Driver fatigue laws apply to drivers of the following heavy vehicles:
• avehiclewithaGVMofmorethan12tonnes
•avehiclecombination,ifaddingtheGVMofeachvehicleinthecombinationgivesatotalGVMofmorethan12tonnes
•abuswithaGVMofmorethan4.5tonnesthatseatsmorethan 12adults(includingthedriver).
Thevehiclesaboveareknownas‘fatigue-regulatedheavyvehicles’.Ifyoudon’tdriveoneofthesevehicles,youarenotrequiredbylawtokeepaworkdiary.
Youmustuseaworkdiaryifyoudriveoneoftheabovevehiclesand:
• youworkunderStandardHoursandyouwilldriveoutsidea100kmradiusofyourbase(100+ km work)OR
• youworkunderBFM,AFMorexemptionhours.
You may not have to keep a work diary if you always drive within a 100kilometreradiusfromyourbase(local work) under Standard Hours (seepage9formoredetails).
Evenifyouarenotrequiredtouseaworkdiary,ifyoudriveoneoftheabovevehiclesyoumustcomplywithmaximumworkandminimumresttimerequirementsapplyingtoStandardHoursdrivers.
If you are unsure whether you have to use a work diary for your vehicle:
• checkthecomplianceplateonthevehicleforGVMrating
• contacttheNationalHeavyVehicleRegulator(NHVR)foradvice (seecontactsonpage3).
It is against the law to drive a heavy vehicle if you are impaired by fatigue
Regardless of how many hours you have worked or how much rest you havehad,youmustneverdriveifyouareimpairedbyfatigue.
The maximum hours of work and minimum hours of rest under your ‘work andresthoursoption’(e.g.StandardHours)areouterlimitsonly:
• youcanhavemorerestthantheminimumrequiredhoursofrest,andyoucanrestatanytime
• youdonothavetoworkthemaximumhoursofwork.

Using a work diary is an important part of managing fatigue for drivers of heavy vehicles. Work diaries must be used correctly to ensure that drivers and parties in the ‘chain of responsibility’ can meet their fatigue management obligations.

Q. Do I have to keep any records when I only do local work under Standard Hours on a day?A. For a day on which you only do local workunderStandardHours,youdon’thavetorecordinaworkdiary.
However,recordkeepers(includingdriverswhoareself-employed)mustrecordsomeinformationaboutlocal work.Ifyourrecordkeeperdoesn’tknowthisinformationalready,theymayaskyoufor:
• theregistrationnumberofthevehicle(s)youdrove
• thetotalnumberofhoursyouworkedandtotalnumberofhoursyourested thatday.
Q. If I am stopped by an authorised officer on the road, is this work or rest time?
A. Ifyouarestoppedbyanauthorisedofficer — forexample,theofficermaywish to check your work diary — thetimeyouspendnotdrivingmaybeworkorresttimedependingonwhetheryouaresubjecttoworkdemands.Examplesofworkdemandsincludeansweringquestionsorattendingtothevehicle.Theauthorisedofficermaybeabletogiveyoufurtheradvice.
Q. Can I have a split rest under BFM?A. Split rests are not encouraged and it is against the law to plan or schedule totakesplitrests.However,theHVNLdoesprovideadefenceifyoutakeasplitrestunderBFM.Asplitrestiswhereadrivertakes6continuoushoursatonetimeand2continuoushoursanothertimeina24hourperiod,ratherthantherequired7continuoushoursofrest.Notethatthedefenceonlyappliesifyouhadatleasttherequired7continuoushoursofrestintheprevious24-hourperiodandyoudidnotschedulethesplitrest.
Q. Where can I get help with filling out a work diary?A. SomeRegisteredTrainingOrganisations(RTOs)offerthecourse‘Completeaworkdiaryintheroadtransportindustry’(TLIE3028A).

When you have to record in a work diaryYou must use a work diary if you will drive outside a radius of 100 km fromyourbase(100+ km work)underStandardHours.
YoumustalwaysuseaworkdiaryifyouworkunderBFM,AFMorExemptionHours(regardlessofwhetherornotyouaredrivingoutsidearadiusof100kmfromyourbase).
Youarenotrequiredbylawtoobtainorrecordinaworkdiaryifyoualways do local work(drivingonlywithina100kmradiusofyourbase)underStandardHours.Ifyouoccasionallydo100+ km work you should obtainaworkdiaryandrecordalltherequireddetailsonanydayinwhichyou do the 100+ km work.
Onlyeverrecordinformationinasinglewrittenworkdiaryatanyonetime.
You must record all details for each day on which you do 100+ km work,beginningfromthetimeyoufirststartwork,including any local work you do on that day.
If you leave on a trip that will take you outside a radius of 100km from yourbase,youmustrecordallworkandresttimefromthestart of the trip.
Steve starts work one day at 4am doing deliveries around town. All Steve’s trips are within a 100km radius of Steve’s base. However, at 10am Steve is scheduled to do a 100+ km trip – in other words, a trip that will take him outside a 100km radius from his base. Because Steve is doing 100+ km work that day, he has to make sure he records all work and rest hours he has that day, including the local work, beginning from midnight.
How long you have to carry work diary records with you Yourworkdiarystayswithyouevenifyouchangevehicles,employersorcontracts.
You must carry work diary records with you whenever you drive one of the vehicleslistedonpage7for28daysaftertherecordismade.
Mostdriverswhodo100+ km work will have to carry their work diary with themeverytimetheydrive,evenondaystheydon’trecordinthediary,becausetheyareonlydoinglocal work.Ifyougetanewdiary,youmayhave to keep your old diary with you in the vehicle while you are working tomeetthe28dayrequirement.
One day Greg undertakes a 100+ km work trip and records the work and rest hour details in his work diary as required. For the next 40 days Greg only does local work. While he doesn’t have to record the local work in his work diary, he must keep his work diary with him in the vehicle for 28 days after the 100+ km work trip.
After 28 days, because Greg continues doing just local work he no longer has to keep his work diary with him in the vehicle. The next time Greg does 100+ km work he will have to record the details in his work diary, and then keep the records in his vehicle for at least 28 days after each 100+ km work day.

Unplanned 100+ km workIfonaparticulardayyouundertakeunplanned100+ km work under Standard Hours you must start to record the required details for the day in yourworkdiaryassoonaspossible.Youmustfillinyourdailysheetfromthestartofthedayonthedailysheet—i.e.midnight—notjustfromthetimeyoubecameawareyouwouldbeundertaking100+ km work.
Changing work and rest optionsYoumustonlyoperateunderoneworkandresthoursoptionatatime. TheworkandresthoursoptionsareStandardHours,BFM,AFMor ExemptionHours.
YoumaychangefromStandardHoursorBFMtoanotheroption,providedthatyoufullycomplywiththeworkandresthoursoptiontowhichyou arechanging.Alternatively,youcanchangefromStandardHoursorBFMtoanotheroptionifyouhavehadaresetrestbreakofnotlessthan 48continuoushoursstationaryrest.
YoumaychangefromAFMoraworkandresthoursexemptiontoStandardHoursorBFMonlyifyoufullycomplywiththemaximumworkandminimumresthoursintheoptiontowhichyouarechangingAND youhavehadaresetrestbreakofnotlessthan48continuoushoursstationaryrest.
Traveling to or from states or territories that don’t use the national driver work diaryAsofAugust2013,WesternAustralia(WA)andtheNorthernTerritory(NT)donothavethesamedriverfatiguelawsastheotherStatesandTerritories.IfyouaredrivingfromanotherstateorterritoryintoNTand/orWA,youshouldcontactthelocalroadagenciestofindoutwhatyourobligationsare.
YoudonothavetorecordinyournationaldriverworkdiarywhileyouareinNTand/orWA,butyoumustbeginrecordinginitagainassoonasyouleaveNTand/orWA.
If you are driving from WA or NT into a state or territory that uses the nationaldriverworkdiary,thefollowingrulesapply:
• IfyouwereinNTand/orWAforlessthan7days,thehoursyou worked and rested while in NT and/or WA count towards your total workandresthours.Therefore,forjourneysoflessthan7days,you should keep a record of your hours of work and rest while in NT and/ orWA(youareallowedtouseyournationaldriverworkdiaryforthis purpose).
If a Standard Hours driver spends 4 days in NT and has a 24 hour continuous rest break during those 4 days, that 24 hour continuous rest break can be used to meet the driver’s requirement to take at least one 24 hour continuous rest break in any 7 day period.
• IfyouwereinNTand/orWAformorethan7days,onlythetime youworkedandrestedsinceyourlastrelevantmajorrestbreakcounts towardsyourtotalworkandresthours.
If a Standard Hours driver spends 8 days in WA, the driver only needs to count the hours of work and rest since the driver’s last relevant major rest break on day 8. Because the Standard Hours driver is returning to a state or territory which uses the national driver work diary, the driver must be careful to comply with Standard Hours work and rest hour requirements beginning from the last relevant major rest break they had before crossing the border.

Being stopped on the roadside for an inspection of your work diaryIfyouarestoppedbyanauthorisedofficerforaroadsideinspection,youmustproduceyourworkdiarywhenrequestedtodoso.Theauthorisedofficermaydirectyoutoimmediatelystopworkandnotworkagainforaspecifiedperiodoftime(forexample24hours)if:
• youfailtoproduceyourworkdiarywithoutareasonableexcuse
• youproduceadocumentthattheauthorisedofficerreasonablybelievesis not a work diary
• theauthorisedofficerreasonablybelievesthattheworkdiaryorotherrecordproducedcannotbereliedupon
• youhaveexceededyourworktimeorfailedtotakeaminimumrestbreak,or
• theauthorisedofficerreasonablybelievesthatyouareimpairedbyfatigue.
Theofficermayremoveoneormoreofthepinkduplicatedailysheetsfromyourworkdiaryifrequired.
Youcanasktheofficertomakeanoteinyourworkdiaryifyouhavebeenstoppedformorethan5minutes.

You only have to record the place and odometer reading once for each rest period IF:
• thestartandendoftherestareonthesamedailysheet AND
• thelocationandodometerreadingshavenotchangedduringtherestperiod.
Rod stops for a rest break in Singleton at 4 pm and records this place and his odometer reading of 94, 081 before he begins his break.
When he starts work again at 7 pm, he does not have to record the place and odometer reading in his work diary again because those details have not changed and the end of his rest break is on the same daily sheet.

Two-up driving
Ifyouareworkinginatwo-updrivingarrangementwithanotherdriveryoumust,attherequestoftheotherdriver,provideanydetailstheotherdriverneedstobeabletocompletethetwo-updriversectionoftheirworkdiaryandsigntheotherdriver’sworkdiarytoconfirmyourdetailshavebeenrecordedcorrectly.
Youandtheotherdriverinthetwo-uparrangementmustrecordeachother’sdetailsandsigneachother’sworkdiariesat the time you start working together.

What you do with the copies of a daily sheet

Who has to keep daily sheet records
Ifyouareanemployeddriver,youremployerasyourrecordkeepermustkeepacopyofeachdailysheetfor3years.
Ifyouareyourownrecordkeeper,youmustkeepacopyofeachofyourdailysheetsatyourrecordlocationfor3years.AnauthorisedofficerortheNHVRmayrequesttheserecordsforauditpurposes.
Dailysheetrecordsmustbekeptinaplacewheretheyarereasonablyaccessibletoanauthorisedofficer.
Providing copies to others in the chain of responsibility
Apersoninyourchainofresponsibilityotherthanyouremployer/recordkeeper,suchasaconsignor,loadingmanagerorprimecontractor,mayrequestthatyougivetheminformationaboutyourworkandresttimesoracopyofyourdailysheets.
While you must not remove daily sheets or duplicates from your work diary forthispurpose,youcanprovidephotocopiesorscansofyourdailysheetstothesepartiesorallowthemtomakecopies.
The law only requires you to give your work diary records to your record keeper.However,thereisnothingtopreventyoufromprovidingrecordstoanotherpartyinyourchainofresponsibility.Itmaybearequirementundera contract that you or your employer have entered into with another party thatyouprovidecopiesofyourworkrecords—thatisamatterforyou,youremployerandtheothercontractingparty.
You must not make false or misleading records
It is against the law to:
• recordinformationinaworkdiarythatyouknow,oroughttoknow,isfalseor misleading
• usemorethanonewrittenworkdiaryatthesametime
• recordinformationforthesameperiodinmorethanoneworkdiary
• defaceorchangeaworkrecordyouknow,oroughttoknow,iscorrect
• pretendyouhavemadeaworkrecordormadeanentryinaworkrecordwhen this is not the case

Part 4: How to count time
Working in different time zones
Driverstravellingoutsidetheirnormaltimezonemustensurethattheycountandrecordtime,includingnightrests,accordingtothetimezoneoftheirbase.
Susie undertakes a round trip under Standard Hours from Armidale, NSW to Toowoomba, QLD. She leaves her base at Armidale NSW at 4.15 pm and drives for 5 hours to Toowoomba QLD where she begins a rest break.
Because of daylight savings, the local time in QLD is 8.15 pm when Susie arrives, however the time in NSW is 9.15 pm. Susie must continue to count and record time according to the time zone of her base in Armidale, which means Susie must record the change from work to rest at 9.15 pm in her work diary.
How to count periods of less than 24 hours
Periodsoflessthan24hoursshouldbecountedforwardfromtheendofanyrestbreak(seepage27foranexample).
Thisruleensuresthatdrivershavetheirrequiredshortrestbreaks(forexample,aStandardHourssolodrivermustnotworkformorethan7½hoursinanyperiodof8hours).

Important advice on counting 24 hour periods
Youmustcountworktimefor the whole 24 hour period following the end of a relevant major rest break.Ifyoutakeanotherrelevantmajorrestbreakduringthat24hourperiod,itdoesnotresetthe24hourperiod,soyoudonotstopcountingworktimeforthefirst24hourperiodatthatbreak.Youmustcountallworktimebeforeandafterthesecondrelevantmajorrestbreakyoutookinthat24hourperiod.
Bob works under Standard Hours. On Monday he starts work at 6am and does the following:
• 5¼ hrs work (6am–11.15am), then takes a 15 min break • 2¼ hrs work (11.30am–1.45pm), then takes a 90 min break • 4½ hrs work (3.15pm–7.45pm), then takes a 7 hour major rest break as required under Standard Hours.
At 7.45pm Bob has undertaken the maximum 12 hours of work time in a 24 hour period allowed under Standard Hours. Therefore, Bob can’t start work again at 2.45am even though he has had the 7 hour major rest break required under Standard Hours. Bob must continue resting until 6am on Tuesday morning because that is when the 24 hour period he began on Monday finishes.

Paul leaves Laverton at 5 am and arrives at Nhill at 9.15 am where he has a 45 minute rest break. At 10 am Paul leaves Nhill and arrives in Port Adelaide at 3 pm where he finishes work for the day.
If an authorised officer reviewed Paul’s work diary, the officer would need to:
• count from the end of every rest break to check compliance with short rest requirements for periods less than 24 hours
• count from the end of the relevant major rest break to check compliance with rest requirements for periods of 24 hours or greater
For example, the authorised officer would count from the end of each rest break at 5 am, 10 am and 3 pm to ensure Paul had at least 15 minutes of rest in each 5 ½ hour period following the end of the rest break. The officer would also check compliance with the rest requirements for each 8, 10 and 11 hour period from the end of each rest break.
The officer would also count forward 24 hours from the end of the major rest break at 5 am to ensure Paul had not worked for more than 12 hours in that period, and that Paul had taken at least 7 hours of continuous rest in that period.

How to get a new work diary
YoucanbuyanationaldriverworkdiaryatanymotorregistryorroadagencyinanyAustralianstateorterritory.Anumberofotherplacesoutsidemajorcitiesalsoissueworkdiaries.IfyouliveinaruralorremoteareacontacttheNHVRforadviceontheclosestplacetoobtainaworkdiary.Proofofidentityisrequiredatthetimeofpurchase.Themotorregistryorroadagencywillcancelunusedpagesinyouroldworkdiary.
What if your work diary is lost, stolen or destroyed
Ifyourworkdiaryislost,stolenordestroyed(andyouhavenotyetobtainedanewworkdiary)youmustreportthisinwritingtoaroadagencywithin2businessdays.Youhaveamaximumof7businessdaystogetanewworkdiary.
Untilyouareissuedwithanewworkdiary,youmustcontinuetorecordinsupplementaryrecords.Supplementaryrecordsmustcontainallthesameinformationasyouwouldrecordinyouworkdiary.
Youcandownloadablankcopyofanationaldriverworkdiarydaily sheetfromtheNHVRwebsitetouseasasupplementaryrecord. Asupplementaryrecordmustbetreatedthesamewayasyourworkdiary.You must keep a copy of each daily supplementary record with you in thevehiclefor28daysafteritismadeandgiveacopytoyouremployerasyourrecordkeeperwithin21days,whomuststoreitfor3years.
Ifthelostorstolenworkdiaryisfoundorreturnedtoyouafteryouhavebeenissuedwithanewone,youmustimmediatelycancelanyunuseddailysheetsintheoldworkdiarybywritingCANCELLEDacrosseachunusedpage.YoumustalsoimmediatelynotifytheNHVRthatthelostorstolendiaryhasbeenrecovered,andgivetherecovereddiarytotheNHVRoraroadagencyassoonaspossible.TheNHVRwillcheckthatthepageshavebeencancelledintherecoveredworkdiaryandwillthenreturnittoyouforrecordkeepingpurposes.
Youmustnotuseaworkdiarythathasbeencancelled,evenifithasunuseddailysheetsthatarenotcancelled.
EachworkdiaryhasauniquenumberandtheNHVRwillkeeparecordofyouractiveworkdiary.Ifyouuseaworkdiarythatisnotactiveyouarebreakingthelaw.
