INTRODUCTION Wendy has worked in the development industry for the last 20 years – 5.5 of those in town planning and the majority of the rest as a senior associate at top ten legal firms specialising in planning and environmental law. She is the current Queensland President of the Planning Institute of Australia and a Development Tribunal referee. Wendy has developed a niche practice in statutory planning. Her experience has included the legal review of various local planning instruments and the creation of standard conditions packages, as well as secondment experience providing legal advice for the Queensland Government. Wendy’s hard earned credentials have given her a distinct advantage over her peers, particularly when advising on development transactions. She acts from project conception and development application structuring through to approval procurement, infrastructure agreement negotiations and court appeals. Before commencing her legal career in 2005, Wendy practiced as a town planner. In that role she gave expert witness evidence in court, bringing a practical and commercial edge to her law career in planning that is unmatched by any other planning lawyer. This, combined with her tremendous enthusiasm and passion, makes Wendy Evans a formidable legal ally. EXPERIENCE An example of Wendy's matters acting for a variety of Government entities including: • attending to a full legal review of the planning schemes for Toowoomba Regional Council, Gold Coast City Council, Redland City Council and Scenic Rim Regional Council (and associated officers, Councillor and industry training in respect to the Gold Coast City Plan); • the Toowoomba Regional Council against Wagner Investments, in ten appeals filed disputing the infrastructure charges levied with respect to the Wellcamp Airport and Business Park; • producing the model conditions for Gold Coast City Council and associated officer training; • the Toowoomba Regional Council in Queensland’s first conversion appeal (The Avenues Highfields Pty Ltd v Toowoomba Regional Council) 2082 of 2017; • an interpretation dispute for the Gold Coast City Council the matters of Ballard v Brett & The Gold Coast City Council (1529 of 2017) and Brett v Gold Coast City Council (1456 of 2017); • assisting the State government (SARA) in the production of their initial model conditions package, and the current Planning Act 2016 version; and • the Toowoomba Regional Council in the technical review project of Planning Scheme Policy 2 (Engineering Standard). Wendy has also acted for a range of private entities including: • Sunshine Energy with respect to the world's largest solar farm; • Stockland's projects in Townsville, Gladstone and Hervey Bay; • McDonalds various resumption matters; • CSR in relation to its Brendale and Oxley sites; QUALIFICATIONS Practising law since 2005 Town Planning since 1999 MEMBERSHIPS • Queensland Environmental Law Association • Queensland Law Society • Fellow & Queensland President, Planning Institute of Australia - Wendy is one of only two Planning & Environment lawyers in Australia who have also practiced as town planners to be elevated to Fellow status at the Planning Institute of Australia.
