However, the Committee's most recent actions do not diminish that a reasonable person will conclude the discovered corporate contributions and corporate in-kind contributions, violating MCFA Sec. 54, were done so "knowingly," as I have explained in my August 29, 2016 rebuttal letter. Unfortunately, the Committee's recent actions fail to properly address all of my original surviving Section 3 contentions, which have already been admitted to by Candidate Tom Reich in his first official response to my complaint, dated August 17, 2016. Even more unusual, the new Committee treasurer has now refunded an in-kind contribution for my MCFA Sec. 57, public body contention, originally dismissed by the Secretary of State (Dept.). As the new Committee treasurer stated he will be reviewing the Committee's past transactions, it prompted me to look more closely, using the check reimbursements as guidance. At the end of this letter, I have included additional Section 4, MCFA Sec. 54 contentions from older Committee campaign finance fillings, but within the five (5) year legal preservation requirement. Given the large number of already established (admitted) violations, it may be prudent for the Secretary of State (Dept.) to seek formal explanations from the Committee regarding these new contentions. My Complaint against the Committee to Re-Elect Tom Reich Sheriff Rebuttal to their Letter Dated August 23, 2016

The sudden replacement of the Committee treasurer and the unsolicited repayment of only a subset of the initially discovered improper corporate contributions and corporate in-kind contributions is highly irregular. However, the Committee's most recent actions do not diminish that a reasonable person will conclude the discovered corporate contributions and corporate in-kind contributions, violating MCFA Sec. 54, were done so "knowingly," as I have explained in my August 29, 2016 rebuttal letter. Unfortunately, the Committee's recent actions fail to properly address all of my original surviving Section 3 contentions, which have already been admitted to by Candidate Tom Reich in his first official response to my complaint, dated August 17, 2016. Even more unusual, the new Committee treasurer has now refunded an in-kind contribution for my MCFA Sec. 57, public body contention, originally dismissed by the Secretary of State (Dept.). Dear Mr. McRae:

The Department of State (Department) has completed its initial investigation of the complaint filed against The Committee to Re-Elect Tom Reich for Sheriff (Committee) by Senator Rick • Jones, which alleged certain violations of the Michigan Campaign Finance Act (MCFA or Act), 1976 PA 388, MCL 169.201 et seq. This letter concerns the disposition of Sen. Jones' complaint.

Sen. Jones filed his complaint on July 29, 2016. Written responses were filed on August 23, 2016 and August 26, 2016. Sen. Jones filed a rebuttal statement on September 6, 2016.

The MCF A requires filed campaign finance statements and reports to be complete and accurate. MCL 169.233. A candidate who knowingly files an incomplete or inaccurate statement or report may be subject to a civil fine ofup to $1,000.00. MCL 169.233(10).

The MCF A also prohibits a corporation or labor organization from making a contribution to a committee other than a ballot question committee. MCL 169.254. A knowing violation of this section is a felony, punishable by a fine of not more than $5,000.00 or imprisonment. MCL 169.254( 4 ). Additionally, Michigan Administrative Rule 169 .35 prohibits the treasurer of a committee, other than a ballot question committee, from accepting a contribution written on a check from a corporate account. A person who accepts an improper contribution may be subject to a civil fine of up to $1,000.00 per violation plus triple the amount of each improper contribution. MCL 169.215(11).

Finally, the Act requires the Department to "endeavor to correct the violation or prevent a further violation by using informal methods [,]" if it finds that there may be reason to believe that a violation has occurred, and if the Department is unable to correct or prevent additional violations, it must ask the Attorney General to prosecute if a crime has been committed or conduct an administrative hearing for enforcement of a civil violation. MCL 169 .215( 1 0)(a), (b ). The objective of an informal resolution is "to correct the violation or prevent a further violation [.]" Id.

Sen. Jones alleged the Committee filed incomplete or inaccurate statements by failing to provide contributor addresses, occupations, or employer names and addresses on the Committee's 2015

July Quarterly and 2016 Pre-Election campaign finance statements. Sen. Jones provided copies of these statements as evidence to support his allegations.

In the first response to the complaint, Sheriff Reich admitted that the omission of the addresses, occupations, and employer names and addresses were a "clerical error and oversi{ght]." A review of the Committee's 2015 July Quarterly and 2016 Pre-Primary campaign statements confirm that there are multiple incomplete contributor entries. In the second response to the complaint, you indicated that the Committee has retained you as the new treasurer for the Committee and that you will be "reviewing the [C]ommittee's past and future transactions carefully to ensure" compliance with the Act.

In addition, Sen. Jones alleged, and a review of the Committee's 2016 Pre-Primary Statement confirms, that a contribution on page 26 of the contribution schedule was labeled "Miscellaneous Internet Receipts." No contributor information is provided. If this information cannot be provided, it must be noted that the MCF A prohibits a committee from accepting an anonymous contribution. MCL 169.241(2). A knowing violation of section 41 of the Act is a misdemeanor, punishable by a fine, imprisonment, or both.

Sen. Jones further alleged that the Committee accepted 80 prohibited corporate contributions as reported on the Committee's 2015 July Quarterly and 2016 Pre-Primary campaign statements, along with prohibited contributions from the Detroit Lions and Centennial Acres. Sen. Jones provided a printout of a page from the Detroit Lions website indicating that the Lions accept donation requests and a printout from the Committee's fundraiser website which states that the Sheriff Tom Reich Golf Outing held on June 24, 2016 was sponsored by Centennial Acres.

In the first response to the complaint, Sheriff Reich explained that a signed Detroit Lions football was contributed to the Committee by an individual and not the Lions organizatio•n. In the absence of any evidence to the contrary, the Department believes this is plausible and accepts Sheriff Reich's explanation. Additionally, Sheriff Reich indicated that Centennial Acres was paid in full for the golf outing at the same pricing as available to the general public. Sheriff Reich asserted that Centennial Acres was not a sponsor to a golf outing. The Committee reported a payment of $3,848.00 to Centennial Acres on its 2016 Pre-Primary statement, which appears to support Sheriff Reich's assertion. It appears to the Department that while it is unfortunate that the Committee's fundraiser website stated Centennial Acres was a "sponsor," the evidence provided does not support a conclusion that the Committee received a prohibited contribution from Centennial Acres.

In the second response you stated that, "the Committee has already acted to refund the full value of the corporate in-kind contributions." You provided a sample letter that was mailed with the refunds, along with copies of the refund checks.

It appears to the Department from your response that 69 refund checks were issued by the Committee totaling $4,009.00.1 However, it appears to the Department that the following 12

The Department further notes that Sen. Jones alleged in his rebuttal statement that the Committee reported corporate contributions on its 2014 October Quarterly Statement and 2014 Annual Statement. Sen. Jones based his allegations on the fact that the listed contributors' addresses were addresses of corporations.

Based on the admissions that the Committee failed to include required information on its 2015 July Quarterly and 2016 Pre-Primary campaign statements and that it accepted prohibited corporate contributions, along with the Department's review of the Committee's campaign statements, the Department concludes that the evidence supports a reason to believe the Committee has violated the Act. Upon making this detennination the Department is required by law to attempt to resolve the matter infonnally. MCL 169.215(10).

Please provide the following to the Department no later than December 11, 2016:

1. Detailed contributor information for the contribution listed as "Miscellaneous Internet Receipts" on the Committee's 2016 Pre-Primary statement.

2. An explanation as to why the contributions listed in the above table are not corporate contributions; or if they were prohibited corporate contributions, proof that the Committee has refunded the contributions.

3. Proof that the contributions listed in Sen. Jones' rebuttal statement -- 10 reported on the Committee's 2014 October Quarterly statement and 10 reported on the

the reason stated in its August 5, 2016 Notice of Complaint letter. The refund of this money does not change the

Department's August 5, 2016 analysis.

Committee's 2014 Annual statement (lists are included as an enclosure for your convenience) -- were made by the individuals listed and not the corporations which addresses were listed, such as copies of the contribution checks or statements from the contributors;2 or if they were prohibited corporate contributions, proof that the Committee has refunded the contributions.

The Department wilt use this information to facilitate an informal resolution of Sen. Jones' complaint.

Please be advised that if the Department is unable to resolve Sen. Jones' complaint through informal methods, it is required by MCL 169.215(10) to conduct an administrative hearing to enforce the civil penalties provided in: 1) MCL 169.215(11), which provides that the Secretary of State may seek a civil fine of triple the amount of each improper contribution, plus up to $1,000.00 for each violation of the Act; and 2) MCL 169.233(10), which provides that the Secretary of State may seek a civil fine of up to $1,000.00 for each knowingly incomplete or inaccurate report.
