4. Findings of fact and reasons for decisionA. Findings of factIn Table A in Annexure 1, I have provided a summary of my findings of fact where l haveinvoked specific provisions under s 33 of the Act. By invoking these provisions,I have reliedon material listed in part 2 above in order to arrive at my decision.B. Reasons for decisionin Table A in Annexure 1, l have provided the reasons for my decision for each folioexempted and those reasons are derivedfrom the findings of fact.5. Appeal rightsNational Archives undertakes careful examination of a record before making a decision toexempt any part of a record. As part of that process we may consult with other agencieswhich haveexpertise on specific national and international matters.lf you do not agree with my decision to exempt information under a provision of s 33 of theAct, you can contact a reference officer in National Archives and seek a furtherexplanation.lf you are still not happy with the decision and within 28 days of receiving it, you canformally appeal by:l) first applying to Archives for an internal reconsideration of my decision; and2) if you still do not agree with thedecision, you can apply to the AdministrativeAppeals Tribunal for a review.For more information please read the National Archives Fact Sheet 12- What to do if werefuse you access. Details which could impact on the Commonwealth's relations withthe current government of a foreign country.8. There are real and substantial grounds to conclude that therelease of theinformation would pose a risk to the security anddefence of Australia.other relevant details could be used by organisations or individuals of national security interestto take counter measures against ASIO security operations. Suchaction would impair ASl0'scapacity to full its statutory responsibilities and would reasonably be expected to causedamage to the security of the Commonwealth.The public release of names and other identiers of officers andemployees of ASIO, either pastor present, would enable the identication of ASIO staff. Once identied these staff could betargeted by persons or organisations interested in obtaining the information they possess touse inespionage, sabotage or threats to Australia’: security. Such disclosure would reasonablybe expected to cause damage to the security of the Commonwealth.ASIO guarantees the identity of its sources remains confidential andprotected. In order to carryout its statutory responsibilities under the Australian Security Intelligence Organisation Act1979, it is necessary for ASIO to rely extensively on confidential sources of information.There is clearly anestablished confidential relationship between ASIO and its sources. Thesesources have indicated that they would not be prepared to continue providing information toASIO if their role was ever to be publicly revealed at any stagein the future.Any diminution of ASl0's ability to obtain information from confidential sources would restrictASl0's capacity to carry out its statutory responsibilities and, as a consequence, causeirreparable damage to the security ofAustralia.Failure by ASIO to protect any information supplied by a foreign country from disclosure wouldthreaten any future exchange relationships.Page 3 of 4

The document contains the name or information that could beused to identify an ASIOsource.Disclosure of this information could identify past or present ASIO officers or employees orsources. Their identities are understood to only be known by ASIO.There is a mutual understanding between ASIO and its staff andits sources of information thatthe anonymity of officers, employees and sources should he protected.Section 92 of the Australian Security Intelligence Organisation Act 1979 also prohibits thepublication of the identities of presentand former ASIO officers and employees.The public disclosure of this information would constitute a breach of confidence.S 33(1) (e) information ormatter the disclosure ofwhich under this Actwould, or could reasonablybeexpected to: (ii)-disclose, or enable aperson to ascertain, theexistence or identity of aconfidential source ofinformation in relation tothe enforcement oradministration of the law.Certain folios are exempt as they each containinformation concerningthe existence, identity or management of an ASIO source.Release of the information exempted could reasonably be expected to disclose the existenceor identity of a confidential source of information toASIO. The condential source providedthe information on the condition that their identity would always remain confidential andprotected. The relationship between ASIO and its confidential sources is based on trust andthatincludes protecting the existence and identity of confidential sources of information.A breach of trust would give rise to concern amongst A5l0's existing or potential sources theywould be identified at a later date. Linda said he had asked for theaddress which she gavebecause it was no secret, and he said he would come innext Friday, then she tried to ring Phil but he was in a meeting, so told Nickabout it. She said this man mentioned to her that he was staying out at Parkvillebut she did notknow who with, adding it was very strange and she did not knowfor sure what she should be saying to him.
