Star date: Mid-March 2015. Morning goes like this………….

4:30 A.M. get up…..get in the shower….get dressed in normal bus driveroutfit (blue jeans and any color shirt that comes out of the closet first).Have one cup of coffee (gotta drive in less than an hour….can’t drinkmore than one cup…more on that later). Leave home 5:15 A.M……arrive

main terminal at 5:30. Sign in locate bus and begin pre-trip ritual. Back in office for official bathroom breakbefore route. Wheels up at 5:45 A.M…….(watch out for the deer and coyotes and the occasional wolf andthe rare moose and dogs and cats and chickens and the occasional flattened raccoon)…..drive 25 milesnorth into the wilderness (also known as the bush up here in tropical Minnesota). Get about ½ block fromfirst stop pull over to wait for appropriate start time…….use the portable facilities available….start rte at6:20. Make 18 stops and say good morning 24 times. Arrive school at 8:10 ish………unload 24 stu-dents….stay in school loading zone tying up traffic and go back and check for sleeping students. Returnto base and change into my management clothes (blue jeans and whatever color shirt I found three hoursearlier) and start doing my 9 hour day job….running a bus company.

Pretty much the same thing I was doing 39 years ago in March 1977…..except for the running a bus com-pany part. The actual job of picking up and dropping off the little darlings has not changed a bit……it’sjust the buses and rules and regulations and physicals and the background checks and the pre-trips andthe post-trips and the drug screens and the spot checks and the paperwork that has changed a little bit.The old manual door and the manual stop arm in the old school bus orange bus from back then did thesame job exactly. As did the driver.

So I am guessing by now you have gotten the drift of my article for this month……..I personally have dri-ven more this school year than in all of the past 5 years….possibly 10 years…….we simply are short ofdrivers whether they be new drivers or old drivers we just can’t seem to find enough. The real truth of thematter is I am sure you have all done the same this year. Let’s keep up the good work and get throughthis spring safely.

Today marks the end of the first “Com-mittee Deadline,” a point roughlyhalfway through the 2015 LegislativeSession. Deadline week also sepa-rates legislative proposals that aremoving positively forward versus thoseproposals that are not progressingthrough the process. Basically, 90% ofall bills fail to make this early mile-stone. Fortunately, for MSBOA, ourprojects are mostly moving forward.

Our proposal to highlight the dangersof “stop arm” violations was reportedby Channel 5 KSTP, in the Twin Cities,and WDIO Television in Duluth. SF1045/HF1948 would increase viola-tions from “not less than $300 to notless than $500” for illegally passing aschool bus with red lights flashing andthe stop arm extended. Require vio-lators to attend a “distracted drivercourse.” Lastly, the proposal wouldprevent a conviction of a violation frombeing “masked” preventing an agency,court, or public official in Minnesotafrom masking, defer imposition ofjudgement for, or allow an individual toenter into a diversion program thatwould prevent a conviction fromappearing on an individual’s drivingrecord. While this proposal may notreceive a hearing this year, there maybe an opportunity for the proposal tomove forward in a larger transportationor public safety bill.

The next two bills are the result ofMSBOA members’ statements regard-ing extreme lengths of time for criminalbackground checks through the BCAand delays in road and skills tests byDiver and Vehicles Services (DVS.)MSBOA introduced two proposals toattempt to shorten the timeline forreceiving Commercial Drivers Licens-es, with an “S” endorsement. HF 1163would allow for a background check tobe conducted by the BCA, the FBI, ora private source acceptable to theCommissioner. The bill also would

allow the Commissioner to issue a 180day temporary license to an otherwisequalified candidate with a sworn affi-davit stating they have not been con-victed of a disqualifying offense. DVShas testified in three committee hear-ings, stating that the backlogs havebeen corrected, this proposal will cre-ate an excess paper burden, and 180days is too long – even though the 180days is allowed currently for individu-als having not resided in Minnesota forthe last 5 years. HF1163 is awaitingaction on the House Floor and in theState Senate.

MSBOA’s second proposal to helpalleviate licensing delays is to make iteasier to become and maintain certifi-cation as a 3rd party tester for CDLskills and roads tests, allowing forcompanies to test other school buscompanies’ employees (as is the casefor school districts.) Driver and Vehi-cle Services (DVS) has concerns withHF 1164 citing cases of fraud in otherStates, however in Wisconsin andSouth Dakota only vendors provideroad and skills tests. DVS claims thebill would require them to hire 1.5 moreemployees ($250K for two years) andassumes the program will double insize. DVS said that they are going tooffer more hours of service at the test-ing stations, but did not say where thatmoney was coming from.

The testing bill passed out to theHouse Floor, meeting deadline, andwas also laid over for possible inclu-sion in the Trans Omnibus Bill. DVSsaid that they will commit to havingtests occur within 14 days. Additional-ly, DVS has changed the policy that aBCA check is valid for 90 days, not theprevious 45 days.

As introduced a drivercould only be fined when a driver failsto wear a seat belt, and for each pas-senger not wearing a seat belt. Thebill would have amended the law to “a”single ticket, not including driver forany or all passengers not wear seatbelts nor would the driver be subject toany fine for passengers under the ageof 15 not wearing seat belts. Ultimate-ly, the bill was amended to not applyseat belt use to a school bus, includinga TyPE III vehicle, a Head Start bus,including a TyPE III Head Start Vehi-cle. The future of this proposal isuncertain.

The Safety and Compliance Outreach meetings will be held throughout the state this March – April. The Outreach meet-ings cover Driver File Requirements, Drug and Alcohol Testing, Post Crash Follow Up, The Commercial Learner’s Permit andInspection Issues. These meetings were designed to be respectful of staff time and occur mid-day – hopefully betweenroutes for many of you. They are ideal for your safety director and dispatchers. The One Day Stop Arm Check will be held April 22nd in Minnesota. Please take the time to take part in this survey. TheMSBOA has worked for the last two legislative sessions on strengthening the stop arm law. We utilize this data while talkingwith legislators and other decision makers.

The Minnesota School Bus Road-e-o – Will be held in Arden Hills on May 30th. During this current driver shortage utiliz-ing events such as this could benefit driver retention. Showing that you are proud of and support your drivers go a long waytoward overall employee satisfaction. you no longer need a team of drivers. The MSBOA Summer Conference – June 14-16 – Ruttger’s Sugar Lake Lodge – The full agenda is up on the website! Thisconference is a great opportunity to network with your fellow school bus professionals. Sometimes the most meaningfullearning opportunities happen while you have a chance to ask other transportation companies handle issues that are occur-ring to you right now.

We offer opportunities to talk with various vendors, the State Patrol, Driver and Vehicle Services, Tom Revnew – Legal Coun-sel and this year Tom Keliher will be doing a Legislative 101 session. If you’ve always wanted to know more about what hap-pens at the Capitol but were afraid to ask, this session is for you. We are currently working on a media plan for individualcompanies that we hope to unveil. Stay tuned!!

Sadly this week, there were two incidents in Georgia and Florida where parents and other adults got onto a school bus andstabbed or beat a student on the school bus. As a training reminder, we have our “Unauthorized Rider” DVD available onour website as well as the training guide. Make sure your drivers understand how to handle school bus boarding attempts.

We have also converted our Stop and Stay Stopped video to DVD. This is a great intro video for new drivers as well as forthe general public. The Pre-Trip Inspection Video may be helpful if your new drivers are struggling with the Pre-Trip inspec-tion.

The Minnesota Association of Pupil Transportation (MAPT) has introduced a bill to provide a specific penalty for interferingwith a school bus on route or trespass on a school bus. Specifically the bill proposes that a person who boards a school buswhen the bus is on its route or otherwise in operation, or while it has children in it, and who refuses to leave the bus ondemand of the bus operator is guilty of a misdemeanor. This provision would not apply to a child or school volunteer autho-rized to be on the school bus. This bill has missed deadline and may be considered in 2016.

The Bemidji area legislators have again introduced proposals to provide “transportation sparsity aid” to certain rural schooldistricts. Some rural districts, Bemidji is a prime example, have a large geographic district with low student populations. Oneof the proposals attempts to solve this problem for many rural school districts ($60 million or more) with a second proposalto solve the problem for few districts ($6 million or less.) The second, smaller, proposal is the one they are pursuing. Itsfuture funding is uncertain.

Over the next 4 weeks Legislators will finalize their budget and spending priorities. Factions within the DFL Senate want tocreate a “wholesale” motor fuels tax, and spend much of the surplus. Others in the Senate want to save much of the sur-plus and spend sparingly on k-12 education priorities, Higher Ed, and possibly a pre-kindergarten program. The House GOPappears to wish to give the majority of surplus back to taxpayers and find funds for transportation and rural nursing homes.So for the next 8 weeks, 2015 Legislative Session must be completed by May 18th, members of the Legislature and the Gov-ernor will be shopping their favorite uses for the surplus and the design of spending pri-orities. On March 3, 2015, Holly Hoglund Klein, President of Hoglund Bus Co., Inc. tragi-cally lost her life in an automobile crash. Holly leaves behind a loving husband, 3young children, parents Wayne and Lisa Hoglund, 3 siblings and spouses and theirfamilies, and her family of Hoglund Employees.

Holly had joined Hoglund Bus Co., Inc. with her parents, Wayne and Lisa Hoglundin 1999 to become a third generation Hoglund in the school transportation industry.Holly became President and Owner of Hoglund Companies in 2011.

“As President and Owner, Holly led an era of expansion and growth for the Hoglund Companies. She grew their sales terri-

tory in Minnesota and Iowa, taking on several new product lines, and expanded the Commercial Bus Sales into Wisconsin as

well. She opened satellite service locations in Roseville and Lakeville. In 2007 she helped found a new company, Hoglund

Body and Equipment, opening a full-service bus and truck body shop. During her 15 years with the company, Holly's leader-

ship has overseen growth from a local bus dealer with 40 employees to a regional leader in the transportation industry

approaching nearly 90 employees. Holly's crowning achievement was overseeing Hoglund's awarding of 2013 National Deal-

er of the Year for IC/Navistar.”

Holly was a great supporter of MSBOA functions and activities. A conference or special project never went by without Hollycalling to see if there was any way Hoglund Companies could help or contribute. Holly graciously shared her great ideas forengaging people and was a wonderful resource for making events memorable. We will miss her and the time she spent withus at conferences or getting together for lunch.

Holly Hoglund Klein was a beautiful person inside and out. She put so much energy into everything she was a part of - herfamily, her business, her church, and the schools her children attended. She was passionate about the school bus industryand was constantly working on improving herself, her business, and the industry as a whole. She founded WIT (Women InTransportation) and held monthly events for women in the industry that were educational, motivational, and enjoyable. Hollywas a tremendous example of someone who wanted to lift up others. She could have easily just enjoyed her own success,but she truly wanted to see others succeed.

It seems impossibly unfair that someone with such a keen eye to the future could be taken from us so suddenly. Our heartsare broken, but we know Holly’s vision for the future will live on through the many lives she has touched.

Please keep the Hoglund & Klein families in your thoughts and prayers.

The world of labor and employment law is constantly changing. The following is a summary ofsome of the more notable changes under federal law as well as a summary of recent enforcement statistics.

Quickie Elections:On April 15, 2015, the NLRB’s quickie election rules will take effect. Under these new rules, an election could take place asquickly as 10 days from the date a representation petition is filed with the NLRB. While Congress passed a law to repealthe quickie election rule, President Obama has promised to veto the law. Further, while litigation is pending in WashingtonD.C., in which ABC and other trade associations are challenging this law, a court decision striking down the regulation is notexpected immediately. As such, Seaton Peters & Revnew recommends that contractors take proactive steps now to pre-pare for and respond to these new election rules by educating supervisors and employees on the pitfalls of being union.

FMLA Regulations Updated: On February 25, 2015, the U.S. Department of Labor revised the FMLA regulations to expandthe definition of spouse for leave purposes. Employees in same-sex marriages – regardless of where they live – will havethe same rights to benefits under the FMLA. The federal FMLA applies to employees with 50 or more employees. SeatonPeters & Revnew recommends that MSBOA members update their FMLA policies as a result of this new regulation.

EEOC Enforcement Declines: For the third-year in a row, the total number of charges filed with the EEOC dropped to 88,778.All categories of discrimination (i.e., race, age, gender, etc) reported a drop in 2014. Despite the drop, the EEOC hired morethan 300 employees in 2014 who will be dedicated to investigations.

FLSA Enforcement: In late February, the Department of Labor published its wage and hour enforcement statistics for 2014.

The following are notable changes:• Back Wages: decline to $240,831,606 from $249,954,412• Employees Receiving Back Wages: increase to 270,570 from 269,250• Complaints Registered: decline to 22,557 from 25,628• Enforcement Hours: decline to 1,188,531 from 1,339,029• Average Days to Resolve Complaint: increase to 116 from 110• Overtime Violation Cases: decline to 11,238 from 12,108• Overtime Back Wages: increase to $136,239,001 from $130,703,222• FMLA Complaint Cases: decline to 1,502 from 1,634• FMLA No Violation Cases: decline to 809 from 890

In sum, despite hiring 150 additional investigators in 2009, Wage/Hour enforcementstatistics have been on a steady decline since 2010 in many areas. Despite this drop,MSBOA members should carefully review their wage and hour compliance to avoidpotential litigation.

Teamsters Oversight Ends: On February 17, 2015 a federal judge approved a settle-ment that will phase out and end the government’s oversight and 25-year consentdecree to keep mob influence out of the 1.4 million-member union. The oversight willofficially end in 2020. In the settlement, the Teamsters agreed to internal electionreforms for their next two elections (2016 and 2021) that were put in place in 2001.

As most of you are already aware, Owner and President of Hoglund Bus Co., Inc.Holly Hoglund Klein was taken from us unexpectedly earlier this month. Active in thebusiness since 1999, Holly officially took over as owner from us, Wayne and LisaHoglund (her parents and current Board Members) in 2011. While we are delightedthat Holly was very successful in taking over as a third-generation business owner, andwe share the heavy burden of her loss with all of you, we are determined to continueHolly’s legacy in making Hoglund Bus Co., Inc. successful for generations to come.

To that end, we are working closely with Holly’s husband Tom Klein to continue oper-ations in the same manner, in fufillment of Holly’s vision, and provide a seamless tran-sition of leadership. As you know, we are very experienced in the business of trans-portation, and successfully ran Hoglund Bus Co., Inc. for 31 years, as well as severalother transportation entities. We are confident that Holly’s loss will not change Holly’svision, and Hoglund Bus Co., Inc. will continue as a leader in the transportation indus-try.
