    Purpose

    To ensure:(a) class 1 and class 2buildings are energy and water efficient;(b) air-conditionersinstalled in class 110buildings are energy efficient;(c) the electricity supplied to each meterable premises is able to be measured

    appropriately; and

    (d) end of trip facilitiesare provided in major developmentslocatedin designated localgovernment areas.

    Commencement

    This version of Mandatory Part (MP) 4.1:

    (a) commences on 8 July 2011;and(b) replaces the version of MP 4.1 published on 12 November 2010.

    Application

    (1) This part applies to the lawful carrying out of building work as indicated by ticks() in the relevant columns in Table 1 below, subject to (2).

    (2) This part and the relevant BCA provisionsdo not apply to the lawful carryingout of building work1 to a class 1 building where:(a) any of the following applies:

    (i) a building certifier has, by written notice given to the owner,certified that the building has been affected by a flood or stormsurge; or

    (ii) the building is located in a natural hazard management area(flood); or

    (iii) a local government has, by written notice given to the owner or

    notice published on the local governments website, declared thatthe building is likely to be affected by a future flood or stormsurge; and

    (b) a building certifier certifies the work is, or directly relates to, raising thebuilding.

    Note: Reference should also be made to sections 36, 37, 61 and 81 of the Building Act 1975, whichmay affect the application of MP 4.1.

    Definitions

    Note: Italicisedwords in the text of the part are as defined below.

    Acceptable solutionmeans a relevant building solution which is deemed to satisfythe relevant performance criterion for the purposes of section 14 (4) (a) (ii) of theBuilding Act 1975.

    Air-conditioner, for the purposes of P6 and A6,means a single-phase or 3-phaseair-conditioner of the vapour compression type for which a Minimum EnergyPerformance Standard (MEPS) applies under AS/NZS 3823.2.

    Alterationhas the meaning given in the Building Act 1975.

    BCA has the meaning given in the Building Act 1975unless a particular edition of theBuilding Code of Australia published by the Australian Building Codes Board, includingany amendments published by the board for that year, is specified (for example BCA2009).

    Bicyclemeans a two-wheeled vehicle designed to be propelled by human power andwith overall dimensions within those specified by AS 2890.3:1993.

    Bicycle parking and storage facilitymeans an area or structure used for parking,storage or securing of bicycles, which provides a level of security for the bicycle inaccordance with the security classifications provided in AS 2890.3:1993 (includingmodifications as specified in Schedule 2).

    Change roommeans a room where an occupantis able to change clothes in privacy,either individually or on a gender basis and that contains washbasins, mirrors,showersand sanitary compartments.

    Classes 1 to 10has the meaning given in the BCA.

    Climate zonehas the meaning given in the BCA.

    Commercial office buildingmeans a class 5building as classified under the BCA.

    Common areameans an area of common property.

    Common propertymeans the lot allocated to the body corporate for the communitytitles scheme.

    Community titles scheme has the meaning given in section 10 of the BodyCorporate and Community Management Act 1997.

    Customerhas the meaning given in the Electricity Act 1994.

    Designated local government areameansa) the area of the local governments identified in Schedule 1; orb) for local governments not identified in Schedule 1:

    (i) the area identified in a local government planning scheme as a designatedlocal government areafor the purpose of this code; or(ii) the area identified by a local government resolution as a designated local

    government areafor the purpose of this code where notice of the resolutionis published:(A) in a newspaper that is circulating generally in the local government

    area; and(B) on the local governments website.

    Domestic serviceshas the meaning given in the BCA.

    Electricity includes electric current, electrical energy and the like, and any relatedphysical qualities.

    Electricity meter means a device that measures and records the production orconsumption of electricity.

    Electricity sub-metermeans a device thatmeasures and records the production orconsumption of electricitythat either:

    a) is a minimum accuracy class 1 under AS62053.21:2005; orb) complies with AS1284.1:2004.

    Employeehas the meaning given in the Industrial Relations Act 1999.

    End of trip facilitymeans a facility within a building or on-site that is required to beconstructed in compliance with P13(1) of this part.

    Energy Efficiency Ratio (EER), for an air conditioner, means the air conditionersaverage energy efficiency ratio for cooling determined as a result of testing under astandard for testing and rating for performance stated in AS/NZS 3823.2.

    Energy efficient lighting is lighting with a minimum output of 27 lumens per Wattand excludes a heat lamp used in a bathroom for the purposes of radiating heat.

    Entrancemeans a main path into a building that is not for emergency use.

    Floor areahas thesame meaning as given in the BCA.

    Full time equivalents for workforce numbers includes full time aggregates of part-time and casual employeehours.

    Hospitalmeans a class 9abuilding as classified under the BCA.

    Installationmeans, for an air-conditioner, placing in position for use in the buildingand includes connecting to the buildings electrical wiring either directly by apermanently fixed connection or by using a plug to access a general purpose outlet.

    Lockermeans a compartment for storage that can be securely locked.

    Major additionmeans any addition to an existing major developmentthat results inadditional floor areaof at least 1000m2.

    Major developmentmeans a:a) commercial office buildingwith a floor areagreater than 2000m2; orb) shopping centrewith a floor areagreater than 2000m2; orc) tertiary educational facilitywith a floor areagreater than 2000m2; ord) hospitalwith a floor areagreater than 2000m2; ore) development specified in a local government planning scheme as a major

    development for the purposes of QDC MP 4.1

    Note: Local governments may specify additional development to be major development.

    Meter labelmeans a label of white heat-resistant material with black lettering fixed by

    means of screws, rivets or glue that clearly identifies each meterable premise.

    Meterable premisesmeans:a) the sole occupancy unit of a class 2 or class 5 building that is or will be

    connected to a supply of electricity, except where a sole occupancy unitof aclass 2or class 5buildinghas or will have an electricitymeteras a customerofa retail entityor special approval holder;or

    b) each storeyof a class 5building that is or will be connected to a supply ofelectricity where more than one sole occupancy unit for that storeyhas notbeen identified at the time of the buildings development approval for buildingwork, except where a storeyof a class 5building has or will have an electricity

    meteras a customerof a retail entityor special approval holder.

    Natural hazard management area (flood) means an area designated as a naturalhazard management area (flood) by a local government under the Building Regulation2006, section 13.

    Newmeans newbuilding work and does not include renovationsto existing buildings.

    Occupantsmeans the number of persons accommodated in the building, as calculatedin accordance with BCA Volume One Table D1.13 (Area per person) and for thepurposes of calculating occupants in Schedule 3, hospital means patient care areas,

    shopping centre means shop, tertiary education facility means school andcommercial office building means office.

    Other renovationmeans any alterationor addition to an existing class 1 building orthe sole occupancy unitof a class 2building which requires a building developmentapproval and a plumbing approval.

    Outdoor living areameans a space that:

    a) is directly accessible from, and attached to, a living area of the building suchas a lounge, kitchen, dining and family rooms; and

    b) has a minimum floor areaof 12.0 square metres and a minimum dimension inall directions of 2.5 metres; and

    c) is fully covered by an impervious roof; and

    d) has:

    (i) for class 1 buildings - two or more sides open or capable of being readilyopened, not including the connection between the internal living area andthe outdoor living area; or

    (ii) for class 2buildings - at least one side open or capable of being readilyopened, not including the connection between the internal living area andthe outdoor living area.

    Performance requirementhas the meaning given in the Building Act 1975.

    Plumbing approval means the compliance assessment processes, compliancepermit or compliance certificate, under sections 78 and 79 of the Plumbing andDrainage Act 2002 for ensuring that plumbing, drainage and on-site seweragesystems complies with the Plumbing and Drainage Act 2002and Standard Plumbing

    and Drainage Regulation 2003.

    Relevant BCA provisionsmeans section 3.12 in Volume Two of the BCA.

    Renovationmeans any alterationor addition to an existing class 1 building or thesole occupancy unitof a class 2building requiring building development approval.

    Retail entityhas the meaning given in the Electricity Act 1994.

    Sanitary compartmenthas the meaning given in the BCA.

    Shopping centremeans premises comprising two or more individual tenancies that iscomprised primarily of shops and which function as an integrated complex.

    Showermeans a separate and lockable compartment equipped with a showerhead.

    Special approval holderhas the meaning given in the Electricity Act 1994.

    Software ratingmeans an energy rating under the Nationwide House Energy RatingScheme using a calculation method that complies with the Australian Building CodesBoard Protocol for Houses Energy Rating Software.

    Sole occupancy unithas the meaning given in the BCA.

    Standardmeans the edition of Australian Standard AS/NZS 3823.2, AS 62053.21,AS 1284.1 and AS 2890.3 referenced by this part.

    Storeyhas the meaning given in the BCA.

    Tertiary educational facilitymeans a class 9bbuilding that is in a university, college orsimilar establishment and does not include a primary or secondary school.

    Total R-Valuehas the meaning given in the BCA.

    Unisexdesignis suitable for any gender.

    Water serviceis defined by the Water Supply (Safety and Reliability) Act 2008.

    Water service providerfor premises, means the person registered under the Water

    Supply (Safety and Reliability) Act 2008, chapter 2, part 3, as the water serviceproviderfor retail water servicesfor the premises.

    Workforce numbers means the number of day time employees that are full timeequivalents.

    Energy Efficiency class1 buildings

    P1 The thermal performance of aclass 1 building and anenclosed class 10a buildingattached to a class 1 buildingmust comply with performancerequirement P2.6.1 of theBCA 2010 (Volume 2).

    A1 (1) A class 1 building, including anenclosed class 10a buildingattached to a class 1 building,complies with:

    (a) parts 3.12.1, 3.12.2, 3.12.3,and 3.12.4 of the BCA 2010(Volume 2) except, forbuildings in climate zones 1and 2, disregard 3.12.1.5(a)(i)and (iii); or

    (b) verification using a referencebuilding in accordance withV2.6.2.2 of the BCA 2010(Volume 2); or

    (c) a software rating of not lessthan 6 stars; or

    (d) in climate zones1, 2 and 5, acombination of a softwarerating of not less than 4.5stars and a nominal creditobtained under (2) to reach atotal of 6 stars; or

    (e) in climate zone 3, acombination of a softwareratingof not less than 5 starsand a nominal credit obtainedunder (2) to reach a total of 6stars; or

    (f) part 3.12 of the BCA 2009(Volume 2), where a nominalcredit of not less than 1 star isobtained under (2).

    (2) For the purposes of (1)(d)-(f) thefollowing nominal credits apply:

    (a) 0.5 star where a buildingincludes an outdoor livingarea, the roof covering ofwhich achieves a Total R-Value of at least 1.5 fordownward heat flow;

    (b) 1 star where a buildingincludes an outdoor livingarea the roof covering ofwhich achieves a Total R-Value of at least 1.5 for

    of not less than 900 mm;

    (c) 1 star where a building has asolar photovoltaic system ofat least 1kW in capacity(maximum power output) isinstalled.

    Energy Efficiency class2buildings

    P2 The thermal performance ofsole occupancy units inclass 2 buildings complieswith performance requirementJP1 of the BCA 2009(Volume 1).

    A2 (1) The thermal performance of soleoccupancy unitsin class 2buildingscomplies with JV1 of the BCA 2009(Volume 1) except that:

    (a) for JV1(a)(i) each soleoccupancy unit has a softwarerating of not less than 4 stars;and

    (b) for JV1(a)(ii) the averagesoftware rating of all soleoccupancy unitsis not less than

    5 star; and(c) the deemed to satisfyprovisions of Section J of theBCA 2009 (Volume 1) have noeffect for sole occupancy units.

    (2) For the purposes of calculating theaverage software rating underA2(1)(b) of all sole occupancy unitsof a class 2 building in climatezones 1 or 2 the following creditsapply towards the software rating

    for each sole occupancy unit:

    (a) 0.5 star where a soleoccupancy unit includes anoutdoor living area, the roofcovering of which achieves aTotal R-Value of 1.5 fordownward heat flow; or

    (b) 1 star where a sole occupancyunit includes an outdoor livingarea that has at least onepermanently fixed ceiling fan

    with a speed controller and ablade rotation diameter of notless than 900mm and the roof

    (3) To achieve a credit under A2

    (2)(b) an air-conditioner thatservices any room directlyadjacent to an outdoor livingarea must automatically shutdown when an external doorthat provides access to theoutdoor living area is open formore than 1 minute.

    Energy Efficient DomesticServicesand air-conditioners

    P3 For class 1 buildings and anenclosed class 10a buildingattached to a class 1 building,artificial lighting complies withperformance requirementP2.6.2(a) of BCA 2010(Volume 2)

    A3 Class 1 buildings, including a verandah,balcony or an enclosed class 10abuilding attached to a class 1 building,have:

    (a) artificial lighting that complies withPart 3.12.5.5 of BCA 2010(Volume 2); or

    (b) energy efficient lighting for a

    minimum of 80 per cent of totalfixed artificial lighting.

    P4 In sole occupancy units ofclass 2buildings fixed artificiallighting must be energyefficient.

    A4 Sole occupancy units of class 2buildings, including a verandah,balcony or an enclosed class 10abuilding attached to a class 2building,have energy efficient lighting for aminimum of 80 per cent of total fixedartificial lighting.

    P5 For class 1 buildings hot water

    systems comply with theQueensland Plumbing andWastewater Code.

    A5 For hot water systems for a class 1

    building:(c) disregard BCA 2010 (Volume 2)

    3.12.5.6; and instead(d) comply with the Queensland

    Plumbing and Wastewater Code.

    P6 Replacement and new air-conditioners installed in class1-10buildings must be energyefficient.

    A6 In class 1-10 buildings, new andreplacement air-conditioners with anEERmust have an EERof at least 2.9.

    Water Conservation

    P7 In class 1 and class 2buildings, in areas serviced bya water service provider,

    shower roses must facilitatethe efficient use of water.

    A7 In class 1 and class 2 buildings, inareas serviced by a water serviceprovider, all shower roses have a

    minimum 3-star Water EfficiencyLabelling and Standardsrating.

    Note: Water Efficiency Labelling and Standards(WELS) references the Australian Governmentslabelling and standards scheme for water efficientproducts.

    P8 In class 1 and class 2buildings, in areas serviced bya water service provider, toiletcisterns and bowls mustfacilitate the efficient use ofwater.

    A8 In class 1 and class 2 buildings, inareas serviced by a water serviceprovider, all toilet cisterns:

    (a) have a dual flush function andhave a minimum 4-star Water

    Efficiency Labelling and Standardsrating; and

    (b) are compatible with the size of thetoilet bowl to allow for properfunctioning of the toilet.

    P9 In class 1 and class 2buildings, in areas serviced bya water service provider, tapware must facilitate theefficient use of water.

    A9 In class 1 and class 2 buildings, inareas serviced by a water serviceprovider, tap ware with a minimum 3-star Water Efficiency Labelling andStandards rating serves:

    (a) laundry tubs; and

    (b) kitchen sinks; and

    (c) basins.

    Electricity Sub-metering

    P10 The electricity supplied toeach meterable premises isable to be measured.

    A10 Each meterable premises has anelectricity sub-meter installed whichmeasures only the electricity supplied

    to that meterable premises.

    P11 An electricity meter must belocated so it is easy and safeto read and maintain at anyreasonable time.

    A11 The electricity sub-meteris:(a) installed in a common area;and(b) free of hindrance or obstruction to

    a person authorised to read and/ormaintain the electricity sub-meter.

    P12 The electricity meter for eachmeterable premises must belabelled to indicate whichmeterable premises it is

    associated with.

    A12 A meter label identifying whichmeterable premisesit is associated withis affixed or located adjacent to theelectricity sub-meterfor each meterable

    premises.

    End of Trip Facilities

    P13 (1) End of trip facilitiesareprovided for employeesoroccupants, in the buildingor on-site within areasonable walkingdistance, and include:

    (a) adequate bicycleparking and storagefacilities; and

    (b) adequate provision forsecuring belongings;and

    (c) change roomsthatinclude adequateshowers, sanitary

    compartments, washbasins and mirrors.

    (2) Notwithstanding (1) thereis no requirement toprovide end of tripfacilities if it would beunreasonable to providethese facilities havingregard to:

    (a) the projectedpopulation growth and

    forward planning forroad upgrading anddevelopment of cyclepaths; or

    (b) whether it would bepractical to commuteto and from thebuilding on a bicycle,having regard to thelikely commutedistances and natureof the terrain; or

    (c) the condition of theroad and the natureand amount of trafficpotentially affecting thesafety of commuters.

    A13 (1) Bicycle parking and storagefacilitiesare:

    (a) easily accessible and provided inthe building, or on-site within 100metres of an entrance to thebuilding, in accordance with:(i) five percent (5%) of the

    number of employees, basedon workforce numbers; or

    (ii) the occupant ratios inSchedule 3 (rounded up tothe nearest whole number);and

    (b) designed and constructed in

    compliance with AS2890.3:1993 (includingmodifications as specified inSchedule 2).

    (2) Lockersare:

    (a) provided in the building, or on-site within 100 metres of anentrance to the building, on a1.6:1 ratio for every bicycleparking space; and

    (b) co-located or located within 50metres of change roomsrequiredby A13(3) of this part; and

    (c) provided with minimumdimensions of 900mm (height) x300mm (width) x 450mm (depth).

    (3) Change rooms:

    (a) are provided in the building, oron-site within 100 metres of anentrance to the building and

    comply with Schedule 4, TableA, Column B; andi) are fitted with a lockable door

    or otherwise screened frompublic view; and

    ii) are located within 100 metresof bicycle parking andstorage facilities required byA13(1) of this part if thebicycle parking and storagefacilities and change roomsare not located in the

    building.

    (4) Change roomsprovide:

    (ii) are constructed incompliance with F2.3 (e) andF2.5 of BCA (Volume One);and

    (c) wash basins that are locatedwithin change rooms and meetSchedule 4, Table A, Column E;and

    (d) a mirror located above washbasins; and

    (e) a hook and bench seatinglocated within each showercompartment; and

    (f) a socket-outlet located adjacentto each wash basin.

    (5) Where change room requirementsare predominantly located in acarpark or on a basement floor thatis not regularly used by occupantsoremployees, they may not be countedtowards the requirements of theBCA, Volume One Part F2.

    (6) Notwithstanding ((1), (2), (3) & (4)),a local government planningscheme may require additional

    bicycle parking and storagefacilities, locker facilities, changerooms, showers, sanitarycompartments, wash basins andmirrors.
