    MUSLIM FILIPINOS DEFINING ITS POWERS,FUNCTIONS AND RESPONSIBILITIES ANDAPPROPRIATING 'FUNDS THEREFOR AND FOROTHER PURPOSES

    Be it enacted by the Senate and Honse of Representatives0/ the Philippines in Congress assembled:SECTION 1. Title. -- This Act shall be known as the

    "NatIOnal' Commission on Mushm FlIipinos Act of 2009".SEC. 2. Declaration ol Policy. -. I t is henceforth the pohcyof the State to ensure the rights and well-being of MushmFilipinos with due regard to their behefs, customs, traditIons

    2and institutions, as well as to further ensure their contributionto national goals and aspirations and to make them activeparticipants in nation-building.

    ARTICLE ICREATION AND COMPOSITION OF THE COMMISSION,AND TERM OF OFFICE OF THE COMMISSIONERS

    SEC. 3. Creation of the National Commission on MuslimFilipinos. - In pursuance of the abovementioned policy, theNational Commission on Muslim Filipinos, hereinafter referredto as the Commission, is hereby created.

    The Commission, which shall be under the Office of thePresident, shall take over the functions of the Office onMuslim Affairs (OMA), which is hereby abolished. Its coverageshall be both local and national affairs involving MuslimFilipinos that include the implementation of economic,educational, cultural, and infrastructure programs for MuslimFilipino communities.

    SEC. 4. Mandate. - The Commission shall preserve anddevelop the culture, traditIOn, institutions, and well-being ofMuslim Filipinos, in conformity with the country's laws andin consonance with national unity and development.

    SEC. 5, Composition of the Commission. - TheCommission shall be composed of nine (9) full-time memberswho are Muslim Filipinos and shall be headed by a Secretary:Provided, That one (1) of the Commissioners shall come fromthe women sector, one (1) from the youth sector and anotherCommissioner shall come from the Ulama sector: Provided,further, That not JUore than two (2) Commissioners shall comefrom the same Muslim Filipino tribe at any given time, toensure a more equitable representation in the Commission. ThePresident shall appoint the regular members of theCommission. The Commissioners shall be academic degreeholders and must speak and write fluently the Enghsh andlorArabic languages. They shall be individuals who possess thehighest degree of integrity and have the endorsement of theirrespectlYe tribes or sectors.

    representatives to act on theIr behalf.The CommiSSIOn may create a Council of Advisers to becomposed of cultural, religious, traditIOnal, and tribal leaders.The Counc!l shall advise the CommissIOn on matters pursuantto the Commission's mandate.SEC. 6. Term of Office. - The Secretary, who shall bethe Chief Executive Officer of the Commission with Cabinetrank, shall attend the Cabinet-level meetings, appointed by thePresident from among the nine (9) Commissioners, and shallserve for a period of two (2) years without prejudice toreappointment.For the mitial set of Commissioners, the first fIVe (5)Commissioners shall have a term of office of four (4) yearsand the remaining four (4) shall hold office for two (2) years.

    Thereafter, the succeeding set of Commissioners shall servefor a full term of four (4) years.Should a Commissioner fail to complete hislher term, the

    PreSIdent shall appoint a successor from the trIbe theCommissioner represents. The successor will only serve for theunexpired portion of the term.

    The Secretary and the CommiSSIOners shall have thesame rank, salary, and privileges as those of a CabinetSecretary and Assistant Secretaries, respectively.

    SEC. 7. Removal from Office. The President mayremove any member of the Commission before the expirationof luslher term, for cause and after observance of the properdue process required by pertinent laws.

    ARTICLE I IPOWERS AND FUNCTIONS

    SEC. 8. Powers and Functions. - To accomplish itsmandate, the Commission shall have the following powers andfunctions:

    4(a) Provide advice and assistance to the President in the

    formulation, coordinatiori, implementation and monitoring ofpolicies, plans, programs and projects affecting Muslim Filipinocommunities; when so authorized, represent the President onmatters concerning Muslim Filipino communities; serve as alink between the President and public or private agencies,internal or external, that are involved in such programs andprojects; and recommend such affirmative actions as may benecessary fo1' their efficient and effective implementation;

    (b) Undertake and coordinate development programs andprojects for the advancement of Muslim Filipino communities,including designing, implementing and maintaining settlementsfor Muslim Filipino communities: Provided, That theCommission shall not take jurisdiction or ownership over lands,and bodies of water traditionally and actually occupied byindigenous peoples and within the identified ancestral domainsof the National Commission on Indigenous Peoples: Provided,further, That lands may be identified by the Commission forthe purpose of settling the homeless and displaced Muslimfamilies to improve the conditions of the members of theMuslim communities;

    (c) Act as the primary government agency through whichMuslim Filipinos can seek government assistance and redress;serve as the medium through which such assistance may beextended to Muslim Filipinos; for this purpose, the Commissionis hereby authorized, subject to existing auditing rules andregulations, to give grants-in-aid out of its appropriations orother appropriate funds to cooperating government agencies forsuch programs or projects for the development of MuslimFilipino communities; provide services including legalassistance, medical aid, relief, rehabilitation and other formsof assistance for socioeconomic upliftment of Muslim Filipinocomm unities;

    (d) Participate in the peace process involving conflictsbetween Filipino Muslim groups and/or individuals and thegovernment in cooperation with appropriate agencies,individuals and institutions. Pursuant hereto) the Commission'sSecretary or his/her duly designated representative shall sitas a regular member of the government's peace panel

    5negotiating peace with the Muslim Filipino groups orindividuals;

    (e) Enter, subject to existing laws, pohcies and guidelmes,into contracts, agreements or arrangements with governmentor private agencies/entities as may be necessary to attam theobjectives of the Commission;

    (f) In accordance with exisbng laws, rules and regulatIOnsand subject to guidelines provided by the OffICe of thePresident, promote and enhance the development o( domestictrade and commerce among the members of the MuslimFilipino communities; promote or facilitate the establishmentby members of the Muslim FilIpino communities joint ventureand investments in cooperation or coordinatIOn With eXlsbngpublic enterprises, corporatlOns or private entitles; initiate and!or organize, in accordance with pertinent laws, rules andregulations, enterprises based on the principles of Islamicbusiness and finance for the benefit and welfare of the MushmFilipino communities;

    (g) Recommend to the Department of Budget andManagement (DBM) the proposed expenditure for thedevelopment of all MuslIm FilIpino commulllties;(h) Promote and develop the Philippine Halal Industryand accredit halal-certifying entities/bodies for the utmostbenefit of MuslIm Filipinos and in partnership or cooperationwith approprIate agencies, individuals and institutlons here andabroad;(i) Develop CrIteria for allocating additional resources foreducation, economic and cultural development programs;G) Monitor and evaluate the performance of all existmgpolicies and development programs of the government that seekto strengthen and uplift the socioeconomic conditions of Muslim

    Filipinos and identify areas that need government interventionand support;(k) Acquire, lease or own property or assets m whateverform as ,may be necessary, and sell or otherwise dispose of

    the same, and serve as the custodian 01' admmistrator of such

    6lands or areas and other propertIes or assets the Presidentmay reserve for the benefit of Muslim Filipino communities;

    (1) SolicIt and accept grants, donations and gifts, in cashor in kind, m whatever source, in coordination with theappropriate agency for the benefit of the Muslim Filipinos, andadminister the same in accordance with the terms thereof, orin the absence of any condition, in such manner consistentwith the interest of Muslim Filipinos as well as existing laws;

    (m) Undertake studies, establish and maintamethnographic research centers and museums on the culturesand institutions of Muslim Filipinos for policy formulation andprogram implementation and for the purpose of preservingtheir historical heritage;(n) CertIfy, whenever approprIate, membership of personsin Muslim Filipino communities for purposes of establishingqualifications for specific requirements of government and

    private agencies or for benefits as may be provided by law;. (0) Provide legal and technical services for the survey,adjudication, titling, and development of Muslim Filipinoancestral lands and settlements proclaimed by the govel'llmentfor the Muslim Filipinos;

    (p) Assist the National Statistics Office (NSO) inconducting census on the actual population of Muslim FilipinosI I I the country;

    (q) Adnllnister all programs, projects and actIvities,formulate the necessary rules and regulatlOns, and coordinatewith pertinent offices to ensure the success of the annual Hajj(pilgrimage) to Mecca, Kingdom of Saudi Arabia;(r) Promote the development of a Hajj Assistance Fundthat shall be created from contributions of Muslim Filipinosand other donors which shall be used to support the financialneeds of deserving Muslim Filipinos intending to participatein the annual Hajj;(s) Admllllster and hold in trust awqa! (endowment)properties andlor awqaf institutions, and receive by way of

    7grant, donations or gifts, awqaf investments in accordance withthe principles of Islamic investments and fiaance;

    (t) Prescribe rules and regulations for the establishmentof awqaf institutions, admmistration of awqaf assets, andsettlement of disputes among awqaf beneficiaries pursuant tothe general principles of Shari'ah (Islamic Law);

    (u) Formulate and adopt continuing programs andactivities to strengthen Madaris (plural of Madrasah) schools;Islamic Studies, and Shari'ah and Islamlc jurisprudence, incoordination with appropriate agencies of the government;

    (v) Promote and supervise, in coordination wlthapproprIate agencies of the government, the Implementation ofthe Madrasah education system throughout the country exceptin the Autonomous Region m Muslim Mindanao (ARMM)where the system shall be implemented and supervised by theDepartment of Education-ARMM; and provide assistance in theexpeditious accreditation of Madrasah educational institutIOnswith the appropriate agencies of the government;

    (w) Ensure that the curriculum of the Madrasaheducation system shall conform WIth the basic curriculum ofthe national formal education system which, along withteachings on Arabic Language, IslamIC Studies, and Filipinoand Islamic Values shall include, among others, the subjectson Filipino and English Grammar and Usage, PhihppmeHistory and Geography, Science and Technology, Mathematics,Physical Education and Sports Development, and VocatIOnalEducation to SeClli"e the local and international competitivenessof Muslim Filipino graduates from the Madrasah educationalinstitutions;

    (x) Develop critena for the grant of local and foreignscholarships and the selection of deserving students and,teachers of Madrasah and other educational institutions;

    (y) Provide and/or facIlitate access to local and foreignscholarships to deserving Muslim Filipinos in coordination WIthformal educatIOnal institutions here and abroad;

    8(z) Ensure the continuous. transfer of technology to

    Muslim Filipino communities to uplift the quality of life ofMuslim Filipinos;(aa) Promulgate such rules and regulations and exercisesuch powers and functions as may be necessary to carry outthe purposes and objectives outlined in this Act; and(bb) Perform such other functions as may be necessaryfor its effective operations and continued enhancement as a

    government entity.SEC. 9. Administrative Supervision and Control. - Theadministrative supervision and control over the personnel,except the Commissioners, and the properties of theCommission shall be vested in the Secretary. Except forpresidential appointees, the appointment of and imposition ofdisciplinary measures on the same personnel shall likewise be

    vested in the Secretary who shall accomplish the same inconsultation with the Commissioners, except that when theadministrative charge entails, considering the circumstancesalleged in the complaint, the penalty of dismissal from theservice, the decision thereon shall be by the majority of allthe members of the Commission. The Secretary shall exerciseadministrative supervision over the Commissioners. TheCommissioners shall assist the Secretary in the performanceof his/her functions, who may assign or delegate specific,substantive or administrative responsibilities to any of them.

    SEC. 10. Organizational Structure. - The COmmisslOnshall be composed of the offices of the Secretary, theCommissioners, the Executive Director and the DeputyExecutive Director and their immediate staff, the Bureaus,Services, Regional Offices, Field Offices and Sub-offices.SEC. 11. Bureaus. - The Bureaus of the Commissionsnail consist of the Bureau of Muslim Economic Affairs,

    Bureau of Muslim Cultural Affairs, Bureau of MuslimSettlement, Bureau of External Relations, Bureau of Pilgrimage'and Endowment, Bureau of Peace and Conflict Resolution, andthe Bureau of Legal Affairs. Each of these Bureaus shall beheaded by a Director who shall hold the same rank, salary,and privileges of a Staff Bureau Director.

    The Bureau Director shall be appointed by the Presidentfrom among the names or nominees submitted by theCommission to the President.

    (a) Bureau of Muslim Economic Mfairs. - This Bureaushall promote and develop economic livelihood programs andprojects through the extension of loans, entrepreneurship, tradeand marketing assistance to the members of Muslim Filipinocommunities. I t shall also be responsible for the promotion anddevelopment of cooperative endeavors among Muslim Filipinosin coordinatIOn with the Cooperative Development AuthorIty(CDA). It shall likewise promote and implement manpowertraining and commumty self-help projects for the economICdevelopment of Muslim Filipinos.

    (b) Bureau of Mushm Cultural Affairs. - This Bureau. shall be responsible for the conduct of research and studieson the cultural development of Muslim Filipino communitieswhich would serve as the basis for policy and plansformulation, and program and project implementation.

    I t shall formulate and implement an educatIonprogram especially designed to improve the literacy level ofMuslim Filipinos, including theIr study of the Arabiclanguage, Islamic heritage, and maintaIn a central library,museum and audio-visual center to serve as repositories ofinformation on the Muslim Filipino peoples.

    I t shall be responsible for the Madrasah institutions mthe country wherein it will assist and facilitate the applicatlOnsfor registration and accreditation with the Department ofEducatIOn (DepED). I t shall also oversee the conduct of theAnnual Quot'an Reading Competition.

    (c) Bureau of Muslim Settlement. - This Bureau shall beresponsible for the promotIOn and development of MuslimFilipino settlements in coordination with concerned agenciesof the government.

    (d) Bureau of External R e l a t I O n ~ - This Bureau shall beresponsible in forging linkages atnbng Muslim Filipinocommunities and organizations within and outside the country

    10including print, broadcast and electronic communications. TheBureau shall also serve as the public information arm of theCommission and assist m fulfilling information disseminationon issues affecting Muslim Filipinos. I t is tasked to carry-outsound dissemination practices and may use the services ofother agencies to help achieve an informed judgment on issues.

    (e) Bureau of Pilgrimage and Endowment. - This Bureaushall be primarily responsible for the administration of theannual Muslim pilgrimage to Mecca, Kingdom of Saudi Arabia;and the formulation and implementation of programs, projectsand activities for the efficient and effective administration andsupervision of the conduct of pilgrimage activities: Provided,Tljat the supervision accorded the Bureau under this sectionshall not include control.

    Pursuant to the above responsibilities, the Bureau shallformulate the necessary guidelines to ensure the timelyprocessing of the pilgrim's travel documents and the equitableand reasonable collection of fees. Such collection shall belimited to mutawiff and passporting andlor processing fees only.Collected fees shall be deposited in a special trust fund whichshall be established by the Commission, the expenses fromwhich shall be subject to existing auditing laws, rules andregulations.

    The pilgrims shall be accorded free choice of travelagencies and airlines or other means of transportation to andfrom the site of pilgrimage: Provided, That pilgrims complywith the prescribed arrival and departure schedule fixed bythe Ministry of Hajj of the Kingdom of Saudi Arabia: Provided,further, That all pilgrims shall be legitimate holders of roundtrip tickets to and from the Kingdom of Saudi Arabia:Provided, furthermore, That the pilgrims shall be free tochoose on where to purchase or acquire other logistics,materials and supplies for the pilgrimage.

    In no instance shall the pilgrims be forced to purchasesuch logistics, materials and supplies from the Commission orits authorized agents or representatives.The Bureau shall also accredit qualified and deserving

    sheikhs. I t shall also formulate, subject to the approval of

    11the Commission, the timetable of annual Hajj activities whichmust be posted in all areas accessible to Muslim Filipinos.

    The Bureau shall likewise be responsible for theadministration of awqaf properties and institutions, and theconduct of research and studies for the establishment andmaintenance of Hajj towns, Islamlc centers and awqaf projects.

    (f) Bureau of Peace and Conflict Resolution. - ThisBureau shall primarily be responsible for the conduct ofpeace and settlement of conflict among Muslim Flbpinos andshall likewise participate in the natIOnal peace processefforts, particularly for Muslim Mindanao. It is aimed toprevent, de-escalate and find solution to conflicts by peacefulmeans.

    (g) Bureau of Legal Affairs. - The Legal Affairs Bureaushall be responsible for providing Muslim Filipinos with legaleducation and assistance in case of litigation involvIng theirpersons or interests; act as the legal counsel of theCommission; and investigate cases involving its personnel andsubmit appropriate recommendations pertmning thereto. TheBureau shall also investigate valid complaints brought beforethe Commission.

    SEC. 12. Services. - The Services of the Commission shallconsist of tbe Administrative Service, Finance andManagement Service and Planning Service, each of which shallbe headed by a Staff Director with the same rank, salary, andprivileges of an Assistant Staff Bureau Director.

    (a) Administrative Service. - ThIs Service shall beresponsible for providing the Commission WIth efficient andeffective staff services relating to personnel, mformatIOn,records, supplies, equipment, collection, disbursement, securityand custodial work.(b) Finance and Management SerVICe. - This Service shallbe responsible for providing the Commission with effICIent andeffective staff advice and assistance on budgetary, fmanci,,] and

    management matters.

    12(c) Planning Service. - Th,s Service shall be responsiblefor providing the Commission with efficient and effective staffservices relating to planning, monitoring, and evaluation of

    programs and projects.SEC. 13. Regional Offices, Field Offices, Sub-Offices. -The Commission is hereby authorized to establish, operate, and

    maintain Regional Offices in such appropriate administrativeregions of the country, each of which shall be headed by aRegional Director.

    A Regional Office shall have, within its admmistrativeregion, the following functions:

    (a) Implement laws, rules, regulations, policies, programs,and projects of the Commission;(b) Est"blish regional and provincial Hajj coordinating

    and monitoring units;(c) Provide efficient and effective service to MuslimFilipinos;(d) Coordinate with regional offices and agencies of the

    Executive Department;(e) Coordinate with local government units; and(I) Perform such other functions as may be provided bylaw.The Commission is likewise authorized to establish,operate, maintain, and determine the functions of field officesand sub-offices, whenever necessary, appropriate and feasible.SEC. 14. The Secretariat. - The Commission shallorganize a Secretariat that shall assist the Secretary in the

    performance of his/her functions and shall serve as thetechnical arm of the Commission. I t shall be headed by anExecutive Director who shall be appointed by the President.The Executive Director shall execute the policies and programsof the Commission and shall be responsible for the efficientand effective day-to-day management of the operations of theCommission.

    The Executive Director shall recommend to the Secretary,for approval of the Commission, the budget of the Secretariat,its staffing pattern, position classification and compensationscheme, and the appointment of its personnel subject toexisting laws, rules and regulations.

    The Executive Director shall be appointed by the Presidentand shall enjoy security of tenure and may only be removedfor cause in accordance with law.

    SEC. 15. Hajj Attache. - The President shall appointa Hajj Attache from among the three (3) recommendees of theCommission within fifteen (15) days from the submIssIOn ofsuch recommendees by the Commission. The Hajj Attacheshall coordinate with the Ministry of Hajj of the Kingdom ofSaudi Arabia on all matters pertaining to the conduct of theannual Hajj. HelShe shall be an academic degree holder andmust be able to write and speak fluently the Arabic language.HelShe shall hold office in the Kingdom of Saudi Arabia andshall enjoy .the same rank, salary, and privileges as those ofattaches of the national government.

    SEC. 16. Amiml Hajj. - The President shall appoint theSecretary of the Commission as the Amiml Hajj who shallserve as the representative of the President and as the headof the Muslim Filipino pilgrims who will attend the annualHajj.

    SEC. 17. Change of Pilgrim's Name. - The Commissionshall authenticate the certification which is issued by the HajjAttache and the Ministry of Hajj of the Kingdom of SaudiArabia and which provides a Muslim name to a pilgrim. Theauthentication issued by the Commission, which shall containboth the pilgrim's registered name in the Philippine CivilRegistry and hislher newlY-Issued Muslim name, shall thenbe legally recognized by the national government as valid forall intents and purposes.

    14ARTICLE III

    ApPROPRIATIONS, MANAGEMENT AND ADMINISTRATIONSEC. 18. Appropriations. - The amount necessary for theinitial implementation of this Act shall be charged against the

    current year's appropriations of the OMA. However, to carryout the additional functions and powers of the Commission asprovided in this Act, an additional amount of One hundredmillion pesos (PhplOO,OOO,OOO.OO) is hereby appropriated.Thereafter, such sums as may be needed for the continuedimplementation of this Act shall be included in the annualGeneral Appropriations Act.

    SEC. 19. Record ol Transaction. - The Commission shallkeep proper accounts and records of all its transaptions andaffairs, and ehall exert all efforts to ensure that all paymentsmade out of its moneys are correctly made and properlyauthorized, and that adequate control is maintained over theassets of, or in the custody of the Commission and theexpenditures it may incur. The Commission shall be subjectto audit by the Commission on Audit.

    SEC. 20. Civil Service Law Coverage for Employees. -The hiring, appointment, employment, promotion, disciplinarycontrol, separation, and other terms and conditions of theservice of all employees of the Commission and such othermatters affecting its employees shall be consistent with theprovisions of the CiVIl Service Law and the Civil ServiceCommission's rules and regulations.

    SEC. 21. Government Service Insurance System (GSIS)Coverage for Employees. - All employees of the Commissionshall be deemed members of the GSIS and shall enjoy all thebenefits of said System.

    SEC. 22. Transitory Provisions. - The OMA is deemedabolished upon the creation of the Commission. All the powers,functions, assets, liabilities, capital, accounts, contracts,equipment, and facilities of the OMA which are owned by thegovernment, shall be transferred to the Commission.

    15During the transition period, which begins upon approval

    of this Act, the President may appoint the incumbentExecutive Director of the OMA as Acting Secretary of theCommission until the regular Secretary of the CommIssIOnshall have been appointed.All regular or permanent employees of the OMA shall be

    absorbed or transferred to the Commission: Provided, Thatthey possess the necessary qualifications, and shall not sufferany loss of seniority or rank or decrease in emoluments.

    No officer or employee in the career service shall beremoved except for a valid cause and after due notice andhearing. A valid cause for removal exists when, pursuant toa bona fide reorganization, a position has been abolished orrendered I'edundant or there is a need to merge, dIvide orconsolidate positions in order to meet the exigencies of theservice, or other lawful causes allowed by the Civil ServiceLaw.

    Employees separated andlor phased-out from the serviceas a result of the abolition of the OMA under the provisIOnof this Act shall, within thl'ee (3) months from their separationand/or p h a s e ~ o u t from the serVIce receive a separation pay inaccordance with existing' laws, rules and regulations. Inaddition, those who are qualified to retire shall be allowed toretire and be entitled to all benefits provided under existingretirement laws. The fund of the Commission may be usedto fund this purpose.

    SEC. 23. Periodic Performance Evaluation. - TheSecretary is hereby required to formulate and enforce a systemof measuring and evaluating periodically and objectively theperformance of the Comnlission and submit the same annuallyto the President and to the Congress of the Philippines.SEC. 24. Implementing Rules and Regulations. - TheNational Commission on Muslim Filipinos (N.CMF) and the

    Department of Budget and Management shall issue theimplementing rules and regulations ninety (90) days after theeffectivity of this Act.SEC. 25. Separability Clause. - If for any reason, anysection or provision of this Act is declared unconstitutional orinvalid, the other sections or provisions hereof which are notaffected thereby shall continue to be in full force' and effect.SEC. 26. Repealing Clause. - Executive Order No. 122-A, as amended by Executive Order No. 295 is hereby repealed.

    All other acts, decrees, instructions, rules and regulations orparts thereof mconsistent with the provisions of this Act arealso hereby repealed or modified accordingly.SEC. 27. Effectivity Clause. - This Act shall t.ake effectfIfteen (15) days after its publication in two (2) nationall1eWdpapers of general circulation.A proved,
