He discussed the legislative interest in repealing deductions and credits on Gross Receipts Tax paid on medical services and moving to a flat tax that all health care providers would pay. Replacing a system that taxes some providers at varying rates and shelters others from any tax at all with a broad based tax of 2% on all licensed facilities and medical providers would elimi- nate the disparity in GRT assessed to different provider types, simplify a physician's tax filing, and increase the Medicaid budget by leverag- ing 3 to 1 federal matching funds. Some of the 2017 legislative issues for the 60- day session (January 17 - March 18) include: 1. SB145 - Scope of Practice Act would establish an interim legislative committee and deliberative process to study all expanded practice initiatives prior to intro- duction of legislation. 2. John Anderson reviewed the current eco-nomic shortfall of New Mexico and possibleinitiatives to increase revenues. He discussedthe legislative interest in repealing deductionsand credits on Gross Receipts Tax paid onmedical services and moving to a flat tax thatall health care providers would pay. 3. HB364 - Optometrists want to prohibit eye examina-tions and lens prescribing through telemedicine.

4. HB215 - Physician Assistants want to change the def-inition of profession and move from supervision by physi-cians to a collaborative practice with the health care team.

5. SB150 - Chiropractic profession wants to changedefinition to chiropractic medicine and add two cate-gories of certified advanced practice chiropractic physi-cians which would be allowed to prescribe, administer,inject and dispense dangerous drugs other than Schedule1 of the Controlled Substance Act.

6. SB82 - Amend the Non-Compete Act to prohibitemployers from placing provisions in their employee con-tracts which allow out of state operations as the legally-binding venue. New Mexico would be the venue on allnon-compete contracts for health care providers.

7. SB152 - Amend the Medical Practice Act to allow theNMMB to establish a special licensure fee of $100 to beused for loan forgiveness for physicians practicing in ruralareas to help recruit and retain physicians to New Mexico.

8. HB11 - Mandate health insurance benefits to coverthe cost of coronary artery calcium scans for atherosclero-sis screening.

9. HB260, SB180 - Expand the definition of "biologicalproduct" to include biosimilars and enable pharmacists tosubstitute them for brand name biologic medicines.

10. HB228, HB263 - Allow terminally-ill patientsaccess to investigational treatments that have passedbasic safety testing (Phase I) with the FDA, but are not yetavailable on pharmacy shelves.

11. HB171 - Allow physician-assisted suicide. 12. SB319 - Prohibit sale of E-cigarettes to anyone

under the age of 21.13. HB313 - Allow provider and carrier to negotiate

reimbursement rate for "surprise bills" for healthcare services received out of network for non-emergencytreatment.

As reported in October, NMMS was awarded a grant fromthe AMA Scope of Practice Partnership which was used todevelop a media campaign that includes a website, broad-cast advertising, and targeted online digital advertising forScope of Practice issues at the legislature. The response tothe tv ads, digital marketing, and requests for action via"Your Voice For Medicine" has been phenomenal and reallymade an impact on legislators and improved their under-standing of the complexity and urgency surrounding billsimpacting Medicine in the state. I was honored by the Speaker of the House in beingappointed to the Committee to Select the Public Member ofthe AMA Board, which I currently chair. I was recently select-ed as an officer of the AMA Forum for Medical Affairs. I authorthe AMA Reports for NMMS, and strive to keep physiciansinformed. I'm especially proud of my work in supporting ourmedical students and encouraging their involvement. I wouldbe honored to continue as one of your Delegates.

It has been an honor to serve as the YoungPhysician Delegate for the AMA for 2016. Itwould be a privilege to continue to be a voicefor the many issues that impact healthcare inour state and country. oncologist in urban and rural communities I will continue toadvocate for the unique needs of patients and physicians inthese areas. Q: Can pharmacists prescribe in NM? If so, what?

A: Pharmacists in NM can prescribe under Pharmacy Boardprotocols that have been allowed by law and specific rules.In New Mexico, pharmacists can become certified to:• Administer vaccinations to individuals of all ages.• Perform tuberculin skin testing.• Prescribe medications for emergency contraception and

tobacco cessation as well as naloxone to treat opiateoverdoses.

• Prescribe hormonal contraceptives (approved byMedical Board in November 2016. Pharmacy board willadopt the final rule. NMMS took a neutral position, hav-ing received comments pro and con equally on theexpanded ability to prescribe.)

Each year, UNM has a "Certification Day" in which fourth-year PharmD students can participate in training programsto become certified in any of the above activities.

Pharmacist Clinicians: New Mexico is one of only four statesin which pharmacists with advanced training have prescrip-tive authority under collaborative drug management proto-cols. Since 1993, the state of New Mexico has recognizedadvanced pharmacist providers, known as pharmacist clini-cians. Based on state statute and regulations, pharmacistsseeking to become pharmacists clinicians in New Mexicomust provide proof of completion of 60 hours of boardapproved physical assessment course work followed by a150-hour, 300-patient-contact preceptorship supervised bya physician or other practitioner with prescriptive authority.

The scope of practice for the Clinical pharmacist setsforth:"Pharmacist clinician" means a pharmacist with addi-tional training required by regulations adopted by the boardin consultation with the New Mexico medical board and theNew Mexico academy of physician assistants, who exercis-es prescriptive authority in accordance with guidelines orprotocol.

Q: Why are Medicaid payers in NM no longer will-ing to pay for nurse advice calls to the Nurse AdviceLine? The different centennial programs andstraight Medicaid had paid for this service in thepast, but will no longer be paying for the serviceafter 12/31/2016. Because of NM Medicaid payersno longer supporting this service, the NM Nurseadvice line can no longer pay for itself and will nolonger be available to the Medicaid patients in ourstate. This puts the burden of taking all after hourcalls on the physicians to either take the calls them-selves or pay for another nurse advice service.

A: Two of 4 the Medicaid MCOs participated with the NMNAL prior to Centennial Care. Centennial Care requiredeach MCO to have a NAL but did not mandate contractingwith the NM NAL since some of the MCOs leverage theirnational NALs. It makes better sense for the MCOs to haveinternal NALs since they are able to immediately accesspatient records while on the phone and better coordinatecare and referrals. The MCOs continue to pay NM NAL permember when members call the NM NAL instead of theirinternal NALs, but that isn't going to sustain them. NMHSDhas encouraged the NM NAL to diversify and seek otherfunding streams such as hospitals, after hour physicians,etc. HSD will not mandate that the MCOs contract with NMNAL. Medicaid financing must be tied back to a member-soMedicaid has been contributing its fair share for calls whenattributed to a Medicaid member.
