Unit Transfer Policy for Rentals
In accordance with the Condominium Documents, the following policy for the transfer of units
by leasing will take effect immediately:
1. The Board of Directors of the Association has to approve the applicant in writing based
on a completed background check.
2. The applicant(s) will have to fill out a detailed personal information packet and submit a check in the amount of $100 ($100 for married couples) payable to the Murano Grande Condominium Association, for the purpose of a background check per applicant other than husband/wife or parent/dependant child. (the background check may take up to 4-
3. Once the Management Office has received the Background Results, it “may” take an
additional (5) days to receive the decision of the Board.
4. A one‐time $250.00 non‐refundable fee for the move‐in and a $250.00 non‐refundable fee for the move‐out will be collected in the form of a check made payable to the Murano Grande Condominium Association prior to the move‐in date / move‐out date. Along with the fee, a $2,500.00 refundable deposit is also required prior to the move. Move in/out must be scheduled with 72 hours prior notice.
5. The owners must submit a copy of the signed lease.
6. No lease of a unit shall be for a period of less than (6) months.
7. The renter will have to place in escrow with the Association a deposit in the amount of
one‐month’s rent in form of a check made payable to the Murano Grande Condominium Association. The deposit will be returned 15 business days after moving out and a completed inspection of the Common Areas, which will reveal no damage to the Association’s property.
8. During an orientation meeting the Management will receive a copy of the Rules and
Regulations of the Association & pay fees applicable before the condo approval letter will be released. The lessee will have the same rights and responsibilities as a unit owner.

INDEMNIFICATION AND RELEASE FORM
WHEREAS, the undersigned Unit Owner(s) or Tenant(s) in Unit No._______________ of ___________________________ located at _______________________________________ (street address) is/are desirous of having _______________________________________. (The “Association”) and/or The Continental Group, Inc. (“TCG”) its authorized agent, perform the following service on my/our behalf and not on behalf of the Association: (Circle if appropriate)
1. Use of key to my/our unit which Association has to allow access to me/us, or my/our guests or tenants if locked out.
2. Use of key to my/our unit which Association has to allow access to contractors who are to perform work in my/our unit.

WHEREAS, to protect the Association, TCG. their officers, directors, partners, parent company, members, agents and employees (hereinafter the “Association Parties”) from any claims, damages, demands, suits, judgments, actions, causes of actions, debts, sums of money, accounts, claims and demands arising out of, or related to, the services performed hereunder on behalf of the undersigned unit Owner(s) or Tenant(s), I/we agree to indemnify and hold harmless the Association Parties from any such actions, demands, suits, etc., and
WHEREAS, the Association and TCG are not willing to provide the above referenced services to the undersigned unit Owner(s)/Tenant(s) without the benefit of this Indemnification and Release Form.
NOW THEREFORE, for Ten ($10.00) and other good and valuable consideration, the receipt and adequacy of which is hereby acknowledged by the Association Parties and the undersigned, it is hereby agreed that the undersigned Unit Owner(s) or Tenant(s) hereby agrees/agree to hold harmless and indemnify the Association Parties from any claims, demands, suits, etc., including, but not limited to reasonable attorney’s fees and costs whether pre-litigation, or at the trial or appellate levels, if applicable, against it or them by any party, resulting from or related to the performance or the above services for the undersigned and the undersigned hereby releases said Association Parties and will not assert any claims against such Association Parties for services performed hereunder. ADDENDUM TO LEASE AGREEMENT
This Addendum shall serve to modify and/or supplement that certain Lease Agreement dated _________________, 20_____ by and between _______________________________________ (hereinafter “Owner(s)/Lessor(s)”) being the Owner(s) of the following described unit:
Unit # _______ of the Murano Grande at Portofino, a Condominium, according to the Declaration of Condominium thereof recorded at Official Record Book 21134 at Page 3930 of the Public Records of Miami-Dade County, Florida (“Unit”).
and _______________________________________ (hereinafter “Lessee(s)” or “Tenants(s)”). Notwithstanding anything to the contrary in the aforementioned Lease Agreement, the parties hereto agree as follows:
1. Murano Grande at Portofino Condominium Association, Inc. (hereinafter “Association”) and/or its authorized agents shall have the irrevocable right to have access to each unit from time to time during reasonable hours as may be necessary for inspection, maintenance, repair or replacement of any common element therein or accessible therefrom, or for making emergency repairs therein necessary to prevent damage to the common elements or another unit or units.
2. The Lessee agrees not to use or allow the use of, the Unit or any portion of the common elements in a manner which violates the provisions of the Declaration of Condominium of Murano Grande at Portofino or the By-Laws or Rules and Regulations of the Association or anything which violates any applicable law, code, ordinance or regulation of any governmental entity having jurisdiction over the property operated by the Association or interferes with the rights of other residents of the Association.
3. The Association shall have the right to collect, and Lessee shall have the obligation to pay to Association, all rental payments and apply same against unpaid Assessments (as defined in the Declaration of Condominium) together with interest, costs, late fees and reasonable attorney’s fees, if and to the extent that Owner(s)/Lessor(s) is/are delinquent in the payment of assessments, interest, costs, late fees or reasonable attorney’s fees. Owner(s)/Lessor(s) specifically grant the Association the right to notify Lessee(s) of any failure to pay Assessments or other charges so as to exercise the right contained herein and Lessee(s) shall make payment of all rent to the Association otherwise payable to the Owner(s)/Lessor(s), without deduction, until such delinquency is satisfied in full, or until the Lease is terminated or expires, whichever occurs first. For so long as Lessee(s) have the obligation to pay rent to the Association, they shall not be in default of their obligations to Owner(s)/Lessor(s) for the failure to pay rent so long as all of such rental payments are being made in full to the Association pursuant hereto. Owner(s)/Lessor(s) release the Association from any

liability under federal or state laws regulating debt collection or credit reporting in connection with the exercise of the Association‘s rights pursuant hereto.

No person other than those specifically identified herein shall be allowed to occupy the Unit (except as to guests for no more than twenty one days (21)), nor may the Lease be assigned, extended or renewed without prior written approval of the Association. 5. Any violation of the terms of this Addendum, including the failure to pay rent pursuant to paragraph
3, shall constitute a basis for the Association to require that all persons otherwise allowed to occupy the Unit vacate such unit upon five (5) days written notice. The Association may enforce these rights through an eviction action or through injunctive relief and it shall be presumed that the violation of any provisions hereof shall constitute irreparable harm and that the Association has no adequate remedy and would be entitled to a temporary injunction to enforce the requirement to vacate the Unit. In any such proceedings, the Association shall not be required to join the Owner. In any such proceedings, the prevailing party shall be entitled to recover its reasonable attorney’s fees and costs.
6. Nothing contained in the Lease, this Addendum, or the Condominium Documents shall in any manner (i) be deemed to make the Association a party to the Lease or this Addendum (except to the extent necessary, if at all, to enable the Association to enforce its rights hereunder or under the Condominium Documents), (ii) create any obligation or liability of the Association to Owner/Lessor or Tenant (including, without limitation, any obligation as a landlord under applicable law or any liability based on the Association’s approval of Tenant pursuant to the Declaration of Condominium, such approval being solely for the benefit of the Association), or (iii) create any right or privileges of Tenant under the Lease, this Addendum, or the Condominium Documents in or as to the Association.
