    SUBPARTA

    GENERALREQUIREMENTS

    FCL.001 Competentauthority

    Forthepurposeof thisPart, thecompetentauthorityshallbetheauthoritydesignatedbytheMemberStatetowhomapersonappliesfortheissuanceofpilotlicencesorassociatedratingsorcertificates.

    FCL.005 Scope

    ThisPartestablishestherequirementsfortheissueofpilotlicencesandassociatedratingsandcertificatesandtheconditionsoftheirvalidityanduse.

    FCL.010 Definitions

    ForthepurposesofthisPart,thefollowingdefinitionsapply:

    Aerobatic flight means an intentional manoeuvre involving an abrupt change in an aircraftsattitude,anabnormalattitude,orabnormalacceleration,notnecessaryfornormalflight.

    Aeroplanemeansanenginedrivenfixedwingaircraftheavierthanair,thatissupportedinflightbythedynamicreactionoftheairagainstitswings.

    Aeroplanerequiredtobeoperatedwithacopilotmeansatypeofaeroplanethatisrequiredtobeoperatedwithacopilotasspecifiedintheflightmanualorbytheairoperatorcertificate.

    Airship means a powerdriven lighterthanair aircraft, with the exception of hotair airships,which,forthepurposesofthisPart,areincludedinthedefinitionofballoon.

    Balloonmeansalighterthanairaircraftthatisnotenginedrivenandsustainsflightthroughtheuseofeithergasoranairborneheater.Forthepurposesof thispart,ahotairairship,althoughenginedriven,isalsoconsideredaballoon.

    BasicInstrumentTrainingDevice(BITD)meansagroundbasedtrainingdevicewhichrepresentsthestudentpilotsstationofaclassofaeroplanes.Itmayusescreenbasedinstrumentpanelsandspringloaded flight controls, providinga training platform for at least the procedural aspects ofinstrumentflight.EachBITDshallcomplywithaspecificBITDmodelandbeaserialnumberedunit.

    Categoryofaircraftmeansacategorisationofaircraftaccordingtospecifiedbasiccharacteristics,forexampleaeroplane,poweredlift,helicopter,airships,sailplane,freeballoon.

    Classofaeroplanemeansacategorisationofsinglepilotaeroplanesnotrequiringatyperating,inaccordancewiththeoperationalsuitabilitycertificateissuedinaccordancewithPart21.

    Classofballoonmeansacategorisationofballoonstakingintoaccounttheliftingmeansusedtosustainflight.

    Competencymeansacombinationofskills,knowledgeandattituderequiredtoperformatasktotheprescribedstandard.

    Copilotmeansapilotoperatingotherthanaspilotincommand,anaircraftforwhichmorethanone pilot is required, but excluding a pilotwho is on board the aircraft for the sole purpose ofreceivingflightinstructionforalicenceorrating.

    CrossCountrymeansaflightbetweenapointofdepartureandapointofarrivalfollowingapreplannedrouteusingstandardnavigationprocedures.

    Dual instruction time means flight time or instrument ground time during which a person isreceivingflightinstructionfromaproperlyauthorisedinstructor.

    FullFlightSimulator(FFS)meansafullsizereplicaofaspecifictypeormake,modelandseriesaircraft flight deck, including the assemblage of all equipment and computer programmesnecessarytorepresenttheaircraft ingroundandflightoperations,avisualsystemprovidinganoutoftheflightdeckview,andaforcecueingmotionsystem.

    Flighttimemeans:

    foraeroplanes, touringmotorglidersandpoweredlift, thetotal time fromthemomentanaircraftfirstmovesforthepurposeoftakingoffuntilthemomentitfinallycomestorestattheendoftheflight.

    forhelicopters,thetotaltimefromthemomentahelicoptersrotorbladesstartturninguntilthemomentthehelicopterfinallycomestorestattheendoftheflight,andtherotorbladesarestopped.

    for airships, the total time fromthemomentanairship is released from themast for thepurposeof takingoff until themoment theairship finally comes to rest at theend of theflight,andissecuredonthemast

    forsailplanes, thetotaltimefromthemomentthesailplanecommencesthegroundrun intheprocessoftakingoffuntilthemomentthesailplanefinallycomestoarestattheendofflight

    forballoons,thetotaltimefromthemomentthebasketleavesthegroundforthepurposeoftakingoffuntilthemomentitfinallycomestoarestattheendoftheflight.

    Flight timeunderInstrumentFlightRules(IFR)meansall flight timeduringwhichtheaircraft isbeingoperatedundertheInstrumentFlightRules.

    Flight Training Device (FTD)means a full size replica of a specific aircraft types instruments,equipment, panels and controls in an open flight deck area or an enclosed aircraft flight deck,includingtheassemblageofequipmentandcomputersoftwareprogrammesnecessarytorepresenttheaircraftingroundandflightconditionstotheextentofthesystemsinstalledinthedevice.Itdoesnotrequireaforcecueingmotionorvisualsystem.

    Flight andNavigation Procedures Trainer (FNPT)meansa training devicewhich represents theflight deck or cockpit environment including the assemblage of equipment and computerprogrammesnecessarytorepresentanaircrafttypeorclassinflightoperationstotheextentthatthesystemsappeartofunctionasinanaircraft.

    Groupofballoonmeansacategorisationofballoonstakingintoaccountthesizeorcapacityoftheenvelope.

    Helicoptermeansaheavierthanairaircraftsupportedinflightchieflybythereactionsoftheairononeormorepowerdrivenrotorsonsubstantiallyverticalaxes.

    Instrumentflighttimemeansthetimeduringwhichapilotiscontrollinganaircraftinflightsolelybyreferencetoinstruments.

    Instrumentgroundtimemeansthetimeduringwhichapilotisreceivinginstructioninsimulatedinstrumentflightinflightsimulationtrainingdevices(FSTD).

    Multicrewcooperation(MCC),meansthefunctioningoftheflightcrewasateamofcooperatingmembersledbythepilotincommand.

    Multipilotaircraft

    Inthecaseofaeroplanes,meansaeroplanescertificatedforoperationwithaminimumcrewofatleasttwopilots.

    Inthecaseofhelicopters,airshipsandpoweredliftaircraft,meansatypeofaircraftthatisrequiredtobeoperatedwithacopilotasspecifiedintheflightmanualorbytheairoperatorcertificateorequivalentdocument.

    Nightmeanstheperiodbetweentheendofeveningciviltwilightandthebeginningofmorningciviltwilight,orsuchotherperiodbetweensunsetandsunriseasmaybeprescribedbytheappropriateauthority,asdefinedbytheMemberState.

    Pilotincommandundersupervision(PICUS)meansacopilotperforming,underthesupervisionofthepilotincommand,thedutiesandfunctionsofapilotincommand.

    Poweredlift aircraft means any aircraft deriving vertical lift and in flight propulsion/lift fromvariablegeometryrotorsorengines/propulsivedevicesattachedtoorcontainedwithinthefuselageorwings.

    Powered sailplane means an aircraft equipped with one or more engines having, with enginesinoperative,thecharacteristicsofasailplane.

    Routesectormeansa flight comprising takeoff,departure,cruiseofnot less than15minutes,arrival,approachandlandingphases.

    Sailplanemeansaheavierthanairaircraftthatissupportedinflightbythedynamicreactionoftheairagainstitsfixedliftingsurfaces,thefreeflightofwhichdoesnotdependonanengine.

    Singlepilotaircraftmeansanaircraftcertificatedforoperationbyonepilot.

    Soloflighttimemeansflighttimeduringwhichastudentpilotisthesoleoccupantofanaircraft.

    Touring Motor Glider (TMG) means a specific class of powered sailplane having an integrallymounted,nonretractableengineandanonretractablepropeller. Itshallbecapableoftakingoffandclimbingunderitsownpoweraccordingtoitsflightmanual.

    Type of aircraft means all aircraft of the same basic design including all modifications theretoexceptthosewhichresultinachangeinhandlingorflightcharacteristics.

    FCL.015 Applicationandissueoflicences,ratingsandcertificates

    (a) An application for the issue, revalidation or renewal of pilot licences and associated ratings andcertificates shall be to the competent authority in a manner established by this authority. Theapplicationshallbeaccompaniedbyevidencethattheapplicantcomplieswiththerequirementsforthe issue, revalidation or renewal of the licence or certificate as well as associated ratings orendorsements,establishedinthisPartandPartMedical.

    (b) Any limitation or extension of the privileges granted by a licence, rating or certificate shall beendorsedinthelicenceorcertificate.

    (c) ApersonshallnotholdatanytimemorethanonelicenceissuedinaccordancewiththisPart.

    (d) Anapplicationforanamendment,revalidationorrenewalofapilotlicenceandassociatedratingsorcertificatesshallbemadetothecompetentauthoritythatissuedthepilotlicence,exceptwhenthe pilot has requested a change of competent authority and a transfer of his records to thatcompetentauthority.

    FCL.020 Studentpilot

    (a) Astudentpilotshallnotflysolounlessauthorisedtodosobyaflightinstructor.
