NGATI TAMATERA PSGE RESOLUTION

“I as a member of Ngāti Tamaterā agree that the Ngāti Tamaterā Treaty Settlement Trust

will be the post settlement governance entity and the recipient of Ngāti Tamaterā Treaty

Settlement redress”

INFORMATION & BACKGROUND

• Is one of the13 iwi/hapu with historical treaty claims in Tamaki Makaurau

• Initiated the PSGE proposal early to take advantage of opportunities arising from the Tamaki Collective Settlement

INTRODUCTION & BACKGROUND

• Five hui were held with Ngāti Tamaterā to develop the PSGE proposal (25 March, 15 April, 29 April, 19 May and 27 May)

• On 27 May 2012 seven initial trustees were appointed

• Negotiations in Tamaki on Marutuahu and Tamaterā specific redress and in Hauraki on the Hauraki Collective and Tamaterā specific redress continue

• Maintain flexibility to evolve the PSGE as the Ngāti Tamaterā settlement evolves

NGĀTI TAMATERĀ POST SETTLEMENT GOVERNANCE ENTITY PROPOSAL

PSGE CROWN REQUIREMENTS• Adequately represents and is fully accountable to all members

• Transparent decision making and dispute resolution procedures

• Ensures the “beneficiaries” of the settlement and the “beneficiaries” of the governance entity are identical

• The Ngāti Tamaterā Treaty Settlement Trust PSGE meets the Crown requirements

STRUCTURE

• It is a private trust called the NGĀTI TAMATERĀ

TREATY SETTLEMENT TRUST.

• Enables the setting up of subsidiaries to manage commercial and cultural redress

PURPOSE

Receive, manage, administer treaty settlement redress for Ngāti Tamaterā

ACCOUNTABILITY & TRANSPARENCY

• Trustees accountable to Ngāti Tamaterā• Annual Plan• 5 year strategic plan• AGMs• Regular (3 yrs) elections

FISHERIES & AQUACULTURE SETTLEMENT

Incorporates an ability of Ngāti Tamaterā to withdraw and transfer their fisheries and

aquaculture settlement assets

TRUSTEES

• 5-7 trustees• Responsible for governance of the PSGE• Must act for the benefit of all Ngāti Tamaterā

INITIAL TRUSTEES

• Hold office for 1-2 years

• Positions will be rotated so that following the settlement of the claims all trustees, by the 3rd year, will be elected.

TRUSTEE NOMINATIONS

Registered adult member 18 yrs and older can nominate

Notice given to members of nominations

Three registered members need to endorse nomination

Any adult member is eligible for nomination save a few exceptions

Nominee must give written consent and 21 day period to receive nominations

Elections of Trustees

• Only registered members of Ngāti Tamaterā can elect trustees

• Elections will be held when terms of trustee ends or vacancy

• 3 year term and trustees are eligible for re-election• 28 days notice of an election of trustees and

how votes can be cast

Kaumatua Council

• Authorised to appoint a Kaumatua Council to advise on matters relating to tikanga, reo, kawa, korero and whakapapa

• Can’t be trustee on PSGE and member of Kaumatua Council at the same time.

RATIFICATION PROCESS

• If sufficient support for collective settlement PSGEs, the Tamaki Collective Deed will be signed and the legislative process undertaken

• If sufficient support for Ngāti Tamaterā PSGE, Ngāti Tamaterā will be in a state of readiness to participate in the Tamaki Collective settlement.
