A Buyer’s Premium will be added to the successful bid price and is payableby the buyer as part of the total purchase price. The Buyer’s Premium shallbe: 25% on the first $20,000 of the hammer price of each lot, 20% on theportion from $20,001 through $500,000, and 12% on the portion of thehammer price exceeding $500,000.

All items in the catalogue are subject to the 8% Pennsylvania andPhiladelphia sales tax. Dealers purchasing for resale must register their taxnumbers on current PA forms. Forms should be submitted to our ClientServices office on the second floor.

All item descriptions, dimensions and estimates are provided for guidanceonly. It is the buyer’s responsibility to inspect all lots prior to bidding toensure that the condition is to their satisfaction. If potential buyers areunable to inspect lots in person, our specialists will be happy to preparedetailed Condition Reports on individual lots as quickly as possible. At the sale Registered bidders will be assigned a bidder number and given apaddle for use at the sale. Once the first bid has been placed, theauctioneer asks for higher bids in increments determined by the auctioneer.To place your bid, simply raise your paddle until the auctioneeracknowledges you. In the same way that Picasso’spaintings challenged and pushed the traditional definitions of painting, theartist’s printmaking techniques were innovative and experimental withwonderful effect.

Linoleum cuts were first invented in the 1860’s and enabled artists to createa rich, multi-colored image by inking several different linoleum ‘blocks.’Typically, each was cut differently to depict another area of the final image,then inked and layered one over the last to create the final print. Picasso,along with master printer Hidalgo Arnéra however, experimented with usingjust one block to create his layered images. This was achieved by cutting,inking and impressing just one block over and over into the same sheet ofpaper so that the finished print was comprised of the differing cuts (states)one over the other.

The present working proofs which originally came directly out of Arnéra’sstudio offer a unique chance to glimpse the artist testing the effects of thesecuts before inking and applying them to his prints. State III of IV (caramelover white) here shows the artist’s new cuts to the arms, shoulder and facethat ultimately appear in the final state IV of IV.$50,000-80,000

In a 2009 Wall Street Journal article about theprevious year's financial meltdown and theimpact it was having on the art market, Jack L.Wolgin, who died a year later at the age of 93,expressed his concern about the artists whowould have to face the difficult days ahead andcommented, "I would rather have art thanmoney." Fortunately for our native Philadelphia,he gave both with a remarkable thoughtfulness,generosity and foresight. Undeniably, a large partof his legacy is tied to his city. Freeman's ispleased to offer here thirteen exceptional worksfrom his estate.

Some Philadelphians may not know the Wolginname but they most certainly know of ClaesOldenburg's 1976 monumental and iconicClothespin. Towering near City Hall in the CentreSquare Plaza office complex Wolgin helped todevelop, it was one of three works he hadcommissioned at that time to fulfill the city'srequirement that a percentage of newconstruction costs be allocated for art. His goalwas "to provide art that would enhancePhiladelphia by integrating into the daily life ofthose who live or work in the city, the joy andinspiration derived from great art."

We can view the Clothespin, especially inPhiladelphia and its association with Jack Wolgin,as something of a link between the impact ofextraordinary 20th-century public art and theinfluence artists will have in the coming decades.In 2008, he created the Jack Wolgin InternationalCompetition in the Fine Arts administered byTemple University's Tyler School of Art - a trulyoutstanding annual prize of $150,000 to beawarded to one artist to promote "excellence bytranscending traditional boundaries." It is theworld's largest juried visual arts prize. JackWolgin gave Philadelphia monumental art andsignificant resources to guarantee thatcontemporary art in all dimensions will flourishin the future. 

Freeman's takes particular pleasure in being ableto offer a selection of Jack Wolgin's manytreasures. Like the enduring artistic andphilanthropic legacies he left to Philadelphia, itseems appropriate that Freeman's, with a uniqueand historic link to the fine arts of the city, willassist in yet another chapter in the life of one ofthe city's great champions of the arts.

“I’m not an abstract artist. I’m a realist. The way I look at it,abstraction is not sufficiently complicated; abstraction doesn’trelate enough to everyday life. You see, that’s my realist bias. I’musing these objects because I want to employ the world aroundme, which I feel a relationship with. I’m a purist on my own termsbut not a purist in the sense that I want to eliminate the world ofappearances or the tactile world.” Claes Oldenburg

When the 40-foot Clothespin sculpture was unveiled indowntown Philadelphia in July of 1976, it was the manifestationof nearly ten years of the artist’s working to translate one of themost functional and familiar tools in the artist’s studio into agrand public monument. Clothespins “are the instruments ofconnection which are so important in the fabrication of my work... My studio is full of clothespins. I handle these objects. After awhile I begin to see them as much larger structures than theyactually are and think of enlarging them. They have anarchitectural character.”

In 1967, Oldenburg held a real clothespin to the plane windowas he flew over Chicago and first envisioned the everyday objectas a variation on the Hancock building, innovative for itsrejection of the usual vertical building format . He then workedthe idea into the cover for Artforum magazine that same year.

In 1972, the theme continued to evolve as the artist used adrawing of a clothespin with a collaged element of Brancusi’s‘The Kiss’ as a poster and limited edition print [see lot 57] forhis solo exhibition at the Philadelphia Museum of Art. The artistreferenced the iconic sculpture, in the holdings of thePhiladelphia Museum “because it contained two structurespressing close together and held in an embrace: In the case ofthe clothespin, the parts were held by a spring.”

No doubt, Philadelphia businessman and art collector JackWolgin would have attended this local 1972 exhibition aroundthe time he was seeking to commission a large sculpture for hisCentre Square Project in downtown Philadelphia . That sameyear, Oldenburg had begun work with Don Lippincott on theproduction of a few studies and models for a large scaleclothespin. After many fits and starts, revisions of line and ofmedium, the artist and Lippincott put into production three ten-foot steel clothespins and nine four-foot sculptures [one ofwhich is offered here].

Distilled down to its most elegant curves and finished in awarm, golden patina, “Model for Clothespin” is an alluringcelebration of the beauty in the universal, common and familiar.

In 1975, Jack Wolgin commissioned Alexander Calder todesign eight banners to hang in the atrium of his CentreSquare, downtown Philadelphia complex as part of theRedevelopment Authority’s percent-for-art programrequirement. The artist submitted proposed designs to Mr.Wolgin in the form of gouache works on paper, one of which isoffered here. The magnificent final products, brilliantly huedbanners of dyed cotton and silk ranged from 18 to 28 feet inlength and were unveiled at a gala event on July 1st, 1976,timed to coincide with the city’s bicentennial celebration.

The banners are the only ones ever designed by the artist.

Suspended from the sky-lit atrium around a large sculpture byJean Dubuffet with the newly installed 40-foot “Clothespin” byClaes Oldenburg just outside, the three works together made astunning impact and instantly marked Philadelphia as a greatsupporter and nurturer of public art. Mary Kilroy, former headof the Redevelopment Authority art program, said the 1976installation of those artworks marked a cultural “breakout” forthe city.

After Centre Square was sold in the 1980s, the atrium was re-designed and the banners temporarily removed and placed instorage. Ownership of Centre Square subsequently changedhands at least twice more, and the banners were lost for manyyears. Thanks to the efforts of many people including SusanDavis, former director of public art at the PhiladelphiaRedevelopment Authority, however, the banners were found in2009 and hung at the Philadelphia Free Library for publicviewing for the first time in over twenty years.

Beginning in the 1940s, the artist Paul Jenkins’ mother developed a long term friendship with her neighbor, George Hudock.Over time, Hudock also met Paul Jenkins. Throughout the following decades, the two corresponded and visited each otherfrom time to time.  During these years, Hudock received several gifts of artwork from Jenkins, several of which are included inthis exceptional group of paintings and sculptures.

1Unless otherwise indicated, allProperty will be offered byFreeman’s as agent for theConsignor.

2Freeman’s reserves the right to varythe terms of sale and any suchvariance shall become part of theseConditions of Sale.

3Buyer acknowledges that it had theright to make a full inspection of allProperty prior to sale to determinethe condition, size, repair orrestoration of any Property.Therefore, all property is sold “AS-IS”. Freeman’s is acting solely as anauction broker, and unless otherwisestated, does not own the Propertyoffered for sale and has made noindependent investigation of theProperty. Freeman’s makes nowarranty of title, merchantability orfitness for a particular purpose, orany other warranty orrepresentation regarding thedescription, genuineness,attribution, provenance or conditionto the Property of any kind or naturewith respect to the Property.

4Freeman’s in its sole and exclusivediscretion, reserves the right towithdraw any property, at any time,before the fall of the hammer.

5Unless otherwise announced by theauctioneer at the time of sale, allbids are per lot as numbered in theprinted catalogue. Freeman’sreserves the right to determine anyand all matters regarding the order,precedence or appropriateincrement of bids or the constitutionof lots.

6The highest bidder acknowledgedby the auctioneer shall be the buyer.The auctioneer has the right toreject any bid, to advance thebidding at his absolute discretionand in the event of any disputebetween bidders, the auctioneershall have the sole and finaldiscretion either to determine thesuccessful bidder or to re- offer andresell the article in dispute. If anydispute arises after sale, theFreeman’s sale record shall beconclusive in all respects.

7If the auctioneer determines thatany opening or later bid or anyadvance bid is not commensuratewith the value of the Propertyoffered, he may reject the same andwithdraw the Property from sale.

8Upon the fall of the hammer, title toany offered lot or article willimmediately pass to the highestbidder as determined in theexclusive discretion of theauctioneer, subject to compliance bythe buyer with these Conditions ofSale. Buyer thereupon assumes fullrisk and responsibility of theproperty sold, agrees to sign anyrequested confirmation of purchase,and agrees to pay the full price, plusBuyer’s Premium, therefore or suchpart, upon such terms as Freeman’smay require.

9No lot may be removed fromFreeman’s premises until the buyerhas paid in full the purchase pricetherefor including Buyer’s Premiumor has satisfied such terms thatFreeman’s, in its sole discretion,shall require. Subject to theforegoing, all Property shall be paidfor and removed by the buyer athis/her expense within ten (10)days of sale and, if not so removed,may be sold by Freeman’s, or sentby Freeman’s to a public warehouse,at the sole risk and charge of thebuyer(s), and Freeman’s mayprohibit the buyer fromparticipating, directly or indirectly,as a bidder or buyer in any futuresale or sales. In addition to otherremedies available to Freeman’s bylaw, Freeman’s reserves the right toimpose a late charge of 1.5% permonth of the total purchase price onany balance remaining ten (10) daysafter the day of sale. If Property isnot removed by the buyer within ten(10) days, a handling charge of .1%of the total purchase price permonth from the tenth day after thesale until removal by the buyer shallbe payable to Freeman’s by thebuyer; Freeman’s shall charge 1.5%of the total purchase price permonth for any property not soremoved within 60 days after thesale. Freeman’s will not beresponsible for any loss, damage,theft, or otherwise responsible forany goods left in Freeman’spossession after ten (10) days. If theforegoing conditions or anyapplicable provisions of law are notcomplied with, in addition to otherremedies available to Freeman’s andthe Consignor (including withoutlimitation the right to hold thebuyer(s) liable for the bid price)Freeman’s, at its option, may eithercancel the sale, retaining asliquidated damages all paymentsmade by the buyer(s), or resell theproperty. In such event, the buyer(s)shall remain liable for any deficiencyin the original purchase price and

will also be responsible for all costs,including warehousing, the expenseof the ultimate sale, and Freeman’scommission at its regular ratestogether with all related andincidental charges, including legalfees. Payment is a precondition toremoval. Payment shall be by cash,certified check or similar bank draft,or any other method approved byFreeman’s. Checks will not bedeemed to constitute payment untilcleared. Any exceptions must bemade upon Freeman’s writtenapproval of credit prior to sale. Inaddition, a defaulting buyer will bedeemed to have granted andassigned to Freeman’s, a continuingsecurity interest of first priority inany property or money of, or owingto such buyer in Freeman’spossession, and Freeman’s mayretain and apply such property ormoney as collateral security for theobligations due to due to Freeman’s.Freeman’s shall have all of the rightsaccorded a secured party under thePennsylvania Uniform CommercialCode.

10Unless the sale is advertised andannounced as “without reserve”,each lot is offered subject to areserve and Freeman’s mayimplement such reserves by biddingthrough its representatives on behalfof the Consignors. In certaininstances, the Consignor may payless than the standard commissionrate where Freeman’s or itsrepresentative is a successful bidderon behalf of the Consignor. Wherethe Consignor is indebted toFreeman’s, Freeman’s may have aninterest in the offered lots and theproceeds therefrom, other than thebroker’s Commissions, and all salesare subject to any such interest.

11No “buy” bids shall be accepted atany time for any purpose.

12Any pre-sale bids must besubmitted in writing to Freeman’sprior to commencement of the offerof the first lot of any sale. Freeman’scopy of any such bid shallconclusively be deemed to be thesole evidence of same, and whileFreeman’s accepts these bids for theconvenience of bidders not presentat the auction, Freeman’s shall notbe responsible for the failure toexecute, or, to execute properly, anypre-sale bid.

13A Buyer’s Premium will be added tothe successful bid price and ispayable by the buyer as part of thetotal purchase price. The Buyer’s

Premium shall be: 25% on the first$20,000 of the hammer price ofeach lot, 20% on the portion from$20,001 through $500,000, and12% on the portion of the hammerprice exceeding $500,000.

14Unless exempted by law from thepayment thereof, the buyer will berequired to pay any and all federalexcise tax and any state and/or localsales taxes, including wheredeliveries are to be made outsidethe state where a sale is conducted,which may be subject to acorresponding or compensating taxin another state.

15Freeman’s may, as a service to buyerarrange to have purchased propertyposted and shipped at the buyer’sexpense. Freeman’s is notresponsible for any acts oromissions in packing or shipping ofpurchased lots whether or not suchcarrier recommended by Freeman’s.Packing and handling of purchasedlots is at the responsibility of thebuyer and is at the entire risk of thebuyer.

16In no event shall any liability ofFreeman’s to the buyer exceed thepurchase price actually paid.

17 No claimed modification oramendment of this Agreement onthe part of any party shall bedeemed extant, enforceable orprovable unless it is in writing thathas been signed by the parties tothis Agreement. No course ofdealing and no delay or omission onthe part of Freeman’s in exercisingany right under this Agreement shalloperate as a waiver of such right orany other right and waiver on anyone or more occasions shall not beconstrued as a bar to or waiver ofany right or remedy of Freeman’s onany future occasion.

18These Conditions of Sale and thebuyer’s, the Consignor’s andFreeman’s rights under theseConditions of Sale shall be governedby, construed and enforced inaccordance with the laws of theCommonwealth of Pennsylvania andConsignor and Buyer agree to theexclusive jurisdiction of thePhiladelphia, Pennsylvania Court ofCommon Pleas and the UnitedStates District Court for the EasternDistrict of Pennsylvania.

Terms & Conditionsall property offered and sold (“property”) through samuel t. freeman & co,(“freeman’s”) shall be offered and sold on the terms and conditions set forthbelow which constitutes the complete statement of the terms and conditions onwhich all property is offered for sale. by bidding at the auction, whether presentin person or by agent, by written bid, telephone, internet or other means, the buyeragrees to be bound by these terms and conditions.
