    Saudara saudari,

    Kepimpinan MTUC mengucapkan Selamat Tahun Baru kepadasemua ahli gabungan dan pekerja-pekerja di Malaysia. Dengan

    kepimpinan baru MTUC, tahun 2014 menjanjikan suatu permulaanera baru bagi kesatuan-kesatuan sekerja di negara ini. Wujudnyakeperluan untuk melakukan pembaharuan yang segera danpembaharuan ini perlu dilakukan dalam beberapa bidang utama.MTUC perlu mencari jalan bagi mengatur diri kita untuk meningkatkanpenyertaan pekerja dalam aktiviti kesatuan sekerja. Keahlian MTUCperlu dipertingkatkan agar MTUC dan kesatuan sekerja mempunyaisuara yang besar dan mempunyai pengaruh yang kuat terhadapperkembangan ekonomi dan sosial di negara ini.

    Pelbagai cabaran dihadapi oleh Kesatuan sekerja untukmeningkatkan keahlian kesatuan. Proses yang melibatkan perkara-perkara seperti pengiktirafan kesatuan, memperluaskan danpentakrifan semula skop kesatuan sekerja, kelewatan dalammenangani isu-isu yang melanda pekerja dan kesatuan sekerjasememangnya membimbangkan dan tidak ada kesudahan dalammemperjuangkannya. Proses-proses ini direka sedemikian untukmenghalang penubuhan kesatuan-kesatuan sekerja di negara ini. Iniperlu ditangani melalui satu siri langkah-langkah yang terancang.MTUC perlu memberi tekanan yang berterusan kepada kerajaan

    supaya dapat menyelesaikan permasalahan-permasalahan inisekaligus meminda undang-undang buruh supaya ia memberimanfaat dan faedah kepada ahli-ahli kesatuan sekerja.

    MTUC perlu bersatu bagi menangani perkara ini. Saya menjemputsemua kesatuan gabungan, ahli-ahli kesatuan sekerja, pekerja dansemua penyokong kaum pekerja untuk tampil ke hadapan bagimembolehkan MTUC berdiri dengan teguh dan kukuh.Marilah kita bersama-sama membuat tahun 2014 sebagai tahunkenangan untuk kesatuan sekerja di Malaysia.

    MTUC protests against the M in istry of Hum an Resourc es

    MTUC protests against the Ministry o f Human Resources

    Workers across Peninsular got together for the MTUC Picketagainst the Ministry of Human Resources. The workers joinedthe broad coalition of unions and workers activist movementin a mobilisation against the economic, social, and politicalinjustice by the one percent and the unholy support extendedby the Ministry of Human Resources.

    The Chairman of the MTUC Action Committee, Bro AbdulRazak Md Hassan has documented nation-wide practices of

    wage theft, denial of union rights and abuse of workers.

    This picket said Abdul Razak, is just the beginning of the na-tion-wide campaign that will be organized against the Ministryof Human Resources for causing the erosion of workers rightsin the country said Abdul Razak.

    The MTUC calls upon the Ministry to change the SecretaryGeneral of the Ministry for the failure of the Ministry to protectworkers and ensure their basic benefits are protected. Thepicket, added Abdul Razak was as a result of the Ministrysfailure in taking steps to:

    1. Cancel the registration of the Maybank in house union evenafter the Minister admitted in Parliament that the Ministry hadblundered in the said registration;

    2. Stop the unfair dismissal of trade union leaders;

    3. Stop the discriminative implementation of the MinimumWage;

    4. Stop all forms of outsourcing;

    5. Stop the victimisation of workers by Hong Leong Bank; and

    6. Ensure the effective implementation of ILO Convention 98;

    Bro Abdul Razak has assured the workers present at the pick-et that MTUC will continue to lobby for the change in the Min-istry of Human Resources to protect the most important assetof the country that is the workers.

    MTUC President, Bro Khalid Atan and Secretary General Bro Abdul Halim Mansor were present to extend their full support.

    Protes terhadap Kementerian Sumber Manusia

    Pekerja di seluruh Semenanjung Malaysia bersatu dalamPiket anjuran MTUC bagi membantah tindakan KementerianSumber Manusia. Para pekerja menyertai gabungan kesatuansekerja dan pergerakan aktivis pekerja dalam satu mobilisasimenentang ketidakadilan ekonomi, sosial, dan politik yangditunjukkan kepada mereka oleh pihak Kementerian SumberManusia.

    Pengerusi Jawatankuasa Bertindak MTUC, Sdra Abdul RazakMd Hassan telah mendokumenkan amalan pemerasan gaji,penafian hak-hak kesatuan dan pengeksploitasian pekerja diseluruh Negara.

    Piket ini, kata Abdul Razak hanyalah kempen permulaan yangdianjurkan di seluruh negara terhadap Kementerian SumberManusia kerana terhakisnya hak-hak pekerja di negara ini.

    MTUC menyeru Kementerian untuk menukarkan Ketua Se-tiausaha Kementerian kerana kegagalan Kementerian untukmelindungi pekerja dan memastikan faedah asas merekaterjamin. Mengikut Abdul Razak piket ini diadakan kerana

    Kementerian gagal mengambil langkah-langkah untuk:1. Membatalkan pendaftaran kesatuan dalaman Maybank mes-kipun Menteri mengakui di Parlimen bahawa Kementerian telahkhilaf dalam pendaftaran tersebut;

    2. Menghentikan pembuangan kerja yang tidak adil terhadappemimpin-pemimpin kesatuan sekerja;

    3. Menghentikan diskriminasi dalam perlaksaan Gaji minima;

    4. Menghentikan segala bentuk penyumberan luar pekerja;

    5. Menghentikan penindasan ke atas pekerja-pekerja oleh HongLeong Bank dan

    6. Memastikan pelaksanaan Konvensyen ILO 98 secara effektif;

    Sdra. Abdul Razak telah memberi jaminan kepada pekerjayang hadir ke piket bahawa MTUC akan terus melobi bagimewujudkan perubahan dalam Kementerian Sumber Manusiauntuk melindungi aset paling penting di negara ini iaitu hakkaum pekerja.

    Turut hadir ialah Presiden dan Setiausaha AgungMTUC, Sdra Khalid Atan dan Sdra Abdul Halim Mansor untukmemberi sokongan penuh terhadap piket tersebut di sampingpemimpin-pemimpin MTUC yang lain.

    Ahli-ahli kesatuan bersama pemimpin-pemimpin MTUC piket di perkarangan Putrajaya bagi mendesak supayakerajaan memberi keutamaan kepada hal ehwal kesatuan sekerja yang menjadi nadi kepada pembangunan

    ekonomi negara. Piket telah diadakan pada 12 Disember 2013 secara aman.

    The Malaysian Trade Union Congress (MTUC) wants former human resources minister Datuk Seri Dr S. Subra-maniam to face the Parliamentary Labour Caucus over a report he made to the International Labour Organisation(ILO).

    MTUC president Khalid Atan (questioned how Dr Subramaniam could have made such a report two years priorto a High Court decision on November 7 this year against the National Union of Bank Employees (NUBE).

    According to Khalid, Dr Subramaniam told the ILO's Committee of Experts on Freedom of Association that theHigh Court had decided that the Director General of Trades Unions' decision to register a Maybank staff unionwas valid and within the powers of DGTU in 2011.

    NUBE had challenged the registration of the Maybank In-House Union in the High Court. Calling the action anti-union and shocking, Khalid said the High Court decision would have far-reaching consequences on the tradeunion movement in the country. "This will weaken the collective bargaining powers of trade unions in protectingthe workers' interest," he said.

    NUBE general secretary J. Solomon, meanwhile, also questioned Dr Subramaniam's action, saying it hadbrought the matter to the ILO's attention. "How is it possible otherwise for the minister to be aware of a court de-cision made only two years later?" he asked during a press conferenceat the Parliament lobby on Nov 12.

    The ILO will be writing to the government seeking an explanation," hesaid, adding that NUBE is appealing against the decision of the HighCourt.

    Solomon also claimed the governments decision to allow the registra-tion of Maybank's in-house union was mala fide, or in bad faith. "It wasapproved within only six days of application, whereas many other un-ions from other sectors have been waiting years for approval," he add-ed.

    NUBE has over 3,000 Maybank employees as members, he said. "From 2010 up to now, there has been interfer-

    ence from Maybank's management, forcing its employees to join the in-house union. "We see a pattern of influ-ence from the management and the Human Resources Ministry to deliberately ensure members of NUBE resignand join the in-house union," said Solomon. Solomon claimed the ministry violated the Industrial Relations Act1967 and the Trade Unions Act by interfering in union affairs and not permitting NUBE members to meet thebank employees.

    "This weakens the role of the union in bargaining for their (employees) interests," he said. Several oppositionlawmakers who were present, including Kuala Langat MP Abdullah Sani Abdul Hamid and Batu MP Tian Chua,said they would raise the matter in Parliament.

    PERUTUSAN DARI PRESIDENSaya mengucapkan syabas dan tahniah kepada barisan kepimpinan baru MTUC 2014 yang bakal menerajui tu-gasan dan amanat kaum pekerja. Saya juga mengucapkan jutaan terima kasih atas sokongan dan kepercayaanyang diberikan oleh perwakilan dari kesemua kesatuan gabungan terhadap kepimpinan baru ini.

    Saya mohon jasa baik dari semua rakan seperjuangan supaya dapat memberi sokongan dan bekerjasamabagi menegakkan hak-hak kaum pekerja yang kini sedang melalui satu ledakan yang boleh membawa kesan keatas kehidupan dan kesejahteraan mereka.

    Kenaikan harga barangan, pengenalan GST, potongan subsidi, kenaikan kos hidup sememangnya perluditangani dengan wajar supaya tidak memberi kemudaratan yang ketara. Pelbagai usaha perlu dilakukan bagimengatasi permasalahan ini seperti pemberian COLA, pengamalan gaji minima, memberi keutamaan kepadapekerja tempatan, kenaikan gaji tahunan yang wajar, umur persaraan, undang-undang perburuhan yang mampan,dan sebagainya.
