INTRODUCTION

To protect the property value of the homes in the Association and to maintain a clean and neat appearance to the surrounding neighborhood the following rules and regulations governing our community have been developed.

The Rules and Regulations outlined in this booklet explain the policies and guidelines established by the Board of Directors of the Association to help protect and provide a peaceful environment for our community. It is the responsibility of the Board of Directors to administer and enforce the rules. However, it is the responsibility of each resident to cooperate and adhere to the rules.

1. Conditions for Lot Owner Plantings.

a. Landscaping. The Lot Owner shall be responsible for maintaining his / her own plantings, including but not limited to flower beds, at all times .

Trees and shrubs, once planted by the Lot Owner, the Lot Owner shall be responsible . for either replacing dead plantings or restoring the landscaping to its original condition if plantings are removed.

2. Parking and Traffic Area.

Motor Vehicles, except commercial motor vehicles, shall be parked in Unit Owner's garage, driveway area, or designated guest parking area per the parking map on the Association website.

No parking is allowed around the perimeter of the landscaped "island" in the center of the common driveway. Exceptions- Commercial vehicles used for home delivery or moving, contractor services, emergency vehicles and mail carriers so long as the vehicle does not block traffic.

The common driveway must remain free of obstructions to allow traffic to freely drive around the island.

No unregistered or inoperable vehicles shall be moved onto or kept on Association property.

No motor vehicle may be disassembled, nor major repairs made on Association property . This includes but is not limited to engine overhauling, exhaust system repairs, brake line repairs and body work .

Heavy commercial vehicles, including but not limited to moving vans, may not be driven onto Association areas without prior consent of the Board of Directors . The Lot Owner shall be responsible for the expense of restoring the landscaping or common area to its original condition if any damage occurs.

Boats, personal watercraft, trailers, and recreational vehicles may be parked in the common area for no more than 48 hours. Boats, personal watercraft, trailers, and recreational vehicles parked in the common area, driveways, or guest parking areas may not block or impede traffic from driving around the landscaped island area.

3. Pets.

All pets must, at all times, be accompanied and under the full control of their owners in any portion of the common areas.

Animals must be curbed away from Association property; owners must not allow pets to relieve themselves on Association property. However, in the event that an animal should accidentally defecate on Association property, the pet owner shall immediately clean up after it.

Lot Owners shall be responsible for all damages to Association property caused by pets, their children, or guests .

4. Garage Doors.

Any Lot which has not replaced their wood garage door(s) with metal doors must maintain the wood door(s) so as to present a neat and clean appearance.

Wood garage doors must not be delaminated, missing parts, chipping or peeling, or have deteriorated coloring that causes the door to not match the other doors on the property.

No doors may be painted in such a manner or color as not to match the other garage doors on the property.

If the garage doors are replaced, only metal garage doors will be acceptable and must be of the same color and design as the metal doors of other garages on the property. Wood garage doors may not be replaced with wood garage doors, only metal.

All garage doors must be able to open and close normally and have no noticeable gaps or fitment issues.

5. Exterior of Lots.

* No basketball hoops, backboards, poles, ladders, tools, or equipment may be stored outside of a unit; * No window air conditioners may be installed without approval of the Board; * Trash and recycling containers may not be placed or stored outside of a unit in such a manner as they may be seen from the street (Villa Dr.); * Yard waste must be stored in a suitable container or bag that is not viewable from the street (Villa Dr.); * The exterior of the Lots must be kept so as to project a clean and neat appearance.

6. Exterior Modifications.

No Unit Owner shall make any structural addition, alteration or improvement to any building, nor shall he/she paint or change the appearance of any portion of the exterior of any building without prior written consent of a majority of the Members, except as provided for in these Rules and Regulations.

a. Patios and Decks. Construction of patios/decks not visible from the street do not require written permission from the Executive Board but must be constructed per city and county code.

7. Use of the Common Areas.

There shall be no obstruction of the common area nor shall anything be stored in the common area without prior consent of the Executive Board, except as provided for in these Rules and Regulations.

Damage to the common area caused by the actions of a Unit Owner or the actions of his/her children, pets, guests or tenants or the actions of the children, guests or pets of is/her tenants, shall be repaired or replaced at the expense of the Unit Owner.

No clothes, sheets, blankets, towels or laundry of any kind, or other articles shall be hung out or exposed on any part of the common area, including decks . The common areas shall be kept free and clear of rubbish, debris, litter and other objectionable matter.

Barbecue grills and other cooking equipment should be confined to the porch and deck areas.

Bicycles, toys, boats and other outdoor equipment may not be left in roadways, driveways, or lawn areas overnight or indiscriminately strewn over the common area at any time. It is understood that children may leave toys unattended in front of their residence, but bicycles and toys may not be left out overnight or in a manner that presents an unattractive view of the property to the other residents or neighbors.

8. Annoyance.

Any use or practice which is a source of annoyance to residents or which interferes with the peaceful possession and proper use of the property by its residents is prohibited

9. Outside Attachment to Building.

The Lot Owner shall not cause or permit anything to be hung or displayed on the outside of windows except as provided for in these Rules and Regulations, and no signs or awnings, canopies, shutters or radio or TV antennas shall be affixed to or placed on the exterior walls or roofs or any part thereof, without the prior consent of the Executive Board. Satellite dishes are exempt from this rule.

10. Signs / For Sale / For Rent/ Other.

No signs shall be placed in the windows .

11. Seasonal Decorations. Seasonal decorations, including decorative lights, are mitted on the facade, landscaping, and in windows and doors of the units. Seasonal decorations should be removed promptly after the appropriate holiday. Decorations on common area, other than the facade of the units, require advance approval of the Executive Board and will be considered on individual merit.

12. Association Dues.

Villa Association dues are $150.00 per month after January 1, 2016 and monthly dues are due on the first day of each month. Dues that are not received by the Treasurer before 5:00 pm on the 10th day of the month will be considered late and the lot owner will be assessed a $25.00 late fee for that month.

If a check is returned, the lot owner will be charged a $35.00 fee and any late charges will still apply.

The Lot Owner will be charged $25.00 per infraction of any of the Rules and Regulations herein. In the event that the dues and /or fines are not paid on time there will be a $1.00 per month late fee charged to Lot Owner.

13. Infractions.

In the event that the homeowner fails to comply with the Rules and Regulations, the Association shall have the authority to enforce the Rules and Regulations as follows:

1. Letter of Notification to the Homeowner of the infraction(s);

2. Letter of Warning to the Homeowner that the infraction(s) must be rectified to avoid fine(s), repair costs in the event the Association must rectify the infraction and lien; \

3. Notification of assessment of fine(s), repair costs, lien against property; and subject to litigation; and

4. Notification to the Homeowner that litigation will be initiated.

14. Insurance.

All Lot owners are required to keep insurance on their home and property and must have their current policy on file with the Treasurer of the Association.

15. Lease Tenants.

Occupants who lease or rent from a Lot Owner are bound by these Rules and Regulations as are their guests. Lot Owners are required to provide their tenants with the Association governing documents, and assure that their tenants have read and understand the Rules and Regulations, and are responsible for the actions of their Tenants and their guests. The Board of Directors reserves the right to enforce the governing documents in so far as lease tenants are concerned.

No more than two (2) Units can be leased at any time. Tenants that are leasing a Unit from a Lot Owner must obtain an occupancy permit from the proper licensing authority.
