Nikah Form Instructions

General instructions:

Both parties (Bride & the Bridegroom), witnesses, and Jama’at President should read all

instructions. Nikah form is a legal document; don’t alter, white-out or write over on this

form.

Minimum processing time for headquarters’ verification is one week from the date of

receipt of a completed form. Allow at least another week for mailing. If you plan to bring

the form for verification by hand, please call 301-879-0110 and make an appointment

before coming.

A completed Nikah form must be submitted with the following documents:

a. Marriage certificate issued by the government authority.

b. Binding Arbitration Agreement issued by U.S. Jama’at.

c. Pre-marital counseling certificate issued by U.S. or other Jama’at.

Jama’at President is responsible for ensuring that the name, member code (in sections IV

and/or IV) and all other relevant information is accurate before signing a Nikah form. Do

not sign a Nikah form if the person does not belong to your Jamaat.

Either party (bride or bridegroom) can initiate the process of Nikah form completion. Four

copies of Nikah forms are to be completed with original signatures.

The amount of dowry money (Haq Mehr) must be clearly stated in US dollars. Otherwise,

please specify the currency (Pak rupees, Canadian dollars etc.).

According to the system of Jamaat, minimum dowry money for brides in Pakistan/India is

US $10,000. Prior permission from Hadhrat Khalifatul Masih is required if the dowry money

has to be less than US $10,000 in such cases.

When writing dates on the Nikah form, please spell out the month. For example, instead

of writing 4/8/2018, write April 8th 2018 to avoid confusion.

A Nikah must be announced by the Missionary/Murabbi. If this is not possible, a written

permission is required from National Amir.

After the Nikah announcement, all 4 copies the Nikah forms must be submitted to the

National headquarters for registration. Once registered, the headquarters retains two

copies for records and one copy each is returned via USPS to the bride and the bridegroom,

respectively.

FAQs pertaining to unique situations:

Who can be the bride’s guardian (Wali)? Bride’s father serves as the guardian. If for any

reason the father cannot serve as the guardian, then one of the bride’s relatives in the

following order will have to serve as the guardian (according to Fiqah Ahmadiyya):

Bride’s grandfather

Bride’s real brother

Bride’s step brother

Bride’s uncle (the brother of bride’s father)

If none of the above is available, a request is made to Hadhrat Khalifatul Masih to appoint

a guardian.

What if the bride or bridegroom was previously divorced? In case of previous divorce, a copy

of the divorce decree/certificate must be attached with the Nikah form. If the previous

divorce included a decision by the Qadha Board, a verification by the Department of Umur’

Amma regarding implementation of the decision is required before the Nikah can be

announced.

I need my Nikah forms quickly. Do you do expedited mailing? We use USPS first class mailing

which can take 5-7 business days for you to receive your completed Nikah forms within the

50-contiguous states of America. Please include a prepaid label for FedEx overnight

delivery if you need to receive your completed Nikah form urgently.

Are there any special requirements if the bride or bridegroom reside overseas? Signature of

National Amir is required if either the bride or the bridegroom reside outside the US or if

the Nikah will be performed overseas. It is important that one party should complete their

part of Nikah forms before sending it to the other party. This includes all original signatures,

dates, local President’s attestation and verification from National Amir.

Are there any special requirements if the Nikah is to be performed in India? Yes. US Nikah

forms are not valid if the Nikah is to be performed in India. Jamaat Ahmadiyya India

requires the following documents in such cases:

a. Nikah forms must be obtained Qadian, India as they have a unique serial number.

b. In addition to the above mentioned general instructions, a verification letter from

National Amir U.S.A is to be attached to a completed Nikah form. The National

headquarters will issue the said letter within two weeks of receiving a completed Nikah

form. It is the responsibility of the concerned party in the US to ensure that the verification

letter is kept along with the Nikah forms as the Nikah may not be announced without it.

Guidelines and instructions for Nikah in the USA Jamā‘at1

Here is what needs to be done – some of these instructions are not given in the Nikah forms but it is very

important that all these steps are completed in the order given below:

1. Have the civil marriage done and obtain marriage certificate. If civil marriage cannot be

performed before the Nikah then written approval from Amir USA is required that the Nikah can be

performed without the civil marriage. This approval note should be submitted with the completed

Nikah Forms to the Headquarters.

2. Four copies of the Nikah form are needed – all signatures should be original on all four copies

(photocopies of signatures are not acceptable). Marriage certificate and divorce papers (if applicable)

should be attached to each form - therefore four copies of the all the supporting documents are

required.

3. Both bride and groom must complete the “Binding Arbitration Agreement” and have this form

notarized (first 4 pages of “Binding Arbitration Agreement” document) – Effective January 1,

2015.

4. Bride and her guardian/Wali should complete the bride portion of the Nikah forms and have

witnesses (two adults) sign the forms.

5. Haq Mahr (Dower): Haq Mahr should be equivalent to groom’s income of 6 to 12 months. For

groom from USA, Huzoor (ayyadahullāhu ta‘ālā binaṣrihil-‘azīz) has fixed Ḥaq Mahr to be

US$10,000. In exceptional case groom can write to Huzoor (ayyadahullāhu ta‘ālā binaṣrihil-‘azīz) to

seek permission for amount less that the fixed amount.

6. Jamā‘at President of the bride’s Jamā‘at should complete the bride part of the forms and

sign/stamp. If groom lives outside of the US then Amīr Jamā‘at USA should also sign the form.

7. Groom should complete the groom part of the Nikah forms and have witnesses (two adults) sign the

forms.

8. A divorced groom (khula or otherwise) must complete form “Divorce Form” and submit to the local

President along with the Nikah Forms.

9. Jamā‘at President of the groom’s Jamā‘at should complete the groom part of the forms and

sign/stamp. If bride lives outside of the US then Amīr Jamā‘at USA should also sign the form.

10. Provide these forms to the missionary/president who is authorized to perform the Nikah – this

should be done at least one week prior to the Nikah date. If missionary is not available to perform

the Nikah then written approval is needed from Amir USA for any Jama’at President or another

person to perform the Nikah. This approval note should be submitted with the completed Nikah Forms

to the Headquarters.

11. After the Nikah is announced two witnesses should provide required information on the witness

section on page 4 and sign all forms (four of them!).

12. Missionary or the person performing the Nikah submits all four forms to the National

Headquarters (Attn: Saeed Malik, see address given below for the headquarters). The National

Headquarters registers the Nikah and sends two copies back to the person who submitted the forms.

This person then provides one copy each to the bride and groom for their records. Written

acknowledgement should be obtained from both parties that they have received the fully

executed forms.

GUIDELINES FOR MARRIAGE IN ISLĀM All marriages require vast stores of patience, kindness, humility, sacrifice, empathy, love, understanding, forgiveness, hard work, and endless prayers! Give it your best – it’s well worth the investment!

Pray together at every possible opportunity. Pray sincerely for one another; remind each other that the goal, individually and together, is to win Allāh’s pleasure.

Be ever mindful of the comfort, the health and the feelings of your spouse; smile often.

Safeguard the respect and honor of your spouse at all times; careless lapses in speech or action could affect your marriage adversely in the long run.

Maintain behavior that is conducive to household peace and tranquility; learn to compromise, show tolerance and how to express yourself – don’t expect mind reading skills from your spouse.

Act as guardians of one another’s property; be content and grateful for all Allāh’s bounties - as long as your spouse is providing for all reasonable needs according to his means, do not make excessive demands on him.

Whether both spouses are working outside the home or not, each should be fully aware of the household finances.

Make your spouse your main confidante, rather than your friends. Mutual trust is crucial in building a secure relationship. Be a good listener; give the most honest advice.

Consult one another in all important family matters and handle the outcome graciously, even if you have to agree to disagree. Whatever is best for your marriage and for the family unit is what is most important, not the need to be right.

No one likes to feel taken for granted or dismissed. Take time to show appreciation for what your spouse does for the family. Make time for each other, even with hectic schedules.

Try not to allow the luxury of familiarity over time make you lazy about your physical appearance in front of your spouse; the effort will not go unnoticed.

Always be inclined to overlook the minor shortcomings of your spouse and be generous in forgiving and forgetting- re-examine your own weaknesses first. Aim to resolve conflicts quickly; do not let negativity fester. Once resolved, do not regurgitate past problems.

Treat relatives of both sides equally, no matter how different their ways may be to yours; your efforts will strengthen mutual respect and affection.

Getting married should mean something, primarily that you are willing to do whatever it takes to ensure spending the rest of your lives together. Don’t start packing bags at the first sign of discord; view marriage as a lifelong sacred relationship & you’ll feel more committed to making it work. Don’t let trifles lead to situations where tempers are lost and threats of divorce are pronounced. Put issues

into perspective realistically, and pray; if major conflict still exists, seek confidential professional / spiritual guidance from reliable sources.

In essence, dispense with selfishness, and always treat your spouse the way you would like to be treated. Follow this rule & your marriage will have a greater chance for success. Ignore this rule & turmoil or even, God Forbid, permanent failure, could be around the corner.

ETIQUETTE OF WEDDING CELEBRATIONS

Mehndi

Mehndi function can be held if desired but is not obligatory. It should be held in the bride’s home and be limited to bride’s female relatives and close friends. If the home is very small, permission may be requested to rent a space.

Mehndi function should be kept simple and money should not be wasted on:

Celebrations held on several days well before the wedding day.

Different decorations of stage and bride’s seating for each day.

A large variety of foods.

Printed invitation cards just for Mehndi party.

Expensive and excessive clothing for the bride, groom, and other family members.

Only female members of groom’s family may be invited.

The selection of songs to be sung by the bride’s friends should be decent and avoid coarse language. The songs should not promote concept of “shirk” (association of someone with Allah) or concepts of other religions.

Similar functions in name of ‘ronaq’ from the groom’s side are very strongly discouraged.

The bride’s family provides the mehndi. The bringing of mehndi by the groom’s family is a Hindu custom and should be avoided.

Absolutely no dancing is allowed in any function.

Rukhsati (Wedding reception)

Purdah must be strictly observed with separate seating areas for men and women.

Money should NOT be wasted on:

Expensive and fancy bridal dresses for the purpose of showing off or to impressothers.

Expensive wedding invitations, excessive decoration of the house, stage, thebride’s seating.

Large variety of foods.

Playing songs or music is not permitted.

Any ring given to groom should not be made of gold.

Giving milk to drink to the groom and hiding his shoes to demand money from him should be avoided; this is a Hindu custom.

Only a female photographer/videographer is permitted on the women’s side when purdah-observing women are present. Men should not come to the women’s side for this purpose if non-family women are present.

Non-family men are not allowed to videotape at family events.

The groom and his male friends/relatives should not be called to the women’s side when purdah-observing women are present. An announcement should be made so they can put on their purdah.

Women servers only should be used on women’s side. This arrangement can be done before hand when the caterer is being selected.

At the time of Rukhsati (the bride departs with the groom) prayers should be offered instead of songs.

The bride should observe purdah when she arrives on women’s side and when she leaves with her husband. A large chador can be used for coverage.

The Holy Qur’ān should never be held over bride’s head to have her walk under it at the time of Rukhsati.

Money should not be wasted on rental of expensive cars or limousines.

Showing off the Jahaiz (things given to the bride by her parents) should not be practiced.

Gifts, money, or any form of Jahaiz from bride’s family should not be expected or demanded by groom’s family.

Giving gifts to the groom’s family or relatives from bride’s family to follow a custom should not be practiced.

Walimah

The same guidelines as for wedding reception should be followed.

Mixed gatherings are never allowed.

It is a Sunnah (practice) of the Holy Prophet (saw) to serve food at the Walimah, but it is not necessary that it should be a lavish feast or on a large scale.

The scale of the Walimah should be according to one’s own means.

The bride’s family should not be asked to contribute to the Walimah as it is responsibility of the groom’s family.

General Recommendations for Weddings

Wedding is a time of happiness thus appropriate celebration is recommended but no ostentation.

Prayers should be offered more than anything for the new couple.

Taqwa and simplicity should be the top priority. Wastage of money on any occasion for the purpose of showing off or to impress others should be avoided in every event.

Bid’at (innovations) from non-Islamic cultures must be avoided. These include:

Gift registry

Bridal showers

Requesting “no boxed” gifts, i.e. requesting monetary gifts only.

Father walking bride into women’s side or bridegroom receiving bride inwomen’s side when non-family women are present.

Bride and groom cutting cake together when non-family women are present.

Mixed gatherings are never permitted in any function. Purdah should always be observed.

Dancing in any event is not allowed.

Nikah form:

Groom – Completed and signed by the President of the groom’s Jama’at

If one party is outside of the USA then signatures of Amir of each country

are required.

Premarital Counseling Certificate

Binding Arbitration – signed by both parties and notarized.

Divorce Form: If it is not the first marriage of the Groom (in case of the

groom has divorced (including Khula) his wife).

Court Divorce Decree (If divorce took place through the country’s legal

system).

including reasonable attorney's fees, incurred by one side in order to obtain the other party's

performance of the terms of this Agreement.

VI. The decision of the Qadha’a Board shall be made in accordance with Ahmadiyya Jurisprudence. The

parties waive their right to contest the jurisdiction or procedures of the Qadha’a Board or the validity

of this Agreement in any other forum other than the Qadha’a Board. The parties agree to abide by the

bylaws of the Qadha’a Board (which are available by calling the Qadha’a Board). The Qadha’a

Board shall follow its bylaws, which shall govern this arbitration to the fullest extent permitted by

law.

VII. The parties agree to cooperate with the adjudication of the Qadha’a Board in every way and manner.

In the event of the failure of either party to appear before the Qadha’a Board upon reasonable notice,

the Qadha’a Board may issue its decision despite the defaulting party's failure to appear, and may

impose costs and other penalties as legally permitted.

VIII. This Agreement may be signed in one or more duplicates, each one of which shall be considered an

original.

IX. This Agreement constitutes a fully enforceable arbitration agreement. Should any provision of this

Agreement be deemed unenforceable, all other surviving provisions shall still be deemed fully

enforceable; each and every provision of this Agreement shall be severable from the other.

X. Each of the parties acknowledges that he or she has been given the opportunity prior to signing this

Agreement to consult with his or her own attorney or advisor. If a party, after careful review, chooses

not to sign this Agreement, the Qadha’a Board shall have the responsibility to inform the other party

of such failure.
