Intended Learning OutcomesIn this module we will examine the principles of Contract Law: how contracts are formed; the terms of the contract and theenforceability of unfair terms; we consider the vitiating factors that affect the validity of contracts. We examine the basicprinciples concerning performance of contracts, frustration and breach of contract, and remedies for breach, including third-party remedies. We consider the key principles that regulate these issues and any relevant statutory provisions, and how bothhave been applied and interpreted by the courts.

On successful completion of the module, students should be able to:

Describe the basic principles of the law of contract regulating the formation and terms of contracts, including the enforceabilityof e.g. unfair terms. Identify factors that will affect the validity of contracts, for example mistake.

Describe the basic principles of the law of contract concerning performance, frustration and breach of contract, and remediesfor breach including third-party remedies.

Solve legal problems by applying these principles to hypothetical fact situations.

Engage in critical analysis of certain principles.

Demonstrate the ability to communicate clearly in writing.

Intended Learning OutcomesThe aim of this module is to provide an introduction to the overarching legal framework and components of the Canadian legalsystem, including the sources, theories and fundamental principles of law in Canada (eg federalism). In addition, it will outlinethe relative role and responsibilities of the three branches of government, the judicial review function of the courts, the treaty-making process and relationship between international and domestic law, approaches to judicial interpretation (statutoryinterpretation and Federal and Charter review), and the special relationship Aboriginal Peoples with the Canadian State.

On successful completion of the module, students should be able to:

To provide an introduction to and an overview of Canada’s legal system and the role of law in Canadian society

To review various legal theories as they apply to Canadian law

To introduce the overarching legal framework within which the particular areas of law studied in other courses operate

To outline the various sources of Canadian law

To compare the different branches of Canadian government and to critically analyse the relationships between and amongthem

Fundamental Principles of the Canadian Legal System (including Federalism, Rule of Law, Parliamentary Sovereignty,Constitutional Supremacy, Separation of Powers)

To provide an understanding of the Canadian treaty-making process and the implementation of international law into domesticlaw

To provide an understanding of the special relationship Aboriginal Peoples have with the Canadian State, and to enableapplicants to critically assess the impact of the Canadian legal system upon Aboriginal and other minority communities;

To provide an understanding of the nature and function of judicial review and of the basic approaches to statutoryinterpretation and constitutional interpretation (Charter and Federalism Review)

Intended Learning OutcomesThe module will cover four areas: planning law, environmental law, construction law and landlord and tenant law. The moduleseeks to give the students an understanding of the issues relating to the land use policy and the legal framework whichregulates land from the early stages of planning to building properties, taking into account environmental issues andconstruction law, to ownership but specifically landlord and tenant.

The two formative assessments will relate to tasks that lawyers would undertake in legal practice. The first formativeassignment will involve writing a memo to a “supervisor”. The second formative assignment will involve firstly drafting a simplelegal document and secondly writing a letter to the “client” to explain this document to them.

The students will receive feedback on their work on the formative essay and this will help to inform them of the approach to betaken with the practice-based elements of the summative assessments, and how to improve their work for the summativeassessments.

Students enrolled in this course will be doing private research prior to their tutorials. Group of two students will be expected toprovide leadership in each tutorial –in the first tutorial tutors will ask for volunteers and the students will be allocated for thesubsequent tutorials—in order to ensure that all students come prepare and participate in the tutorials.
