    Please read the note below before using this Model Documentation

    This model Output Specification, for a Local Authority street lighting project, is notintended to be a word-for-word template, ready for use. The model will need to berefined to reflect local circumstances and priorities, together with local standards andtargets. Every street lighting project will be different, and users of this model willneed to think through whether the item and its wording are appropriate to theirproject or not.

    The model Output Specification is based on Performance Standards that link throughto the model Payment Mechanism (Models 2 and 2 in this Street Lighting Procurement

    Pack). The model Output Specification also refers to various contractual MethodStatements. If the Local Authority intends to request from Bidders different MethodStatements to those incorporated in this model Output Specification, the modelInstructions and Guidance to Bidders will need to be amended accordingly.

    This Model Documentation has been produced by the 4ps, in consultation withAddleshaw Goddard (legal advisers) and PricewaterhouseCoopers (financial advisers)(together the Advisers) to provide assistance to Local Authorities in the procurementof street lighting projects through a public private partnership or through the Private

    Finance Initiative. The Model Documentation has been published in good faith by the4ps with the help of its Advisers, and neither the 4ps nor its Advisers shall incur anyliability for any action or omission arising out of any reliance being placed on theModel Documentation by any Local Authority or organisation or other person.     Part 1 - Definitions

    1 Definitions1.1 IneachpartofthisOutputSpecificationthefollowingexpressions(inadditiontothosespecified

    inSchedule1(Definitions,InterpretationandConstruction))shall,savewherethecontextortheexpressprovisionsoftheContractotherwiserequireoradmits,bedeemedtohavethemeaningssetoutinthisparagraph1.1.     (i) a Snagging Item has not been rectifiedwithin the time period set out in Table 3 inparagraph13.1ofthisOutputSpecification;

    (j) anyLightingColumnorPostwhichisnotTrueandPlumb(k) anytwistedattachments,includingsignplatesandlightingunits;(l) anymaterialdamagetoApparatus;(m) missingorincorrectnumbering;or(n) any other failure in the Service, as agreed between the parties, identified as a Non-

    2.4 TheLocalGovernmentAct1999placesa statutoryBestValueDutyon theAuthority tomakearrangementstosecurecontinuousimprovementinthewayinwhichitsfunctionsareexercised,having regard to a combination of economy, efficiency and effectiveness. Service usersatisfactionandthequalityoftheservicesdeliveredascomparedwithsimilarservicesdeliveredbyother private and public sector entities,will be used to determinewhether the Authority isfulfillingitsBestValueDuty.

    3 Scope of the Project3.1 The scope of the Project is for the provision of street lighting services to the Performance

    4 Performance Standard 1 (PS1) - Lighting Installation - Core Investment ProgrammePeriod

    Required Outcome

    4.1

    4.3 Where Street Lighting and Off Highway Lighting Installations are replaced, all Apparatus,includingPrivateCableNetworks,within thewholeof the streetorarea inwhich such StreetLightingandOffHighwayLighting InstallationsaresituatedshallbebroughtuptotheRelevantStandards.

    4.4 AllApparatusshallcomplywith theRelevantStandards from theServiceCommencementDateexcept in respectofApparatus formingpartof theCore InvestmentProgrammeServicewhichshallcomplywiththeRelevantStandardsfromthedateofCertification.

    4.5 InreplacingApparatustheServiceProvidershallcomplywithparagraph1.6.4.6 Lighting design, installation and commissioning shall be carried out in compliance with the

    provisionsofthisPS1and,inparticular,sothatPS1PerformanceTargetAissatisfied.DeemedtoComplyApparatus

    4.7 AllApparatusthatisDeemedtoComplyisidentifiedinAppendix4ofthisOutputSpecification.4.8 [AllTrafficSignsandBollardsareDeemedtoComplyasiftheywerelistedinAppendix4ofthis

    OutputSpecification.]UnlitStreetsRoads/Footpathsandotherareas

    4.9 BytheendoftheCIPallunlitstreets,roads,footpathsandotherareaslistedinAppendix4ofthisOutput Specification shall have lighting installed which complies with each Specific LightingDesign Standard. The Service Provider shallnotbe required to installStreet Lighting andOffHighwayLighting Installationsat the locations identified inAppendix4where there iscurrentlynorequirementto lightthem. However,theServiceProvidershallprovide lightingtofootpathswhichhavethesameaddressasastreetwhichislitandwhichleadtothefrontofpropertiesinthatstreet,evenifthefootpathisnotcurrentlylit.Core Investment Programme

    (c) subject to the provisions of paragraph 4.16, in preparing the Core InvestmentProgramme, the Service Provider shall take into account any known significanttransportationprojectsorotherprogrammesofworks that theAuthority (asHighwaysAuthority)orathirdpartyisplanningtocarryout.

    4.11 TheServiceProvidershall,fromthedateoftheContract:(a) assesstheconditionoftheApparatus;(b) installareferencesystemoflightingofnotmorethanten(10)LightingColumnstothe

    reasonablesatisfactionoftheAuthoritypriortothecommencementoftheCIP;and(c) produce designs (and submit the same to the Authority pursuant to the Review

    Procedure)andadetailedprogrammeofworkswithintheCore InvestmentProgrammetoensurethatallApparatususedindeliveringtheService:(i) complywiththeRelevantStandardsoncompletionoftheCIP;and(ii) arecapableofbeingmaintainedinaccordancewiththeRelevantStandards.

    Annual Investment Programmes

    4.12 Three(3)MonthspriortothefinalMilestoneCompletionDate(Projected)andthereafterwithinthree(3)MonthsbeforethecommencementofeachPaymentYeartowhichtherelevantAnnualInvestment Programme relates, the Service Provider shall produce an Annual InvestmentProgramme,whichshallcontainthefollowinginformation:

    (b) havingmadedueenquiry,detailsoftherelevantactivitiesofanyStatutoryUndertakersintheaffectedstreetsandhowtheServiceProviderintendstoco-operatewiththesame;(i) details of theApparatuswhich the Service Provider reasonably believes itwill

    replace in the three (3) PaymentYears following the PaymentYear towhichsuchAnnualInvestmentProgrammerelates;and

    (ii) detailsofsignificanttransportationprojectsorotherprogrammesofworksthattheAuthority (asHighwaysAuthority)ora thirdparty isplanning tocarryoutduringthetwelve(12)MonthperiodfollowingthedateoftherelevantAnnualInvestmentProgrammewhichhavebeenacceptedpursuant toparagraph4.16anddetailsofhow theServiceProviderhas incorporated thechanges requiredbytheAuthority;

    (c) subject to the provisions of paragraph 4.16, in preparing theAnnual Programme theService Provider shall make due enquiry and should take into account any knownsignificant transportationprojectsorotherprogrammesofworksthat theAuthority (asHighwaysAuthority)orathirdpartyisplanningtocarryout;

    (d) without prejudice to the other provisions of this paragraph 4.12, comply with theprovisionsofMethodStatement1B(PostCoreInvestmentProgrammePeriod).

    Timing

    4.13 Without prejudice to paragraph 4.16, the Core Investment Programme and the AnnualInvestmentProgrammeshallbeupdatedbytheServiceProvider,wherenecessary,inaccordancewithclause12.6(AmendmentofInvestmentProgrammes)totakeaccountof:(a) actualprogressoftheService;(b) any notifications received pursuant to Schedule 15 (Accrual and De-Accrual of

    Apparatus);(c) any extensions of time granted in accordance with clause 21 (Relief Events,

    CompensationEventsandExcusingCauses)oftheContract;(d) anyamendmentsmadeby theServiceProviderasaresultofoperational requirements;

    and(e) anyotherrelevantmattersincludinganyalterations,additionsorupdates.

    4.14 Withoutprejudicetothegeneralityofparagraphs4.12and4.13andclauses12.3(Amendmentof Core Investment Programme) and 12.5 (Amendment of Investment Programmes) of theContract, the Service Provider shall provide reasonable prior notice to the Authority of anyplanned amendments to the Investment Programmes and shall provide notice as soon asreasonablypracticablefollowinganyunplannedamendmenttotheInvestmentProgrammes.

    4.15 AnysubmissiontotheAuthoritybytheServiceProvideroftheAnnualInvestmentProgramme(orany amendments thereto) shall be made pursuant to, and in accordance with, the ReviewProcedure.Amendment of Investment Programmes

    4.18 The Service Provider shall, or shall procure that, all designs in connection with the LightingColumnsareproducedinaccordancewithallrelevantCodesofPracticeandthatwarranties(inaformtobeapprovedbytheAuthorityactingreasonablywhichapprovalshallnotbeunreasonablywithheldordelayed)areprocuredforthebenefitoftheAuthorityinrespectofeachofthese. Adesign fileshallbedevelopedandmaintained inaccordancewithall relevantcodesofpracticeincorporatingthedetailsetoutinMethodStatement3(Design).AdoptionsofApparatusfromThirdParties

    4.19 The Service Provider shall, at theAuthority's request, accept as part of the Service, additionalApparatus which is Accrued in accordance with Schedule 15 (Accrual and De-Accrual ofApparatus)and/orSchedule16(ChangeProcedure).Installation

    4.20 All Apparatus shall be installed by the Service Provider in accordance with the followingrequirements:

    (a) theRelevantStandards;(b) theMethod Statements, the Service Provider's health and safety procedures, specific

    operationalworkingpracticesandmanufacturersrecommendations;(c) the Service Provider shall obtain the Authority's prior written approval (not to be

    unreasonablydelayedorwithheld)of the formofallwarrantiesandguarantees tobeassignedtotheAuthorityinrelationtoallnewApparatus;

    (d) allApparatusshallbenewatthetimeofinstallation;(e) all new and replacement Apparatus shall be sited so as to minimise, insofar as is

    reasonableandpracticable,nuisance,dangerandobstructiontoallresidents,businessesandusersofthehighway;

    (f) all Lighting Columns shall have a uniform appearance and be appropriate to and inkeepingwiththerelevantlocation. TheServiceProvidershallobtaintheAuthority'spriorwrittenapproval(nottobeunreasonablywithheldordelayed)inrespectoftheaestheticsand appearance of allApparatus to be replaced or installed in any heritage area (asdesignated by the Authority) or Conservation Area, or in, on, or about any listedbuilding,civicbuilding,monument,placeofworshiporotherplaceorlocationrequiringspecialtreatmentlighting;

    (g) allApparatus,wherepaintedorotherwisecoated,shallbepaintedorotherwisecoatedinthecoloursoftheAuthorityasdetailedinAppendix[]tothisOutputSpecification;

    (h) allApparatusshallbeerectedTrueandPlumb;(i) LightingColumns shallbe inkeepingwith the local topographyof theareaandbe in

    scaleand sympathywithadjacentbuildings. No LightingColumn shallexceed [six (6)metres]inheightinresidentialareas. TheonlyexceptionwillbewherethepriorapprovaloftheAuthorityhasbeenobtained. Noapprovalwillbegiven(andnoconsultationshalltake place) where roads are less than fourteen (14) metres in width. Where suchapprovalisrequired,theServiceProvidershalldemonstrate:

    (iii) carried out generally in accordancewith this PS1 andMethod Statement 13(Working Practices) and the Authoritys practice relating to enclosing allunderground cables within ducting. All excavations and temporaryreinstatements to be permanently reinstated within one month followingexecutionofanyworks;

    (p) theServiceProvidershallnotify theAuthorityofall temporaryenergyconnectionsanddisconnectionstobemadetorelevantitemsofApparatusforconsiderationandapprovalby the Authority (which is not to be unreasonably delayed or withheld). FollowingapprovalbytheAuthority,theServiceProvidershallliaisewiththeDNOandallrelevantassociationssuchastradingassociations,localresidentgroupsandtheAuthority.

    Existing Attachments [to be conformed with Schedule 4]

    4.21 Theproceduresetoutinparagraphs4.22to4.32(inclusive)(whichisalsosetoutinSchedule4(AttachmentsandAdvertising)) shallapply to the siting, removaland installationofallExistingAttachmentsorexistingThirdPartyAttachmentsaspartoftheService.

    4.22 Not less than forty (40)BusinessDaysandnotmore than sixty (60)BusinessDaysprior to theServiceProviderundertakinganyworksinanystreetpursuanttoanyInvestmentProgrammetheServiceProvidershallsurveyallExistingAttachmentsandanyexistingThirdPartyAttachments:(a) provide to theAuthority photographs showing allApparatuswhich have any Existing

    Attachments or any existing Third Party Attachments attached to them (and on thephotographsidentifyeachExistingAttachmentorexistingThirdPartyAttachmentwithanumber)andidentifythelocationaccuratelyonato-scaleplan;

    (b)

    (d) notify the Authority of any Existing Attachments or existing Third Party AttachmentswhichmustremaininsituandinrespectofwhichtheServiceProvidershall,(atitsownexpense)installanewStraightPostwherenecessary.

    4.23 Notlessthanfifteen(15)BusinessDaysafterthereceiptofallrelevantinformationinaccordancewithparagraph4.22,theAuthorityshallnotifytheServiceProviderinwriting:(a) which Existing Attachments or existing Third Party Attachments are to be re-sited,

    indicating insufficientdetailonamarkupoftheplanprovidedbytheServiceProvider,whereeachExistingAttachmentorexistingThirdPartyAttachment is tobe re-sitedonthenewApparatus;

    (b) whether any newAttachment is to be attached to the newApparatus, indicating insufficientdetailonthemarkupoftheplanprovidedbytheServiceProvider,whereeachnewAttachmentistobeattached;

    (c) which Existing Attachments or existing Third Party Attachments are either no longerrequiredorareunauthorised;and

    (d) whichExistingAttachmentsorexistingThirdPartyAttachmentsmustremaininsitu,andwhere the Service Provider shall install a new Straight Post onwhich to attach suchExisting

    Attachments

    or

    TheServiceProviderisnotobligedtocomplywithanyinstructionoftheAuthoritywhichputstheServiceProviderinbreachoftheContractorLegislation.     4.31 Toavoiddoubt,theServiceProvidershallnotberesponsibleformaintainingand/orreplacinganyThird Party Attachment (including any Third Party Attachment in existence as at the ServiceCommencementDate)duringtheContractTerm.

    4.32 TheServiceProvidershallnotifytherelevantthirdpartyorganisationbeforerelocatingThirdPartyAttachments.

    5 Specific Lighting Design Standards5.1 Colour Rendering Index

    Alllightsourcesshallhaveacolour-renderingindexequaltoorinexcessofRa20butnotclassedasfullspectrumlightsourcesunlessotherwisespecified.

    5.2 Strategic/Principal Traffic Routes(a) The roads tobe lit to theRequiredLightingStandardsME2class for the traffic routes

    identifiedAppendix4ofthisOutputSpecification.(b) TherequirementsofatleastS2classwillbeappliedtofootwayandanyvergesbetween

    a carriageway and a footpath, cycleways, emergency lanes, etc on traffic routeswheneveranMEclassisusedforthecarriageway. Allroadjunctions,roundabouts,andminiroundaboutsshallbeclassedasconflictareas. Wheremotorisedtrafficstreamsofdiffering lightingclasses intersect, thehigherclassof road shalldetermine theconflictareaclass.

    (c) All pedestrian crossings, (i.e. toucan, pelican, zebra and refuges) are to be classed asconflictareas.

    (c) Luminairesshallhaveadequateopticalcontroltominimise lightpollutionandobtrusivelight to properties and shall conform to the E3 environmental zone obtrusive lightlimitations, defined in the Institution of Lighting Engineers Guidance Notes for theReductionofLightPollution. OnlyLuminarieswith flatglass, curve temperedglassorshallowdishedpolybowlsshallbeusedtoensureadequatecontroloflightpollution.

    (f) TheAuthorityshallbeconsultedonanyworkscarriedoutpursuanttoparagraph5.5(e)intheTownCentres.

    (g) WheretheAuthorityrequirestheServiceProvidertoinstallApparatuswhichisofabetterappearanceorquality than thatof theoriginalappearanceorqualityof theApparatusbeingreplaced,thentheprovisionsofSchedule16(ChangeProcedure)shallapply.

    (h) SomeApparatuswithincertainstreetsorareasintheTownCentresisfixedtobuildings,and, unless otherwise agreedwith theAuthority (acting reasonably), on renewal, thisarrangementmaycontinueintheselocations. ProvidedthatwhenanexistingNecessaryConsentofanOwner iswithdrawn, theServiceProvidershallcomplywithclause18.3(Process tobe followedwhereconsentnotobtained)of theContractandclause18.4(Excusing Cause) of the Contract shall apply. So far as reasonably practicable theApparatusshouldbe installed inanother locationtofacilitatecompliancebytheServiceProvider with the Contract (including this Output Specification) as agreed with theAuthorityprovided that theAuthorityshall reimburse theServiceProvider in respectofanyadditionalcostsincurredinrespectofsuchrelocation.

    (i) The use ofwallmounting in other locationsmay be desirable on renewal. Whereapplicabletheprovisionsofclause18(NecessaryConsents)oftheContractshallapplyinrespectofNecessaryConsents.

    5.6 Design Variation ApprovalThefollowingprocedureisalsosetoutinparagraph9ofSchedule7(ReviewProcedure):(a) WhereApparatuscanonlybe replaced inexisting locations,andasaresulttheService

    Providercannotmeet theSpecificLightingDesignStandards, then theServiceProvider

    shallbeentitled toapply foradesign variationapprovalby serviceofanoticeon theAuthority (a Design Variation Approval Request). The Design Variation ApprovalRequestshallcontainthefollowinginformation:(i) a fulldescriptionof thecircumstanceswhichmake it impossible toreplace the

    Apparatusin

    anew

    location;

    (ii) theextentoftheareawheretherequirementscannotbemet;(iii) theextenttowhichtherequirementscannotbemet;and(iv) the Service Providers preferred design solution (including any proposed new

    Performance Standards, and, if appropriate any new certification procedure)being the minimum departure from the requirements with at least onealternativetogetherwithastatementastowhythepreferredsolutionshouldbeaccepted.

    (b) TheAuthority,actingreasonably,shall,withintwenty(20)BusinessDayseither:(i) rejecttheDesignVariationApprovalRequest;or(ii) specifyitspreferredsolutionselectedfromthosesetoutintheDesignVariation

    ApprovalNotice.(c) Where paragraph 5.6(a)(i) applies, the Service Provider shall submit a further Design

    Variation Approval Requestwith further alternative design solutions. The Authority,actingreasonably,shall,withintwenty(20)BusinessDaysorreceipt,either:(i) rejecttheDesignVariationApprovalRequest;or(ii) specifyitspreferredsolutionselectedfromthosesetoutintheDesignVariation

    ApprovalRequest.(d) Where paragraphs 5.6(b)(ii) or 5.6(c)(ii) applies the Authority shall issue a notice

    confirming agreement to a variation of the design (the Design Variation ApprovalNotice) within ten (10) Business Days of receipt of the Design Variation ApprovalRequest copy of Design Valuation Approval Notice shall be sent to the IndependentCertifier.

    (e) Intheeventthatparagraph5.6(c)(i)appliesandthepartiescannotagreeasolution,themattershallbereferredtoDisputeResolution.

    (f) Where the Authority issues a Design Variation Approval Notice, the provisions ofSchedule16(ChangeProcedure)shallapply:(i) as if theDesign VariationApproval Requestwas a Service ProviderNotice of

    Change;(ii) as if theDesignVariationApprovalRequestwas accepted in accordancewith

    paragraph3.5ofSchedule16(ChangeProcedure);and(iii) thevariationindesignshallbedeemedtobeaChange.

    For the avoidance of doubt, paragraph 3.7, 3.8 and 4 of Schedule 16 (ChangeProcedure)shallapplyandtheAuthorityshallnotberesponsibleforanycostsincurredasaresultoftheredesign.

    5.7 Design Variation Approval (trees or other immovable objects)(a) WheretheSpecificLightingDesignStandardsarenotachievableduetothe locationof

    treesorother immovableobjects intherelevantroadthentheServiceProvidershallbeentitled to apply for a Design Variation Approval by service of a Design VariationApprovalRequestontheAuthoritywhichshallcontainthefollowinginformation:(i) a full description of the circumstances inwhich the Specific Lighting Design

    Standards cannotbemetasa resultof thepresenceand locationof treesorotherimmovableobjects;

    (ii) theextentof theareawhere the requirementscannotbemetbyhighlightingthe

    area

    in

    ablocked

    format

    on

    the

    design

    drawing;

    (iii) theextenttowhichtherequirementscannotbemet;and(iv) the Service Provider's preferred design solution which shall complywith the

    criteriasetoutinparagraph6.7ofMethodStatement3(Design)(includinganyproposednewPerformanceStandardsand,ifappropriate,anynewcertificationcriteria)being theminimumdeparture from the requirements togetherwithastatementastowhythepreferredsolutionshouldbeaccepted.

    (b) TheAuthority,actingreasonablyshall,either:(i) selectthesolutionsubmittedbytheServiceProviderandissueaDesignVariation

    ApprovalNoticewhichshallidentifytherevisedstandard;or(ii) servewrittennoticeon theServiceProvider stating that the solutiondoesnot

    complywithparagraph6.7ofMethodStatement3 (Design)and/or isnot theminimumdeparturefromtherequirementsandinsodoingidentifythereasonswhytheAuthoritybelievestherequirementshavenotbeenmet.

    (c) TheServiceProvidershall,uponreceiptofanotice:(i) pursuant toparagraph5.7(b)(i)proceed to implement the solution selectedby

    theAuthority, (and thisOutputSpecification shallbedeemed tobeamendedaccordingly);

    (ii) pursuanttoparagraph5.7(b)(i)either issueafurtherDesignVariationApprovalRequestsettingoutfurthersolutionsorreferthemattertoDisputeResolution.

    (d) Where the Authority issues a Design Variation Approval Notice, the provisions ofSchedule16(ChangeProcedure)shallapply:(i) as if theDesign VariationApproval Requestwas a Service ProviderNotice of

    5.8 CCTV Installations(a) TheboundariesoftheroadsandareascoveredbyCCTVareshownondrawingssetout

    inAppendix3andlistedinAppendix4ofthisOutputSpecification.(b) ThelightingclasstobeappliedtotheroadsandareascoveredbyCCTVisCE1.(c) LuminairesshallhavealuminousintensityclassasdefinedbyBSEN13201asfollows:

    (i) allLuminairesusedshallhavealuminousintensityclassofG4orgreaterexceptwhereaffixedtoheritagecolumns;

    (ii) within roads and areas covered by CCTV, light sources shall have a colour-renderingindexequaltoorinexcessofRa80.

    (d) The boundaries of areas and roads considered as suitable for CCTV installations areshownonthedrawingssetoutinAppendix3ofthisOutputSpecification.

    5.9 Conservation Areas(a) The boundaries of the Conservation Areas are shown on the drawings set out in

    Appendix3ofthisOutputSpecification.(b) AllLuminairesusedinConservationAreasshallhavea luminousintensityclassofG4or

    greaterexceptwhereaffixedtoheritagecolumns.(c) WithintheConservationArea,lightsourcesshallhaveacolour-renderingindexequalto

    orinexcessofRa20.(d) ExistingApparatusinConservationAreaswhichisofspecialdesignintermsofaesthetic

    appearance are identified in theMayriseDatabase and inAppendix 4 of thisOutputSpecification. Apparatus installed on renewal shall be of similar appearance andequivalent or higher quality to the original appearance and quality of theApparatusbeing replaced. NoApparatus of a lower appearance or quality shall be installed orincludedinarenewalorrefurbishmentprogrammewithoutthepriorwrittenconsentoftheAuthority. TheApparatusshallbeselectedinconsultationwiththeAuthority.

    (e) TheAuthorityshallbeconsultedonanyworkscarriedoutpursuanttoparagraph5.9(d)inConservationAreas. Where theAuthority requires that the ServiceProvider installsApparatuswhichisofabetterappearanceorqualitythanthatoftheoriginalappearanceorqualityoftheApparatusbeingreplaced,thentheprovisionsofSchedule16(ChangeProcedure)shallapply.

    (f) SomeApparatuswithin certain streets or areas in theConservationAreas is fixed tobuildings, and, unless otherwise agreed with the Authority (acting reasonably) onrenewal, this arrangementmay continue in these locations. Provided thatwhere anexistingconsentofanOwneriswithdrawn,theServiceProvidershallcomplywithclause18.3 (Process tobe followedwhen consent notobtained)of theContract and clause18.4 (ExcusingCause) of theContract shall apply. Wherever possible theApparatusshould be installed in such other location whichwould facilitate compliance by theServiceProviderwith theContract (including thisOutputSpecification)asagreedwiththeAuthorityprovidedthattheAuthorityshallreimbursetheServiceProviderinrespectofanyadditionalcostsincurredinrespectofsuchrelocation.

    (g) The use ofwallmounting in other locationsmay be desirable on renewal. Whereapplicabletheprovisionsofclause18.2(NecessaryConsents)oftheContractshallapplyinrespectofNecessaryConsents.

    5.10 Architectural/Amenity Lighting(a) Areaswitharchitectural/amenity lightingsystemswhichareoutsideConservationAreas

    orTownCentres,areshownonthedrawingssetout intheMayriseDatabase,andtheServiceProvidershallcontinuetoprovidesucharchitecturalandamenitylightingsystemsinaccordancewiththeRelevantStandards.

    (b) TheAuthorityshallbeconsultedonanyworksof installationcarriedout insuchareas.Where theAuthority requires that theServiceProvider installsApparatuswhich isofabetter appearance or quality than that of the original appearance or quality of theApparatusbeingreplaced,thentheprovisionsofSchedule16 (ChangeProcedure)shallapply.

    (c) Inadditiontotheprovisionsofthisparagraph5.10,theServiceProvidershallinstallandmaintain flood lighting on one unlit memorial and one unlit civic building to benominatedbytheAuthority.

    5.11 Car Parks(a) A listofcarparkssubjecttotheprovisionsofthisparagraph5.11are identifiedonthe

    drawingssetoutinAppendix3andlistedinAppendix4ofthisOutputSpecification.(b) ThelightingclassestobeappliedshallbeCE1.(c) Luminaires in carparks shallhave adequateoptical control tominimise lightpollution

    andobtrusive light toproperties. Allcarparks shallconform to theE3environmentalzone obtrusive light limitations, as defined in the Institution of Lighting EngineersGuidanceNotesfortheReductionofLightPollution. OnlyLuminaireswithflatglassorLuminarieswith a bowl depth of no greater than 50mm shall be used exceptwhereaffixedtoheritagecolumns.

    (d) Existing Apparatus which is of special design in terms of aesthetic appearance areidentified in the [MayriseDatabase]. Apparatus installedonrenewalshallbeofsimilarappearance and equivalent or higher quality of the Apparatus being replaced. NoApparatusofalowerappearanceorqualityshallbeinstalledorincludedinarenewalorrefurbishmentprogrammewithoutthepriorwrittenconsentoftheAuthority(nottobe

    unreasonablywithheldordelayed). TheApparatusshallbeselectedinconsultationwiththeAuthority. Themaximumheightof thenewor replacementApparatusshallbenohigherthantheexistingApparatus.

    (e) TheAuthorityshallbeconsultedonanyworkscarriedoutpursuanttoparagraph5.11(d)in

    the

    car

    parks.

    (f) Where theAuthority requires that the Service Provider installApparatuswhich isofa

    better appearance or quality than that of the original appearance or quality of theApparatusbeingreplaced,thentheprovisionsofSchedule16 (ChangeProcedure)shallapply.

    5.12 Subways, footbridges, stairways and ramps(a) Subways,footbridges,stairwaysandrampsareidentifiedonthedrawingssetoutinthe

    [MayriseDatabase].(b) Subways, footbridges, stairways and ramps indicated in Appendix 4 of this Output

    SpecificationshallbelitinaccordancewiththerequirementsofBS5489-12003.(c) Thelightsourcesusedshallhaveacolour-renderingindexequaltoorgreaterthanRa80.

    5.13 Private Roads(a) Roads not maintainable at public expense (Private Roads) which have Existing

    ApparatusareidentifiedinAppendix4ofthisOutputSpecification. TheAuthorityshallbe consultedonanyworksof repair carriedout inaPrivateRoadand included inanInvestmentProgramme.

    (b) WhereaPrivateRoadformspartofanAnnualInvestmentProgrammethepreferencewillbeforaoneforone,likeforlikebasis.

    (c) SomePrivateRoadsmaycontainnon-standardstylelightingsolutions,suchastheuseofpost top columns and/or ornate brackets. Where these are in situ they should bereplaced with Apparatus of a similar appearance and equivalent quality unless theAuthorityconsentstotheuseofalternativeequivalent.

    5.14 Attachments to Columns and Posts(a) TheAuthorityreservestherighttofix,ortoinstructorpermitotherstofixAttachments

    ontostreet lightingcolumns,signpostsoranyotherposts(includingsignsfittedatthetimeof installation,orretrospectively) inaccordancewithSchedule4 (AttachmentsandAdvertising).

    5.15 The provisions of Schedule 4 (Attachments and Advertising) shall apply in respect of theattachmentofBanners,HangingBasketsorFestiveLightingandotherpermittedAttachmentstoApparatus. FestiveLightingandBannersmayinvolveilluminatedequipmentwhichwillmakeuseoftheelectricitysupplywithintheLightingColumn.

    5.16 Theareasorstreetsinwhichattachmentofdecorativeitemsshallberequired,andthenatureofthearrangements,areshownondrawingssetoutinAppendix3ofthisOutputSpecification. Fortheavoidanceofdoubt thesearrangementsapply toall LightingColumns installedwithin theTownCentre. Allnew LightingColumns installed in these identified streetsor areas shall, atrenewal,becapableofcarrying theadditionalstructural loads imposedby theFestiveLighting,HangingBasketsandBanners, andhave facilities for the connectionof Festive Lightingwhichshallincludetheinstallationofahighlevelflushsocket,timeswitch,controllerandswitchedfuseisolator.

    5.17 TheAuthority, in consultationwith the Service Provider, shall vet all applications for a licenceunder S178 of theHighwaysAct 1980 from organisationswishing to install and operate anydecorative

    item.

    5.18 The Service Provider shallmake allowance for any energy consumed by the decorative items

    affixedtoApparatusundertheContract.5.19 TheServiceProvidershallberesponsiblefor installing,replacingasnecessary,removingandfor

    thestorageofFestiveLighting. Allswitchingonoroffofthedecorative itemsshallbe remoteandsimultaneous.

    6 Relevant Standards - General6.1 Liaison and Consultation

    TheServiceProvider shall liaiseandconsultwithall relevantbodies, includingasnecessary theAuthority, the Authoritys officers, town centre committees, emergency services, utilities,statutory bodies, planning authorities, community groups, residents and all other relevantstakeholdersand inparticularshallconductthe initialconsultationandsubsequentconsultationinaccordancewithMethodStatement4(Consultation).Consents, Permits and Approvals

    6.2 Notwithstandingclause50 (ConsentsandApprovals)of theContract theServiceProvider shallensurethatallrelevant,NecessaryConsentsandaccesspermitsinconnectionwiththeServiceareinplaceandarecompliedwith,including,withoutlimitation,anyrestrictionsrelatingtoheritageareas,ConservationAreas, rights ofway and any requirements arising by virtue of any streetfurniture

    being

    listed.

    Electrical Connections and Disconnections

    6.3 The Service Provider shall effectively manage the Connection(s) of Apparatus to the DNOsnetwork,includinganyworks inconnectionwithanyStoppingUpOrders. TheServiceProvidershall reconnectanyExistingApparatus thathas itssupply looped fromApparatus that isbeingreplaced. The Service Provider shall ensure that no Apparatus is disconnected and left unlitduringthehoursofdarknesspriortoasuitablereplacementbeingconnectedandcommissioned.The Service Provider shall reconnect any Existing Apparatus that has its supply looped fromApparatusthatisbeingreplaced. PS2willapplytonon-compliancewiththisparagraph6.3.

    6.4 WhereanyPrivateCableInstallationsneedtobealteredthecablesshallbereplacedratherthanjointedandextended. Wherethisdoesnotprovidebestvalue,jointsshallbekepttoaminimumandshouldonlybeusedwhereexistingcablesareproven tobe ingoodconditionvisuallyandcompliantwiththeIEEWiringRegulationsBS7671. Eachjointpositionshallbeidentifiedonsiteandarecordofthetype,route,depthandlocationofcablesandjointsshallberecordedontheManagement Information System in accordancewith the requirements of PS4 of thisOutputSpecification.Completion
