Maestas, Sr. Education Specialist Office of Diné Accountability and Compliance Subject: Possible Removal of Local School Board Members This memo serves as notification that the Navajo Election Administration officially received notice today regarding possible remove of local school board members; in light of the Navajo Nation Council’s passage of Resolution CMY-38-12 [11 N.N.C. § 6(E)] and the Navajo Nation Supreme Court’s ruling in Mae Y. Sandoval v. Navajo Election Administration and Concerning Leo Johnson, Jr. (No. SC-CV-62-12). The local board members are: 1. Chapo, Bennie To’hajiilee Community School 2. Chatter, Faith Winslow Residential Hall 3. Chee, Robert Winslow Residential Hall 4. Coho, Carolyn Ramah Navajo School Board, Inc. 5. Haskie, Leon Lukachukai Community School 6. Jojola, Tracia K. To’hajiilee Community School 7. Kedelty, Stanley B. Lukachukai Community School 8. Maloney-Begay Flagstaff Bordertown Dormitory 9. Maria, Darnell Ramah Navajo School Board, Inc. 10. Marilyn Tracey Nazlini Community School 11. Martinez, Jr., David Ramah Navajo School Board, Inc. 12. Platero, Cornelia To’hajiilee Community School 13. Redhair, Delrey Rough Rock Community School 14. Yazzie, Elmer Ramah Navajo School Board, Inc. Per the Navajo Elections Administration’s request of our assistance, letters dated December 31, 2012 were sent to the BIE/Grant/Contract schools requesting information on the recently elected local school board’s members’ employments records within the school and/or residential program. Then reminded again via e-mail on March 10, 2013 to follow through with the request, for those schools who responded, this is the outcome. The schools that have not responded will be again notified for further confirmation. CMY-38-12 and 11 N.N.C. § 6(E) states: Must not have been an employee of the school within the last five years to prevent conflict of retaliation from being a recent employee to being a new school board member. Today, verbal confirmation by the Navajo Nation Election staff is that the date the individual officially filed their campaign candidacy will be the countdown date. The Navajo Elections Office is scheduled to proceed with notifications of possible removal this week and the local school board members would be allowed a ten (10) day appeal. If further questions arise by the individuals, please advise that they contact the elections office for further clarification as it is now officially filed with their office. Thank you.
