Transitional provisions on engines Transitional provisions on electrical equipment and systems Transitional provision on dinghies Transitional provisions on escape routes on passenger vessels Transitional provisions for propulsion systems on passenger vessels Transitional provisions for safety devices aft of the aft-peak bulkhead Transitional provisions governing side decks and guard rails

Information is given about the requirements behind each amendment and theconsequences associated thereto.

At the end of the notice there are editorial corrections and details about the deletion oftransitional provisions which have expired.

ES-TRIN 2019/1 will enter into force on 01.01.2020.

1.2. Leaflet on procedures for obtaining derogations or equivalences of ES-TRIN forspecific craftThe CESNI Secretariat is regularly asked by the public for information on the procedurefor derogations and equivalences from technical requirements. In order to ensuretransparent and comprehensive information, in the context of both the EU and theCCNR legal frameworks, CESNI decided to publish a leaflet on its website. Theprocedure described facilitates the gaining of experience with pilot projects (e.g.,alternative fuels) and actively supports innovation and greening of the fleet.

A leaflet providing information on the procedure for derogations and equivalences fortechnical requirements has been published by the CESNI Secretariat. A summary of the procedures, as well as an estimation of the timeframe, is given below:

1.3. Lists of approved authorities, firms, installations and equipment in relation totechnical requirements for inland navigation vesselsES-TRIN contains provisions for the approval of installations and equipment, as well asinstallation firms and technical services. Such approvals are the responsibility of thenational authorities under ES-TRIN and associated regulatory frameworks (e.g., Rhinevessel inspection regulations or Directive (EU) 2016/1629).On a new website (https://listes.cesni.eu/) relevant information can be found on thefollowing installations and equipment:

• Navigational radar installation• Rate-of-turn indicator• Inland AIS equipment• Tachograph• Inland ECDIS equipment• Engine• Onboard sewage treatment plant

Furthermore, the same website contains public information about those inspectionbodies and competent authorities proficient with regard to the technical requirementsfor inland navigation vessels.

1.4. CESNI/PT – PAX- A Working Group for Passenger Vessels (CESNI/PT-Pax) has been created to examinethe difficulties encountered in implementing current Chapter 19 of ES-TRIN; there are90 topics to be analysed. For each topic the Working Group will propose - whennecessary - either an amendment or an entry in the database. - During the 3rd Meeting of the Working Group for Passenger Vessels (CESNI/PT-Pax)on April 02-03, the following topics were examined :

a) Stability issues A discussion was initiated about the need for changes to the stability rules forsmall passenger vessels (less than 25 m and less than 50 or 150 passengers).

b) Fire protectionFire protection for Aluminium and GRP vessels is to be analysed further.Questions about muster areas and evacuation areas were introduced.Some clarification has been provided about fire bulkheads around the galleys andstorerooms; other rooms, such as battery rooms and electrical service rooms,were also taken into account.c) Safe area for catamarans

- “Safety rotas”, “persons with reduced mobility” and “staircases” are among the itemsincluded on the agenda for the next meeting in September 2019.

1.5. Update of the document on FAQs relating to Regulation (EU) 2016/1628 (NRMM) In co-operation with the European Association of Internal Combustion EngineManufacturers (EUROMOT), CESNI has updated the document on frequently askedquestions (FAQs) relating to Regulation (EU) 2016/1628 on Non-Road MobileMachinery (NRMM).

This March 2019 edition includes clarification regarding the use of specific enginecategories (NRE and Euro VI), reduced power engines and the exhaust after-treatmentsystems on new and existing engines.

1.6. Application of European Regulation (EU) 2016/1628 – NRMMIssue N° 4 (December 2016) of our Inland Navigation Statutory News provided detailsof the general content of this Regulation.

From 1 January 2019, all new engines of up to 300 kW must comply with the NRMMrequirements and as from 1.1.2020 new engines with higher power ratings must becertified as fulfilling the requirements for Stage V engines before placing on themarket. In accordance with the NRMM requirements, a transitional period has beengranted for engines already produced.

It is now necessary to examine how this regulation will be applied.

Of primary consideration is the type of engine that can be fitted on board an InlandNavigation vessel.

1.Engines of Stage V (2016/1628)

IWP, IWA

Up until 01.01.2019 for 19 kW <= P < 300 kW

after 01.01.2020 for P >= 300kW

2. In place of an IWA or IMWP category engine an NRE category engine may beused if its power output is less than 560 kW

3. In place of an NRE category engine, an engine with a EURO VI certificationfor heavy goods vehicles (under regulation 595/2009/EC)

4. Instead of IWP or IWA engines , TRANSITION engines can be installed IF:the engine complies with the latest applicable emission limits defined in therelevant legislation applicable on 5 October 2016 (meaning RVIR CCNR II orDirective 97/68/EC Stage IIIA or IIIB or IV in function of P) (see list at https://listes.cesni.eu/2060-en.html) ; and the engine was produced before the beginning of the transition period(meaning 1.1.2019 for P < 300 kW and 1.1.2020 for P ≥ 300 kW); and the engine is placed on the market not later than 24 months from theapplicable date for the placing on the market set out in Annex III of Regulation(EU) 2016/1628 (meaning 1.1.2021 for P < 300 kW and 1.1.2022 for P ≥300 kW); and the production date of the vessel (i.e., the construction date as recorded initem 7 of the inland navigation vessel certificate) is not later than 18 monthsafter the start of the transition period (meaning 30.6.2020 for P < 300 kW and30.6.2021 for P ≥ 300 kW) ;and the inland navigation vessel is placed on the market and a permanent orprovisional certificate is first issued not later than 24 months from theapplicable date for the placing on the market for the engine set out in Annex IIIof Regulation (EU) 2016/1628 (meaning 1.1.2021 for P < 300 kW and 1.1.2022for P ≥ 300 kW).

2.UN-ECE and ADN2019

2.1. Multilateral Agreement ADN / M 024 This Multilateral Agreement concerns the carriage of UN 1179, UN 1216 and UN 3256(Low QI Pitch) in tank vessels.

The Contracting Parties signatory to this Agreement (i.e., Germany, France and TheNetherlands) shall allow on their territories the carriage of

• UN 1179 ETHYL BUTYL ETHER (ETHYL-tert-BUTHYLETHER) in tank vessels of at least type N whose electrical and non-electrical installations andequipment are designed for explosion group II A.

• UN 1216 ISOOCTENES in tank vessels of at least type N whose self-contained protection systems are designedfor explosion group/subgroup II B1.

• UN 3256 ELEVATED TEMPERATURE LIQUID, FLAMMABLE, N.O.S. with flash-pointabove 60 °C, at or above its flash-point (Low QI Pitch) in tank vessels of at least type N whose self-contained protection systems are designedfor explosion group/subgroup II B2.

As from 1 January 2019, for entries of the above-mentioned UN numbers in vesselsubstance lists in accordance with 1.16.1.2.5 of ADN, reference must be made to theapplication of this Multilateral Agreement.

This Agreement will be valid until 31 December 2020.

2.2. Corrections and amendments to ADN2019ADN2019 was issued on 01.01.2019.There are already corrections (adopted for the 2019 edition) and proposedamendments (for entry into force only on 1 January 2021).

2.3. ADN Safety Committee (January 2019)2.3.1.

The dates indicated in the transitional provisions applicable to 9.3.x.24 and 9.3.x.21.1and in the multilateral agreement M018 were discussed. The Safety Committeerecognized that the transitional provisions for 9.3.x.24 and 9.3.x.21.1 might need to bedeleted and welcomed a proposal to this end for the next session. Noting that newamendments to ADN would not enter into force before 1 January 2021, severaldelegations indicated their willingness to update and extend multilateral agreementM018 until 31 December 2023. It was noted that the current transitional period for typeand location of electrical installations and equipment intended for use in explosionhazardous areas in 9.3.x.53.1 would remain unchanged.

2.3.2. The Safety Committee agreed that bunkering of LNG could not be considered a loadingor an unloading operation and therefore the amendment to 7.2.4.7.2 as proposed inparagraph 4 of the document was not necessary. It was noted that bunkering of LNGshould only occur when in conformity with applicable local, regional or nationallegislation, such as port regulations.

3. NATIONAL AUTHORITIES

3.1. BelgiumThe Flemish and Walloon Authorities have partiallytransposed Directive 2016/1629 (EU) (technicalrequirements for inland navigation vessels):
