QWRQualified Written Request

A Qualified Written Request (QWR) is a written correspondence that you, or someone acting on your behalf, can send to your mortgage servicer. The purpose of a QWR is to dispute an error relating to the servicing of your mortgage loan or to request information about the servicing of your mortgage loan. The MEI QWR is powerful, unlike most have ever seen. This QWR has lawful ramifications for any servicer/lender who answers as it must be in Affidavit form and a Notary Presentment is used, as well as a responsibility to Common Law Offices of America. AFFIDAVITS of TRUTH/FACTSAn Affidavit is a written sworn statement of fact voluntarily made by an affiant or deponent under an oath or affirmation administered by a person authorized to do so by law. Such statement is witnessed as to the authenticity of the affiant's signature by a taker of oaths, such as a notary public or commissioner of oaths. The name is Medieval Latin for he/she has declared upon oath. An affidavit is a type of verified statement or showing, or in other words, it contains a verification, meaning it is under oath or penalty of perjury, and this serves as evidence to its veracity and is required for court proceedings. NEW DEED OF TRUSTMORTGAGE SERVICING AGREEMENT

Your new Deed of Trust/Mortgage Servicing Agreement puts you in the drivers seat. You are the secured party, beneficiary and your legal fiction entity is the debtor. MEI is a secured party and Mortgagee. The alleged Mortgagee on your current obligation never had a meeting of the minds with you. If you thought you were getting a mortgage, you were not. NOTICESIn general, notice deals with information that a party knows or should have known. In this context notice is an essential element of due process. Notice can also refer to commonly known facts that a court or Administrative Agency may take into evidence.Actual notice is information given to the party directly. The two kinds of actual notice are express notice and implied notice. An individual is deemed to have been given express notice when he or she actually hears it or reads it. Implied notice is deduced or inferred from the circumstances rather than from direct or explicit words. Courts will treat such information as though actual notice had been given.Constructive notice is information that a court deems that an individual should have known. According to a Rule of Law that applies in such cases, the court will presume that a person knows the information because she could have been informed if proper diligence had been exercised. The MEI process includes giving notice within your Affidavits of fact and recording those facts with your new documents and giving notice by way of police reports. Remember, Affidavits must be rebutted by Affidavits.

TIME TO START THE PAPERWORKUltimately the choice to use or not to use the MEI process to save your property is up to you. We are not going to convince you or talk you into this. The process is working, we have filed them in multiple jurisdictions. The county recorders offices have not wanted to record many of our clients documents, but after review from their legal teams, with the knowledge that this process has gone through the national mortgage fraud prevention team in Georgia, and with the recognition that the process is lawful, they record them. This process takes the profit out of the pockets of the judiciary, attorneys and court clerks to steal your home.
