THE Madras High Court has refused bail to a son, who killed his mother by pushing her into a well.

Justice S Vaidyanathan, who refused bail to K Sathya-kumar of Anna Nagar West Extension, said he was re-minded of Adi Sankara, who took up sanyasa against the will of his mother Aryamba, on condition that he should be present near her death bed and also perform the last rites.

As per her wish, Adi Sankara was near his mother at the time of her death and also performed the funeral-rites. At that time, he composed five verses in praise ofmotherhood, which welled up from the depth of his

mind. The verses highlight that hu-man beings are here because ofmothers. The pains she takes inbringing the children forth alive,the several months that she carriesus all within her so stoically. Such is motherhood!

Adi Sankara recognized the im-mense pains a mother experiences,during and after the birth of achild. He remembers mother’s suf-ferings during the early months ofpregnancy, He recognizes the jani-torial services she renders to thechild with great joy and affection.To such a mother, he says, “mysalutations”!

“When a sanyasi, who has re-nounced his family has felt the importance of perform-ing the last rites for his mother, the petitioner, who is a family man, who is all along with his mother, without even having regard that she brought him up and fed him, is alleged to have murdered her. Hence, this Court is not inclined to grant the relief sought by the petition-er,” the judge said and dismissed the bail application.

The judge, however, said it was open to the petitionerto file a fresh petition before the lower court and the same could be considered by that court in accordance with law and this order would not debar it from takingup the matter, the judge added.

Sathyakumar was arrested by JJ Nagar police andremanded in judicial custody on June 24.

THE death of a sailor, who went miss-ing from Liberian registered vesselMT Kingfisher, which was docked in Chennai Port, was mired in controver-sy as the ship was allowed to sail with-out any inquiry by Indian officials two days after the incident.

Radhakrishnan T K, who was sail-ing on board MT Kingfisher, an oil tanker, went missing around 4.20 amon July 28 and his body was located at Royapuram the same evening. A FirstInformation Report was filed by thepolice the next day but the crew in the ship were not questioned.

The Chennai Port authorities and the Mercantile Marine Department (MMD) said they were not informed about the death when the ship depart-ed from Chennai Port on July 30.

As per the The Merchant Shipping Act of 1958, Section 358, the death ofany sailor should be reported. This in-cident is a blatant violation of Section 358, said Manoj Joy, Chaplain Sailors

Society. Director General of Shipping (DGS) Deepak Shetty told Express that any death should be reported at theMMD based in Chennai and it is their duty to conduct the investigation.

For his part, the recruiting agent ofship and director of Seaarland Man-agement Services, Mumbai, Capt Jairam, citing the rules, said that he had informed the DGS headquarters in Mumbai, and produced the letters that were duly acknowledged by the dis-patch section. But why inform Mum-bai when the incident happened in Chennai? Jairam claimed he went by the rule book. If the DGS, Mumbai failed to act, it is their fault, he argued.

It was also learnt from the agent that the immigration department in Chen-nai Port, which is not tasked to con-duct the inquiry, was informed by In-chcape Shipping Services based in Chennai. “The ship was docked rightin front of the MMD office, yet the agent did not inform MMD,” said Joy.

When Express contacted S Barik, principal officer of MMD, he said his office has not received any orders from the DGS to investigate the incident. “Ifthe DGS asks us to conduct enquiry, we will do so,” he said.

The office of the DGS had in 2006 specified guidelines on how the en-quiry should be conducted when a death is reported on a ship.

“The irony is we don’t know who is responsible for letting the ship sail without conducting any enquiry overthe death of the sailor,” said Joy.

International Transport Workers Federation inspector K Sreekumar has taken up the issue with the shipping company and MMD, and notified the ITF headquarters in London.
