NATIONAL AND INTERNATIONAL CONTINGENCY PLAN FOR BRAZILIAN FIR’S 5.1 INTRODUCTION 5.1.1 This Contingency Plan has been prepared based on the guidelines approved by the ICAO Council, contained in Annex 11, Appendix D, and in the Air Traffic Services Planning Manual (Doc 9426, Part II, Section I, Chapter 1, paragraph 1.3). 5.2 PURPOSE 5.2.1 The purpose of this Contingency Plan is to establish procedures for entry, overflight, landing and take-off of aircraft destined to or coming from international/national FIR, in case of partial or total disruption of ATS services, maintaining orderly and safe air traffic movement. 5.2.2 There is no intention to establish procedures covering all possible degradation scenarios, since they are countless. Thus, the purpose of this Contingency Plan is to define general principles for establishing contingency measures applicable in cases of foreseeable or unforeseeable events and that somehow may affect the provision of air traffic services within the FIR in question. 5.2.3 The procedures relating to partial disruption, event in which only Flight Information Service and Alerting Services are provided, include the establishment of contingency routes between specified Terminal Control Areas and adjacent FIR, used by aircraft seeking to land/take-off at aerodromes located within the FIR in contingency situation. Aircraft intending to overfly FIR in contingency may use the routes published in AIP Brasil and in the Enroute Charts (ENRC). 5.2.4 The procedures relating to total disruption, event in which there is no provision of ATS services, foresee the establishment of contingency routes between Brazilian FIR and between them and adjacent FIR, as well as flight levels and predetermined minimum longitudinal separation. 5.2.5 The effective application of the procedures in question requires close coordination and collaboration between the CGNA and the ACC responsible for the adjacent FIR to the FIR in contingency, as well as with the airspace users 5.3 APPLICABLE RULES AND PROCEDURES 5.3.1 The FIR directly affected by this Contingency Plan are the following: Amazônica/Brazil, Atlântico/Brazil, Brasília/Brazil, Curitiba/Brazil, Recife/Brazil, La Paz/Bolivia, Lima/Peru, Resistencia/Argentina, Bogota/Colombia, Maiquetia/Venezuela, Georgetown/Guyana, Paramaribo/Suriname, Cayenne/French Guiana, Asunción/Paraguay, Montevideo/Uruguay, Dakar/Senegal, Johannesburg/South Africa and Luanda/Angola. 5.3.2 To ensure that the operating procedures of this Plan are implemented in a safe and orderly manner, the following shall be observed: 5.3.2.1 The ATM national contingency unit designated by the Brazilian Administration (Department of Airspace Control - DECEA) to activate, manage, monitor and coordinate the actions resulting from the application of the Contingency Plan is: Name: CGNA (Air Navigation Management Center).     5. NATIONAL AND INTERNATIONAL CONTINGENCY PLAN FOR BRAZILIAN FIR’S

    5.1 INTRODUCTION

    5.1.1 This Contingency Plan has been prepared based on the guidelines approved by the ICAO Council, contained in Annex 11, Appendix D, and in the Air Traffic Services Planning Manual (Doc 9426, Part II, Section I, Chapter 1, paragraph 1.3).

    5.2 PURPOSE

    5.2.1 The purpose of this Contingency Plan is to establish procedures for entry, overflight, landing and take-off of aircraft destined to or coming from international/national FIR, in case of partial or total disruption of ATS services, maintaining orderly and safe air traffic movement.

    5.2.2 There is no intention to establish procedures covering all possible degradation scenarios, since they are countless. Thus, the purpose of this Contingency Plan is to define general principles for establishing contingency measures applicable in cases of foreseeable or unforeseeable events and that somehow may affect the provision of air traffic services within the FIR in question.

    5.3.1 The FIR directly affected by this Contingency Plan are the following: Amazônica/Brazil, Atlântico/Brazil, Brasília/Brazil, Curitiba/Brazil, Recife/Brazil, La Paz/Bolivia, Lima/Peru, Resistencia/Argentina, Bogota/Colombia, Maiquetia/Venezuela, Georgetown/Guyana, Paramaribo/Suriname, Cayenne/French Guiana, Asunción/Paraguay, Montevideo/Uruguay, Dakar/Senegal, Johannesburg/South Africa and Luanda/Angola.

    5.3.2 To ensure that the operating procedures of this Plan are implemented in a safe and orderly manner, the following shall be observed:

    5.3.2.3 In the event of ground/air communications failure, air traffic services will based on HF and VHF frequencies available, respectively, in each ACC or APP that has been assigned the provision of ATS within a given portion of the airspace, as contained in publications in force or in any other designated portion by the central agency

    5.3.2.4 Operators and pilots in command are responsible for previously assessing the relevance of flying in airspace in a contingency situation since, in some cases, the pilot in command will be responsible for providing their own separation.

    5.3.2.5 While the contingency situation endures, the RPL lists shall be suspended, and the users must provide in all cases the FPL in accordance with the contingency route networks. Likewise, flights of non RVSM approved aircraft shall not be allowed, without exception.

    5.3.3 AUTO-TRANSFER PROCEDURES 5.3.3.1 When ATS units are not able to coordinate air traffic due to failure in the Fixed Communications Service, the

    following auto-transferring procedures shall be applicable: 5.3.3.1.1 The ATS unit shall:

    a) Inform the pilot that the Fixed Service with the adjacent ATS unit is not available; and b) Provide information and instructions necessary for the pilot to establish contact with the adjacent unit.

    5.3.3.1.2 The pilot in command shall: a) Try to establish contact with the adjacent unit at least five (5) minutes before ETO on the reporting point of transfer; b) Inform the ATS unit that it is performing an auto-transfer; and c) Transmit the following information: Aircraft identification, origin, destination, route, flight level, transponder code, RVSM approval status and estimated to the auto-transfer reporting point.

    5.3.4 ATS routes contained in the airspace in a contingency situation shall be reclassified as Class G airspace and will only be provided the Flight Information Service and Alerting Service.

    5.3.5 All ATS routes of the lower airspace shall have their minimum FL changed to FL 150, except when the minimum FL is already higher. .

    5.3.6 The minimum longitudinal separation applied between aircraft entering the FIR in contingency shall be 20 minutes for aircraft using the same FL..

    5.3.7 Depending on the speed difference, the flight time in the segment in contingency and the level of degradation of Services, their respective Supervisors may, by mutual agreement, increase or decrease the longitudinal separation, without prejudice to regulatory separations.

    5.4. PROCEDURES PRIOR TO ACTIVATION OF THE CONTINGENCY PLAN 5.4.1 In case of a total or partial disruption, if necessary, while the Contingency Plan is not activated, the aircraft flying in

    the FIR in a contingency situation shall implement the air-ground communication failure procedures established in Annex 2 to the Convention on International Civil Aviation, except for the differences published in GEN 1-7, and keep permanent radio watch on the frequency corresponding to the sector over which it is flying and the air/air frequency (123.45 MHz - TIBA) for Flight Information Broadcast Procedures.

    5.5. PLAN ACTIVATION 5.5.1 NOTAM ISSUANCE 5.5.1.1 The provisions applicable to ATS units and aircraft that take off, land or overfly the Brazilian FIR because of a

    partial or total disruption of Air Traffic Services shall be activated by CGNA, through the issuance of specific NOTAM.

    5.6 DUTIES 5.6.1 Duties of the CGNA (Air Navigation Management Center)

    a) To evaluate the current scenario and establish initial measures in order to regulate air operations and mitigate the effects of specific service degradations in the Brazilian ACC.

    b) To suspend the entry into the FIR in contingency until the situation is duly assessed and the Contingency Plan is implemented. c) To establish flow control measures for entry and for landing and take-off operations to/from FIR in a contingency situation in order to prevent overloading of the ACC and APP control sectors. d) To assess, depending on the length and complexity of the degradation, the need for creating and activating a Contingency Committee, which will coordinate the activities during the contingency period. e) To coordinate contingency situations with sufficient advance, as soon as possible, with the Central Units responsible for the adjacent FIR, with the ICAO (SAM Regional Office) and representatives of the airlines. f) To take the necessary actions to issue the corresponding NOTAM, according to the contingency situation. If the situation is predictable, the NOTAM shall be issued 48 hours in advance at least.

    5.6.2 DUTIES OF THE ATS UNITS INVOLVED a) To transmit, in accordance with the stipulated normal procedures, air traffic messages to the ACC in contingency situation, as well as an estimated time (EST) message to the first FIR located right after the FIR in contingency situation; b) To authorize the entry of an aircraft into the FIR in contingency in accordance with the provisions of items 6.7 and 6.8 of this Contingency Plan; c) To wait for instructions of the Air Navigation Management Center for adjusting the corresponding contingency measures up to the time the system returns to normal operation; d) To coordinate, through the ATS coordination circuits or other available means, at least 30 minutes in advance to the estimated time over the entry/exit points of the FIR in contingency situation; e) In case of a total disruption, the ATS adjacent ATS should instruct pilots in command to maintain the last level and airspeed used while flying over the FIR in contingency; f) When in overflight, to observe that the aircraft shall be leveled at least 10 minutes before entering the FIR in contingency situation; g) To instruct the aircraft in order to try to establish contact with the adjacent ATS units at least five (5) minutes in advance to the estimated time of entry into the subsequent FIR; h) To observe that, in the event of a total or partial disruption of air traffic services, the entry into the FIR in contingency shall be suspended until the situation is duly assessed and the Contingency Plan is implemented by the CGNA – Central Unit; and i) To observe that, during the activation of the Contingency Plan, flights of non RVSM approved aircraft between FL290 and FL410 shall not be allowed, without exception.

    5.6.3 DUTIES APPLICABLE TO AIRCRAFT 5.6.3.1 Aircraft flying over Brazilian FIR and those coming from or destined to the Terminal Control Areas included in this

    Plan shall adhere to the following: a) Only IFR flights which are conducting regular air transport operations, either domestic or international, search and rescue flights, State aircraft and humanitarian flights shall be authorized. The other types of flight shall make prior coordination and obtain specific authorization from CGNA; b) During activation of this Plan, only RVSM approved aircraft may fly between FL290 and FL410; c) The aircraft must fly in the axis of the designated contingency route or as nearest as possible; d) A permanent radio watch must be kept on VHF or HF frequency corresponding to the sector that is being overflown or other designated, as well as on air/air frequency (123.45 MHZ) and report any climbing or descent maneuver as circumstances require. The message shall contain: aircraft identification, position, abandoned level, crossing level and any other relevant information; e) Make the necessary coordination with other aircraft using the corresponding ATC frequency and air/air frequency (123.45 MHz), f) Keep the navigation and anti-collision lights permanently turned on while operating in the FIR in contingency situations; g) Keep the transponder ON and set on code 2000, if no other SSR code has been assigned; h) It is mandatory to be equipped with ACAS to fly in the upper airspace; and i) The FPL shall be completed in accordance with the legislation in force and according to the contingency route networks.

    5.7SPECIFIC PROVISIONS APPLICABLE IN CASE OF PARTIAL DISRUPTION OF AIR TRAFFIC SERVICES IN BRAZILIAN FIR. . 5.7.1 The procedures for partial disruption, in which only Flight Information Service and Alerting Services are provided by

    the unit in contingency or another unit designated by it, include the establishment of contingency routes between specified Terminal Control Areas and between these and the adjacent FIR. Such routes shall be used by aircraft intending to land/take off at aerodromes located within the FIR in contingency.

    5.7.2 Aircraft intending only to overfly the FIR under partial disruption must use the simplified route network for total disruption, according to item 6.8, disregarding the established flight levels. .

    5.7.3 During the application of this Contingency Plan, the following shall be observed:

    a) Aircraft that will land at/or take-off from aerodromes located in the TMA specified below may only fly under IFR, applying the list of flight levels contained in Appendix 3 of ICAO Annex 2, and shall compulsorily use the ATS routes included in the following items; b) Flights with origin and/or destination different from the locations described in items 6.7.4.1, 6.7.5.1, 6.7.6.1 and 6.7.7.1 may only be conducted under VFR flight rules and below FL 145, inclusive, and the pilot in command will have the responsibility to provide his/her own separation. For these aircraft, ATS services will not be provided in the FIR in contingency, being forbidden to submit AFIL Flight Plan to the ACC in contingency; c) All aircraft shall keep radio watch of the TIBA frequency (123.45 MHz), in addition to the control sector frequency that is being overflown; d) For aircraft that will take off from or land at the FIR in contingency, the subsequent paragraphs shall be observed for each FIR; and e) The application of this Contingency Plan provides that at least the Flight Information Services and Alerting Services will be available at the TMA indicated below.

    5.7.4 BRASÍLIA FIR 5.7.4.1 During partial contingency in the Brasília FIR, at least Flight Information Service (FIS) and Alerting Services will be

    provided. For the TMA directly involved with the flight progress that serve the airports of Brasília (SBBR), Goiânia (SBGO), Confins (SBCF), Belo Horizonte (SBBH), Guarulhos (SBGR), Congonhas (SBSP) and Campinas (SBKP), a simplified system will be used, composed of the route network of Brasília FIR, interconnecting these TMA and connecting them to the Amazônica, Atlântico, Curitiba and Recife FIR, and vice versa, as follows:

    5.7.4.1.1 Aircraft coming from Brasília Terminal Area and Anápolis Terminal Area, destined to Recife FIR. They shall use the following routes: a) UZ18; UW59; UZ19 b) W2; W10

    5.7.4.1.2 Aircraft coming from Recife FIR, destined to Brasília Terminal Area and Anápolis Terminal Area. They shall use the following routes: a) UZ18 SIMUV UZ59; UZ27 SIMUV UZ59 BSI UM668; UZ17 SIMUV UZ59; b) W2 BSI W10; W10.

    5.7.4.1.3 Aircraft coming from Brasília Terminal Area and Anápolis Terminal Area, destined to Amazônica FIR. They shall use the following routes: a) UM409; UZ26; UM668; UZ40; b) G678; W10; G449.

    5.7.4.1.4 Aircraft coming from Amazônica FIR, destined to Brasília Terminal Area and Anápolis Terminal Area. They shall use the following routes: a) UZ26 BSI UM668; UM668; UZ6; UZ40; b) G678; W10; G449 .

    5.7.4.1.5 Aircraft coming from Brasília Terminal Area and Anápolis Terminal Area, destined to Curitiba FIR. They shall use the following routes: a) UZ5; UZ31 UDIGI UZ5; UM668 GNV UM544; UM668 BSI UZ6; UZ6; b) W10 BSI G449; W29; W10 BSI Z2; W24.

    5.7.4.1.6 Aircraft coming from Curitiba FIR, destined to Brasília Terminal Area and Anápolis Terminal Area. They shall use the following routes: a) UZ5; UZ5 SIRUL UZ46; UM403; UM544 GNV UM668; UM409 FLAND UZ33; b) G449 BSI W10; W29; W21; W24.

    5.7.4.1.7 Aircraft coming from São Paulo Terminal Area, destined to Recife FIR. They shall use the following routes: a) UZ23 BHZ UZ61 FORTI; UZ23 BHZ UZ16 POSMU; UZ23 BHZ UZ61 QUARU UN866 RUBIC b) W45 BHZ CNF W1; W45 BHZ CNF W8.

    5.7.4.1.8 Aircraft coming from Recife FIR, destined to São Paulo Terminal Area. They shall use the following routes: a) UN741 MUMDI UZ38; UTGIR UZ21; b) DAGOV W1; W10 BSI G449.

    5.7.4.1.9 Aircraft coming from São Paulo Terminal Area, destined to Amazônica FIR. They shall use the following routes: a) UZ25; UZ26; b) Z7 BSI G449; Z7 BSI G678.

    5.7.4.1.10 Aircraft coming from the Amazônica FIR, destined to São Paulo Terminal Area. They shall use the following routes: a) UZ6 NIMKI UZ38; UZ26 BSI UZ6 NIMKI UZ38; UL795 ETAXI UZ38; b) G449 BSI Z2 NIMKI Z6; G678 BSI Z2 NIMKI Z6; W10 GNV W11 MOPNI Z6.

    5.7.4.1.15 Aircraft coming from Recife FIR, destined to Cuiabá Terminal Area. They shall use the following routes: a) UZ59 BSI UM668; b) W10.

    5.7.4.1.16 Aircraft coming from Cuiabá Terminal Area, destined to Recife FIR. They shall use the following routes: a) UM668 BSI UZ59; b) W10.

    5.7.4.1.17 Aircraft coming from Brasília Terminal Area, destined to Belo Horizonte Terminal Area. They shall use the following routes: a) UZ35; b) W17.

    5.7.4.1.18 Aircraft coming from Belo Horizonte Terminal Area, destined to Brasília Terminal Area. They shall use the following routes: a) UZ33; b) W2.

    5.7.5.1 During partial contingency in the Curitiba FIR only Flight Information Service (FIS) and Alerting Services will be provided. For the TMA directly involved with the flight progress that serve the airports of Curitiba (SBCT), Porto Alegre (SBPA), Florianópolis (SBFL), Campo Grande (SBCG), Londrina (SBLO), Galeão (SBGL), Santos Dumont (SBRJ), Guarulhos (SBGR), Congonhas (SBSP), Campinas (SBKP), Confins (SBCF), and Belo Horizonte (SBBH) a simplified system will be used, composed of the route network of Curitiba FIR, interconnecting these TMA and connecting them to the Recife, Brasília, Asunción, La Paz, Montevideo and Resistencia FIR, or vice versa, as follows:

    5.7.5.1.1. Aircraft coming from Asunción FIR, destined to Curitiba Terminal Area. They shall use the following routes: a) FOZ UM548; b) FOZ W34.

    5.7.5.1.2. Aircraft coming from the Curitiba Terminal Area, destined to Asunción FIR. They shall use the following routes: a) UM548 FOZ; b) W34 FOZ.

    5.7.5.1.3. Aircraft coming from Asunción FIR, destined to Porto Alegre Terminal Area. They shall use the following routes: a) GEBUN UL216; b) GEBUN R563.

    5.7.5.1.4. Aircraft coming from Porto Alegre Terminal Area, destined to Asunción FIR. They shall use the following routes: a) UL216 GEBUN; b) R563 GEBUN .

    5.7.5.1.5. Aircraft coming from Asunción FIR, destined to Florianópolis Terminal Area. They shall use the following routes: a) FOZ UM548 CTB UW19; b) FOZ W34 CTB W48.

    5.7.5.1.6. Aircraft coming from Florianópolis Terminal Area, destined to Asunción FIR. They shall use the following routes: a) UW19 CTB UM548 FOZ; b) W48 CTB W34 FOZ.

    5.7.5.1.7. Aircraft coming from Asunción FIR, destined to Campo Grande Terminal Area. They shall use the following routes: a) AKSUL UM544; b) PTP A430.

    5.7.8 ATLÂNTICO FIR 5.7.8.1 In case of partial disruption of the ACC-AO, air traffic flow restriction will be applied only to the EUR/SAM corridor

    due to traffic density. Out of the EUR/SAM corridor longitudinal separation may be extended up to 20 minutes MNT 5.7.8.2 In addition to publishing the NOTAM, as per template in item 7, the contingency situation shall be informed by any

    means and as quickly as possible to the AAC involved and the contingency operating procedures contained in the Aeronautical Information Circular (AIC), specific for the EUR/SAM Corridor, shall be applied.

    5.8 SPECIFIC PROVISIONS APPLICABLE IN CASE OF TOTAL DISRUPTION OF AIR TRAFFIC SERVICES IN BRAZILIAN FIR.

    5.8.1 During total disruption, situation in which there is no provision of ATS services, a simplified contingency route network will be established, between the FIR in Brazil and between them and the adjacent FIR, as well as flight levels and predetermined minimum longitudinal separation.

    5.8.2 Takeoff and landing under IFR shall not be authorized in the FIR in total contingency. 5.8.3 For entering into the FIR in contingency, the following procedures shall be observed: 5.8.3.1 In order to keep the minimum lateral and vertical separations, the aircraft that overfly the FIR in contingency must

    use the flight levels and the simplified route network set forth for each FIR, according to the subsequent paragraphs;

    5.8.3.2 If an aircraft during flight, before entering the airspace in contingency, is unable to fulfill the previously established operating procedures, ATS transferring unit shall coordinate with the Air Navigation Management Center - CGNA.

    5.8.8.1.1 Aircraft coming from Recife FIR destined to DAKAR Oceanic FIR shall be routed through the ATS route network of the FIR, according to the following: a) They will be routed only through the EUR/ SAM corridor.

    b) UL206 VTR UZ44 SGR UN857 UTRAM.

    C) UM661 VAKAM DCT DAGEL UN857 UTRAM.

    5.8.8.1.2 Aircraft coming from DAKAR Oceanic FIR destined to Recife FIR: a) They will be routed only through the EUR/ SAM corridor. b) UL206 BUGAT UZ59 VURBI UZ59 AMBET UN857 DOGSU.

    c) UM661 MOXIP UZ59 VURBI UZ59 AMBET UN857 DOGSU.
