1. On the 17th June 1992, between 21h00 and 22h00, I was at home. When I heard the smashing of windows, I looked outside through the window.

2. I saw a large crowd of people. The crowd was made up of about four smaller groups of fifteen people each. The groups consisted of armed man wearing white headbands. In the front of the group were a few men who were armed with firearms. The crowd was on Boapedi Street, which is visible from my house.

3. I saw the men smash windows of two houses - one on Boapedi Street and another on Qwaqwa Street.

STATEMENT OF NTABISENG MARIA MSIYA

1. On the 10th June 1992, I was on the road when I was kidnapped by Dodi and taken to Kwa-Madala Hostel. Dodi used to lodge at my house and he is a friend of Khetisi. I am 19 years old and the girlfriend of Ntobeko Mnqithi.

2. When I arrived at Kwa-Madala, Ntobeko was already there. He was staying in room 12 6. I moved into this room with him. There were in all 22 people staying in this room. I did not know who the other people were.

3. While I was in Kwa-Madala Hostel, I was not allowed to leave the hostel.

4. On the night of the massacre I heard an announcementthat all he men staying in the hostel had to come to a meeting. After Ntobeko went to the meeting, he returned to our room and took a hammer. He said that he was going to Boipatong. I saw him return to the room about an hour or an hour and a half later. I only saw him enter and leave my room. I did not see him enter and leave the hostel itself. I cannot say how many people left the hostel with him.

5. I left the hostel on the 7th July when Ntobeko cameback to the hostel and told the people there that my uncle had passed away and that I had to go back home for the funeral. In fact, my uncle had not passed away, but this was the only way I was allowed to leave the hostel.

AFFIDAVIT

I,the undersigned,

JOHANNES MTHIMKULU,do hereby make oath and say that:-

1. I cue a 19 year old male residing at Zone 7,Sebokeng.

2. On the 17th October 1991 at about 2.00 PM, I was at Diamond Comer, a shop at Voortrekker Street, Vereeniging.

3. As I left the shop known as Diamond Corner,I was standing at the adjacent robot when I was confronted by 3 men wearing Inkatha T-shirts and caps ,two were armed with pistols.I know one of them as ZANDI.

4. One of them grabbed me and slapped me and forced me to walk towards MARKPARK Shopping Complex.I saw my friend the late SIPHO MTHIMKULU in the company of 4 men,3 of whom were wearing Inkatha T-shirts.

5. The aforesaid Sipho Mthimkulu and Myself were forced towards a car.The group was confronted by two uniformed policemen who asked the group what they were doing.

6. No reply was given.Neither Sipho nor myself said anything to

the police because I did not think they would be able to\

help.Then the police left.

Sipho and I were thereafter put into the boot of a White Cortina.There was already another man whose name is unknown to me in the boot.

We were driven to KWA-MADALA Compound within the ISCOR Premises at Van Der Bijlpark.

All 3 of us were taken out of the boot of the car and led to room number 2.

In the room were another 9 women and 8 men.Inkatha guards were on patrol in the yard outside.

Sipho, myself and the other person were asked our names by the Inkatha members. Then they gave us Inkatha membership cards. They then took our money which amounted to R17,58. They also took my Olympus camera, lumber jacket and wrist watch.

12. At night the women were taken out of Room 2 and were allegedly sexually abused.

13. During the day we were allowed to wander in the grounds which were under Inkatha patrol.

14. We were told that we must attend a funeral on the 19th October, 1991, at Sharpeville. We were taught Inkatha songs and given Inkatha T-shirts.

15. We were put in the front row of a mass march which beganat KWA-MADALA Compound and would end at the funeral at Sharpeville.

16. The march was escorted by 2 police vans at that stage.

17. Some of the Inkatha men participating in the march were wearing dresses under which they concealed weapons.

18. The march entered Sharpeville in a half moon formation. I was in the middle while on the sides were armed men.

19. Those on the sides started attacking people who werestanding on the sides of the streets by hitting them with kieries and by stabbing them.

20. I saw a lady who was standing on the side of the road being hit with a spear and then being stabbed. She managed to run away. This incident took place next to the deceased's family home. I heard the deceased referred to as TOMBIE.

21. We then left the deceased's place and moved towards the shops where a man was stabbed by one member of the march.

22. The march then proceeded to the graveyard where they were met by a police contingent who escorted the group to the grave.

23. After the funeral, and as we were leaving Sharpeville, some people followed the group. A drunk woman started criticising Inkatha. I saw a white policeman shoot in the direction of the woman who was shot in her thigh.

24. We returned to the ISCOR complex under police escort.

25. We remained in the hostel for about two weeks. During the times I heard automatic gun fire from time to time.

26. The following weekend a lot of the Inkatha members left the compound to attend a rally at Stadium. I used the opportunity to escape together with Sipho.

27. I fear for my life and have been in hiding ever since.

28. On New Years Eve at Zone 7 Ext, at 7.00 pm Sipho and Iwere attacked by a group of people. We ran in different directions.

29. On the 2 January, 1992, I heard that Sipho had been killed.

30. I believe that the other 18 people in my group are stillbeing held against their will at Room no. 2 KWA-MADALA compound.

31. I know one of the persons as LANGWANE who has recently returned from exile.

32. I know of residents from Zone 7 who are working for Inkatha at KWA-MADALA compound. Their names are annexed hereto and marked "A".

STATEMENT OF JONAS MTHOMBENI

I am 25 years old and formerly employed by Iscor. I reside at 113 Bapedi Street.

Some people claiming to be from Goldstone asked me to give them a statement. They came in caspirs and were armed. Because of this, I knew they were police and gave them very little information. I said I heard smashing windows but saw nothing. I do not truest the police because I saw them escorting attackers on the night of the 17th June 1992. Since then, I hate the police.

On the 17th June 1992 I visited a friend in Majola Street, facing Slovo Park, and left at about 9.30p.m. I got back home at approximately 9.40p.m. I switched on the tv and immediately heard the sound of gunfire from an automatic pistol. I opened the door and saw a large group of people moving up Bapedi Street, towards Slovo. I heard breaking glass and chanting and these noises were getting closer and closer.

I warned my mother and uncle to switch off the lights and hide on the floor. The mob came into our yard and smashed windows and tried to break down the front door. At that stage, I was lying face down in one of the back

rooms. I heard footsteps past the house and towards the outside flat where I stay. I heard the sound of them banging the door. I am a carpenter and we have very strong doors at my home. I heard a man say in Zulu "if it is too difficult to breakdown, leave them and lets go to the neighbours.

They then proceeded to the next door house at number 111 Bapedi Street.

After a few minutes, when I could no longer hear the sound of smashing windows so loudly, I went outside and from the corner of the house I looked down the street.

I saw a large group of men. I cannot say how many. They were wearing read headbands and white headbands. Others wore white t-shirts and others were dressed in ordinary clothes. I could see that they were carrying shields and other weapons but I could not see clearly enough to say exactly what they were carrying.

8. They proceeded down the street, breaking doors, smashing windows. Behind them was a casspir moving very

slowly with its lights off. I went back into the house and told my mother that we should sleep on the floor. We did sleep that night.

At about 4 - 5 am on the 18th June 1992, I went to Slovo Park to investigate what had occurred the night before. We found many people injured and dead.

I have no doubt that I saw a caspir following the attackers. It was a camouflage colour and I noticed the letters T2 on the back door. However, I know the police often trick us putting false numbers on their vehicles so I don't expect to identify it by those letters.

STATEMENT OF SANDILE MVUNGE

I am 23 years old and reside at 743 Hlubi Street, Boipatong. I am employed by the SAP as an assistant constable. I joined in January 1991 and am stationed at the Mobile Unit, Vereeniging.

On the night of the 17th June 1992 I was asleep in the dining room, when I was woken up by the sound of smashing windows. I thought it may be the comrades attacking my neighbour, Oupa, because he is a policeman.

Suddenly I heard the window of our dining room being smashed. I went and stood at the doorway of the dining room and heard one of them saying "Puma Comrade" (Come out comrade). While I was standing there, someone smashed another of the dining room windows. I heard one of them saying "lets get out of here fast" or words to that effect. There was a large group of Black men in the road outside carrying shiny objects that looked like weapons and wearing headbands.

Once the first group had moved on in a westerly direction, I saw another large group of men moving in the same direction and dressed and armed in a similar fashion. They were carrying tv sets and other objects.

5. While the second group was passing, I heard a scream from a house a little way up the street towards the west. I think it was the 4th house from ours. I saw a caspir slowly following the group of men. It looked as though it was escorting the attackers.

6. Sometime after the group and the caspir passed, some caspirs came and took down the addresses and names of people who had been killed.

7. Somebody came and told myself and Oupa, my neighbour and Sixteen, our lodger, who are both special constables that there was an Inkatha person hiding in House 773, Hlubi Street. Whilst still searching for this man, Oupa or Sixteen (I can't remember which of them) fired a warning shot to get the man to come out. Very soon thereafter a caspir arrived on the scene.

8. On their arrival, one of the policemen recognised Sixteen and called him. Sixteen went to the caspir. We heard them asking 16 what we were doing there. Sixteen explained that we heard a rumour that there was an Inkatha person there. They demanded we hand over the firearm to them, but 16 refused.

These were white policemen, dressed in camouflage uniform. Sixteen seemed to know a number of these policemen. The caspir then moved along in a westerly direction.

The following morning, ie the 18th June 1992, I got a report that 16 and Oupa had been picked up in a caspir with all their belongings and were taken away.

At the end of June we met up with 16 who told me that he had been told never to set foot in Boipatong again.

I think 16 has more information but he is very afraid to talk. He has told me that they have been promised houses of R50 000,00.

It appears that 16 is being kept in some sort of protective custody at the Powerville barracks. He says he is not even allowed to go to the shops.

Sixteen has been lodging at our house since the beginning of March. Oupa (Isaac Monyatso), who is our neighbour asked my mother if he could lodge with us.

He gave his name as Jacob Mosia. He told us he comes from Lesotho. He stays in a shack at the back of our yard and was in the shack at the time of the attack. I don't know what he saw of the attack.

1. On the 17th June 1992 at approximately 19h30, I was on patrol at the corner of Bafokeng and Lekoa Streets with three friends. A casspir arrived on the scene from the direction of Noble Boulevard. A white policeman dressed in camouflage uniform told us to disperse. We were reluctant. While we were talking to the police, another group of about twelve youths approached us. The police fired teargas at them. They ran away. We also ran away.

2. We then went to Mzimvubu Street. Another casspir approached us. It may have been the same one we saw earlier. The policemen asked us what we were doing on the street. We told them that we were just standing there. They told us to go home to sleep.

3. Again, as we were talking, other patrol groups approached us. The police fired at these groups, using live ammunition. I, like the others, ran away. I went home, watched some tv and went to bed at approximately 21h30.

4. Before I had fallen off to sleep, the friends I was with earlier woke me up. They spoke to me through the bedroom window. They told me that I should get up because Inkatha was attacking the township. I refused. They said that the attack looked serious and even though I insisted on not going out, I should beware of the situation.

5. A few minutes thereafter, I heard windows being smashed. My house windows were also broken. The front door was forced open and about five men entered the house. The men wore white headbands. I did not see what the men were armed with. The one who entered first cut my wrist with something which looked like a panga, as I walked passed him.

6. As I was amongst them, I started speaking Zulu and pretended to be one of them by asking "where are they, where are they". I moved towards the bedroom and hid between the bed and the wall. I heard the men demanding money from my father. Some entered my bedroom, switched on the light and searched our trousers, which were lying over the head-board. They found R350,00 in my brother's trouser pocket and took his money.

I was awoken by a man who stepped into the house and said there was a gang of attackers approaching.

I saw four members of the gang. Two were black and two were white. I knew two were white because their skin was white when their sleeves shifted up.

They did not see me and we were fortunate in that no one in our house was attacked.

!• At 7p.m on the evening of the 17th June 1992, I was onpatrol in Batswana Street, near the corner of Mthembu at the west end of the township. Police arrived in a caspir and dispersed us with bird shot. I ran home.

2* At home, I helped my brother to marked some scrips. Wewere in the diningroom when at approximately 10:30 we heard the sound of broken glass.

3. Somebody broke windows in our diningroom. I heard a gun shot. I then heard people calling others in Zulu to come across the road. I went off to the toilet and hid there with my mother and younger brother for a few minutes.

4. A few minutes later, things had quitened down. I went to our kitchen and looked out across at house no. 761. There I saw two policemen and Abednigo, my neighbour, standing outside a caspir. The caspir was parked right inside the yard of no. 761 and the fence in front of the yard had been broken down.

My brothers were standing in the yard of our house, looking at 761 and I joined them and we went over to 7 61. At 7 61 we saw that the mother of the house was already dead and her sister was lying, wounded.

I then went to see what had happened at 765. There I saw the mother of the house lying in the diningroom. She had been chopped with pangas and knives. In the bedroom I saw 2 children. When I touched one of them, I realised that she was already dead. The other was still alive. I went back to Abednigo and told him to tell the police to call an ambulance. He said that they had already done so. The ambulance arrived soon thereafter.
