THE PRESENT COMMERCIAL WARRANTY POLICY PROVIDES WARRANTY PRO-CEDURES RELATIVE TO EACH NEW COMMERCIAL AGUSTAWESTLAND AIRCRAFT. THE AIRCRAFT MUST BE OPERATED IN ACCORDANCE WITH CIVIL AVIATION REGULATIONS AND AW ROTORCRAFT FLIGHT MANUAL AND SHALL BE MAINTAINED IN ACCORDANCE WITH THE TECHNICAL PUBLICATIONS ISSUED BY FINMECCANICA.

THE PRESENT COMMERCIAL WARRANTY POLICY ALSO PROVIDES WARRANTY PROCEDURES AND APPLICABLE COVERAGE RELATIVE TO SPARE PARTS.

1. WARRANTY OF NEW AGUSTAWESTLAND COMMERCIAL AIRCRAFT

THREE YEARS / 2,000 HOURS

WARRANTY AND REMEDY: FINMECCANICA WARRANTS, AT THE TIME OF DELI-VERY, EACH NEW COMMERCIAL AW AIRCRAFT TO BE FREE FROM DEFECT IN MATE-RIAL AND WORKMANSHIP UNDER NORMAL USE AND SERVICE. FINMECCANICA’S SOLE OBLIGATION UNDER THIS WARRANTY IS LIMITED TO THE REPAIR OR REPLACEMENT OF PARTS WHICH ARE DETERMINED TO FINMECCANICA’S REASONABLE SATISFACTION TO HAVE BEEN DEFECTIVE WITHIN THE FIRST 2,000 FLIGHT HOURS OF OPERATION OR THREE (3) YEARS AFTER AIRCRAFT DELIVERY, WHICHEVER OCCURS FIRST, AND REIMBURSEMENT OF REASONABLE FREIGHT CHARGES. FOR PARTS SUBJECT TO RETIREMENT LIFE OR OVERHAUL PERIOD, THERE WILL BE A PRORATED CHARGE TO THE BUYER FOR THE REPLACEMENT PARTS, PRORATING THE HOURS OF TOTAL USE AGAINST THE THEN APPLICABLE PART RETIREMENT LIFE OR OVERHAUL PERIOD. DURING THE FIRST 300 FLIGHT HOURS OR 18 MONTHS, WHICHEVER OCCURS FIRST, AFTER DELIVERY OF THE HELICOPTER, FINMECCANICA WILL REIMBURSE THE BUYER FOR REASONABLE LABOUR CHARGES ASSOCIATED WITH WARRANTY RELATED ISSUES, BUT NOT THEREAFTER. SPARE PARTS INSTALLED AS WARRANTY REPLACE-MENT ON HELICOPTERS WHICH ARE COVERED BY THIS NEW HELICOPTERS FINMEC-CANICA WILL BE WARRANTED FOR THE BALANCE OF THE ORIGINAL SHIP WARRANTY. DEFECTIVE PARTS MUST BE REPORTED IN WRITING TO FINMECCANICA WARRANTY ADMINISTRATION WITHIN THIRTY (30) CALENDAR DAYS OF BEING FOUND DEFECTIVE. WARRANTY REPLACEMENTS MAY BE WITH EITHER NEW OR RECONDITIONED PARTS, AT FINMECCANICA’S ELECTION. WARRANTY ADJUSTMENT IS CONTINGENT UPON THE BUYER COMPLYING WITH FINMECCANICA WARRANTY ADMINISTRATION DISPOSI-TION INSTRUCTIONS FOR DEFECTIVE PARTS. FAILURE TO COMPLY WITH THE TERMS OF THIS PARAGRAPH MAY, AT FINMECCANICA’S SOLE OPTION, VOID THIS WARRANTY.

NOTE:

PARTS, COMPONENTS AND ASSEMBLIES OF ALL NEW HELICOPTERS MAY HAVE BEEN RESTORED OR REWORKED DUE TO MARKS, BLEMISHES, DENTS OR OTHER IRREGULARITIES INCURRED DURING THE MANUFACTURING PROCESS. SUCH RESTORATION AND/OR REWORK ARE PERMITTED UNDER FINMECCANICA’S APPROVED MANUFACTURING AND ENGINEERING PROCESSES AND GUIDELINES. THE RESTORATION AND/OR REWORK SO COMPLETED DO NOT RENDER SUCH ITEMS DEFECTIVE IN MATERIAL OR WORKMANSHIP.

FINMECCANICA EXCLUDES AND DISCLAIMS LIABILITY, WHETHER AS A RESULT OF A BREACH OF CONTRACT OR WAR-RANTY, NEGLIGENCE OR STRICT PRODUCT LIABILITY, FOR INCIDENTAL OR CONSE-QUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGE TO THE AIRCRAFT OR OTHER PROPERTY, COSTS AND EXPENSES RESULTING FROM REQUIRED CHANGES OR MODIFICATIONS TO AIRCRAFT COMPONENTS AND ASSEMBLIES, CHANGES IN RETI-REMENT LIVES AND OVERHAUL PERIODS, LOCAL CUSTOMS FEES AND TAXES, AND COSTS OR EXPENSES FOR COMMERCIAL LOSSES OR LOST PROFITS DUE TO LOSS OF USE OR GROUNDING OF AIRCRAFT OR OTHERWISE.

FINMECCANICA MAKES NO WARRANTY, AND EXCLUDES AND DISCLAIMS ALL LIABILITY IN CONTRACT OR IN TORT (DELICT), INCLUDING, WITHOUT LIMITATION, NEGLIGENCE AND STRICT TORT (DELICTUAL) LIABILITY, WITH RESPECT TO: (I) WORK PERFORMED BY THIRD PARTIES AT BUYER'S REQUEST; AND (II) ENGINES, ENGINE ACCESSORIES; AND (III) HONEYWELL EPIC (ONLY FOR AW139); AND (IV) APU & APU ACCESSO-RIES (ONLY FOR AW189); AND (V) BUYER-FURNISHED EQUIPMENT; AND (VI) BUYER SELECTED MISSION EQUIPMENT.

FOR ANY OF THE AFOREMENTIONED ITEM THE APPLICABLE WARRANTY SHALL BE THE WARRANTY PROVIDED BY THE APPROPRIATE THIRD-PARTY ORIGINAL MANUFACTU-RER, WHICH BUYER SHALL BE ENTITLED TO ENFORCE AGAINST SUCH THIRD-PARTY ORIGINAL MANUFACTURER ONLY AND NOT AGAINST FINMECCANICA. - REPLACEMENT OR REPAIR OF PARTS WHICH ARE DETERMINED AT FINMECCA-NICA’S SATISFACTION TO HAVE BEEN DEFECTIVE WITHIN 1,000 FLIGHT HOURS OF OPERATION OR ONE (1) YEAR AFTER INSTALLATION OR THREE (3) YEARS AFTER THE DELIVERY OF THE PART TO THE BUYER WHICHEVER OCCURS FIRST,

- REIMBURSEMENT OF REASONABLE FREIGHT CHARGES.

THE BUYER'S SOLE REMEDY FOR A BREACH OF ANY SUCH SPARE PARTS WAR-RANTY OR WARRANTIES OR FOR ANY DEFECT IN A PART COVERED BY ANY SUCH SPARE PARTS WARRANTY OR WARRANTIES IS THE REPAIR OR, AT SELLER’S OPTION, THE REPLACEMENT OF AIRCRAFT PARTS AND REIMBURSEMENT OF REASONABLE FREIGHT CHARGES AS PROVIDED HEREIN. FINMECCANICA PROVIDES BUYER WITH SEVERAL OPTIONS FOR RESOLVING COVE-RED WARRANTY ISSUES.

WARRANTY CLAIMS HAVE TO BE SUBMITTED TO FINMECCANICA THROUGH THE MMIR FORM.

WARRANTY ELIGIBILITY WILL BE EVALUATED USING THE INFORMATION PROVIDED THROUGH THE MAINTENANCE MALFUNCTION INFORMATION REPORT (MMIR) FORM. PROVIDED THAT ALL REQUIRED INFORMATION IS SUBMITTED ON TIME, AW STAN-DARD TIMEFRAME FOR MMIR EVALUATION IS 3 DAYS. FINMECCANICA WILL ISSUE A WARRANTY REPLY MEMO (WRM) WHICH INCLUDES INFORMATION ABOUT WAR-RANTY ACCEPTANCE OR REFUSAL AND DETAILED INSTRUCTION FOR PROCESSING THE WARRANTY CLAIM.

THE APPLICABLE WARRANTY REMEDIES ARE DESCRIBED BELOW.

7.1. REMEDY 1: HAVE THE PART REPAIRED LOCALLY AND REQUEST WARRANTY CREDIT

BUYER CAN ASK TO REPAIR THE DISCREPANT PART AT ITS OWN FACILITY OR HAVE IT REPAIRED AT A LOCAL FINMECCANICA APPROVED REPAIR FACILITY:

A. PRIOR TO PROCEEDING WITH REPAIR EXECUTION, BUYER SHALL PROVIDE FINMECCANICA WARRANTY DEPARTMENT WITH A REPAIR QUOTE TOGETHER WITH THE MMIR FORM. (BUYER SHALL SPECIFY EITHER WARRANTY CREDIT FOR LOCAL REPAIR AT APPROVED FACILITY, OR WARRANTY CREDIT FOR LOCAL REPAIR AT BUYER'S FACILITY),

B. UPON APPROVAL OF THE REPAIR QUOTE FROM FINMECCANICA AND COMPLETION OF THE REPAIR ACTIVITY, BUYER IS REQUESTED TO PROVIDE FINMECCANICA WARRANTY DEPARTMENT WITH:

• A COPY OF THE TEAR DOWN REPORT DETAILING PARTS REPLACED AND REASON FOR REPLACEMENT

• A COPY OF THE WORK ORDER OR THE INVOICE DETAILING THE WORK ACCOMPLISHED. BUYER SHALL ANNOTATE THE MMIR NUMBER ON THE INVOICE.

• in case the repair quote is rejected then refer to paragraph 7.2

C. FINMECCANICA WILL THEN ISSUE A WRM TO CONFIRM THE WARRANTY CREDIT IN ACCORDANCE WITH THE ORIGINAL APPROVED QUOTE.

7.2. REMEDY 2: RETURN THE PART TO AGUSTAWESTLAND FOR REPAIR

BUYER CAN ASK TO RETURN THE DISCREPANT PART TO FINMECCANICA FOR REPAIR UNDER WARRANTY:

A. BUYER SHALL SUBMIT TO FINMECCANICA A PROPERLY FILLED OUT MMIR FORM TOGETHER WITH ALL DOCUMENTS NECESSARY FOR THE EVALUATION AND SPECI-FYING:

• REQUEST FINMECCANICA TO REPAIR THE PART UNDER WAR-RANTY.

B. UPON RECEIPT OF ALL THE ABOVE MENTIONED DOCUMENTS, FINMECCANICA WILL ISSUE A WRM TO INFORM BUYER ABOUT WARRANTY ACCEPTANCE OR REFUSAL. IN CASE OF ACCEPTANCE WRM WILL INCLUDE RETURN MATERIAL AUTHORISA-TION (RMA) NUMBER AND DETAILED INSTRUCTION TO RETURN THE DISCREPANT PART (CORE) TO FINMECCANICA.

C. AFTER THE RECEIPT OF THE RMA BUYER SHALL RETURN WITHIN 30 CALENDAR DAYS THE UNSERVICEABLE ITEM TO FINMECCANICA HELICOPTER DIVISION (AS DEFINED IN PAR. 8 “CORE RETURN PROCEDURE”).

D. THE PART WILL BE REPAIRED AND THEN RETURNED TO THE BUYER. PARTS REPAIRED UNDER WARRANTY ARE NOT SUBJECT TO PRORATED CHARGES.

7.3. REMEDY 3: SUBMIT A WARRANTY CLAIM FOR REPLACEMENT

PART

A. BUYER SHALL SUBMIT TO FINMECCANICA , A MMIR FORM FOR A REPLACEMENT PART. THE MMIR WILL HAVE TO INCLUDE ALL THE SUPPORTING DOCUMENTATION (COMPONENT RETURN TAG, COMPONENT LOG CARD) AS APPLICABLE.

ALL ITEMS WILL BE SHIPPED AFTER APPROVAL OF THE WARRANTY CLAIM AND ISSUANCE OF THE WRM (DEPENDING ON AVAILABILITY). REPLACEMENT OF “NEXT HIGHER ASSEMBLY” WILL NOT BE COVERED.

IN CASE OF “AIRCRAFT ON GROUND” (AOG) EVENTS, FINMECCANICA WILL PRO-CESS THE WARRANTY CLAIM THROUGH ITS FLEET OPERATIONS CENTRE ENSU-RING A RAPID RESPONSE TO ACHIEVE THE MOST DEMANDING FLEET AVAILABILITY LEVELS REQUIRED BY BUYER.

B. THE WRM WILL INCLUDE INFORMATION ABOUT WARRANTY ACCEPTANCE OR REFUSAL INCLUDING DETAILED INSTRUCTIONS FOR PROCESSING THE DISCREPANT PART (CORE), AS APPLICABLE:

• RETURN THE CORE TO THE FINMECCANICA ADDRESS INDICATED IN THE WRM (REFER TO PARAGRAPH 8). WRM WILL ALSO INCLUDE RETURN MATERIAL AUTHORIZATION (RMA) CODE WITHIN THIRTY (30) CALENDAR DAYS AFTER THE SHIPMENT OF THE REPLACEMENT PART FROM THE DESIGNATED FINMECCANICA FACILITY. IF THE CORE IS NOT RECEIVED WITHIN THE THIRTY (30) CALENDAR DAYS, BUYER WILL BE INVOICED AND THE BUYER SPARE PART ACCOUNT WILL BE DEBITED FOR THE PRICE OF THE REPLACEMENT PART AND THE WARRANTY ACTION WILL BE CONSIDERED CLOSED,

• SCRAP THE CORE ON SITE. IN THIS CASE UNSERVICEABLE PARTS AND MATERIAL WHEN REMOVED FROM H/C WILL REMAIN PROPERTY OF THE H/C OPERATOR AND SCRAPPED UNDER THE RESPONSIBILITY OF THE H/C OPERATOR IN ACCORDANCE WITH ITS NATIONAL AUTHORITY RULES AND LEGISLATIONS. THEY CANNOT BE OFFERED BY THE H/C OPERATOR AS SCRAP WITHOUT BEING MUTILATED OR DESTROYED RENDERING THEM UNUSABLE AD UNACCEPTABLE FOR THEIR INTENDED USE AND INSTALLA-TION ON AIRCRAFT

BUYER CAN PLACE A WARRANTY CLAIM WITHOUT REQUESTING A REPLACEMENT PART (E. G. BUYER HAS ALREADY HIS OWN PART AVAILABLE AT STOCK), IN THIS CASE BUYER CAN REQUEST FINMECCANICA FOR A CREDIT NOTE.

8. CORE RETURN PROCEDURE

THE PRESENT PROCEDURE IS PROVIDED FOR REFERENCE ONLY AND IS SUBJECT TO CHANGE.

THE PRESENT CORE RETURN PROCEDURE TO FINMECCANICA SHALL APPLY TO THE RETURN OF A DISCREPANT PART TO FINMECCANICA AS A RESULT OF A REPLACE-MENT PART PROVIDED UNDER WARRANTY OR FOR THE RETURN OF DISCREPANT PART TO FINMECCANICA FOR REPAIR UNDER WARRANTY.

CORE RETURN SHIPPING IS AT FINMECCANICA EXPENSE BY USING FREIGHT COLLECT MEANS. THE FOLLOWING PROCEDURE SHALL BE APPLIED:

A. BUYER SHALL PROVIDE FINMECCANICA WITH ADVANCE COPY OF THE CORRECT DOCUMENTATION APPLICABLE TO THE COMPONENTS TO BE RETURNED, SUBMIT-TING IT TOGETHER WITH THE MMIR FORM. PARTS RETURNED WITHOUT THE COR-RECT DOCUMENTATION CANNOT BE RECEIVED, REPAIRED OR RESTORED TO SERVICE. CONSEQUENTLY SUCH PARTS CAN NO LONGER BE USED. THEREFORE FINMECCANICA REQUESTS TO BUYER TO TAKE THE NECESSARY ACTIONS TO ASSURE THAT THE FOLLOWING DOCUMENTATION IS CORRECTLY ISSUED AND RETURNED:

• COMPONENT TAG

THE MAINTENANCE ORGANIZATION IN CHARGE OF THE COMPONENT REMOVAL SHALL FILL OUT A COMPONENT TAG INDICATING ITS SERVICEABI-LITY OR UNSERVICEABILITY STATUS AND THE REASON FOR REMOVAL IN ENGLISH LANGUAGE. THE COMPONENT TAG SHALL BE PROPERLY SIGNED BY A CERTIFYING STAFF OR A CERTIFIED MECHANIC OF THE MAINTE-NANCE ORGANIZATION.

• ASSEMBLY HISTORICAL RECORD / LOG CARD (WHENEVER APPLICA-BLE)

THE ASSEMBLY HISTORICAL RECORD (OR LOG CARD), WHENEVER APPLI-CABLE FOR A COMPONENT, TYPICALLY FOR LIFE LIMITED COMPONENTS OR SUBJECT TO SCHEDULED OVERHAUL OR INSPECTIONS, SHALL REPORT ALL THE APPLICABLE DATA (E.G. REASON FOR REMOVAL, A/C TOTAL TIME/LAN-DINGS, ASSY LIFE TOTAL TIME, ASSY LIFE TIME SINCE OVERHAUL, ETC.) IN ENGLISH LANGUAGE AND SHALL BE PROPERLY SIGNED BY A CERTIFYING STAFF OR A CERTIFIED MECHANIC OF THE MAINTENANCE ORGANIZATION.

IN THE EVENT THAT THE BUYER USES A FORM DIFFERENT FROM FINMEC-CANICA LOG CARD TEMPLATE TO TRACK COMPONENT RECORDS, THE SAME DATA AS PER FINMECCANICA LOG CARD TEMPLATE SHALL BE RECORDED, IN ENGLISH LANGUAGE, AND SHALL BE PROPERLY SIGNED BY A CERTIFYING STAFF OR A CERTIFIED MECHANIC OF THE MAINTENANCE ORGANIZATION.

• MMIR FORM

A COPY OF THE COMPLETED MMIR FORM, PROPERLY FILLED OUT SHALL BE RETURNED WITH THE CORE AND A COPY OF THE MMIR FORM SHALL BE ACCESSIBLE AND VISIBLE FROM THE OUTSIDE OF THE SHIPPING CONTAI-NER.

• RETURN MATERIAL AUTHORIZATION (RMA)

THE RMA IS A REFERENCE CODE ISSUED BY FINMECCANICA THAT SHALL BE OBTAINED BY THE BUYER VIA WRM PRIOR TO ANY SHIPMENT OF MATERIAL TO FINMECCANICA DESIGNATED FACILITIES. A COPY OF THE COMPLETED RMA FORM, PROPERLY FILLED OUT SHALL BE RETURNED WITH THE CORE AND A COPY OF THE RMA FORM SHALL BE ACCESSIBLE AND VISIBLE FROM THE OUTSIDE OF THE SHIPPING

customer operational needs

• 2 alternative service levels, both with a performance guarantee

• 2 alternative payment methods

A total of 16 combinations is possible, providing customers with fexibility and a clear solution to their support needs.

SCOPE OF COVERAGE: The Full Components Plan, provides a Logistic Support Guarantee covering all components considered in the basic helicopter confguration.

The plan provides repair, overhaul, replacement and/or exchange of parts including Life Limited parts, Time Between Overhaul parts and parts for Mandatory technical bulletin application.

Coverage extends to scheduled and unscheduled events, enhancing Customer aircraft availability, reducing inventory costs and minimising R&O expenses.

COMPONENTS & ITEMS EXCLUDED:

• Engines & Engine Accessories, Auxiliary Power Unit (APU)

• Primus Epic System (only for AW139)• Optional kits (can be included upon Customer

request)• Items with a unit price less than 200 EUR/250

USD• Aircraft Paint, upholstery, carpets, interior panels• Fuel, lubricants, and consumable materials• Labour for scheduled and unscheduled/on-

condition maintenance• Any costs attributable to abuse or misuse of the

SEARCH AND RESCUE (SAR) MISSIONSDelivering effective SAR missions relies on highly competent crews. These crews require specifc operational training covering a range of skills and disciplines in a large range of terrain and weather conditions. PLATFORM & DECK LANDINGS

If landing on oil and gas rigs, executive ships, coastguards or naval vessels is key to your operation then dedicated training is required. NIGHT VISION DEVICES

Helicopter operations today widely use night vision goggles due to the technological advances and availability of equipment. CREW SERVED WEAPONS

Well trained and capable rear crew are vital in acquiring and eliminating targets and acting in self-defence in a range of military roles. Skyfight is the gateway to enhancing your Finmeccanica Helicopter Division fying experience. It has been designed to support Customers in their Flight Planning activities whilst operating with the AgustaWestland family of products..

The application provides an intuitive, simple and modern Human Machine Interface, which requires no formal training. Skyfight is the optimal off-aircraft tool to carry out pre-fight evaluation of all the aspects of any mission ensuring a thorough safety assessment.

Wherever you are, through your internet enabled device, you will be provided with relevant aviation information, in addition to a real-time stream of weather and environmental data, which is used in conjunction with the Finmeccanica Helicopter Division aircraft performance data. The essential tools for the route planning still remain available when Skyfight is off-line.
