6. Personnel. Committee members were asked to review the Government Affairs Committee (Attachment 1) and Central Code Committee (Attachment 2) rosters and advise Amy or Brian of any corrections needed. 7. NEII Government Affairs Committee Legislative Assignments. The committee was asked to review the GAC Legislative Assignments document on the website at

http://www.neii.org/members/committees/25/index.cfm and advise Amy of any necessary corrections.

(a) The committee reviewed the NEII® State Activity Chart. (Attachment 3) (b) Amy provided an update on state legislative adjournments. Dennis Mayer proposed that the GAC/CCC discuss the assignment of states and the potential of switching assignments. The GAC/CCC discussed the background for the current assignments and the recent additional of several new members to the GAC presenting an opportunity for Otis (and potentially Schindler) to reduce the number of states assigned to them. After some discussion, it was determined that Amy would solicit feedback from each company and then the GAC would revisit the issue on the August conference call.

8. Schindler Elevator Corp. Legislative Monitoring Assignments.

(a) California – CA Working Group has been formed and held its first meeting in May. Have a draft writ of mandamus in response to Circular E-11-01. The committee discussed our options including lawsuit, meeting and letter with draft writ attached. Decided we would send a strong letter with the draft writ attached to try to prompt a meeting. (b) Delaware. In June a licensing provision was passed under the electrician’s regulations and requires insurance, ID on vans, etc. John to gather additional information. (c) Florida – Comments were submitted on proposed code changes, and comments on a second proposal are under development. (d) Georgia – Most activity is related to PBC, and the update will be provided under that section of the agenda. (e) Idaho. No update at this time. (f) Indiana. No update at this time. (g) Iowa. No update at this time. (h) Louisiana. No update at this time. (i) Michigan. No update at this time. (j) New Jersey – NEII® submitted comments to Assembly and Senate on proposed Board and licensing requirements. Considering a lobbyist (Mickey Faigen, who has worked with Schindler previously) to assist our efforts to modify the proposed bill (s). Mickey is gathering some additional information on viability, etc. before we discuss a contract. (k) North Carolina. No update at this time. (l) Ohio. No update at this time. (m) Pennsylvania – MEL bill still pending after four years. Amy to check on status. (n) Virginia. No update at this time. (o) Wisconsin. No update at this time.

9. Otis Elevator Co. Legislative Monitoring Assignments. (a) Arkansas. No update at this time. (b) Connecticut. No update at this time. (c) District of Columbia. No update at this time.

(d) Kansas. No update at this time. (e) Maryland – A new seat has been added to the Elevator Board for cab renovators, and we are working with our lobbyist to secure the appointment of our candidate. State is now developing a proposal to limit reciprocity; we are working with them on this issue. (f) Massachusetts – The state is working on the rules to implement the increased fines passed last year. Also trying to include licensing requirements and mechanic penalties for which they have no authority, and we’ve written a letter on this issue. Also, there is an opening on the Board; Peggy will be contacting Cheri Davis about that position. (g) Missouri – We’ve been working with the state on the development of elevator rules. The current proposal is pretty decent. A few remaining minor issues remain unresolved, but we think it might be prudent to wait until the next round of rule development rather than risk all accomplished to date. (h) Nevada – The Department stakeholder meeting was held March 1. Bill Stanley verbally attacked the Chief Inspector; we did not engage. Several issues were raised at the stakeholder meeting. The next step will be proposed rules, which we hope will be issued before the end of the year or they have to wait until after the legislative session. (i) New Hampshire. No update at this time. (j) New York – MEL bill with major penalties was under consideration. We secured lower fines, but the bill stalled, and the Assembly is now in recess. The Assembly could come back after the election and consider this bill, but the possibility is remote; we are keeping a close eye on the situation. (k) New York City – NYC was also considering a licensing bill. Efforts heavily influenced by politics – Council Chair running for mayor, recent accidents, etc. Bill on hold and potential action this year uncertain. NYC Working Group has been formed. Discussing licensing issues, as well as other policies and procedures impacting the industry. Working on internal solutions and the identification of issues that need to be taken to the Dept of Buildings in order to be addressed. (l) Oklahoma. No update at this time. (m) Oregon. No update at this time. (n) Rhode Island – There was legislation pending related to QEI qualifications and dropping the current position that recognizes QEI for insurance inspectors only. Legislature has adjourned for the year, but issue may come back next year. (o) Vermont. No update at this time. (p) Washington. Recently began enforcing old regulations. We formed an industry working group that will be meeting with the Commissioner of Labor and Industry August 14 to not only raise issues of concern, but also to introduce new lobbyist and discuss ways we can work more cooperatively with the agency.

10. ThyssenKrupp Elevator Corp Legislative Monitoring Assignments.

(a) Alaska. No update at this time. (b) Arizona – the state contacted NEII about its interest in undertaking a review of the current inspection program. NO further information, but Amy will follow-up with the state staff. (c) Hawaii. No update at this time. (d) Kentucky. No update at this time. (e) Minnesota – There are a couple of code proposals that we will review and determine if action is needed.

(f) Mississippi. No update at this time. (g) Puerto Rico. No update at this time. (h) South Carolina. No update at this time. (i) Texas. No update at this time. (j) Utah. No update at this time. (k) West Virginia. No update at this time.

11. KONE Inc. Legislative Monitoring Assignments. (a) Alabama. No update at this time. (b) Colorado. No update at this time. (c) Illinois – The bill to extend the IL Elevator Act to 2023 passed the legislature and awaits the Governor’s signature. The bill will be enacted if not signed within 60 days. Plan to meet with a state legislator August 1 to discuss the other changes we want to pursue. Opening on the Elevator Board due to the relocation of Rick Jandora (Otis); working to secure the appointment of his replacement. (d) Chicago – There will be an Advisory Committee meeting on August 1 to review code updates. Also there will be discussion of some major inspection issues including the potential to allow 3rd party inspections on an emergency basis. (e) Maine No update at this time. (f) Montana. (g) Nebraska – The legislature was considering various bills to overhaul MEL and make changes as to what Department would oversee the Elevator Division. Our local representative was planning on meeting with key stakeholders in July, but he EIWPF was not ready and asked for the meeting to be postponed. No new meeting date has been set. (h) New Mexico. No update at this time. (i) North Dakota. No update at this time. (j) South Dakota. No update at this time. (j) Tennessee. No update at this time. (k) Wyoming. No update at this time.

12. Model Elevator Law.

Please review the most recent copy of the EIWPF Activity Chart on the GAC website at http://www.neii.org/members/committees/25/.

(a) John Karnash provided an update on EIWPF, IUEC relationship. The Board supported sending a letter to the EIWPF, IUEC regarding the MEL and our position that the MEL rev3 agreement remains in effect until a new version is adopted. John also indicated that he has sent several messages about trying to schedule a meeting on the finances and MEL issues. No response has been received to date.

(b) MEL Rev4 development. It was determined that a subcommittee would review the proposed changes put forward by Bill Stanley in March and identify other changes NEII might want to pursue. Betsy Ceriello and Tom Austin volunteered to work with Amy. The CCC would also identify two members to participate in the MEL rev4 development efforts.

(c) NEII® MEL database. Amy reported that she met with Stateside via teleconference and they are in the process of updating the MEL database. After a review, Stateside discovered that there was some missing data that needed to be added. Those efforts are underway and should be completed by Labor Day.

13. Performance Based Code (PBC) Project. (a) Website Review Group. Amy reported that several pages have been updated and posted on the PBC website. Efforts were suspended during the busy legislative season and will resume soon.

(b) The committee reviewed the 50-State A17.1/A17.7 report (Attachment 4) and PBC adoption chart (Attachment 5). Amy and Brian updated the group on our need to be more coordinated on code comments, and the committee agreed that the GAC leads would ensure input from their code folks and draft comments would be sent to the CCC for review as well. (c) Target state discussion.

i. The GAC/CCC agreed to remove Washington, DC from the target list because the DC Elevator TAG voted to exclude A17.7 for this code update and the will notbe revisited until 2014. ii. FL, OH and SC were removed from the target list because A17.7 has been adopted. iii. California – Still waiting for the Leacox brothers to secure a meeting on PBC. iv. Georgia – The Elevator Division moved from the Department of Labor to the Fire Marshall’s office. The GAC brought on a lobbyist to work with the new agency on education, etc and secure introduction of the code updates that include A17.7, but have been lingering for 18 months.. v. Massachusetts – Amy, Brian and Bob Rodophele, met with key agency personnel to discuss code updates and the PBC. The meeting was very positive, but there is a clear disconnect between the regulatory staff and the Elevator Board related to updating the codes. We are reviewing/revising our strategy for MA. vi. Michigan – The Board voted to move ahead with adoption of A17.1 (2010) including the PBC. This proposal now moves to the legislature for approval.

(d) NEII® PBC Action Plan (attachment 6) Amy presented a suggested PBC Action Plan for 2012-2013. After GAC/CCC discussion, it was decided that a revised set of target states would be developed based on code update cycles, contacts and other factors. The GAC and CCC would then each review and approve the plan prior to the Sept. Board meeting.

14. Communication Tools. (a) MEL Tutorial for the website. On hold due to EIWPF issues. (b) The Insider Update & Topics discussion. The GAC/CCC approved development of a case study on our efforts in HI and an introduction to NEII® for legislators in January.

15. GAC Budget Review.

(a) The GAC/CCC reviewed the 2012 GAC Budget (Attachment 7). John noted that we are on track to fulfill obligations for the remainder of 2012 without exceeding our budget.

(b) The committee began its 2013 Budget discussions and decided that we needed to “build the budget from the bottom up.” The GAC state representatives would work with Amy on forecasting issues/efforts for their states and estimate related budget expectations for 2013. Amy would put together a budget proposal and the GAC would have an extensive discussion on its August conference call.

16. New Business.

(a) Due to concerns about a lack of progress on our efforts in CA, the GAC/CCC discussed our options for moving forward. It was decided that we would not terminate our relationship with the Leacox brothers until via alternatives were identified. Amy was tasked with securing proposals from several firms and the GAC would revisit on its next call.

(b) Elevator Board openings. (Attachment 8) Amy distributed a document identifying the elevator industry representatives on the elevator boards across the country and potential openings where we could secure a NEII member company appointment. The GAC was asked to review the document to make sure all key folks were identified properly and provide feedback to Amy. (c) Based on a new policy of NEII, all committee policies are supposed to be reviewed routinely and updated (or removed) as necessary. Due to the number of policies that need to be reviewed by the GAC, Amy will stagger the cycle based on the dates of adoption and send out periodically to the GAC for action.

17. Next Meeting Dates. (a) GAC/CCC meeting Oct. 30, CCC meetings Oct. 31, Nov. 1, 2012 in Mason, OH. (c) NEII® Board meeting September 13, 2012 in Atlantic City, NJ.

Amendments to building regulations are forwarded to advisory committees formed specifically for the purpose of reviewing the codes. These committees are usually named after the statutory chapters they are responsible for reviewing. As such, the elevator committee, when convened, is called the Ch. 1307 committee.
