COVID-19 Response Act: guidance for Mäori en es

The COVID-19 Response (Requirements for En es – Modifi ca ons and Exemp ons) Act 2020 provides temporary relief for governance en es who are unable to meet their statutory obliga ons or the obliga ons in their cons tu on or rules because of the COVID-19 outbreak.

The Act covers many en es such as Mäori land trusts established under Te Ture Whenua Mäori Act 1993.

It will help en es aff ected by the COVID-19 restric ons to operate more eff ec vely, by allowing for:

• an en ty to use electronic means (e.g. electronic vo ng and electronic signatures) when its cons tu on or rules do not permit this;

• an en ty to temporarily modify its cons tu on or rules;• the Minister for Mäori Development to grant exemp ons from certain statutory

obliga ons under Te Ture Whenua Mäori Act; and • the Chief Judge of the Mäori Land Court to grant relief form certain terms of Mäori

trust orders and Mäori incorpora on orders.

The Act covers the period 21 March to 30 November 2020.

• Mäori land trusts;• Mäori incorpora ons;• body corporates or trustees appointed to administer a Mäori reserva on; and• assembled owners (under Part 9 of Te Ture Whenua Mäori Act).

Under rule 5.11(1) of the Mäori Land Court Rules 2011 the Registrar of each Court in each District must prepare a quarterly schedule of applications on the last day of February, May, August and November listed the applications that were fi led with the Court 6 months or more before the date of the schedule and that have not been fi nally determined.
