Tender Documents Fees has to be paid online through payment gateway during the "Downloading of Tender Document & Payment of Tender Document fees" stage and Earnest Money Deposit has to be submitted through Demand Draft in favour of Commissioner, Municipal Corporation Faridabad. Reference of the EMD is to be mentioned online. The envelopes 'ED' & 'TI' shall be kept in a big outer envelop, which shall also be sealed. In the first instance, the Envelop - 'ED' of all the Bidders containing the Earnest Money and documents supporting eligibility criteria shall be opened online. If the Earnest Money and eligibility of bidder is found proper, the Envelop 'TI' containing Technical Bid shall be opened in the presence of such bidders who either themselves or through their representatives choose to be present. The Technical and Financial bid shall be opened only if the bidders meet the eligibility criteria as per the Bid document. The bidder will submit the necessary documents as under. Envelope 'ED' - Earnest Money Deposit and eligibility criteria Envelop Online EMD Envelope-Reference details of the Earnest Money Deposit instrument and scanned copy of documents supporting eligibility criteria. Envelope 'TI' - Technical Bid Envelope Online Technical Envelope - All the information and scanned copies of the Documents / Certificates as required to be submitted as per the Tender. Also, all such documents, if any, that cannot be submitted online i.e. all the Information and Documents / Certificates as required to be submitted in physical technical envelope as per the Tender. Envelope 'CI' - Price Bid Envelope To be submitted mandatory online- "Information related to Price Bid of the Tender". The Envelopes "ED" & "TI" shall be placed in another envelop of bigger size clearly marking the name of agency & name of work. In case, the Bidders have submitted all the information and documents/ certificates

The bidder can submit their tender documents as per the dates mentioned in the schedule above. CONDITIONS 1. Tender will be issued to those contractor(s) who are enlisted with MCF/CPWD/MES/Railway/PWD (B&R),

HUDA, HSIDC, Haryana Marketing Board etc. and other Central Govt./State Govt./Semi Govt. Departments/ Undertakings/ Boards in appropriate categories of estimate amounts who have successfully & satisfactorily executed at least 2-3 projects of similar nature and cost, as mentioned in condition No.(a),(b)&(c) of eligibility criteria shall only be eligible to quote.

2. No tender will be issued to the agency if it fails to qualify the terms & conditions/eligibility mentioned above. 3. The earnest money in the form of Bank Draft/Pay order of the above mentioned amount in

Favour of Commissioner, Municipal Corporation, Faridabad be submitted in separate envelop at the time of submission of Tender. No tender without earnest money will out rightly be rejected.

4. The undersigned reserves the right to reject any or all the tenders without assigning any reason what so ever and no conditional and postal tenders will be accepted.

5. The contractors will have to quote their rates including the cost of cement of ISI quality 43 grade OPC cement brands like ACC, Binani, J.K., Ambuja, Vikram, Birla or approved by Engineer in charge. The cement manufactured by mini plant shall not be allowed.

6. The offer will remain valid upto 90 days from the date of opening of tenders. 7. Application for tender documents must accompany with an attested copy of registration

certificate of the contractor/ societies. 8. Proof of sale Tax, Vat, EPF, ESI and labour registration and work conduct are to be supplied

before issuance of tender.

- 6 -9. That the rate of bitumen/emulsion at the refinery on the date of receipt of tender shall be

considered as base rate. If during execution of the works, the rate of bitumen/emulsion increases or decreases at refinery, the difference in cost shall be paid/recouped from the contractor in the bill, subject to the following conditions:-

A. The bitumen/emulsion will be arranged by the contractor from approved refinery only. B. The contractor shall submit original bill/voucher of the refinery while claiming the payment

for the work done. The bill/voucher should pertain to the period of original contractual time limit and should correspond with the progress of work. No extra payment due to increase in rate of bitumen/emulsion will be paid if the original bill/vouchers are not submitted by the agency. No increase in prices of the bitumen/emulsion shall be reimbursed to the contractor beyond the original time period allowed for construction as per contract agreement irrespective of extension of time limit granted to the agency for any reason, whatsoever.

C. After approval of tender, the contractor shall submit the work programme for execution of work and get it approved from the Engineer-in-Charge in the time limit prescribed in the tender document. The increase in rates of bitumen/emulsion shall only be paid if the bituminous work is carried out within the prescribed period as per the approved work programme.

10. The execution of entire work will be monitored by a citizen supervisory committee comprising persons who are stake holder in the work. The contractor shall be bound to keep the committee apprised of various important phases of the work right form the beginning till the end. The contractor shall also give due consideration to the suggestion this committee may make from time to time with regard to the quality of work. In the event of contractor finding such a suggestion to be irresponsible or unacceptable he will bring the matter to the notice of the Municipal Corporation, Faridabad.

11. A third party would be engaged to inspect the work during its execution to ensure the work is done according to the specifications/agreement, qualitatively & quantitatively. The

- 7 -fee/charges of third party inspection, sampling, testing etc. would be born by Municipal Corporation Faridabad.

ANNEXURE-A

CONDITIONS OF E-TENDERING

Instruction to Contractor on Electronic Tendering

These conditions will over-rule the conditions stated in the tender documents, wherever relevant and applicable.

1. Registration of contractors on E-tendering Portal:-

All the Contractors intending to participate in the tenders processed online, are required to get registered on the Electronic Tendering System on the Portal http://mcfbd.etenders.in.For more details, please see the information on the Registration info link on the home page.

2. Obtaining a Digital Certificate:

2.1 The Bids submitted online should be encrypted and signed electronically with a Digital Certificate to establish the identity of the bidder bidding online. These Digital Certificates are issued by an Approved Certifying Authority, by the Controller of Certifying Authorities, Government of India.

2.2 A Digital Certificate is issued upon receipt of mandatory identity (i.e. Applicant’s PAN Card) and Address proofs and verification form duly attested by the Bank Manager/ Charted Accountant/ Any Gazatted Officer whose stamp carrying emblem of Ashoka. Only upon the receipt of the required documents, a digital certificate can be issued.

2.3 The contractors may obtain Class-II digital certificate from any Certifying Authority or Sub-certifying Authority authorized by the Controller of Certifying Authorities or may obtain information and application format and documents required for the issue of digital certificate from:

2.4 Bid for a particular tender may be submitted online using the digital certificate, which is used to encrypt the data and sign the hash during the stage of bid preparation & hash submission. In case, during the process of a particular tender, the user looses his digital certificate (be it due to virus attack, hardware problem, operating system or any other problem) he will not be able to submit the bid online. Hence, the users are advised to keep a back up of the certificate and also keep the copies at safe place under proper security (for it’s use in case of emergencies).

2.5 In case of online tendering, if the digital certificate issued to the authorized user of a firm is used for signing and submitting a bid, it will be considered equivalent to a no-objection certificate/power of attorney /lawful authorization to that User. The firm has to authorize a specific individual through an authorization certificate signed by all partners to use the digital certificate as per Indian Information Technology Act 2000. Unless the certificates are revoked, it will be assumed to represent adequate authority of the user to bid on behalf of the firm in MC FARIDABAD tenders as per Information Technology Act 2000. The digital signature of this authorized user will be binding on the firm.

2.6 In case of any change in the authorization, it shall be the responsibility of management / partners of the firm to inform the certifying authority about the change and to obtain the digital signatures of the new person /

- 12 -user on behalf of the firm / company. The procedure for application of a digital certificate however will remain the same for the new user.

2.7 The same procedure holds true for the authorized users in a private/Public limited company. In this case, the authorization certificate will have to be signed by the directors of the company.

3 Opening of an Electronic Payment Account:

For purchasing the tender documents online, contractors are required to pay the tender documents fees online using the electronic payments gateway service. For online payments, please refer to the Home page of the e-tendering Portal http://mcfbd.etenders.in

4 Set up of machine:

In order to operate on the electronic tender management system, the user’s machine is required to be set up. A help file on setting up of the system can be obtained from M/s Nextenders (India) Pvt. Ltd. or can be downloaded from the home page of the website - http://mcfbd.etenders.in.

5 Online Viewing of Detailed Notice Inviting Tenders:

The contractors can view the detailed N.I.T and the time schedule (Key Dates) for all the tenders floated through the electronic tendering system on the MC FARIDABAD e-tenders website http://mcfbd.etenders.in

6 Download of Tender Documents:

The tender documents can be downloaded from the Electronic Tendering System through the Portal http://mcfbd.etenders.in

7 Key Dates:

The contractors are strictly advised to follow dates and times as indicated in the Notice Inviting Tenders. The date and time will be binding on all contractors. All online activities are time tracked and the system enforces time locks

- 13 -that ensure that no activity or transaction can take place outside the start and end dates and the time of the stage as defined in the Notice Inviting Tenders.

8 Bid Preparation (Technical & Financial) Online Payment of Tender Document Fee and Submission of Bid Seal (Hash) of online Bids:

8.1 The Payment can be made by eligible / contractors online directly through Credit Cards / Internet Banking Accounts / Cash Cards. The contractors have to pay the cost of the tender documents online by making online payment of tender document fees using the service of the secure electronic payment gateway. The secure electronic payments gateway is an online interface between contractors and credit card / online payment authorization networks.

8.2 Submission of bids will be preceded by submission of the digitally signed bid seal (Hash) as stated in the time schedule (Key Dates) of the Tender.

9 Generation of Super Hash:

After the submission of Bids (Hash) by the Contractors, the bidding round will be closed and a digitally signed Super Hash will be generated by the authorized Municipal Corporation FARIDABAD officers. This is equivalent to sealing the tender box.

10 Submission of actual online bids:

Contactors have to submit their encrypted bids online and upload the relevant documents for which they generated the hash at the stage of hash generation & submission after the generation of Super Hash. The process is required to be completed within the date and time as stated in the Notice Inviting Tenders (Key Dates). The electronic bids of only those contactors who have submitted their bid seals (Hashes) within the stipulated time, as per the tender time schedule (Key Dates), will be accepted by the system. A contractor who does not submit his bid seal (Hash) within the stipulated time will not be allowed to submit his bid.

Note:- Bidders participating in e-tendering shall check the validity of his/her Digital Signature Certificate before bidding in the Tenders floated online at e-tendering portal of MC Faridabad website http://mcfbd.etenders.in.

(d) Service provider shall be responsible for all the dues as fixed by the Govt.

(e) The Manpower to be provided should be as per the qualifications and experience prescribed in the Haryana Municipal Corporation (Recruitment & Conditions) Service Rules 1998. Post wise qualifications as prescribed are available with the tender form.

(f) The Service provider Agencies having good track record, manpower capacity, annual turnover of Rs. One Crore each year for

the last three year

g) The Tenderer should carefully read, filled up and attach all the documents as required in the tender form from part-I to part-III

1) The Service Charges quoted above shall remains valid for six months after grant of work order and no enhancement of rates whatsoever shall be claimed by the tenderer.

2) The material for the services shall be provided by the office of Municipal Corporation Faridabad. Leave reserve for weekly rest and other Holidays/ National Holidays shall be provided by the service provider

and no extra charges will be paid by the Municipal Corporation Faridabad. 3) The selected agency will have to sign service agreements on the given format within seven days from the date of

the receipt of the work order.

- 7 - B) TERMS & CONDITIONS:

3. All the information as required in the tender documents should be filled up in the relevant part and no column should be left unfilled and incomplete tender document submitted without the earnest money deposit will be summarily rejected. However, Committee will be at liberty to call for any other documents for its satisfaction at the time of opening of tender. Tenderer will submit required papers with in two hours.

4. The agency will have to deposit the Earnest Money to the Municipal Corporation, Faridabad in the shape of Demand Draft in favour of the commissioner MCF.

5. The Man Power to be provided by the agency shall always remain the employee of the agency for all intents and purposes and the service provider/agency shall alone be liable for any disputes amongst the employee and the agency, which may arise in any court of law.

6. All the persons engaged by the service agency/provider should be healthy, physically fit and free from communicable diseases. 7. The agency should quote percentage of Service Charges (on D.C. Rates only) per month as per the format

mentioned in part-II of the tender in respect of staff deputed in the Department. 8. The service provider shall be responsible for the attendance of his staff in the Department. In case of any staff of the

agency remains absent or granted leave by them, they will send/ arrange his/ her substitute otherwise a penalty of Rs. 500/- per day per person will be imposed on the agency and the penalty so imposed will be deducted from the bill of the agency or from the earnest money deposit as subject case.

9. In case of inability of personnel deputed to the job in MCF the same will be got done from the market at the cost of service provider and amount will be deducted from the bill of agency presented in the department.

10. In case the contractor discontinues the contract before the expiry of the period mention in work order his security shall be forfeited if the agency do not start the work after grant of work order his earnest money will be forfeited.

11. The personnel sent/deputed on job will be on the pay roll of the service provider and will be the employee of the service provider for all intents and purposes. However the service agency shall communicate, the name, parental, residential address, date of birth, academic qualifications, previous experience etc. along with a photograph of a person.

12. The commissioner Municipal Corporation Faridabad or his nominee shall be at liberty to check any time, the deployment of the Man Power of the service provider.

13. The antecedents of the personnel deployed by the service provider should be credible and above board. 14. The staff deployed will be issued identity card by the service provider which will be required to be displayed at the

time of the duty , in case of pilferage , theft breakage , the agency will be responsible and Commissioner Municipal Corporation Faridabad will be at liberty to deduct the amount of such loss from the agency after holding an enquiry. The decision of the Commissioner of Municipal Corporation Faridabad to this effect shall be final and binding the parties, in case of unsatisfactory performance and violation of any condition of the contract, service agreement, the contract shall be liable to be cancelled and the Earnest Money deposited by the Agency, will be fortified. The personnel so deployed on the job for various activities will not be changed by the agency without the approval of the department.

15. That the agency shall not sublet the contract to any other concern/individual. 16. The agency will pay to the personal engaged the D.C. Rates as per the wages fixed by D.C. Office, Faridabad,

Haryana. 17. The payment of Service Tax, ESI, EPF, Labour Welfare Funds & Salary will be made office-wise through ESCROW

account. 18. In case of Man Power of Security Guards, the agency shall have the license from ADGP; Haryana as prescribed

under Haryana Private Security Agencies Rules; 2009. 19. The agency having good track record, manpower capacity, annual turnover of Rs. One Crore per year for the last

three years duly certified by C.A..and relevant experience in the format attached. 20. The agency will be responsible for the payment of statutory liabilities such as PF/ESI and Labour Welfare Fund,

Service Tax etc. through Escrow Accounts, in respects of persons deputed in the department and will submit the deposit challans showing the individual figure of deposit for the previous month along with remuneration bill. The agency will also submit the copy of the quarterly return of PF/ESI etc. filled with the concerned authority of MCF.

21. The service agreement will be for a period of Six Months from the date of taking over the charge of work .The department may, however at its sole discretion can reduce or extend the period of the contract on the prevalent terms and conditions.

- 8 -22. The agency will have to deposit the earnest money of Rs. 1.00 Lacs with the tender in favour of Commissioner of

Municipal Corporation Faridabad in the shape of pay order or demand draft payable at the Faridabad. No cash will be accepted.

23. The agency awarded contract will have to execute an agreement on the stamp papers of appropriate value that he will abide by the terms and conditions as mentioned in the service agreement.

24. The agency will be responsible for obtaining a license as the case may be from the licensing authority under the Contract Labor (Regulation and abolition) Act 1970 and the department shall not be responsible for any damage and losses on this account.

25. The agency will have to comply with all the rules and regulation pertaining to PF, ESI and Labor Laws and taxation etc. as applicable.

26. The Commissioner Municipal Corporation Faridabad reserve the right to terminate this contract at any time by giving of 30 days notice if the services of the contractor are found unsatisfactory and or any other reasons.

27. That in case of disputes with regard to the service agreement, the same shall be subject to arbitration by the Commissioner of the Municipal Corporation Faridabad whose decision shall be final and binding on both the parties.

28. The Contractor’s quotations below 2.1 percent (2.1%) as service charges will be rejected. Service charges in amount shall not be accepted.

29. In case rates quoted by the bidders are the same in more than one case the decision will be taken by draw of lot in the presence of participants.

30. The agency, who has been blacklisted by state Govt./Center Govt. will not be eligible to participate. 31. Conditional/telegraphic/incomplete tender will not be accepted. 32. The agency will have to pay the wages to its workforce through Escrow Account by opening and transfer in

individual account of the workforce only. The bill must be submitted on or before 5th of each month. The agency will bound to attach/show receipt of payment made to the employees along with previous month`s challans and detailed bills of the due month otherwise a penalty of Rs. 500/- per day per person will be imposed on him and the penalty so imposed will be deducted from the bill of the agency or from the earnest money deposit as the case may be.

33. The agency will submit his complete bills of service charges, wages including ESI, EPF, Service Tax and other statuary charges every month.

34. The number of workforce can be increased or decreased as per the requirement of Municipal Corporation, Faridabad time to time.

35. The Corporation reserve the right to add/amend/modify/withdraw any of the terms of conditions of the tender document at any time without any notice. The decision of the MCF in this regard will be final.

36. Any amendment to a tender after opening of tender made by the tenderer according to his own will is liable to be ignored together and such tenderer will be debarred from tendering for a period of six months besides rejecting the tender.

37. Other information’s and detail if required can be obtained/seen from the office of the Establishment Officer, Municipal Corporation Faridabad.

38. The agency shall open ESCROW account within 5 days of award of contract failing which MCF has reserve the right to cancel the work allotment and in this case his Earnest money as well as special security will be forfeited.

39. The agency shall deposit special security of Rs. 3 Lacs within two days of allotment of work order which will remain deposited in the corporation till the termination of contract. MCF will be at liberty to adjust all typed of losses from this security or by taking legal action.
