The White House Office of the Press Secretary For Immediate Release March 16, 2012 Executive Order -- National Defense Resources Preparedness EXECUTIVE ORDER NATIONAL DEFENSE RESOURCES PREPAREDNESS By the authority vested in me as President by the Constitution and the laws of the United States of America, including the Defense Production Act of 1950, as amended (50 U.S.C. App. 2061 et seq.), and section 301 of title 3, United States Code, and as Commander in Chief of the Armed Forces of the United States, it is hereby ordered as follows: PART I - PURPOSE, POLICY, AND IMPLEMENTATION Section 101. Purpose. This order delegates authorities and addresses national defense resource policies and programs under the Defense Production Act of 1950, as amended (the "Act"). Sec. 102. Policy. The United States must have an industrial and technological base capable of meeting national defense requirements and capable of contributing to the technological superiority of its national defense equipment in peacetime and in times of national emergency. The domestic industrial and technological base is the foundation for national defense preparedness. The authorities provided in the Act shall be used to strengthen this base and to ensure it is capable of responding to the national defense needs of the United States. Sec. 103. General Functions. Executive departments and agencies (agencies) responsible for plans and programs relating to national defense (as defined in section 801(j) of this order), or for resources and services needed to support such plans and programs, shall: (a) identify requirements for the full spectrum of emergencies, including essential military and civilian demand; (b) assess on an ongoing basis the capability of the domestic industrial and technological base to satisfy requirements in peacetime and times of national emergency, specifically evaluating the availability of the most critical resource and production sources, including subcontractors and suppliers, materials, skilled labor, and professional and technical personnel; (c) be prepared, in the event of a potential threat to the security of the United States, to take actions necessary to ensure the availability of adequate resources and production capability, including services and critical technology, for national defense requirements; (d) improve the efficiency and responsiveness of the domestic industrial base to support national defense requirements; and (e) foster cooperation between the defense and commercial sectors for research and development and for acquisition of materials, services, components, and equipment to enhance industrial base efficiency and responsiveness. Sec. 104. Implementation. (a) The National Security Council and Homeland Security Council, in conjunction with the National Economic Council, shall serve as the integrated policymaking forum for consideration and formulation of national defense resource preparedness policy and shall make recommendations to the President on the use of authorities under the Act.

The White House Office of the Press Secretary For Immediate Release March 16, 2012 ExecutiveOrder--NationalDefenseResourcesPreparednessEXECUTIVEORDERNATIONALDEFENSERESOURCESPREPAREDNESSBytheauthorityvestedinmeasPresidentbytheConstitutionandthelawsoftheUnitedStatesofAmerica,includingtheDefenseProductionActof1950,asamended(50U.S.C.App.2061etseq.),andsection301oftitle3,UnitedStatesCode,andasCommanderinChiefoftheArmedForcesoftheUnitedStates,itisherebyorderedasfollows:PARTI-PURPOSE,POLICY,ANDIMPLEMENTATIONSection101.Purpose.ThisorderdelegatesauthoritiesandaddressesnationaldefenseresourcepoliciesandprogramsundertheDefenseProductionActof1950,asamended(the"Act").Sec.102.Policy.TheUnitedStatesmusthaveanindustrialandtechnologicalbasecapableofmeetingnationaldefenserequirementsandcapableofcontributingtothetechnologicalsuperiorityofitsnationaldefenseequipmentinpeacetimeandintimesofnationalemergency.Thedomesticindustrialandtechnologicalbaseisthefoundationfornationaldefensepreparedness.TheauthoritiesprovidedintheActshallbeusedtostrengthenthisbaseandtoensureitiscapableofrespondingtothenationaldefenseneedsoftheUnitedStates.Sec.103.GeneralFunctions.Executivedepartmentsandagencies(agencies)responsibleforplansandprogramsrelatingtonationaldefense(asdefinedinsection801(j)ofthisorder),orforresourcesandservicesneededtosupportsuchplansandprograms,shall:(a)identifyrequirementsforthefullspectrumofemergencies,includingessentialmilitaryandciviliandemand;(b)assessonanongoingbasisthecapabilityofthedomesticindustrialandtechnologicalbasetosatisfyrequirementsinpeacetimeandtimesofnationalemergency,specificallyevaluatingtheavailabilityofthemostcriticalresourceandproductionsources,includingsubcontractorsandsuppliers,materials,skilledlabor,andprofessionalandtechnicalpersonnel;(c)beprepared,intheeventofapotentialthreattothesecurityoftheUnitedStates,totakeactionsnecessarytoensuretheavailabilityofadequateresourcesandproductioncapability,includingservicesandcriticaltechnology,fornationaldefenserequirements;(d)improvetheefficiencyandresponsivenessofthedomesticindustrialbasetosupportnationaldefenserequirements;and(e)fostercooperationbetweenthedefenseandcommercialsectorsforresearchanddevelopmentandforacquisitionofmaterials,services,components,andequipmenttoenhanceindustrialbaseefficiencyandresponsiveness.Sec.104.Implementation.(a)TheNationalSecurityCouncilandHomelandSecurityCouncil,inconjunctionwiththeNationalEconomicCouncil,shallserveastheintegratedpolicymakingforumforconsiderationandformulationofnationaldefenseresourcepreparednesspolicyandshallmakerecommendationstothePresidentontheuseofauthoritiesundertheAct.

(b)TheSecretaryofHomelandSecurityshall:(1)advisethePresidentonissuesofnationaldefenseresourcepreparednessandontheuseoftheauthoritiesandfunctionsdelegatedbythisorder;(2)provideforthecentralcoordinationoftheplansandprogramsincidenttoauthoritiesandfunctionsdelegatedunderthisorder,andprovideguidancetoagenciesassignedfunctionsunderthisorder,developedinconsultationwithsuchagencies;and(3)reporttothePresidentperiodicallyconcerningallprogramactivitiesconductedpursuanttothisorder.(c)TheDefenseProductionActCommittee,describedinsection701ofthisorder,shall:(1)inamannerconsistentwithsection2(b)oftheAct,50U.S.C.App.2062(b),advisethePresidentthroughtheAssistanttothePresidentandNationalSecurityAdvisor,theAssistanttothePresidentforHomelandSecurityandCounterterrorism,andtheAssistanttothePresidentforEconomicPolicyontheeffectiveuseoftheauthoritiesundertheAct;and(2)prepareandcoordinateanannualreporttotheCongresspursuanttosection722(d)oftheAct,50U.S.C.App.2171(d).(d)TheSecretaryofCommerce,incooperationwiththeSecretaryofDefense,theSecretaryofHomelandSecurity,andotheragencies,shall:(1)analyzepotentialeffectsofnationalemergenciesonactualproductioncapability,takingintoaccounttheentireproductionsystem,includingshortagesofresources,anddeveloprecommendedpreparednessmeasurestostrengthencapabilitiesforproductionincreasesinnationalemergencies;and(2)performindustryanalysestoassesscapabilitiesoftheindustrialbasetosupportthenationaldefense,anddeveloppolicyrecommendationstoimprovetheinternationalcompetitivenessofspecificdomesticindustriesandtheirabilitiestomeetnationaldefenseprogramneeds.PARTII-PRIORITIESANDALLOCATIONSSec.201.PrioritiesandAllocationsAuthorities.(a)TheauthorityofthePresidentconferredbysection101oftheAct,50U.S.C.App.2071,torequireacceptanceandpriorityperformanceofcontractsororders(otherthancontractsofemployment)topromotethenationaldefenseoverperformanceofanyothercontractsororders,andtoallocatematerials,services,andfacilitiesasdeemednecessaryorappropriatetopromotethenationaldefense,isdelegatedtothefollowingagencyheads:(1)theSecretaryofAgriculturewithrespecttofoodresources,foodresourcefacilities,livestockresources,veterinaryresources,planthealthresources,andthedomesticdistributionoffarmequipmentandcommercialfertilizer;(2)theSecretaryofEnergywithrespecttoallformsofenergy;(3)theSecretaryofHealthandHumanServiceswithrespecttohealthresources;(4)theSecretaryofTransportationwithrespecttoallformsofciviltransportation;(5)theSecretaryofDefensewithrespecttowaterresources;and(6)theSecretaryofCommercewithrespecttoallothermaterials,services,andfacilities,includingconstructionmaterials.(b)TheSecretaryofeachagencydelegatedauthorityundersubsection(a)ofthissection(resourcedepartments)shallplanforandissueregulationstoprioritizeandallocateresourcesandestablishstandardsandproceduresbywhichtheauthorityshallbeusedtopromotethe

nationaldefense,underbothemergencyandnon-emergencyconditions.EachSecretaryshallauthorizetheheadsofotheragencies,asappropriate,toplacepriorityratingsoncontractsandordersformaterials,services,andfacilitiesneededinsupportofprogramsapprovedundersection202ofthisorder.(c)Eachresourcedepartmentshallact,asnecessaryandappropriate,uponrequestsforspecialprioritiesassistance,asdefinedbysection801(l)ofthisorder,inatimeframeconsistentwiththeurgencyoftheneedathand.Insituationswheretherearecompetingprogramrequirementsforlimitedresources,theresourcedepartmentshallconsultwiththeSecretarywhomadetherequireddeterminationundersection202ofthisorder.SuchSecretaryshallcoordinatewithandidentifyfortheresourcedepartmentwhichprogramrequirementstoprioritizeonthebasisofoperationalurgency.InsituationsinvolvingmorethanoneSecretarymakingsucharequireddeterminationundersection202ofthisorder,theSecretariesshallcoordinatewithandidentifyfortheresourcedepartmentwhichprogramrequirementsshouldreceivepriorityonthebasisofoperationalurgency.(d)IfagreementcannotbereachedbetweentwosuchSecretaries,thentheissueshallbereferredtothePresidentthroughtheAssistanttothePresidentandNationalSecurityAdvisorandtheAssistanttothePresidentforHomelandSecurityandCounterterrorism.(e)TheSecretaryofeachresourcedepartment,whennecessary,shallmakethefindingrequiredundersection101(b)oftheAct,50U.S.C.App.2071(b).ThisfindingshallbesubmittedforthePresident'sapprovalthroughtheAssistanttothePresidentandNationalSecurityAdvisorandtheAssistanttothePresidentforHomelandSecurityandCounterterrorism.Uponsuchapproval,theSecretaryoftheresourcedepartmentthatmadethefindingmayusetheauthorityofsection101(a)oftheAct,50U.S.C.App.2071(a),tocontrolthegeneraldistributionofanymaterial(includingapplicableservices)inthecivilianmarket.Sec.202.Determinations.Exceptasprovidedinsection201(e)ofthisorder,theauthoritydelegatedbysection201ofthisordermaybeusedonlytosupportprogramsthathavebeendeterminedinwritingasnecessaryorappropriatetopromotethenationaldefense:(a)bytheSecretaryofDefensewithrespecttomilitaryproductionandconstruction,militaryassistancetoforeignnations,militaryuseofciviltransportation,stockpilesmanagedbytheDepartmentofDefense,space,anddirectlyrelatedactivities;(b)bytheSecretaryofEnergywithrespecttoenergyproductionandconstruction,distributionanduse,anddirectlyrelatedactivities;and(c)bytheSecretaryofHomelandSecuritywithrespecttoallothernationaldefenseprograms,includingcivildefenseandcontinuityofGovernment.Sec.203.MaximizingDomesticEnergySupplies.TheauthoritiesofthePresidentundersection101(c)(1)(2)oftheAct,50U.S.C.App.2071(c)(1)(2),aredelegatedtotheSecretaryofCommerce,withtheexceptionthattheauthoritytomakefindingsthatmaterials(includingequipment),services,andfacilitiesarecriticalandessential,asdescribedinsection101(c)(2)(A)oftheAct,50U.S.C.App.2071(c)(2)(A),isdelegatedtotheSecretaryofEnergy.Sec.204.ChemicalandBiologicalWarfare.TheauthorityofthePresidentconferredbysection104(b)oftheAct,50U.S.C.App.2074(b),isdelegatedtotheSecretaryofDefense.ThisauthoritymaynotbefurtherdelegatedbytheSecretary.PARTIII-EXPANSIONOFPRODUCTIVECAPACITYANDSUPPLYSec.301.LoanGuarantees.(a)Toreducecurrentorprojectedshortfallsofresources,critical

technologyitems,ormaterialsessentialforthenationaldefense,theheadofeachagencyengagedinprocurementforthenationaldefense,asdefinedinsection801(h)ofthisorder,isauthorizedpursuanttosection301oftheAct,50U.S.C.App.2091,toguaranteeloansbyprivateinstitutions.(b)Eachguaranteeingagencyisdesignatedandauthorizedto:(1)actasfiscalagentinthemakingofitsownguaranteecontractsandinotherwisecarryingoutthepurposesofsection301oftheAct;and(2)contractwithanyFederalReserveBanktoassisttheagencyinservingasfiscalagent.(c)TermsandconditionsofguaranteesunderthisauthorityshallbedeterminedinconsultationwiththeSecretaryoftheTreasuryandtheDirectoroftheOfficeofManagementandBudget(OMB).Theguaranteeingagencyisauthorized,followingsuchconsultation,toprescribe:(1)eitherspecificallyorbymaximumlimitsorotherwise,ratesofinterest,guaranteeandcommitmentfees,andotherchargeswhichmaybemadeinconnectionwithsuchguaranteecontracts;and(2)regulationsgoverningtheformsandprocedures(whichshallbeuniformtotheextentpracticable)tobeutilizedinconnectiontherewith.Sec.302.Loans.Toreducecurrentorprojectedshortfallsofresources,criticaltechnologyitems,ormaterialsessentialforthenationaldefense,theheadofeachagencyengagedinprocurementforthenationaldefenseisdelegatedtheauthorityofthePresidentundersection302oftheAct,50U.S.C.App.2092,tomakeloansthereunder.TermsandconditionsofloansunderthisauthorityshallbedeterminedinconsultationwiththeSecretaryoftheTreasuryandtheDirectorofOMB.Sec.303.AdditionalAuthorities.(a)Tocreate,maintain,protect,expand,orrestoredomesticindustrialbasecapabilitiesessentialforthenationaldefense,theheadofeachagencyengagedinprocurementforthenationaldefenseisdelegatedtheauthorityofthePresidentundersection303oftheAct,50U.S.C.App.2093,tomakeprovisionforpurchasesof,orcommitmentstopurchase,anindustrialresourceoracriticaltechnologyitemforGovernmentuseorresale,andtomakeprovisionforthedevelopmentofproductioncapabilities,andfortheincreaseduseofemergingtechnologiesinsecurityprogramapplications,andtoenablerapidtransitionofemergingtechnologies.(b)Materialsacquiredundersection303oftheAct,50U.S.C.App.2093,thatexceedtheneedsoftheprogramsundertheActmaybetransferredtotheNationalDefenseStockpile,if,inthejudgmentoftheSecretaryofDefenseastheNationalDefenseStockpileManager,suchtransfersareinthepublicinterest.Sec.304.SubsidyPayments.Toensurethesupplyofrawornonprocessedmaterialsfromhighcostsources,ortoensuremaximumproductionorsupplyinanyareaatstablepricesofanymaterialsinlightofatemporaryincreaseintransportationcost,theheadofeachagencyengagedinprocurementforthenationaldefenseisdelegatedtheauthorityofthePresidentundersection303(c)oftheAct,50U.S.C.App.2093(c),tomakesubsidypayments,afterconsultationwiththeSecretaryoftheTreasuryandtheDirectorofOMB.Sec.305.DeterminationsandFindings.(a)Pursuanttobudgetauthorityprovidedbyanappropriationsactinadvanceforcreditassistanceundersection301or302oftheAct,50U.S.C.App.2091,2092,andconsistentwiththeFederalCreditReformActof1990,asamended(FCRA),2U.S.C.661etseq.,theheadofeachagencyengagedinprocurementforthenationaldefenseisdelegatedtheauthoritytomakethedeterminationssetforthinsections301(a)(2)

and302(b)(2)oftheAct,inconsultationwiththeSecretarymakingtherequireddeterminationundersection202ofthisorder;provided,thatsuchdeterminationsshallbemadeafterdueconsiderationoftheprovisionsofOMBCircularA129andthecreditsubsidyscorefortherelevantloanorloanguaranteeasapprovedbyOMBpursuanttoFCRA.(b)OtherthananydeterminationbythePresidentundersection303(a)(7)(b)oftheAct,theheadofeachagencyengagedinprocurementforthenationaldefenseisdelegatedtheauthoritytomaketherequireddeterminations,judgments,certifications,findings,andnotificationsdefinedundersection303oftheAct,50U.S.C.App.2093,inconsultationwiththeSecretarymakingtherequireddeterminationundersection202ofthisorder.Sec.306.StrategicandCriticalMaterials.TheSecretaryofDefense,andtheSecretaryoftheInteriorinconsultationwiththeSecretaryofDefenseastheNationalDefenseStockpileManager,areeachdelegatedtheauthorityofthePresidentundersection303(a)(1)(B)oftheAct,50U.S.C.App.2093(a)(1)(B),toencouragetheexploration,development,andminingofstrategicandcriticalmaterialsandothermaterials.Sec.307.Substitutes.TheheadofeachagencyengagedinprocurementforthenationaldefenseisdelegatedtheauthorityofthePresidentundersection303(g)oftheAct,50U.S.C.App.2093(g),tomakeprovisionforthedevelopmentofsubstitutesforstrategicandcriticalmaterials,criticalcomponents,criticaltechnologyitems,andotherresourcestoaidthenationaldefense.Sec.308.Government-OwnedEquipment.TheheadofeachagencyengagedinprocurementforthenationaldefenseisdelegatedtheauthorityofthePresidentundersection303(e)oftheAct,50U.S.C.App.2093(e),to:(a)procureandinstalladditionalequipment,facilities,processes,orimprovementstoplants,factories,andotherindustrialfacilitiesownedbytheFederalGovernmentandtoprocureandinstallGovernmentownedequipmentinplants,factories,orotherindustrialfacilitiesownedbyprivatepersons;(b)provideforthemodificationorexpansionofprivatelyownedfacilities,includingthemodificationorimprovementofproductionprocesses,whentakingactionsundersections301,302,or303oftheAct,50U.S.C.App.2091,2092,2093;and(c)sellorotherwisetransferequipmentownedbytheFederalGovernmentandinstalledundersection303(e)oftheAct,50U.S.C.App.2093(e),totheownersofsuchplants,factories,orotherindustrialfacilities.Sec.309.DefenseProductionActFund.TheSecretaryofDefenseisdesignatedtheDefenseProductionActFundManager,inaccordancewithsection304(f)oftheAct,50U.S.C.App.2094(f),andshallcarryoutthedutiesspecifiedinsection304oftheAct,inconsultationwiththeagencyheadshavingapproved,andappropriatedfundsfor,projectsundertitleIIIoftheAct.Sec.310.CriticalItems.TheheadofeachagencyengagedinprocurementforthenationaldefenseisdelegatedtheauthorityofthePresidentundersection107(b)(1)oftheAct,50U.S.C.App.2077(b)(1),totakeappropriateactiontoensurethatcriticalcomponents,criticaltechnologyitems,essentialmaterials,andindustrialresourcesareavailablefromreliablesourceswhenneededtomeetdefenserequirementsduringpeacetime,graduatedmobilization,andnationalemergency.Appropriateactionmayincluderestrictingcontractsolicitationstoreliablesources,restrictingcontractsolicitationstodomesticsources(pursuant

tostatutoryauthority),stockpilingcriticalcomponents,anddevelopingsubstitutesforcriticalcomponentsorcriticaltechnologyitems.Sec.311.StrengtheningDomesticCapability.TheheadofeachagencyengagedinprocurementforthenationaldefenseisdelegatedtheauthorityofthePresidentundersection107(a)oftheAct,50U.S.C.App.2077(a),toutilizetheauthorityoftitleIIIoftheActoranyotherprovisionoflawtoprovideappropriateincentivestodevelop,maintain,modernize,restore,andexpandtheproductivecapacitiesofdomesticsourcesforcriticalcomponents,criticaltechnologyitems,materials,andindustrialresourcesessentialfortheexecutionofthenationalsecuritystrategyoftheUnitedStates.Sec.312.ModernizationofEquipment.Theheadofeachagencyengagedinprocurementforthenationaldefense,inaccordancewithsection108(b)oftheAct,50U.S.C.App.2078(b),mayutilizetheauthorityoftitleIIIoftheActtoguaranteethepurchaseorleaseofadvancemanufacturingequipment,andanyrelatedserviceswithrespecttoanysuchequipmentforpurposesoftheAct.InconsideringtitleIIIprojects,theheadofeachagencyengagedinprocurementforthenationaldefenseshallprovideastrongpreferenceforproposalssubmittedbyasmallbusinesssupplierorsubcontractorinaccordancewithsection108(b)(2)oftheAct,50U.S.C.App.2078(b)(2).PARTIV-VOLUNTARYAGREEMENTSANDADVISORYCOMMITTEESSec.401.Delegations.TheauthorityofthePresidentundersections708(c)and(d)oftheAct,50U.S.C.App.2158(c),(d),isdelegatedtotheheadsofagenciesotherwisedelegatedauthorityunderthisorder.ThestatusoftheuseofsuchdelegationsshallbefurnishedtotheSecretaryofHomelandSecurity.Sec.402.AdvisoryCommittees.TheauthorityofthePresidentundersection708(d)oftheAct,50U.S.C.App.2158(d),anddelegatedinsection401ofthisorder(relatingtoestablishmentofadvisorycommittees)shallbeexercisedonlyafterconsultationwith,andinaccordancewith,guidelinesandproceduresestablishedbytheAdministratorofGeneralServices.Sec.403.Regulations.TheSecretaryofHomelandSecurity,afterapprovaloftheAttorneyGeneral,andafterconsultationbytheAttorneyGeneralwiththeChairmanoftheFederalTradeCommission,shallpromulgaterulespursuanttosection708(e)oftheAct,50U.S.C.App.2158(e),incorporatingstandardsandproceduresbywhichvoluntaryagreementsandplansofactionmaybedevelopedandcarriedout.Suchrulesmaybeadoptedbyotheragenciestofulfilltherulemakingrequirementofsection708(e)oftheAct,50U.S.C.App.2158(e).PARTV-EMPLOYMENTOFPERSONNELSec.501.NationalDefenseExecutiveReserve.(a)Inaccordancewithsection710(e)oftheAct,50U.S.C.App.2160(e),thereisestablishedintheexecutivebranchaNationalDefenseExecutiveReserve(NDER)composedofpersonsofrecognizedexpertisefromvarioussegmentsoftheprivatesectorandfromGovernment(exceptfulltimeFederalemployees)fortrainingforemploymentinexecutivepositionsintheFederalGovernmentintheeventofanationaldefenseemergency.(b)TheSecretaryofHomelandSecurityshallissuenecessaryguidancefortheNDERprogram,includingappropriateguidanceforestablishment,recruitment,training,monitoring,andactivationofNDERunitsandshallberesponsiblefortheoverallcoordinationoftheNDERprogram.TheauthorityofthePresidentundersection710(e)oftheAct,50U.S.C.App.2160(e),todetermineperiodsofnationaldefenseemergencyisdelegatedtotheSecretaryof
