Happy holidays from your FCBA! It is a joyous season withreasons to rejoice. Christmas, Hanukkah, Kwanza, and otherholiday celebrations came early for Project Wait No Longerand the FCBA Foundation, thanks to the most successfulFCBA Charity Auction ever! Thanks to your generosity andthe excellent leadership and planning abilities of the AuctionCommittee – led by Micah Caldwell and Mark Brennan – theCharity Auction raised over $130,000 for these wonderfulorganizations. They deserve all the accolades for their hard work, creativity, anddedication.

The holiday season reminds all of us of the many blessings we enjoy in ourprofessional and personal lives. It is naturally a season to give back – and the Pay ItForward initiative has lots of opportunities to do that. See page 7 for moreinformation. Have you ever felt that you’re getting lost in 47 CFR? Spending too much time withfootnotes from a Wireline Bureau decision from eight years ago? Then we also havea gift to engage your mind at a higher level during these holidays. Our inauguralDistinguished Scholar Speaker Series event will feature Erwin Chemerinsky,Founding Dean of the University of California—Irvine School of Law, for aluncheon discussion on Thursday, December 16 at Hogan Lovells. DeanChemerinsky, a noted Constitutional scholar and the author of close to 200 lawreview articles, regularly argues cases in both the U.S. Court of Appeals and the U.S.Supreme Court. The Dean will talk about the state of First Amendment regulationsin light of the rapidly fading distinctions between traditional media formats, and intrue academic fashion, will assign readings for those attending and conduct hisdiscussion in a true classroom style. Be sure to sign up for this event now, as spaceis limited.

This month, the Pay It Forward spotlight will shine on Matt Gerst, who hasdemonstrated the Pay It Forward ideals of service, dedication, and generosity ofspirit. Matt, who serves as Counsel for External & State Affairs at CTIA – TheWireless Association®, is very active in the FCBA, serving on the PublicitySubcommittee for the Charity Auction where he helped lead the effort, along withRon Whitworth, to implement the first-ever online auction component. In addition,Matt has participated as a moderator and a panelist in recent events held by theDiversity, Privacy & Data Security, and Professional Responsibility Committees.Also, on Saturday, November 20, he represented Team FCBA Foundation in FannieMae’s Help the Homeless Walk in Washington, DC. For all of these efforts and hiscontinued commitment to the FCBA, Matt Gerst has been selected to bask in thismonth’s Pay It Forward spotlight!

Also, I look forward to seeing you all at the Chairman’s Dinner on December 9 andat PLI on December 9 and 10. As we approach the holidays and look forward to anew year, I want to thank all of you for being members of the FCBA and forcontributing so much of your time and energy to make our bar association such avaluable resource – and a reflection of the wonderful people that we practice witheach and every day. When the clock strikes midnight on December 31 and we headinto 2011, the FCBA will be officially celebrating its 75th anniversary year. The International Telecommunicationsand Privacy and Data SecurityCommittees will co-host a CLE that willaddress various international privacylaws and policies that affect all multi-national companies and organizations,as well as cross-border services. Theseentities must navigate a myriad ofprivacy laws and enforcement regimes,ranging from broad laws in Europe tomore patch-worked laws in other partsof the world. Soon, this picture willbecome more complicated with theimplementation of the APEC dataprivacy framework in the Pacific Rim.The CLE will include two panels: thefirst will focus on recent developmentsin data privacy laws and policies inEurope and Asia (including the revisionof the EU Data Protection Directive andthe implementation of the APECprivacy framework), and the secondwill examine case studies of specificcross-border privacy problems facingmulti-national companies (e.g., humanresources data management,outsourcing and third party processors,cloud computing, and tensions betweenU.S. requirements and EU dataprotection laws and blocking statutes ininternal investigations). We are, however,always looking for new locations thatcan host FCBA events. We will beexperimenting with some newpresentation technology in future CLE

seminars, which require moretechnical support than we haveneeded in the past.

In general terms, we need conferencerooms that can seat at least 30 (more ifpossible) people at tables for brownbag lunches and committee meetingsand conference rooms that can seat aminimum of 60 for CLE seminars.Firms and companies hosting brownbag lunches provide beverages anddesserts; firms and companies hostingCLE seminars provide beverages andsnacks. CLE seminars are generallyheld from 6:00 – 8:30 p.m.

Additionally, for CLE seminars weneed facilities that can providetechnology support for microphonesfor as many as six speakers on a panel,the ability to tie the house soundsystem into a teleconference bridge,video projection capabilities forPowerPoint presentations, and accessto the internet for presentations byspeakers. Given the potential for Smart Gridtechnologies to improve electric powerreliability, increase the ability to taprenewable energy sources, conserveenergy, and save money for consumers,the Department of Energy (DOE) hasbeen working to facilitate the transitionto a smarter national electrical grid. Inthis vein, Scott Blake Harris will discusstwo DOE reports addressing importantfoundational Smart Grid policy issues,which were released this fall as afollow-on to the FCC’s NationalBroadband Plan: Data Access andPrivacy Issues Related to Smart GridTechnologies and CommunicationsRequirements of Smart GridTechnologies. In a proceeding initiatedand conducted under the auspices ofthe General Counsel’s office, thesereports were the culmination of acomprehensive public process thatincluded both a public notice andcomment proceeding and publicmeetings. They set forth a series of

findings and recommendations for bothindustry and government – some ofwhich are already being implemented.Harris was nominated as GeneralCounsel of the Department of Energy byPresident Barack Obama in March, andwas confirmed by the United StatesSenate in May 2009. He also serves asCo-Chair of the BroadbandSubcommittee of the Administration’sNational Science and TechnologyCouncil.

Mr. Harris has practiced law inWashington, DC for 34 years both in theprivate sector and in government. the Federal CommunicationsCommission and the CommerceDepartment may be directly invited toattend the dinner as guests ofindividuals and organizationspurchasing tables or tickets. In mostcases, individuals and organizationsmay issue invitations to the Chairman’sDinner without the involvement of theFCBA. Some agencies, departmentsand branches of the FederalGovernment, however, apply additionalstipulations above the regulationsissued by the Office of GovernmentEthics. This year’s Symposium opened with a keynote from The Honorable PamelaJones Harbour, Commissioner of the Federal Trade Commission.Commissioner Harbour provided her perspective on privacy and data security.Three substantive sessions followed. The first covered the government’s role inprivacy and data security, including the effectiveness of regulatory enforcementmechanisms and self-regulatory regimes. The second focused on requisitecontract clauses, due diligence requirements, and insurance coverage to helpreduce liability for relationships with third party service providers, behavioraladvertising and social networking websites/services, and e-commerce services.The third session provided an overview of domestic state and federal laws,regulations, and guidelines that govern traditional telemarketing andcommercial messages and promotional efforts delivered via wireless devices,including nuances regarding text messages, bounceback messages, and wirelessemails.

Michael J. Copps is the seniormember of the FederalCommunications Commission. Hebegan his service in 2001 and wassworn in for his second term in2005.

Mr. Copps served from 1998 untilJanuary 2001 as Assistant Secretaryof Commerce for TradeDevelopment at the U.S.Department of Commerce. In thatrole, Mr. Copps worked to improvemarket access and market share fornearly every sector of Americanindustry, including informationtechnologies andtelecommunications. Mr. Coppsdevoted much of his time tobuilding private sector-public sectorpartnerships to enhance our nation’ssuccess in the global economy. From1993 to 1998, Mr. Copps served asDeputy Assistant Secretary for BasicIndustries, a component of the TradeDevelopment Unit.

Mr. Copps moved to Washington in1970 to join the staff of Senator FritzHollings (D-SC) and served for overa dozen years as AdministrativeAssistant and Chief of Staff. From1985 to 1989, he served as Directorof Government Affairs for a Fortune500 Company. From 1989 to 1993,he was Senior Vice President forLegislative Affairs at a majornational trade association.

Mr. Copps, a native of Milwaukee,Wisconsin, received a B.A. fromWofford College and earned a Ph.D.in United States history from theUniversity of North Carolina atChapel Hill. He taught US history atLoyola University of the South from1967 to 1970.

He and his wife Beth have fivechildren and six grandchildren.

And, on Saturday, November 20,Matthew Gerst (and his dog, Brooks)and Megan Anne Stull represented TeamFCBA Foundation in Fannie Mae’s Helpthe Homeless Walk in Washington, DC.The FCBA Foundation would like tothank all of the participants in thesegreat activities, as well as the generoussupporters who contributed funds forour efforts.


FCBA CHARITY AUCTION

21st Annual CharityAuction a Record-Breaking Success!On Thursday, October 28, 2010, theYoung Lawyers Committee and theFCBA Foundation hosted the 21stAnnual FCBA Charity Auction.Smashing an all-time record, theAuction raised more than $130,000 tobenefit Project Wait No Longer(PWNL) and the FCBA Foundation.PWNL, a groundbreaking program runby the non-profit organization TheBarker Foundation, will use its share ofthe Auction proceeds (80 percent) tostrengthen its mission to findpermanent homes and the stability of a“forever family” for older children andteenagers who are growing up in thepublic foster care system. The FCBAFoundation will use the remainingAuction proceeds to support its annualscholarship and internship program.

The Auction was held at the HamiltonCrowne Plaza Hotel, Sphinx Ballroom atthe Almas Temple, and drew a large andlively crowd. In addition to bidding atthree silent auction tables, the eveningincluded a live auction featuring award-winning professional auctioneer B.J.Jennings. Facilitating the bidding werecelebrity emcees Bryan Tramont andToni Cook Bush. Special thanks fromthe Charity Auction Committee to boththe auctioneer and emcees for theirentertaining and effective persuasiveefforts!

Joseph A. Marino(1935-2010)Joseph Anthony Marino, an attorneywith the FCC for 37 years, died onOctober 7, 2010 in Clearwater, Florida,of complications from late-stageadrenal-cortical cancer. He was 75.

Joe was a native Washingtonian. Hebegan his career at the FCC in 1960upon graduation from the University ofNotre Dame, where he earned bachelor’sand law degrees and was a member ofthe law review.

At the FCC, Joe served in a number ofdifferent offices, including Chief of theOffice of General Counsel’s LitigationDivision for three years and Chairmanof the Review Board for 15 years. Healso served in the Office of Opinionsand the Broadcast Bureau’s HearingDivision. In the Common CarrierBureau, Joe was Acting Chief and Chiefof the Enforcement Division, as well as

Managing Counsel of the Bureau’sCompliance and Litigation Task Force.

In 1978, Marino argued theCommission’s position before theSupreme Court in the well-known“Seven Dirty Words” case [FCC v.Pacifica Foundation, 438 U.S. 726(1978)], in which the Supreme Courtagreed with the Commission thatGeorge Carlin’s monologue was“indecent” when aired at a time of daywhen “children were undoubtedly inthe audience.” It is said that no one atthe Commission wanted to argue thecase, but Marino agreed to do so as oneof the Commission’s most-experiencedappellate litigators.

Joe is remembered fondly by the juniorlitigators of the time for the monthlydinner parties held at his home, wherehe would invite guest speakers todiscuss current legal issues andhomemade sausage was cooked toItalian perfection.

As Review Board Chairman, Marinopresided over hundreds of comparativebroadcast hearing, renewal, andrevocation cases. Fellow Review Boardmember Jerold Jacobs fondlyremembers their time together on theReview Board as marked by wisdom,kindness, and calmness in the Board’sdeliberations and decision-making.

Marino served in the U.S. Marine CorpsReserve for seven years. He was amember of Ascension Catholic Churchin Bowie, Maryland, where he served asdirector of the Church’s religious schoolprogram. He moved to Clearwaterupon his retirement in 1997, where hewas active in his church and in a localsoup kitchen, and enjoyed his life-longhobby of golf. Joe is survived by hiswife of 39 years, Marian Lucille “Lucy”Marino, their son Nicholas, and Joe’sbrother Fausto.

Pursuant to the Office of Government Ethics regulation on widely-attended gatherings (5 C.F.R. 2635.204(g)(2)), the Chairman’s Dinner appears toqualify as a widely attended gathering. The value of an individual ticket to the dinner is $205.00.
