Ms. Allyson Burden, 6254 - 134A Street, was present to speak in favour of this application. Ms. Burdencommented that when she moved into the area she was told that the development of this property was subject toa Restrictive Covenant that would keep any building in line with the existing homes in Heritage Woods. She

encouraged Council to approve the By-law.

Councillor Watkins commented that the house in question is not that large. Ms. Burden agreed that it is not toolarge but added that neither is it compatible with the neighbourhood. She added that the home has the capacityof containing an illegal suite.

Councillor Huot questioned if the home is within the confines of the Heritage Woods subdivision. It was notedthat this lot is in the interface between the homes in Heritage Woods and the larger single family lots to thenorth.

Mr. Raghbir Ray Mand, 12609 - 55 Avenue, was present to speak in opposition to this application. Mr. RayMand advised that he is a realtor is Surrey and expressed concern with respect to the proposed reduction inFloor Area Ratio. He pointed out that often townhomes are 2,000 sq.ft. and commented that it is difficult to sellsmaller homes. He referenced difficulty associated with trying to sell homes in Vancouver that are only1,400 sq.ft.

Mr. Ray Mand then submitted a petition signed by residents in the neighbourhood who are opposed to therezoning.

In response to questions from Council, it was noted that the liveable space of the home would be 1,650 squarefeet.

Mr. Pritpaul Dhaliwal, 12561 - 56 Avenue, was present to speak in opposition to this application. He advisedthat he is representing Mr. Saini, the owner of the property in question. He stated that Mr. Saini sold 13426 -63 Avenue last year and presented the new owner with design guidelines. Mr. Dhaliwal briefly discussed thehistory of the application and measures taken by Mr. Saini to ensure the home built adheres to the designguidelines.

Mr. Dhaliwal then described the modifications required to bring the existing building in line with the homes inHeritage Woods. It was noted that the liveable area in the house is 2,340 square feet.

Ms. Jane Harris, 6264 - 134A Street, was present to speak in favour of this application. Ms. Harris stated thather decision to purchase in Heritage Woods was based on the heritage design and single family nature of thearea.

Ms. Harris questioned if the Restrictive Covenant has no relevance any longer. She commented on theimportance of ensuring compatibility of new homes with the size and style of homes in the Heritage Woodssubdivision. She pointed out that homes in the subdivision range in size from 1,400 - 1,800 square feet.

Mr. Robert McDonald 6266 - 134 Street, was present to speak in support of the rezoning application. He addedthat he has lived in the area for 4 years and that most people who visit him comment on how quaint the area is. He urged Council to ensure that future developments in the area are consistent with the Heritage Woodsdesign.

Mrs. Tone Belich, 6253 - 134A Street, was present to comment on the proposed rezoning. Mrs. Belichcommented that it was the quaintness of the subdivision that attracted her to buy a home in the Heritage Woodssubdivision. She added that when the subject property was originally rezoned to CD the neighbourhoodcirculated a petition to ensure future development was consistent with the homes in Heritage Woods.

Mrs. Belich referenced the house under construction and commented that there is very little back yard area onthe lot, adding that this is not in keeping with the design of homes in the subdivision. Mrs. Belich pointed outthat the neighbourhood approached Planning and went through due process to ensure that new developmentwould be consistent with the homes in Heritage Woods.

Mrs. Belich commented that the neighbourhood is trying very hard to preserve their area and made adetermined effort to ensure future developments complied with the house design of Heritage Woods.

Mayor Bose returned to the Public Hearing at 7:50 p.m. but did not assume the Chair.

Mr. Roger S.Sidhu, 12330 -64A Avenue, was present to comment on the proposed rezoning. Mr. Sidhuadvised that he has been a realtor in Surrey for a number of years. Mr. Sidhu sought confirmation that the.55 floor area ratio was previously approved and commented that it is not fair to change the size of the houseafter it had already been approved. Mr. Sidhu confirmed that he does not support the proposed By-law.

Councillor Watkins left the Public Hearing at 7:58 p.m.

Mr. Greg Belich, 6253 - 134A Street, was present to comment on the proposed rezoning. Mr. Belich pointedout that the lots in Heritage Woods are 5,000 sq.ft. and expressed the opinion that the home under constructionoverpowers the neighbourhood.

Acting Mayor Robinson repeatedly requested that people in the foyer refrain from talking as the noise was interferingwith the ability to hear speakers at the podium.

Councillor McKinnon left the Public Hearing at 8:00 p.m.

Mr. Belich expressed the opinion that the 5,000 sq.ft. lots are not suitable for a large home and suggested that8,000 sq.ft. lots are more appropriate for the development of large homes.

Mr. Peter Zadorozny, 6272 & 6273 - 134A Street, was present to speak in support of the proposed rezoning. Mr. Zadorozny commented that he bought in the subdivision when it was first developed and encouragedCouncil to support the reduced house size and decrease the Floor Area Ratio.

Mr. Zadorozny advised that he attended the original public hearing on this application and was of the opinionthat the design guidelines for Heritage Woods would be followed.

Councillor Watkins returned to the Public Hearing at 8:16 p.m.

Mrs. Jeanne Eddington, 6659 -122A Street, was present to comment on the proposed rezoning. Mrs. Eddingtonexpressed concern with respect to the By-law and how it affects infill situations. She pointed out thatdevelopers often sign to indicate that they will adhere to the design guidelines; however, they do not read theguidelines they have agreed to observe. Mrs. Eddington pointed out that it is not fair to allow the home to bebuilt to a certain size and then change the floor area ratio after the fact.

Councillor McKinnon returned to the Public Hearing at 8:18 p.m.

Councillor Huot left the Public Hearing at 8:18 p.m.

Mr. Pat Bertrand, 13472 - 63 Avenue, was present to comment on the proposed rezoning. Mr. Bertrandsuggested that all the homes should follow the same design guidelines, but with respect to the house size, he isopposed to this size of home on such a small lot.

Mr. Bertrand pointed out that many people were not aware that the new homes would not conform to theHeritage Woods design guidelines. He encouraged Council to ensure the remaining homes are built inaccordance with Heritage Woods design guidelines. The delegation confirmed that he is in support of theproposed rezoning.

Mr. Dhaljit Gill, 11548 - 84 Avenue, was present to comment on the proposed rezoning. He advised that heattended the original Public Hearing where the developer had the option to subdivide to 3 lots of 8,000 sq. ft. or5 lots at 5,000 sq.ft. Mr. Gill added that the developer gave assurances that basement entry style homes wouldnot be built and he is now willing to ensure the design is revised to complement the homes in Heritage Woods. He added that the same design consultant will review the designs of the remaining lots regardless of who buysthe lot.

Mr. Tony Trainer, 6301 - 135 Street, was present to speak in support of the rezoning application. Mr. Trainerpointed out that the lots in question directly adjoin Heritage Woods and the neighbourhood wishes to retain thecharacter of this unique subdivision.

Councillor Huot returned to the Public Hearing at 8:29 p.m.

Mr. Dhaliwal approached the podium and pointed out that the setbacks meet those required by the City, as well,it was noted that one of the setbacks is greater than that required by the City.

Mrs. Belich referenced the Floor Area Ratio (FAR) and questioned if it is to include garages and exterior

buildings. It was noted that outbuildings and garages are included in the FAR. Mrs. Belich requested to knowthe size of the home and asked if there is sufficient space left to allow for an outbuilding. Mrs. Belich thenasked if an easement exists on the property.

The Public Hearing recessed at 8:35 p.m. and reconvened at 8:42 p.m. with all members of Council present, exceptCouncillor McCallum and Councillor Watkins, who entered the Public Hearing as noted in the minutes.

Mr. Roy Langton, 12825 - 20 Avenue, gave an overview of the proposal and how it evolved. He advised thatmaintenance of the landscaped area would be turned over to the City at their request. Lots on 20 Avenue willbe subject to a Restrictive Covenant.

Councillor McCallum returned to the Public Hearing at 8:45 p.m.

With respect to school needs, Mr. Langton commented that the elementary school is presently not overcrowdedand will not be as a result of this application. He also pointed out that 98% of people surveyed in the impactarea are not opposed to the proposal.

Mr. Langton then read a letter from Val Meredith expressing support for the proposal. It was noted that thisletter is included in the package submitted by Mr. Langton.

Mr. Arychuk approached the podium and displayed a map showing the area referred to as the “impact area”. Itwas noted that the area surveyed is the same as that which received notification of the public hearing from theCity.

Mr. Rod Adam, 2066 - 127A Street, was present to speak in support of the proposal. He added that he issupportive of the project based on public safety, the greenspace and public consultation that has taken place. He added that he has been contacted four times by people seeking input on this application. Mr. Adamencouraged Council to support the application.

Mr. K.E. Hollas, 12764 - 20A Avenue, was present to speak in support of the proposal. He advised that he andhis wife have lived in the area since 1984. He stated that the majority of residents in the immediate areaapprove of the proposal. Mr. Hollas added that Mr. Langton has worked hard to make this a friendly, pleasingand imaginative proposal. He expressed the opinion that this will add to, rather than take away from, the area. Mr. Hollas urged Council to support the application.

Mr. Greg Vanstone, 12948 - 21A Avenue, was present to speak in opposition to the proposal. Mr. Vanstonedisplayed a map showing the Ocean Park Terrace subdivision and commented on how this application willaffect that area. Mr. Vanstone referenced the colour-coded map which indicated residents opposed to, neutral,or supportive of the proposal.

Mr. Vanstone referenced the Official Community Plan (OCP) and pointed out that many people purchaseproperty based on the OCP. He added that the OCP should not be changed easily. He commented that if this isapproved, it will set a precedent for the development of neighbouring land. Mr. Vanstone urged Council tokeep in mind that Suburban zoning does not necessarily mean mega homes.

Mr. Vanstone submitted a petition showing 119 people in favour of retaining the Suburban designation.

Mr. Vanstone added that many people could not be in attendance tonight, due to the Spring Break holiday. Hethen referenced a letter from the Ocean Park Community Association and asked that it be received.

In conclusion, Mr. Vanstone urged Council to retain the suburban designation.

Mr. Alex Barrie 2120 - 126 Street, was present to speak in support of the proposal. Mr. Barrie read a letter hesent to the General Manager of Planning advising that he was initially opposed to the application and hadencouraged residents to contact City Hall to express their opposition. He since contacted Mr. Langton to workout a compromise. Mr. Barrie discussed the compromises reached. He pointed out that the committee herepresents agree to the revised proposal and urged Council to support the application.

Mr. John Plummer, 12597 - 17A Avenue, was present to speak in opposition to this application. Mr. Plummeradded that he supports Council in their efforts to hold the line on taxes. He explained that he supportsincreased development in Surrey, but not the proposed development as it requires a change in the OCP. Addedto that, it doubles the density presently permitted. Mr. Plummer commented that this sets a precedent and willlead to many similar applications coming forward.

Mr. Plummer urged Council to leave the Suburban designation and encouraged Council to adhere to the OCP inplace.

Mrs. Sue Ann Gentry, 13175 - 14 Avenue, was present to speak in opposition to this application. Mrs. Gentrycommented that she does not live in the immediate vicinity of the development but added that it will affect herlifestyle by increasing the number of people using existing services and facilities.

Mrs. Gentry referenced public meetings where 46% of people supported two units per acre in the area of Mr.Langton's property.

Sheadded that this property was included in a study area where the majority of people expressed a preference forno Urban development in the study area.

With respect to drainage, Mrs. Erhardt questioned where the outflows drain to. She suggested that a retentionpond may be required. Mrs. Erhardt commented that without a proper groundwater study no one knows whereit will drain to.

Mrs. Erhardt then commented that this application will put the population over that allotted for the water supplyavailable. She reminded Council that the community was promised permanent Suburban and requested thatdesignation be retained.

Mr. Ken Diewert, 1315 - 130 Street, was present to comment on the proposal. He added that if this were theonly development application in the area, it is likely he would support it, but expressed concern that this isprecedent setting.

Councillor Watkins returned to the Public Hearing at 9:44 p.m.

Mr. Vanstone requested that a copy of the package circulated to Council be made available. He then added thathe does not disagree with the safety concerns or the plans for the park system but added that you do not need todevelop in an urban manner to ensure the bus stop is made safer or the unsightly lot is cleared up.

Mr. Vanstone urged Council to retain the character of the neighbourhood by maintaining the Suburbandesignation.

Mr. Barrie commented that the entire Semiahmoo Peninsula was clear cut around the time of the war and statedthat Mr. Langton's property has not recently been clear cut.

Mr. Clarence Arychuk, approached the podium to clarify comments attributed to him. Mr. Arychuk describedMr. Langton's efforts to discuss his plans for development when the studies were undertaken in Area A, atwhich time he was told the boundaries would continue to be refined.

Mr. Arychuk displayed maps and advised that a tree survey was submitted on this application very early in theprocess. He confirmed that the trees removed were taken out after a serious storm, at the request of BC Hydro.

Mr. Arychuk added that the neighbours immediately affected by the application are supportive of theapplication. He then expressed the opinion that Mr. Vanstone's concerns can most likely be addressed.

Mr. Langton approached the podium and discussed the events which led to trees being removed from theproperty. He explained that 59 trees were blown down in a domino effect during a storm in 1992. He thenreferenced the measures he took to ensure an arborist was involved in the tree removal process.

Mrs. Sandra Bramall, 2496 - 136 Street, was present to speak in opposition to the proposal. She added that herobjection is that you cannot build the City by word of mouth. She referenced statements made by developersregarding what or where they are permitted to develop and pointed out that there is not documentation tosupport such statements.

Mrs. Bramall referenced sewage requirements and the sewage regulation act. She suggested that Boundary

Mr. Barrie commented that he moved from his home on 128 Street due to increased density in the area andadded that his reason for making this comment is to support the need for RS-1 type housing in the area. Mr. Barrie expressed the opinion that Mr. Langton's application is appropriate for the neighbourhood.

Mrs. Kathy Diewert, 1315 - 130 Street, was present to comment on the proposed rezoning. She expressedconcern for children in the area and commented on the need for community facilities. Mrs. Diewert questionedwhy more people are being brought in to the area when there are no facilities to support them.

In response to questions from Mrs. Erhardt, Mr. Ham advised that staff have been tracking populationgrowth in the area in terms of adequate water supply. As an interim measure a water main will beconstructed to service the area.

Mrs. Erhardt commented that the population numbers keep changing and appear to be at capacity. Sheadded that in light of this information the application should not be considered for third reading nextweek.

Mrs. Erhardt then commented on the storm drainage provisions. She pointed out that no sediment pondhas been identified on any maps of the area. She questioned how siltation will be dealt with. Mrs.Erhardt stated that the drainage study has not been done and this should not be approved until then.

As well, Mrs. Erhardt commented on the practice of a different Municipality which requires developersto provide 25 ft. of amenity space per unit and suggested the City should also consider this.

Mrs. Barbara Paton, 3417 - 148 Street, was present to comment on the proposed rezoning. She pointed out thatthere is no development sign on the property and questioned if the legal description is accurate. Mrs. Patonreferenced the road network, noting that some of the roads have different names after they cross the KingGeorge Highway. She then questioned if on street parking will be permitted along 29A Avenue. Mrs. Patonrequested that during the construction phase consideration be given to residents of the Care home which existsto the north of the proposal.

PROPOSAL: To rezone the above properties from “Full-Serve and Self-Serve Gasoline Station Zone (C-G(2)” (By-law No. 5942) and “Tourist Commercial Zone (C-T(1)” (By-law No. 5942) to "One-AcreResidential Zone (RA)" (By-law No. 12000).

The rezoning is to allow cancellation of the Servicing Agreement.

The Notice of the Public Hearing, except the legal description, was read by the City Clerk. The location of theproperties was indicated to the Public Hearing.

Ms. Trudy Studer, 9912 - 179 Street, was present to comment on the proposed rezoning. She advised that shehas a financial interest in a nearby property. Ms. Studer commented that this is a complex issue and that shehas done much research into the matter. Ms. Studer then offered her opinions for the reasons behind thisapplication.

Councillor Robinson returned to the Public Hearing at 11:28 p.m. and left at 11:29 p.m.

Ms. Studer commented that taxes have not been paid on the property and questioned whether Surrey tax payerswould become liable for all charges against the property should ownership be transferred to the City.

Ms. Studer referenced a letter dated October 16, 1995 letter, in which she was advised that a corporate reportwould be prepared, with respect to drainage. This was followed up by another letter indicating that she shouldnot be concerned about drainage because the property will be downzoned. Ms. Studer explained that she is nowconcerned about the viability of Surrey to downzone the property and the financial impact this will have.

That the letters submitted by Mrs. Studer be received. Carried

Mr. Richard Fraser, 9736 - 132A Street, was present to speak in support of the proposed rezoning. Mr. Fraserreminded Council that many residents were opposed to the initial rezoning application. He added that this is akey property in the area and seems that this is a golden opportunity to rethink the development for that entire
