t Commissioner of the D i s t r i c t w i t h i n which such area is situated i n respect of such classified trades as such D i s t r i c t Commissioner may by such order declare that i t shal l a p p l y . "

3. Sections 10, 11 and 12 of the p r i n c i p a l Ordinance shal l be repealed and the fo l lowing sections shall be substituted therefor: — "Offences. 10.—(1). A n y person shall be gu i l ty of an offence

who— ( c ) carries on a classified trade i n any area, being

a classified trade to which this Ordinance applies i n that area, otherwise than under the authori ty of a v a l i d licence granted under this Ordinance,

( b ) being the holder of a v a l i d licence granted under this Ordinance i n respect of a classified trade car r ied on by h im i n any area, being a classified trade to which this Ordinance applies i n that area, contravenes, or causes or permits any other person to contravene, any of the con­di t ions of the licence or any provisions of any rules made under section 13, or

(c) not being the holder of a v a l i d licence as afore­said, contravenes any rules made under section 13, or

( d ) refuses or neglects to produce his licence on de­mand made by any person who is authorised under section 9 to enter upon premises licensed i n respect of a classified trade, or obstructs any such person. -

(2) Notwi ths tanding any provis ion of law to the contrary, a l l such offences shall be deemed for a l l purposes to be misdemeanours. !

Closing orders. 1 1 . — ( l ) Where a charge has been brought under paragraphs ( a ) or ( b ) of section 10, the D i s t r i c t Commissioner of the D i s t r i c t i n which the premises are situated may make a provis ional closing order i n respect of a l l or any of the premises i n which the classified trade is car r ied on by the person against whom the charge has been brought. ;

(2) A provis ional closing order may at any time be' revoked by order of the D i s t r i c t Commissioner and shall cease to have effect i n the event of the charge be ing . wi thdrawn or the person accused being acquitted on the charge; but i f the person accused is convicted on the charge and the provis iona l closing order has not been revoked, the provis iona l closing

order sha.ll have effect, and. the l ike consequences shall ensue, as though i t was a closing order made under subsection (3).

(3) The D i s t r i c t Commissioner of the D i s t r i c t w i th in which the premises are situated may make a closing order i n respect of a l l or any of the premises i n which a classified trade is car r ied on by any person i f that person has been convicted on any charge brought under paragraph ( a ) or ( b ) of section 10 i n re la t ion to that classified trade carried, on by h i m ; but a closing order may at any t ime be revoked by order of the D i s t r i c t Commissioner, and shall cease to have effect i n the event of the convict ion being sub­sequently set aside.

(4) A n y person aggrieved by the mak ing of a pro­vis ional closing order or a closing order may appeal to the H i g h Commissioner i n Counc i l who may con­firm or revoke the order, but the lodging of any such a p p e a l shall not have the effect of s taying the operation of the order.

(5) A provis ional closing order or a closing order may authorise the police to enter upon the premises to which i t refers and remove or seal up any goods found thereon and. take such other steps as may be necessary to secure obedience to the order.

(G) A n y person who carries on a classified trade i n any premises i n respect of which a provis iona l closing order or a closing order is i n force i n re la t ion to that classified trade shall be g u i l t y of an offence.

Penalties. 12.—(1) A n y person convicted of an offence against paragraph («) of section 10, or of an offence against paragraph ( b ) of section 10 which is a cont inuing offence, or of an offence against subsection (6) of section 11 shall , subject to the provisions of subsection (3), be l iable to a fine of two hundred and fifty pounds or to imprisonment for s ix months or to both such penalties, and to a further fine of ten pounds or to further imprisonment for seven days or to both such further penalties for each day during; which the offence is continued.

(2) The H i g h Commissioner i n Counc i l may by order direct that, i n re la t ion to any specified class or description of classified trade, higher or lower max imum penalties shall be substituted for a l l or any of the penalties set out i n subsection (1) and there­upon this section shall have effect accordingly.

(3) F o r the purposes of subsection (1 )—

( a ) i t is hereby declared for the avoidance of doubt that the recommencement of an offence after an in terval constitutes a fresh offence;

(6) a prosecution may be inst i tuted, and the person accused may be convicted and sentenced, from time to time i n relat ion to any por t ion of the period du r ing which the offence continues to be committed, not being a por t ion of such period i n relat ion to which the !!erson accused has been previously convicted and sentenced for the offence.

(4) A n y person convicted of an offence against paragraph ( b ) of section 10 which is not a cont inu ing offence, or of an offence against paragraph (c) or ( d ) of that section, shall be liable to a fine of fifty pounds or to imprisonment for three months or to both such penalties.'' '

O B J E C T S A N D R E A S O N S .

I Th i s b i l l makes certain amendments to the Trades and Industries (Regulat ion) O r d i n -[ ance, Cap . 143.

The object of clause 3 is to enable provis ion to be made by Order for exc luding w i t h i n a M u n i c i p a l A r e a the app l ica t ion of the Ordinance to any pa r t i cu l a r classified trade or trades. F o r example, i t is considered that the classified trade of hawking might ap­propr ia te ly be controlled by M u n i c i p a l Bye-laws.

Clause 3 has two m a i n objects. The first object is to c l a r i fy and amend the law re la t ing to closing orders. A t present provis iona l closing orders are made by the D i s t r i c t Com­missioner whereas other closing orders are made by the C o u r t on convict ion. I t is con­sidered that a l l closing orders should be made by the D i s t r i c t Commissioner since there may be many circumstances affecting their m a k i n g which are ex t ra j u d i c i a l . O n the other hand i t is thought that there should be a r ight of appeal and the r igh t of appeal is accordingly given i n a l l cases to the H i g h Commissioner i n Counc i l . The provis ion o i the present section l l ( l ) ( c ) enabling provis iona l closing orders to be made i n cases m which the business of a licensee has been conducted so as to endanger publ ic health or publ ic order has been deleted. I n the first place there is no point i n enabling pro­v is iona l orders to be made i n these circumstances unless there is power also to make per­manent orders. I n the second place i t is thought that the tests of what constitutes danger to publ ic health or publ ic order should be l a i d down i n the Rules and not left to the dis­cretion of the D i s t r i c t Commissioner. The second object of Clause 3 is to increase the penalties. The present penalties are imprisonment for 15 days or a fine of £ P . 5 or both such penalties. These penalties are clearly inadequate. The new penalties w i l l be found in section 12 as re-enacted i n the clause.

Claxise 4 deletes the provis ion i n section 13 which requires a statement of the rules relevant to a classified trade to be endorsed upon the licence. Rules may change from time to time after a licence is issued. I t is f a i r to assume that a person who carries on a classified trade w i l l both wish and be able to acquaint himelf wi th the Rules applicable to that trade.
