What are the salient points detailed in the Occupational Safety and Health Act 1994, which are of importance to both employ-ers and employees? What are the potential issues that can arise from failure to adhere and enforce the Act in an organisa-tion? Some cases and case law will be presented and discussed in relation to the application of OSHA in an organisa-tion.

Retrenchment and Employee’s Rights 10:15 am – 11:30 am

In today’s current economic climate, and the uncertain future, a need for adjustment to the workforce may be needed, like retrenchment. This session will review the many facets of retrenchment - when can an employee be retrenched, guide-lines and the consequences of wrongful retrenchment. Also discussed, will be statutory retrenchment benefits, best practice severance packages, application of LIFO principles and its exceptions as well as other alternatives to retrench-ment.
