    term limits hits home in the legislature

    Thanks to term limits imposed by voters on Nevada ofcials, only onemember of the state Senate has been there more than four years.

    That 21-member Senate saw the arrival of 10 new faces in 2011. Another 10

    are new this session. But its not like the senators whose upper-house experiencedates only to 2011 are all newcomers to the Legislature, 14 of them aretransplants from the Assembly.

    The veteran Senate member is Republican Barbara Cegavske of Las Vegas,who was elected a senator in 2004 after 10 years in the Assembly.

    The 42-member Assembly also has seen huge turnover, with 20 new facesin 2011 and another dozen this session. But two of those lower-house membersare back after a gap in service and one, Maggie Carlton, moved to the Assemblyafter a dozen years in the Senate. That gives Assembly Speaker Marilyn Kirkpatrick,D-North Las Vegas, some experienced members to head lower-house committees.

    Its not just new legislators, said Senate Majority Leader Mo Denis, D-LasVegas. There are a lot of new staff people, a lot of new lobbyists. A lot of peoplewho were over departments have retired.

    The dearth of experienced leadership led Denis to name three Senatefreshmen as committee chairs, Aaron Ford in Natural Resources, Justin Jones inHealth and Human Services and Patricia Spearman in Legislative Operations andElections.

    All three are from Clark County pointing up another effect of the term-limits turnover. The only Northern Nevada lawmaker to lead one of the 10 Senatestanding committees in the 2013 session will be Debbie Smith of Sparks who willchair the powerful Senate Finance Committee. In contrast to some of the otherchairs, Smith former head of the Assembly Ways and Means Committee has

    the experience.In the Assembly, three of 10 chairs are northern legislators. Republicans

    lost decades of experience over the past four years. The departure of just threesenators, Renos Bill Raggio and Randolph Townsend and Elkos Dean Rhoads, costthe Senate more than 100 years of legislative experience.

    Senate Minority Leader Michael Roberson of Las Vegas has just one session

    as a lawmaker under his belt. His lieutenant, Sen. Ben Kieckhefer of Reno, also is alegislative sophomore, although he covered the lawmakers as an AP reporter in the2003 session.

    Roberson agreed the loss of so much experience will present challengesbut said its more a burden on the majority Senate Democrats than on his GOPcaucus. Democrats hold a bare 11-10 edge in the Senate and a 27-15 margin in theAssembly.

    When youre in the majority, youve got to make the trains run on time, hesaid.

    Roberson also said hes condent the four caucus leaders in the Senate andAssembly will work well together.

    The Senate leaders counterparts in the Assembly are Kirkpatrick and GOPMinority Leader Pat Hickey of Reno.

    What Im encouraged by is that Mo, Marilyn, Pat and I always get alongreally well, Roberson said. You didnt see that last session.

    Denis echoed Robersons prediction of much more bipartisanship thissession, saying the turnover may enable the Senate to deal with issues it couldnthandle smoothly in the past.

    As Marilyn says, we dont have the baggage some of the people had before,he said, adding, The way to make things work is we have to be willing to talk.

    Another change is that six of the Senate committees will have just vemembers instead of seven this session. That is double the number of ve-memberpanels in the 2011 Senate, and stems from the 11 Democrats effort to maintain amajority in every committee.

    Six Republican senators including Roberson have just two committeeassignments while the rest of the members all have three.

    Thats just the way things worked out, Denis said.Kirkpatrick, whose rst term was in 2005, is the second woman in state

    history to hold the title of Assembly speaker. She got the job after Marcus Conklin,

    the odds-on favorite to succeed former Speaker John Oceguera, was defeated inNovember by Republican Wes Duncan.

    The Assembly Ways and Means Committee will be headed by Maggie Carltonof Las Vegas. While this is only Carltons second session in the Assembly and onlyher second time on Ways and Means, she is a veteran of 12 years in the Senate.

    Most of the other Assembly leadership positions are lled with memberswho have at least a couple of sessions under their belts. But six of them arechairing committees for the rst time: Elliot Anderson, Teresa Benitez-Thompson,

    Jason Frierson, Skip Daly, Irene Bustamonte-Adams and Richard Carillo. Three ofthe 10 chairs are northern lawmakers. David Bobzien, Benitez-Thompson and Dalyall represent parts of Washoe County.

    Hickey is entering his third term in the lower house while his top lieutenant,Cresent Hardy of Mesquite, is a sophomore.

    In several statements, he has made the same points Roberson and Denis

    made, saying the public is demanding solutions-oriented government.And in that sense, our parties recognizes that and I think the Democrats do

    as well, he said.Hickey said that means having the courage to go up against not only the left

    but the right as well.Its denitely an interesting dynamic, said Denis.Nevada voters decided in 1996 to limit state lawmakers to 12 years in

    both the Assembly and Senate. Supporters contend term limits prevent careerpoliticians from locking out newcomers and becoming beholden to specialinterests. Critics maintain term limits have resulted in a loss of institutionalmemory and an increase in power of staff, bureaucrats and lobbyists. The limitscan be removed only by constitutional amendment.

    bills & resolutions

    Every ofcial action the Nevada Legislature takes is in the formof either a bill or a resolution.

    Bills are legislation that add to, delete or amend state lawdealing with anything and everything from criminal penalties tobusiness licensing.

    Senate bills are labeled SB, Assembly bills AB - according tohouse of origin. They are numbered in order of their introduction.To become law, a bill must be approved by both houses of the

    Legislature and signed by the governor. In Nevada, the governor canallow legislation to become law by not signing it for 5 days if theLegislature is in session, 10 days if they have adjourned. That is theopposite to the U.S. Constitution which interprets the Presidentsfailure to sign legislation within 10 days as a veto.

    If the governor actually vetoes a bill, it requires a two-thirdsvote of each house to override that veto.

    Nearly all other business is handled by resolutions that doeverything from commemorating an individuals contributions to

    society and setting Senate and Assembly operating rules to proposingconstitutional amendments for voters to consider.The three types of resolutions are simple, concurrent and joint.

    Simple resolutions, labeled AR or SR followed by their number,are used by each house to set its own rules, set its own committeemembership and leadership or take another action that is completelywithin the jurisdiction of that house. Simple resolutions requireapproval by only the house where they originate.

    Concurrent resolutions are designated ACR or SCR followedby their number. They are used for purposes such as urging othergovernmental entities to take action or make changes in an areawhere the Legislature may not have specic power.

    They are also often used to memorialize a deceased public gureor civic leader in Nevada. And they are used to set and amend jointrules of the Legislature.

    Concurrent resolutions must be approved by both the Assemblyand Senate. Joint resolutions are labeled AJR or SJR and are most often usedfor more weighty matters. They are the vehicle for proposing changesto the state constitution or calling for action by the U.S. Congress.

    Like concurrent resolutions and bills, joint resolutions must beapproved by both the Senate and Assembly.Unlike bills, resolutions dont require the governors approval.

    The Legislative Counsel Bureau has expanded its Internetservices for the 2013 session, improving whats already a highlyuseful tool for anyone interested in following the progress, or lack ofprogress, of Nevada lawmakers.

    The award-winning website is a compendium of informationabout the 2013 session, bill drafts and pre-led bills, state laws andregulations, court rules, previous legislative sessions and even Nevadacity charters. A list of agendas for various legislative committeesand Senate and Assembly oor sessions is updated daily. And, forthose who cant get to the Legislative Building, live video of nearly allcommittee and other meetings is available on the website.

    The website also provides detailed information about eachlegislator, including contact information, committee assignmentsand the measures they have proposed this session. There alsois a link that lets viewers share their opinion on thosemeasures.

    One of the biggest changes was the additionof budget information to the Nevada ElectronicLegislative Information System (NELIS). Thatsystem is designed to make reports, exhibits,testimony and presentations electronicallyavailable to lawmakers as well as the press andpublic. NELIS was rolled out in the 2011 Legislativesession but didnt include budget information, which nowcan be searched by budget account, department or function.

    Viewers also can search for reports and other data bycommittee and check on the status of bills in each Senate and

    Assembly committee. NELIS also allows a search for differentlegislation either by name, sponsor or text within a proposed bill.

    77h2013LCB also expanded its Personalized Legislative Tracking (PLT)

    system to allow individuals to receive notications on bills, draftsand budgets of interest. Individuals can track up to 10 bills, drafts orbudgets for free in the PLT system. There are fees for tracking morethan that, up to an unlimited subscription for $600.

    The PLT system provides notication of hearings and a dailystatus report on the items you choose to track. The system is also

    smart-phone compliant, and LCB ofcials say it will becontinually rened and enhanced during the

    how to read a bill

    Bill nuMBerEach bill is designated either SB for Senate bill or AB for Assembly bill,

    followed by a number. The rst bill introduced in the Senate each session isSB1, the rst in the Assembly is AB1 and so on. In a normal session, there willbe 550 to 600 bills introduced in each house.

    sPonsorAfter the bill number is the name of the lawmaker or the legislative

    committee that introduced the proposal. Usually, the rst legislator listed isthe author and prime supporter of the bill, although some are requested onbehalf of a group of constituents. In that case, the bill says by request afterthe sponsors name.

    Lawmakers often send their bills around the room asking otherlawmakers if they wish to join in sponsoring the proposal. In legislationinvolving popular issues, most if not all will sign on to the bill.

    The rules also permit joint sponsorship of bills by members of both theAssembly and Senate. That might be used, for example, by Carson City Senateand Assembly members to jointly sponsor a popular measure on behalf of theCapital. The chief benet is that, politically, they share the credit.

    Committee introductions can be the product of an interim study,

    requested by the governor or a state agency, or the product of discussionduring a hearing that revealed the need for legislation. Limited numbers of billsalso come directly from sources such as the Nevada Association of Counties,League of Cities, attorney general, Board of Regents and other groups.

    Incumbent senators can request 26 bills. New senators because therst deadline is before the election are limited to 14. Incumbent and newAssembly members each get half that number. Members of leadership canrequest and introduce more pieces of legislation, as can committee chairs.Occasionally, a lawmaker will ask a committee to introduce a bill to keep his orher name off the measure for political reasons.

    The executive branch, agencies and all outside organizations are alsolimited in the number of bills they can request.

    introduCtion and reerralBelow the sponsor is the date the measure was introduced, followedby the committee it was referred to for study. The date allows you to look inthe journal for that day and see whether there was any discussion about themeasure on the oor.

    suMMarYThe summary gives a synopsis of what the bill is intended to do and, in

    parentheses, which bill draft request it came from. That allows you to comparewith the original proposal and see if it was changed before introduction. Thesummary doesnt include every detail of what the bill would do.

    isCal noteFiscal notes analyze the effect of the measure on state and local

    government budgets. They dont analyze the impact on business or the public.If the bill contains an appropriation, the note states whether that money

    is already in the executive budget. And it states whether the bill requires orincreases a term of imprisonment which was added after the unanticipatedimpact of felony DUI legislation increased prison populations aboveprojections.
