2.2.3. TfNSW passes smoky vehicle information to the EPA and the EPA is responsible for
sending out infringement notices. The public can also report smoky vehicles on the EPA’s
website or by calling 131 555. Information such as the vehicle’s registration plate would need
to be included in the report.
Please note the M5 East Heavy Vehicle Emission Reduction Program ended in 2017 and
Transport for NSW no longer provides smoky vehicle information to the NSW EPA. Please also
note that the EPA may send in first instance advisory letters (not infringement notices) to
owners of smoky vehicles who have been reported by the public. If a second or subsequent
report is received, a defective vehicle notice may be issued. Please refer to the response below
for more details.
4.6 : Will there automatically be an infringement notice issued for heavy polluters or smoky
vehicles, in the same way as a traffic fine, speed fine or mobile phone fine is issued?
In NSW, both Transport for NSW (TfNSW) and the EPA have a role in regulating air emissions
from motor vehicles.
The Heavy Vehicle (Vehicle Standards) National Regulation (NSW) is the key piece of legislation
for heavy vehicles (vehicles over 4500kg GVM) in NSW. With respect to air emissions, the
Regulation specifies that vehicles must not emit visible smoke for more than 10 seconds and
must comply with the Australian Design Rules, which included standards for non-visible exhaust
gases. TfNSW administers this Regulation on behalf of the National Heavy Vehicle Regulator.
The Road Transport (Vehicle Registration) Regulation 2017 is the key piece of legislation for light
vehicles in NSW. With respect to air emissions, the Regulation outlines the requirements that
relate to the Australian Design Rules and specify that vehicles must not emit visible smoke for

more than 10 seconds. TfNSW administers this Regulation. NSW Police and TfNSW Enforcement
Officers can issue Penalty Notices for smoky vehicle offence under Road Transport legislation.
Motor vehicles that emit ‘excessive air impurities’ are also regulated by the EPA under the
Protection of the Environment Operations (Clean Air) Regulation 2010. ‘Excessive air impurities’
are deemed to have been emitted when there are visible air emissions (smoke) for more than 10
seconds. An owner of a motor vehicle is guilty of an offence if a vehicle emits excessive smoke
while being used on the road.
The EPA runs a smoky vehicle enforcement program that aims to reduce vehicle emissions by
ensuring owners properly maintain their vehicles. Detailed information and online reporting

Where a member of the public report smoky vehicles to the EPA and all the required details are
included in the report and can be matched to a vehicle registration, the EPA may issue an
advisory letter to the registered owner of the vehicle reported. If a second or subsequent report
is received a defective vehicle notice may be issued, requiring the vehicle owner to service or
repair the vehicle so that it no longer emits excessive smoke.
Where an EPA authorised officer reports a smoky vehicle, the EPA may issue a Penalty Notice to
the registered owner of the vehicle: a fine of $300 for an individual or $600 for a corporation.

4.7 : If smoky vehicles are not fined automatically, in a similar way a speeding driver would be
caught on camera and automatically fined, is there a reason that the driver of the smoky
vehicle does not receive also an automatic fine, given there are cameras that detect the
smoke?
Please refer to the response above that explains the process currently in place for smoky
vehicles.
In most cases, the driver of a smoky vehicle is not aware that their vehicle is emitting excessive
smoke. By reporting smoky vehicles, the vehicle owners can be made aware of the problem with
their vehicles. If the observed vehicle’s details are matched with a vehicle registration, the EPA
will issue an advisory letter to the owner. The EPA’s follow-up surveys show that most vehicle

owners who receive an advisory letter take steps to have their vehicle checked and repaired if
necessary.
2. Community Updates and Complaints Presentation by Transurban (Attached)

3.1. Do the annual ambient exceedance numbers represent an average?
3.1.1. – Yes, the annual ambient exceedance is the average over the last 12 months to date.

4. Other Business
4.1. According to the Conditions of Approval (CoA) the M4 East AQCCC meetings are required for
two years post opening of the M4 Tunnel. Next year, 2021, the AQCCC can make
recommendations to the Chair who will consult with the Secretary of the Department of
Planning, Industry and Environment (DPIE) if it is considered that the meetings should continue
past two years post opening of the tunnel. The Secretary DPIE will make the final decision.

4.2. Two years post opening of the tunnel the AQCCC will also need to review whether the ambient
air stations are required to continue monitoring air quality. (Condition of Approval E8)
4.3. EPA is the licencing authority for the M4 East ventilation outlets, and exceedances are reported
to the EPA. The EPA regulates emissions from the ventilation facility only. Exceedances of the
internal tunnel air quality and ambient air quality are not regulated by the EPA, but reports are
copied to the EPA.
4.4. Does the EPA issue any infringement notices to smoky vehicles? And how many are issued?
4.4.1.The EPA issues advisory letters following reports of smoky vehicles from the public to
drivers. Drivers often get their smoky vehicles fixed after receiving EPA advisory letters. If a
second or subsequent report is received a defective vehicle notice may be issued,
requiring the vehicle owner to service or repair the vehicle so that it no longer emits
excessive smoke. An authorised EPA officer can also issue a penalty notice. Transport for
NSW (TfNSW) also have a role in regulating smoky vehicles as explained in the EPA
response to questions from the previous AQCCC meeting. Post meeting comment: please
refer Item 1 above for more information.

4.5. Community Comment: Some residents living near the tunnel are concerned about the smoky
vehicles seen in the area.
4.6. Will the ventilation facility located at Underwood Road have advertisements displayed on the
building?
4.6.1. The ventilation facility at Underwood Road, is fitted with an LED lighting controlled system.
The lighting of the building is operating under normal facility lighting. The facility has the
capability for special lighting, however Department of Planning, Industry and Environment
(DPIE) would need to authorise any use for advertising and there are no plans to use the
lighting for this purpose.
4.7. How quickly are exceedances of air quality measures reported to EPA? Is there a required
reporting time frame?
4.7.1. If emissions monitoring in the ventilation outlet shows exceedances of concentration limits
on the Environment Protection Licence, the Operations manager notifies WestConnex and
must immediately notify the EPA via the Environment Line. Outside business hours
WestConnex will look into the issue and collate information from the controllers at the
affected outlet. Many exceedances have been found to be due to instrument faults. All
information gathered is presented as a report to the EPA Environment Line, immediately,
who issue a reference number. Fulton Hogan Egis Operations Maintenance (FHEOM)
provide an immediate notification report which includes information such as affected
ventilation outlet and air pollutant that exceeded permitted concentration limits. The
report is provided to the EPA, DPIE, Department of Health (DoH) and TfNSW.
4.7.2. The Environmental Protection License and CoA E16 also require WestConnex|Transurban
to prepare a more detailed report within 20 days which must identify and explain the
cause of the exceedance. The Independent expert, SNC-Lavalin, reviews the report and
provides their own report on whether SNC-Lavalin agree with the
WestConnex|Transurban report. This report states SNC Lavalin findings. The report is also
sent to the EPA, DPIE, Department of Health (DoH) and TfNSW and is published on the
LINKT website.
4.7.3. In tunnel and ambient air exceedances follow a similar process, however there is no
requirement to report immediately to the EPA via the Environment Line. This is because
EPA does not regulate air quality within the tunnel or include ambient air limits or
monitoring requirements. However, the CoA (E6 for In-tunnel and E11 for ambient)
requires WestConnex|Transurban notifies the EPA and DPIE of exceedances within 24hrs.
4.8. Are there any figures showing whether usage of the tunnel is increasing? And is there any
evidence of people avoiding use of the tunnel?

4.8.1. Taken on notice by WestConnex|Transurban.
4.8.2. Usage of the M4 East tunnels has to date exceeded the traffic modelling undertaken as
part of the Environmental Impact Statement.
4.9. Community comment: we have noticed on our footpaths in our area, and gardens still a lot of
dumping of soot when it rains
4.9.1. WestConnex has received some community feedback since the M4 Tunnels opened, that
they have noticed a reduction in black dust/ soot that is visible on outdoor areas.
4.9.2. Community comment: Soot is also generated from diesel trains and other industry in the
area.
4.10. ECOTECH is still performing routine maintenance. An In-tunnel maintenance closure
took place in August for the quarter. The maintenance was on time and to schedule.
4.11. The next meeting is scheduled for 1 December 2020.

4.8 Are there any figures showing whether usage of the tunnel is increasing? And is there any evidence of people avoiding use of the tunnel?
WestConnex|Transurban The M4 Tunnels are operating at levels expected and forecast in the Environmental Impact Statement, and Parramatta Road has therefore seen the largest reduction in traffic.
Transurban is required to publish traffic data quarterly and attached is the last ASX from the full year results in August – the traffic data for M4 including the M4 Tunnels is on page 11.
Transurban is also required to publish all data on the “NSW Toll Road Data” website which is also publicly accessible: https://nswtollroaddata.com/
Travel time data (which is based on publicly available TomTom / Google Maps information), shows motorists are saving up to an hour each day on their journeys by using New M4 Tunnels. This a huge benefit to motorists using the tunnels, vs the free alterative (i.e. Parramatta Road).
As Parramatta Road is owned/ operated by TfNSW we are unable to provide any data on the reduction in usage. TfNSW will commission a 12 month post opening review to identify changes on the surface network as a result of the M4 Tunnel opening. This review will provide more details regarding the traffic volumes on the surface network.

TRANSURBAN FY20 RESULTS
FY20 summary
• FY20 performance impacted by the COVID-19 pandemic with average daily traffic (ADT) decreasing by 8.6% across the portfolio1
• FY20 distribution of 47.0 cents per stapled security (cps) representing $1.3 billion distributed to security holders
• In response to the COVID-19 pandemic the business took action to support its customers, communities and people, including granting $4.7 million in tolling credits to customers impacted by the crisis (to June 2020) and $1.5 million in additional targeted social investment2. The toll credit program has been extended to those in need to the end of 2020 as well as to frontline workers in Melbourne for the duration of Stage 4 restrictions
• Proportional toll revenue decreased by 3.4% to $2,492 million3
• Proportional earnings before interest, tax, depreciation and amortisation (EBITDA) and before significant items decreased by 6.4% to $1,888 million4
• Statutory loss of $153 million • Completion of three major projects with a further eight major projects advanced • Working to resolve the technical and commercial issues that have led to delays on the West Gate
Tunnel Project • 339,000 hours average workday travel-time savings5
• Record performance on key safety metrics with FY20 Road Injury Crash Index (RICI) of 3.70 and contractor Recordable Injury Frequency Rate (RIFR) of 3.60
Chief Executive Officer Scott Charlton said challenging global operating conditions through the second half of FY20 due to COVID-19 had resulted in subdued traffic levels across Transurban’s portfolio, however gradual improvement was now evident in all markets with the exception of Melbourne, which is still under strict government-mandated restrictions.
“Transurban, like most businesses, has seen significant impact to our revenue as a result of COVID-19 and the associated government actions,” Mr Charlton said.
“Pleasingly we have seen clear signs of improvement in most of our markets as government restrictions have been eased. However, as evidenced by recent declines in traffic in Melbourne, we expect traffic to remain sensitive to government responses.”

Transurban continues to monitor customer views on transport and mobility and today releases a new research report, Urban Mobility Trends from COVID-19, available at transurban.com/transport- industry-report.
“Our recent research gives some interesting insights into the way people expect to work and travel in the future and the potential implications on transport networks and for transport policy decision makers. For example, while we have made enormous strides in flexible working over the last few months, the office is far from dead. Over 85% of survey respondents expect they will return to the workplace, saying it helps them maintain relationships with their colleagues and separate work from home life,” Mr Charlton said.
Mr Charlton said that despite the challenging conditions, FY20 represented a significant year of development and delivery for the business, with three projects reaching completion.
“Despite the more challenging conditions, the business continued to make significant progress on its project pipeline with the New M4 tunnels, Logan Enhancement Project and 395 Express Lanes all reaching completion during FY20. In addition, the M8 (formerly New M5) tunnels opened and tolling commenced on the M5 East in July and NorthConnex is expected to open in the coming months,” he said.
Mr Charlton said Transurban continued to be in a strong position to pursue attractive opportunities emerging within its core markets, including the proposed M7 widening and M7/M12 interchange in western Sydney.
“Long-term and proactive management of our balance sheet and organisational capability means we are able to pursue the significant pipeline of opportunities in our existing markets. As always, this will be balanced alongside maintaining our strong investment-grade credit metrics and distributions for security holders” he said.

Sydney
• Proportional toll revenue increased by 2.8% to $1,072 million despite impacts from COVID-19, driven by the opening of the New M4 tunnels in July 2019 and the additional ownership interests in the M5 West6
• ADT decreased by 6.5% to 761,000 trips, driven by a weak June quarter as a result of COVID-19 • Car traffic decreased by 6.6% and large vehicles decreased by 4.9% • Completed acquisition of remaining 34.62% interests in M5 West, taking ownership to 100% • EBITDA excluding significant items increased by 2.8%7
• Peak construction now reached on M4-M5 Link tunnels with 28 road headers excavating the tunnels and more than 6,000 people involved in delivering the project to date

• Proportional toll revenue decreased by 8.1% to $747 million, with COVID-19 impacts partly offset
by the relative resilience of large vehicles

Distribution and DRP
A distribution totalling 16.0 cents per stapled security will be paid on 14 August 2020 for the six months ended 30 June 2020. This will be paid from the Transurban Holding Trust and controlled entities and will not have franking credits. This takes the total FY20 distribution to 47.0 cents per stapled security, of which 2.0 cents is fully franked.
The Distribution Reinvestment Plan (DRP) will operate for this distribution payment. For further information on distributions and the DRP, visit the Investor Centre at transurban.com.
Outlook
Transurban advises that it expects the FY21 distribution will be in line with Free Cash, excluding Capital Releases.13

25 Transurban has improved the calculation of Average Daily Traffic (ADT). Traffic measurement involves the correlation of images and tags from detected vehicles. Reporting improvements have enabled faster removal of duplicate trips, for example, where multiple tags are detected in a vehicle. The change to the calculation has resulted in reported ADT reducing for some assets, by a maximum of 1%. ADT for prior corresponding periods has been restated for comparative purposes. • New round of WestConnex community grants will open from Monday 12 October until Friday 6
November.

Blue Datto Partnership
• ‘Keeping Safe’ safe driver program open to any interested high schools along the project corridor.
• Program can commence from Term 4 when restrictions are likely to ease.

• The course can be a few hours or a full day, depending on what the school is able to accommodate.

Complaints – Air Quality Complaints received since last AQCCC meeting
One complaint received between 2 June 2020 and 1 September 2020
• Complaint received 2 August 2020.
• Issue: ambient air quality reporting was not available on the website.
• Response: WestConnex were aware of the issue and were in the process of having it resolved.
Once resolved, data would be backdated and available on the website.

Air Quality reporting Exceedances occurring since last AQCCC meeting (2 June 2020)
• 06/06/2020 – Ventilation Outlet VOC
• Report certified by Independent Expert (SNC Lavalin) confirmed that exceedance was caused by the sensor
going into fault. Ecotech have since repaired the sensor
• 06 & 07/06/2020 – Ambient – PM2.5
• Report certified by Independent Expert (SNC Lavalin) confirmed that exceedance was caused by a Sydney
wide event and was not the result of tunnel operations.
• 16/06/2020 – In Tunnel - Visibility
• Planned tunnel road sweeping was occurring in the eastbound stubb prior to and during the visibility
exceedance. The Eastbound stubb links the M4 East tunnel with the M4-M5 Link tunnel and is currently not
open to traffic. Disturbed particulates as a result of sweeping resulted in the above-limit reading and was not
the result of traffic related influences.
• 10, 24 & 25/07/2020 – Ambient – PM2.5
• Report certified by Independent Expert (SNC Lavalin) confirmed that exceedance was caused by a Sydney
wide event and was not the result of tunnel operations.
• 13/07/2020 – Ambient – PM2.5 – Annual
• Report certified by Independent Expert (SNC Lavalin) confirmed that exceedance was due to poor annual
average ambient air quality within the Sydney Region potentially caused by exceptional events such as the
unprecedented NSW 2019-2020 bushfire season.

M4 Tunnels E24 audit report findings
There were two ‘non-conformance’ issues raised with WestConnex’s reporting and equipment as part of
the E24 Audit Report. These were known issues, that WestConnex had been working to resolve.
The non conformances have all now been closed with all works now complete.
