NEw FISCAL DIVISIONS (CAPE). 436 NATIVES LAND.

Act No.26 (2) Within the division of Calitzdorp the said assistant of 1913. resident magistrate shall possess all the powers and jurisdic

tion, and shall carry out all the duties and obligations, codferred or imposed by the said Act No. 4 of 1889 or by any other law upon the civil commissioner, but he shall not thereby acquire the status of a civil commissioner.

Provisions of 5. The provisions of Act No. 24 of 1858 of the Cape of Act No. 24 of Good Hope shall, so far as the same are applicable, apply 1858 to apply mutatis miutandis to the divisions of Calitzdorp, Oudtshoorn to new divisions and Ladismith as constituted under this Act as if they were

named in the Schedule to Act No. 12 of 1857.

Short title. 6. This Act may be cited for all purposes as the New Fiscal Divisions (Cape) Act, 1913.

Schedule. AREA TO BE CONSTITUTED THE NEW FISCAL DivisioN or

CALITZDORP

(1) The area which at the commencement of this Act is co-terminous with the magisterial sub-district of Calitzdorp, in the magisterial district and fiscal division of Oudtshoorn.

(2) So much of the following area as is not included in the said sub-district but is at the commencement of this Act in the magisterial district and fiscal division of Oudtshoorn, namely, the area comprising the farms Cangoberg, Kruisrivier, Buffelskloof, Uitvlugt, and part of Langverwacht.

(3) That portion of the division of Ladismith which at the commencement of this Act is included in the fiscal division of Ladismith and comprises the following farms :-Huisrivier, Cloete, Crown, Halfcrown, Tijgerkloof, Danielskraal (including the Outspan), Triangle, Rietvallei, Oudehuiskloof, Spitskop and Groenfontein.

Act No.27 Act, and may present inte iju reports and recommendations : of 1913. Provided that Parliamen may by resolution extend (if

necessary) the time for the completion of the commission's enquiry. All such reports and recommendations shall be laid by the Minister, as on as possible after the receipt thereof, upon the Tables f both Houses of Parliament.

Membership 3. (4) The commission or ny member thereof or any )erson acting as assistant, or ass ssor, or secretary thereto may enter upon any land for the rposes of its enquiries and obtain thereon the information ne ssary to prosecute the enquiries. The commission shall witho t fee or other charge have access to the records and regist s relating to land in any public office or in the office of y divisional council or other local authority.

mI"ad 5. (1) Any 'person w o is a party to any attempted legal purchase, sale, hire or lease, or to any agreement or transaction proceedings, which is in contravention of this Act or any regulation made

Iq 14 .?.. . thereunder shall be guilty of an offence and liable on conviction to a fine not exceeding one hundred pounds or, in default of payment, to imprisonmnent with or without hard labour for a period not exceeding six months, and if the act constituting the offence be a continuing one, the offender shall be liable to a further fine not exceeding five pounds for every day during which that act continues.

(2) In the event of such an offence being committed by a company, corporation, or other body of persons (not being

Union shall be liable to prosecution and punishment and, in the event of any such offence being committed by a firm or partnership, every member of the firm or partnership who is within the Union shall be liable to prosecution and punishment.

6. Provided that--

(a) nothing in an- su law or in this Act shall be construed as restr'ictini the number of natives who, as farm labourers,_ ay reside on any farm in the Transvaal ;

(b) in any proceeding ,,for a contravention of this Act the burden of prov g that a native is a farm labourer shall be upon t] e accused

(c) until Parliament, a .ting Iupon the report of the said commission, h made other provision. no native resident onl an farm in the Transvaal or Natal shall be liable to pe lties or to be removed from such farm under any w, if at the commencement of this Act be or the ad of his family is registered for taxation or .er purposes in the department of Native Affain, as being resident on such far~n, -nor shall the o', er of any such farm be liable to the penalties imp ed by section five in respect of the occupation the land by such native; but nothing herein ontained shall affect any right possessed by la by an owner or lessee of a farm to remove an - native therefrom.

7. (1) Chapter XXXIV of the Orange Free State Law Book and Law NO. 4 of 1895 of the Orange Free State shall remain of full force and effect, subject to the modifications and interpretations in this section provided, and sub-section (1) (a) of the next succeeding section shall not apply to the Orange Free State.

(2) Those heads of families, with their families, who are described in article twenty of Law No. 4 of 1895 of the Orange Free State shall in the circumstances described in that article be deemed to fall under the provisions of Ordinance No. 7 of 1904 of that Province or of any other law hereafter enacted amending or substituted for that Ordinance.

Act No.27 (3) Whenever in Chapter XXXIV of the Orange Fre. of 1913. State Law Book theexpressions "lease" and " leasing" are used, those expressions shall be construed as inclling or referring to an agre(ement or arrangement whereby a person, in coisideration of his lbeing permnitted to occupy land, renders or promises to render to any person a share of tile produce thereof, or any valuable consideration of any kind whatever other than his own labour or services or the la)our or services of any of his family.

Savings. 8. (1) Nothing in this Act contained shall be co:,strued as,

arrangement lawfuiiy entered into and in existence at the eomrmencene t of this Act which is a hiring or leasing of land as defined in this Act ; or

(b) invalidating or affecting in any manner whatever anv agreement or any other transaction for the 1uichase of land lawfully entered into prior to the commenevnient of this Act, or as prohibiting n-y person from purchasing at any sale held by order of a competent court any land which was hypothecated by a mortgag, bond passed before the commencement of this Act ; or!

(') prohibiting the acquisition at any time of land or interests in land by devolution or succession on death, whether unlder a will or on intestacy ; or

(d) preventing the due registration in the proper (le-. Is ,'fi-e (whenever registration is necessary) of documnents giving effect, to any such agreement, transaction, devolution or succession as is in this section mentioned ; or

() prohibiting any person from claiming, acquiring, or holding any such servitude as under Chapter VII, of the Irrigation and Conservation of Waters Act, 191"2, he is specially entitled to claim, acquire, or hold ; or

of this Act, provided it is a condition of tho acquisition that no land or interest in land iii such township has at any time been or shall in future be, trausferred except to a native or coloured1 person ; or

(J) permitting the ali lation of land or its diversion from the purposes ft- which it was set apart if, under section ow, hundrl aind Thr/q-st'ile~ of the South Africa Act, 1909, or h other law, such land could not he aliewtod or so dlji-erted except under the authority of an Act of Parli ient: or

(A) in any way modifying the provisions of any law \herelby nortgages of or charges over land may be created to secure advances out of public moneys for ,-p.cific pirposes mentioned in' such law and the interest on such advances. or whereunder the inortpagee ,r )person having the charge may enter and take possession of h(, land so mortgaged or charged, except that ill any sale of such la'nd in accordance will) such law the provisions of this Act shall be observed.

(2) Nothing in this t containedI which imposes restrictions upon the acquisit i by any person of land or rights thereto, interests therein, or servitudes thereover, shall be in force in the Province of tl ( Cape of Good Hope, if and for so long as such person wo d, by such restrictions, be prevented from acquiring or h ding( a qualitication wherenider he is or may become -entit edl to be registered as a voter at parliamentary elections in a y electoral division in the said Province.

Regulations 9.
