Instead of adding to traffic congestion, Rose likes to run errands on her bicycle, making more parking available for others. But that’s the problem. While drivers may have a secure place to park their cars, Rose doesn’t believe there are enough safe locations to properly lock up her bike, so she either avoids Downtown or takes her car. Now he wanted to get paid. As a lawyer in her office’s civil division, it was Kanoff’s job to defend City Hall against the allegations. She followed her normal routine, locating the video tape from the bus system’s on-board surveillance system that showed the incident in question. The plaintiff, David Hamodot, claimed in court papers he had been “thrown to the ground” by the bus door, causing him pain and suffering that required “extensive med- ical and chiropractic” care. CITY HALL When it landed on her desk, thecase was like scores of others that DebraKanoff has handled during her nearly three-decade career in the Santa Monica CityAttorney’s Office: A man who had boarded aBig Blue Bus claimed he’d been injuredwhen the driver closed the door on him.Now he wanted to get paid.

LOS ANGELES You don’t typically hearSouthern Californians rhapsodize about afreeway.

But the 8.2-mile route betweenDowntown Los Angeles and suburbanPasadena isn’t typical.

Opened in 1940, the oldest freeway inthe West follows the meanders of theArroyo Seco wash past parks and lushembankments, and under bridges andthrough tunnels built with the elegance of abygone era.

Known variously as the Arroyo SecoParkway, the Pasadena Freeway or simply“the 110,” it also carries motorists past someof the city’s oldest — and toughest — neigh-borhoods as its tight curves open and closeviews of mountain peaks and skyscrapers.

Squinting to shut out thoroughly mod-ern gang graffiti and the mangled plasticdebris of 21st century auto mashups, it’sstill possible to envision a Ford Model Awending its way to Los Angeles or a statelyGeneral Motors LaSalle carrying an oilbaron home to one of the old school man-sions of Pasadena.

That’s why preservationists are cryingfoul over the freeway’s first major improve-ment project in 70 years, a $17 million effortto line the original six miles of the route withnew concrete barriers and lighting.

They complain that the work willremove historic features that define itscharacter and that the additions don’t havea sufficiently authentic appearance.

“The Arroyo Seco Parkway is a real gem.I don’t think people fully appreciate that yetand I think they’ll regret the damage that’sbeing caused,” said Paul Daniel Marriott,

author of “Saving Historic Roads.”The route represents a transitional peri-

od in American highway constructionwhen planners were moving away from theparkways popularized on the East Coast forleisure driving to building roads for high-speed, efficient travel, Marriott said.

Its design melded lush landscaping withsix lanes allowing commuters to reachspeeds of 45 mph.

Many of its elements became prototypesfor the modern freeway, so much so that bythe 1950s, when Los Angeles was emergingas a car capital, the parkway’s name evolvedto the Pasadena Freeway.

“This is where we come from, this iswhere our freeways evolved from,” saidNicole Possert, a community activist lead-ing the preservation effort. “This was a test-ing ground for what was to become theCalifornia freeway system.”

THERE’S PROBABLY NO BETTER PLACE TOcatch up on the gossip than at a big commu-nity gathering. The Santa Monica Festival atClover Park on Saturday, May 8, was the per-fect venue.

It was a beautiful spring day, so CloverPark was packed with festival-goers. Localpoliticians and wanna-be politicos strolledthe exhibits and being that this is an electionyear, everyone wanted to talk. One topic oneveryone’s mind was the fall municipal elec-tions.

Some new faces may run for CityCouncil. I promised not to reveal one namebut she’s been active with numerous SantaMonica service organizations and her runfor the council dais could be very interest-ing.

All three council incumbents will seek re-election. Bob Holbrook, who has alreadyserved 20 years on the dais, will seek a sixthterm. Pam O’Connor previously said she isgoing for a fifth term and already has a cam-paign organization in place and is raisingmoney — primarily from developers andreal estate interests. Kevin McKeown, theNo. one vote getter in 2006, will seek afourth term.

The 2010 election is unique because thereare the usual three four-year seats up for re-election and two, two-year interim seats.With the passings of Herb Katz and KenGenser, two mid-term council seats areopen. Council candidates must specifywhether they’re running for two-year orfour-year seats.

Appointees Gleam Davis and TerryO’Day will have to come in first and secondamong candidates running for two-yearterms to serve out the last half of Katz’ andGenser’s terms. Rent Control CommissionerRobert Kronovet has already announced heis running for a two-year seat.

Davis and/or O’Day could also decide torun for a four-year seat instead and chal-lenge the three incumbents. It is generallybelieved that at least two of the three incum-bents are strong enough to easily holdtheir seats. With a large number of chal-lengers expected to run for the full terms,the odds may be better for those seeking thetwo-year seats, which may attract fewer chal-lengers.

Scuttlebutt is that O’Connor may not getthe Santa Monicans for Renters’ Rightsendorsement at their Annual Congress inearly August. Many City Hall watchers stillthink that if she doesn’t, she’ll jump ship andgo with a business-backed slate consisting ofO’Day and Holbrook. Veterandeveloper/hotel lobbyist and behind-the-scenes power player Kim Karie is hitting updevelopers, big hotels, real-estate interests

and other deep-pocket sources for bothO’Day and O’Connor, which portendsa large war chest for a business and develop-er-backed team.

On the other side, SMRR members willprobably endorse McKeown, Davis andJennifer Kennedy (currently on the RentControl Board) and/or planning commis-sioner Ted Winterer, who ran for council andfinished fifth in 2008. O’Day has friends inSMRR and he may try for the group’sendorsement, but I’m still hearing he won’tprevail. School board member Oscar de laTorre has announced he’s running for coun-cil, but word is that some SMRR leaderswant him to stay on school board for a thirdterm.

At Clover Park, the complaint heard mostoften was a condemnation of the SantaMonica-Malibu Unified School DistrictBoard of Education. There was a lot of talkabout finding candidates to retire BarrySnell, Kelly Pye and de la Torre, whose termsexpire this fall.

Chris Bley, who came in a close fourth forschool board in 2006, has been mentionedas electable if he should run again. I’ve heardfrom multiple sources that Community forExcellent Public Schools co-founder LaurieLieberman (wife of land-use attorney ChrisHarding) has said she’ll run for schoolboard. Lieberman and CEPS have been driv-ing forces behind most of the district’srecent bond and parcel tax measures.

MISINFORMATION DOES ME INLast week, I wrote that the Campaign for

Quality Public Schools parcel tax committeehad not filed “any financial disclosure state-ments” and was in violation of Fair PoliticalPractices Commission regulations.

I had been repeatedly told by both theFPPC and the L.A. County Registrar-Recorder/County Clerk the committee hadnot filed campaign statements.

I had also searched City Hall’s PublicAccess Portal and neither the name of thecommittee or their FPPC number came up.Knowing that the opposition “No on A”committee, had been instructed both by theFPPC and the county registrar to file withthe county, I went with the information Ihad believing it to be accurate.

To set the record straight, it now appearsthat information I received was wrong andthe CFQPS did file their disclosure state-ments as required by law, but with the SantaMonica City Clerk, after all. I regret the errorand regret having called their campaignpractices “sleazy” as a result of the misinfor-mation I had received.

The Santa Monica Daily Press deserves applause for itseditorial supporting Measure A, the local school fundingmeasure to protect our Santa Monica-Malibu schools. PTAmembers throughout our district believe that Measure A isabsolutely necessary to both protect the high quality edu-cation for local students and to ensure the fiscal integrityof our outstanding local public school system.

We have exceptional local schools in Santa Monica andMalibu. Our schools, however, are adversely affected by sig-nificant cuts in state funding to K-12 public education inrecent years. More than 70 percent of the district’s fundscome from the state; however, the state has cut an averageof $10 million per year over the past two years from fundsowed to our local schools. More revenue cuts are likely thisyear. As a result, we could lose up to one in eight of our out-standing teachers, lose counselors and librarians, increaseclass sizes, and cut back instruction in core academics, whichwill compromise the quality of schools in our community.

Measure A will provide the district about $5.8 mil-lion per year for five years. Measure A expenditures aresubject to citizen oversight and independent annualaudits. None of these funds can be used for administra-tor salaries. Most importantly, these locally generatedfunds cannot be taken away by the state.

Our district has excellent financial management prac-tices. PTA takes its role as an organization advocating forthe health, education and welfare of every child very seri-ously, and thus has representation at virtually all Board ofEducation meetings. The budget process is very transpar-ent in our district. This view is supported by the independ-ent citizens oversight watchdog, SMMUSD’s FinancialOversight Committee, as well as by the independentnational financial rating agencies including Standards &Poors, which has awarded the district one of the highestcredit ratings of any school district in California.

The coalition supporting Measure A is broad anddiverse — parents and teachers, senior citizens andyouth organizations, business and labor, and officials ofevery one of our neighborhood associations, along withhundreds of individual supporters.

“They’re not ready for the Arctic,” Kingiksaid from his home in Point Hope, 700 milesnorthwest of Anchorage.“It’s completely dif-ferent up here.”

Shell Oil two years ago spent $2.1 billionfor leases in the Chukchi, the arm of theArctic Ocean that the United States shareswith Russia, and the home to one ofAmerica’s two polar bear populations.

The federal Minerals ManagementService estimated the sale area contained 15billion barrels of conventionally recoverableoil and 77 trillion cubic feet of conventional-ly recoverable natural gas. Shell is poised tobegin exploratory drilling this summer onleases as far as 140 miles off shore.

Alaska Native groups and environmental-ists are hoping a judge or the Obama admin-istration will intervene.

Shell notched a significant court victorylast week when the 9th U.S. Circuit Court ofAppeals rejected consolidated lawsuits thatchallenged Minerals Management Serviceapproval of the oil company’s plans.

The court determined that the MMS metits obligations to consider the potentialthreat of exploratory drilling to wildlife andthe risk for disaster before it approved Shell’sArctic Ocean projects.

Shell spokesman Curtis Smith said the com-pany awaits appeals of required federal air per-mits before it can send its drilling ship north tothe Chukchi and Beaufort seas off Alaska’snorthwest and north coast. The company alsoneeds a final Interior Department blessing andauthorizations on several wildlife issues.

Alaska’s indigenous people and environ-mentalists say a catastrophic spill in theChukchi would leave the petroleum compa-ny without backup resources consideredroutine in the rest of the country.

The nearest Coast Guard base is Kodiak,more than 900 air miles away. Nearby coastalcommunities such as Point Hope are tiny andlack deep-water harbors and large airports.Cleanup assets are stationed at Prudhoe Bay,hundreds of miles away on Alaska’s northcoast. Unlike at Prince William Sound, wheremore than 300 fishing boats are under con-tract to lay down boom if another super-tanker hits a reef like the Exxon Valdez,there’s no one to call for local assistance.

If a blowout occurred late in the summer,it could be impossible for another rig to arriveand drill a relief well before the water freezes,

leaving a well to flow until it plugged itself orspill response vessels reached it the followingsummer, according to drilling opponents.

Shell’s 514-foot drilling ship, the FrontierDiscoverer, could be in place by July. Smithsaid Shell can drill safely and that it’s not fair todraw parallels between drilling in the relativelyshallow Chukchi and the Gulf of Mexico.

“The (Deepwater) Horizon was drillingin 5,000 feet of water to a depth of 18,000feet,” he said by e-mail. “The pressure theyencountered in the well is three to five timesgreater than what we expect to encounter inAlaska, where we will be drilling in 150 feetof water to a depth of roughly 10,000 feet.”

The difference in expected down-hole pres-sure, he said, gives Shell a higher safety margin.

“We would have significantly more time toidentify and respond to a downhole event,” hesaid. If its blowout preventer failed, theweight of drilling mud remaining in the wellwould effectively shut-off the well, he said.

Margaret Williams, a World WildlifeFund director in Anchorage, said,“The pointis it could happen. We saw the state-of-the-art technology go wrong in the gulf.”

The Minerals Management Service andShell have touted advances in Arctic oil spillresearch and cleanup in water choked withice. Williams said advances have not beentested outside of optimal lab and field condi-tions. Burning requires thick, pooled oil. Theability to detect and track oil in and under iceremains unproven, according to the WWF.

The Chukchi Sea, frozen most of the year,rarely offers optimal conditions.Summertime temperatures in the 40s andgale-force winds are common. Heavy fog canrestrict visibility.

Shell’s exploration plan states that thechances for a catastrophic spill are minimal.

"A large oil spill, such as a crude releasefrom a blowout, is extremely rare and notconsidered a reasonably foreseeable impact,”it said. The Minerals Management Serviceagreed, concluding, “the probability of alarge spill occurring during exploration isinsignificant.”

Rebecca Noblin, an Anchorage-basedattorney for the Center for BiologicalDiversity, said the analysis was dubious lastyear and without merit now.

“In light of the recent catastrophic oilspill occurring in the Gulf of Mexico fromBP’s exploration drilling, such a position isnow clearly untenable,” she said.

Smith said Shell is prepared for the worst-case scenario — a spill of 5,500 barrels perday. The company is accompanying the drillship with a flotilla of about a dozen boats,including a response vessel, a storage tanker,barges, skimmer vessels and a tug. Smithsaid Shell has invested hundreds of millionsof dollars in “response assets.”

an artist who paints in acrylics said thatdoing so is more eco-friendly than paintingin oils. I somehow doubt it. Aren’t acrylicspetroleum based? And aren’t some oilpaints made from natural materials?

OF COURSE, THERE ARE NO EASYanswers. There are environmental and healthissues with both oil and acrylic art paints.The big downside of oil paints is the paintthinner required to clean them up. Whilesome of the pigments in oil paint might betoxic or poisonous depending on color —reds, yellows, some blues and many whitesare produced using potentially toxic heavymetals — the paint itself is typically made offood-grade linseed oil, which could hardly bemore harmless to the environment (where itcame from, after all). But oil paint is notori-ously hard to clean up; getting those brushes,palettes and work areas clean requires the useof paint thinners, such as turpentine or min-eral spirits, that are not only potentially toxicif used improperly but give off noxious odorsand are highly flammable.

As for acrylic paints, they are water-basedso clean-up is a breeze: Just wash it down thedrain with some warm water, no paint thin-ner required. But acrylic paint is a petrole-um-derived polymer, i.e. plastic. While clean-ing it up might be easier than cleaning up oilpaints, do we really want to be rinsing plasticdown our drains? How good could this be forsurrounding ecosystems? The other negative,of course, is that just buying them con-tributes to our reliance on petroleum.

So what’s a green painter to do? Oneoption is to go for so-called water mixableoil paints that, according to manufacturerslike Grumbacher, appear and behave in thesame manner as traditional oil paints in

every aspect except when it comes to clean-up — like acrylics, they thin and clean upwith water instead of noxious chemicals.Water mixable oils are ideal for those sensi-tive to chemical fumes. Art supply chainUtrecht sells a wide variety of water mixableoil paints online and at its retail locationsacross the U.S.

If you must use traditional oil paints —many professional artists just prefer themfor their thickness, color brilliance and otherqualities — you can go with a brand thatpays attention to the environmental impactof its products and operations. Oregon-based Gamblin Artists Colors Company usesonly high-quality raw materials in its paints,avoiding preservatives that degrade the qual-ity and release chemicals. Gamsol, the com-pany’s paint thinner, uses mineral spiritsthat evaporate much more slowly than tur-pentine, which has a reputation for irritatingbreathing passages and inducing nausea.Every spring the company cleans its machin-ery, and instead of throwing the filter dustout, it recycles it and gives away tubes of theresulting gray paint free to artists throughretail locations, and hosts a contest for artcreated with the unique color.

Another way to go would be truly all-nat-ural. Berkeley, California-based GLOB craftsits paints from food-grade botanicalextracts, so it’s even safe for kids aged threeand older. Colored by real fruits, vegetables,flowers and spices, GLOB paints are all-nat-ural, non-toxic, and free of chemicals,parabens, petroleum and synthetic preserva-tives. The palette is limited to just six colors,but creative artists should be able to mix totheir heart’s content. The paints can be mailordered, and they come in a dry powderedformat, which saves weight, money andenergy when shipped — users add water andstart painting.

son bike racks are few and far between and most of the timethey are full.”

City Hall plans to change that. In the coming months, citytransportation officials will be installing over 400 bike racksthroughout the city, with more than 170 in Downtown,thanks to a $200,000 grant, said Annette Colfax, City Hall’stransportation demand program manager. The cash comesfrom Proposition C, a half-cent sales tax measure approvedby Los Angeles County voters in 1990 to fund critical trans-portation projects and programs.

In this fiscal year, approximately 172 bike racks areplanned for Downtown, including 50 racks on the ThirdStreet Promenade. Officials with the Bayside District Corp.,a public-private management company that overseasDowntown, will be working with city planners to find prop-er locations to install the racks and are taking input frombike riders, including members of Santa Monica Spoke.There’s also the question of which racks to purchase.

A large number will be located in the parking structuresadjacent to the mall, Colfax said. The racks will be secured bysome type of enclosure and those who park there will pur-chase for a nominal fee an access card to retrieve their bikes.Showers would also be installed for those commuting towork, she said.

Approximately another 250 racks are planned for otherareas in the city: Montana Avenue (25), Ocean Park (25), MainStreet (35), the Santa Monica Pier (35) and other locations (80).

Last week, 18 more racks were installed at the MainLibrary, replacing two parking spaces on the surface lot,Colfax said.

The key is to locate the racks in places that are conven-ient and where riders will feel comfortable, said BryanBeretta, a member of Santa Monica Spoke who uses hiscargo bike to get groceries. Riders want to leave their bikes inareas where there are a lot of eyes to watch over them. Ridersalmost prefer locking their bikes where they can see themand others, too. Lighting is also important at night as isproximity to businesses.

“You can’t have bike racks in alleys or in dark parkinggarages with low visibility,” Beretta said.

Some might think riders like Rose and Beretta are justparanoid, but the statistics prove they have reason to worryabout the safety of their bicycles, some of which can costthousands of dollars.

In April, there were 39 reported bicycle thefts comparedto 30 the year before. Over the first for months of 2010, therehave been 136 bicycles reported stolen, a 13 percent increasecompared to the same period in 2009, said Santa MonicaPolice Department’s Sgt. Jay Trisler.

The police department recommends bike riders purchase adurable “U-Lock” that can be secured around a tire, the bicycleframe and a rack. Small chains and more expensive “cable”locks have been easily cut, officers said.

“Maybe I get more involved, I don’tknow,” she said.

A graduate of UCLA and SouthwesternLaw School, when she decided to become anattorney Kanoff thought she’d defendwomen’s rights. Instead she ended up fight-ing on behalf of the Santa Monica PoliceDepartment, and she couldn’t be happier.

“I love my job,” she said. “I get to do theright thing. If I think that the city shouldprevail in a case I can go all the way to trial.If I think the city maybe messed up or therewas a problem, I can settle the case.”
