1. vessels under 50 tons gross registered tonnage. andpreferably capable of carrying up , to 35 tons, to provide andmaintain an efficient shipping service from Darwin to the Vic-toria - River, calling at the Daly River as required. The suc-cessful tenderer, may also be required to make occasional tripsto points along the roast between Cape Don and Victoria River,and the adjacent Islands. .

Attention is invited to the intimation in the CommonwealthGazette of 16th February, 1928, regarding the exemption fromsections 14 and. 43 of the Navigation Act of vessels under 50tons, trading within the limits of North Australia.

NOTE. ---It is generally considered that vessels drawing morethan 4 ft. 6 in. are unable to satisfactorily navigate theMosquito Flats in the Victoria River.

2. Tenders are. to .cover--*-(a) The provision, maintenance, equipment, and man -

'ning of a vessel and the conveyance of all loadingoffering to and from the places mentioned inparagraph 1, and from and to any of them.

The completion of at least six trips each year tothe Victoria River Depot, the first shipment tobe delivered early in April and the last shipmentto be delivered early in December.

NOTE. In the case of the 1928 season, the con-tractor is to state the date he will be in a posi-tion to commence the service.

The carrying out, as agreed to by the Commission,of such intervening shipments as are necessarybetween the dates of the six trips to the VictoriaRiver Depot, and of shipments to and from theother places mentioned in paragraph 1, and fromand to any of them.

3. Tenderers are to state the amount of subsidy requiredfor the season, based on the following freight rates beingcharged.:

Darwin to Rate per ton.Victoria. River landing places .. .. £6

Daly River landing places .. .. £3

Any other point along the coast as specifiedin paragraph 1 .. .. .. £3

with half these rates for all back loading to Darwin.4. Regularity of the service is essential, and the vessel must

have such engine power or auxiliaries as will enable the ser-vices to be carried out to schedule to be agreed to by theCommission.

5. Full particulars of the vessel to be used in the servicemust be furnished.

6. The successful tenderer will be required to enter into acontract for the carrying out of the service for a period ofthree years. Amongst other things provision will be madetherein for penalties for delays 'or stoppages 'in the service(except delays or stoppages beyond the control of the con-tractor) and for the payment of the season's subsidy in eightequal instalments distributed over the period specified inparagraph 2 (b) . The successful tenderer may also be requiredto furnish security for the satisfactory carrying out of theservice. ,

7. Tenders; accompanied by a deposit of £10 (Ten pounds),are to be addressed to the Secretary, North Australia Com-mission, Darwin, North Australia, and the receipt of them willclose at that office on 15th April, 1928. The envelope en-closing the tender is to be endorsed " Tender for ShippingService."

E it ordained by the Governor- General of the Commonwealthof Australia, with the advice of the Federal Executive

Council, in pursuance of the powers conferred by the New GuineaAct 1920 -1926, as follows :

1. (1.) This Ordinance may be cited as the Mining Ordinance1928. .

(2.) The Mining Ordinance 1922 -1927 is in this Ordinancereferred to as the Principal Ordinance.

(3.) The Principal Ordinance, as amended by this Ordinance,may be cited as the Mining Ordinance 1922 -1928.

Commencement.. 2. This Ordinance shall be deemed to have commenced on thefirst day of July, One thousand nine hundred and twenty- seven.

3. Section four of the Principal Ordinance is amended byadding at the end thereof the following definition :

" ` Warden ' includes an Assistant Warden."

BE it ordained by the Governor- General of the Commonwealthof Australian with the advice of. the Federal Executive

Council, in pursuance of the powers conferred by the Seat ofGovernment Acceptance Act 1909 and the Seat of Government(Administration) Act 1910, as follows :--

1.--(1.) This Ordinance may be cited as the Trespass on Corn- Short titlemonwealth Lands Ordinance 1928. and citation.

(2.) The Trespass on Commonwealth Lands Ordinance 1922-1927 is in this Ordinance referred to as the Principal Ordinance.

(3.) The Principal Ordinance, as amended by this Ordinance,may be cited as the Trespass on Commonwealth Lands Ordinance,1922 -1928.

BE it ordained by the Governor - General . of the Commonwealthof Australia, with the advice of the . Federal Executive

Council, in pursuance of the powers conferred by the Seat ofGovernment Acceptance Act 1909, and the Seat of Gov ernment(Administration) Act 1910, as follows :

1. This Ordinance may be cited as the Apiaries Ordinance Short title.1928.

2. In this Ordinance, unless the contrary intention appears- -" Apiary " means any place where bees are kept ;LI

Bee keeper " means any person who keeps bees, or anyperson in charge of bees ;

Disease, " means foul- brood, bee - moths, and any otherdiseases or pests declared by the Commission, by noticepublished in the Gazette, to be diseases within themeaning of this Ordinance ;

Frame -hive means a hive containing movable frames inwhich the combs are built and which may be readilyremoved from the hive for examination ;

Inspector " means inspector appointed in pursuance of thisOrdinance and _ includes an inspector appointed underthe Apiaries Act, 1916, of the State of New South Wales,who is authorized, under this Ordinance, to exercise thepowers and functions of an inspector under thisOrdinance;

the Commission " means the Federal Capital Commission.

3. (1.) The Commission may delegate any of its powers andfunctions under this Ordinance (except this power of delegation)in relation to any matters or dass of matters so that the delegatedpowers and functions may be exercised by the delegate withrespect to the matters or class of matters specified in the instrumentof delegation.

(2.) Every delegation under this section shall be revocable atwill and no delegation shall prevent the exercise of any power orfunction by the Commission.

4. The Commission may appoint such inspectors and other'officers as are necessary to carry out the provisions of thisOrdinance.

Exercise of 5. (1.) Inspectors appointed under the Apiaries Act, 1916powers andfunctions by of the State of New South Wales, may (if thereto authorized in?State inspectorsand officers, writing by the Commission) exercise all the powers and functions

of inspectors under . this Ordinance, and any other officerappointed under that Act may (if thereto authorized in writingby the Commission) exercise those powers and functions underthis Ordinance which correspond to the powers and functionswhich he may exercise under that Act.

(2.) The Commission may enter into an arrangement with theproper authority of the State of New South Wales for the paymentof the salaries and travelling allowances of inspectors and officersof that State whilst they are exercising the powers and functionsof inspectors under this Ordinance.

6.(1.) A bee - keeper shall not(a) keep or allow to be kept upon any land occupied by

him any bees, bee - combs, hives, or appliances knownby him to be infected by or liable to spread disease,without immediately taking the prescribed steps tocure or eradicate the disease ; or

(b) sell, barter, give away, or, . otherwise than in theprescribed manner, dispose of any bees or appliancesfrom an .apiary known by him to be infected by orliable to spread 'disease.

(2.) A person shall not bring into, or cause to be brought into,the Territory any bees, bee - combs, hives or appliances unless anduntil he has made an application to the Commission for thepurpose and the Commission has consented thereto.

(a) ,Any application for the consent of the Commission inpursuance of the last preceding sub section shall be accompaniedby a certificate by an inspector appointed under the Apiaries Act,1916, of the State of New South Wales that the bees, bee- combs,hives or appliances are free from disease.

(4.) The lessee, holder or occupier of any land onto 'which anybees, bee- combs, . hives or appliances are to be brought from -outsidethe Territory shall forthwith notify that fact to the Commission.

7. Every bee- keeper in whose apiary any disease appears shall, Bee - keeper tonotice ofimmediately after first becoming aware of its presence, send written isease.

8. Any inspector may enter and inspèct áuÿ premises wherebees are kept, and may inspect any bees, bee- hives, fittings,apparatus, appliances, or any articles used in connexion therewith.

9. (1.) If an inspector certifies, in writing; to the Commissionthat any bees are diseased and, in his opinion, are a source ofdanger to other bees, and that they ought to be destroyed, theCommission may make an order directing the bee -keeper in chargeto destroy the bees.

(2.) If, at the expiration of seven days after the service of theorder upon the bee- keeper, the bees are not destroyed, any 'inspectormay cause them to be destroyed at the bee keeper's expense.

10.= -(1.) If an inspector finds that any bee -hive, fittings; Bee - hives, &c.,liable to spreadapparatus; appliances, or any other articles are, in his opinion, disease to be

liablé to spread disease, he may order-- = disinf ected.

Power todestroy bees.

(a) that all or any of them be cleansed, disinfected, orreadjusted in such manner and within such time ashe directs, at the bee- keeper's expense ; and

(b ) that the articles, or such of them as he specifies, shallnot be sold or otherwise alienated or removed -for afurther specified period of not more than one month,except with his written consent.

(2.) If the inspector certifies in writing to the Commission thatany of the articles mentioned in this section cannot be effectivelycleansed, disinfected, or readjusted, and that .. they ought to bedestroyed, the inspector may cause the articles to be destroyed atthe cost of the bee - keeper :

Provided that where the value of the articles ordered to bedestroyed exceeds . Five pounds, this power shall not be exercisedwithout the written approval of the Commission.

11. On and after a date to be fixed by the Commission by after date tonotice in the Gazette any person keeping bees, other .than. native aged

14.(1.) A bee- keeper shall apply to have his apiary Registration ofapiaries.registered.

(2.) The applicaiton for the registration of an apiaryestablished at the commencement of this Ordinance shall be madewithin one month thereafter.

(3.) The application for the registration of an apiaryestablished after the commencement of this Ordinance shall bemade within one month . after the establishment thereof.

(4.) A bee. keeper who removes his apiary shall within fourteendays of the removal give notice thereof.

(5.) Applications and notices under this section shall be madeto the Commission in accordance with the prescribed form.

(6.) The' Commission may in its absolute .discretion registeror refuse to register any apiary.

(7.) A bee- keeper who fails to comply with any of theprovisions of this section shall be guilty of an offence.

Penalty: Twenty pounds.

Inspectors not 15. (1.) An inspector acting in the execution of thisliablefor Ordinance shall not be deemed . to be a trespasser by reason of anydame. entry or removal or destruction authorized by this Ordinance, nor

be liable for any damage occasioned in carrying out the provisionsof this Ordinance, unless the damage was occasioned by theinspector wilfully and without necessity.

(2:) A person shall not be entitled to receive any compensationin consequence of any measures taken for the eradication Of anydisease or the destruction oi;, any bees or any articles ordered tobe destroyed under this Ordinance, or in respect of any damagethat may result to him therefrom, either directly or indirectly,unless the damage was occasioned wilfully and without necessity.

Serviçe of 16. Every direction or order by the Commission, or anorders, le. inspector, shall be in writing, and, in the case of a direction or:-

order. by an inspector, signed under his hand, and shall be eitherdelivered to the bee keeper personally or sent to him by registeredletter addressed to him at his last known place of abode.

Offences and 17. Every person whopenalties. (a) obstructs an inspector in the exercise .of his duties

under this Ordinance ; or(b) fails to comply with any order or direction given under

the provisions of this Ordinance ; or(c). commits any other breach of this Ordinance,

shall be guilty of in offence, and shall, where no other penalty isprovided, be liable to a penalty not exceeding Twenty pounds ; andin the case of a failure to comply with any such order or directionthe inspector may himself carry out the necessary work at theexpense of the person failing so to comply.

(a) the duties of inspectors ;(b) the obligations of bee - keepers with . respect to

inspections;(e) the fees payable in respect . of the registration of

apiaries; : and(d) the imposition : of penalties not exceeding ..Twenty

pounds for breaches of the regulations.

AN ORDINANCERelating to Methodist Church Properties.

BE it ordained by the Governor - General of the Commonwealthof Australia, with the advice of the , Federal Executive

Council, in pursuance of the powers conferred by the Seat ofGovernment Acceptance Act 1909 and the Seat of Government(Administration) Act 1910, as follows :-

1. This Ordinance may be cited as the Methodist Church Short title.Property Ordinance 1928.

2. This Ordinance shall be incorporated and read as one with Incorporation.

3. In this Ordinance, unless the contrary intention appears Definitions.

" Land " includes any estate or interest in land (legal orequitable) and any easement, right, power or privilegeover, in or in connection with land ;

" Lease " includes a sub -lease ;" Methodist Church Property Acts " means the Methodist

Church Property Acts, 1889 -1902 of the State of NewSouth Wales in their application to the Territory ;

" Model Deed " means The Methodist Model Deed of NewSouth Wales, and includes any duly authorised altera-tion or modification thereof ;

" Real Property Ordinance " means the Real PropertyOrdinance 1925-1927;

" Registrar of Titles " ,means the Registrar of Titlesappointed under the Real Property Ordinance,

and any expression used in this Ordinance shall have the samemeaning as in the Methodist Church Property Acts.

4. The Registrar of Titles shall keep in safe custody and forreference a printed copy of the Model Deed certified by theCustodian of Deeds, when that copy is presented or tendered tohim for that. purpose by or on behalf of the President for thetime being of the Annual Conference of the Methodist Church ofAustralasia in New South Wales.

5. Where, whether before or after the commencement of thisOrdinance, a lease of any land is granted by or in the . name . ofthe Commonwealth or the Federal Capital Commission, subjectto the provisions of the Model Deed, the lease shall be held uponthe trusts and subject to the provisions of the Model Deed; andthe Registrar of Titles shall register the lease in the names ofthe lessees therein mentioned subject to the provisions of theModel Deed.

6. Where any land, which, whether before or after the Registration ofafer ocommencement of this Ordinance, is granted or transferred upon

the trusts and subject to the. provisions of the Model Deed, isheld under the Real Property Ordinance, the Registrar of Titlesmay register the grant or transfer, and may issue a certificateof title in the names of the transferees therein mentioned, orany subsequent trustees of the lands, subject to the provisions ofthe Model Deed.

8. Where any sale, mortgage, exchange or lease of any Churchlands is made in pursuance of and in conformity with the trustsof the Model Deed, if the lands are held under the Real PropertyOrdinance, the transfer, inörtgage, exchange or lease thereof,and all other necessary documents shall be as effectual if signedby a majority of the trustees for the time being of those Churchlands named in the Register of Trustees as if the transfer, mort-gage, exchange or lease, or other document had been duly signedby all the trustees or registered proprietors thereof ;

Provided that the trustees signing any such transfer, con-veyance, mortgage, exchange, lease or other document shall benot less than three in number:

Provided also that any trustee absent from the Territory mayjoin in, make and execute any such transfer, mortgage, exchange,lease or other document by his attorney duly appointed by himin that behalf.

The trustees shall be deemed and taken to be dulyentered or registered in pursuance of this section, when amemorial of their appointment has been entered in the RegisterBook upon the folium constituted by the existing grant or certifi-cate of title of the land or endorsed on any other instrumentevidencing title to the land.

The entries in the Register of Trustees authorised byTrustees andcertificate of the Methodist Church Property Acts to be made therein,. whenCustodian ofDeeds sufficient authenticated b y the signature of the Custodian of Deeds or theevidence. Acting Custodian of Deeds for the time being, and any extract

purporting to be an extract from the Register of Trustees inaccordance with the form in the Second. Schedule to the WesleyanMethodist Church Property Trust Act, 1889 of the State of. NewSouth Wales, certified under the hand of the Custodian of Deedsor Acting Custodian of Deeds, shall be received and taken, inall dealings with Church lands before the Registrar of Titlesand on all occasions whatsoever as sufficient evidence of theseveral extracted matters comprised in the extract, so far as theymay relate to any particular Church lands, without the pro-duction of the Register of Trustees.

BE it ordained by the Governor - General of the Commonwealthof Australia, with the advice of the Federal Executive

Council, in pursuance of the powers conferred by the Seat ofGovernment Acceptance Act 1909 and the Seat of Government(Administration) Act 1910, as follows:

1.(1.) This Ordinance may be cited as the Industrial Board Short title andcitation.Ordinance 1928.

(2.) The Industrial Board Ordinance 1922 -1926 is in this Ordi-nance referred to as the Principal Ordinance.

(3.) The Principal Ordinance, as amended by this Ordinancemay be cited as the Industrial Board Ordinance 1922 -1928.

2. After Section 8c of the Principal Ordinance the following.Section is inserted :

" 8n. Any printed paper purporting to be a copy of any Evidence ofdecision of the Board and to be printed by the Government decisions.

Printer shall, in all courts having jurisdiction in the Terri-tory, be evidence that such decision has been duly given bythe Board ".

AN ORDINANCERelating to the Protection of Birds.

BE it ordained by the Governor - General of the Commonwealthof Australia, acting with the advice of the Federal

Executive Council, in pursuance of the powers conferred by theNorthern Australia Act 1926, as follows :-

1. This Ordinance may be cited as the Birds Protection short title.Ordinance 1928.

2. This Ordinance shall commence on a date to be fixed by the Commencement.Government Resident by notice in the Gazette.

3. The Ordinances specified in the First Schedule to this Repeat.Ordinance are hereby repealed.

Ordinance repealed by thisOrdinance committed before the commencement of this Ordinanceshall be punishable in the same m anner as if this Ordinance hadnot been passed, and all permits issued or granted, things done,notices given, and proceedings had, under the authority or byvirtue of any of the said Ordinances, and not expired at the timeof the commencement of this Ordinance, shall confer and involvethe same rights and privileges, liabilities, and effects as if thisOrdinance had been in force when they were granted, issued, done,given, or had under the authority or by virtue of this Ordinanceand all inspectors and other officers appointed under the authorityof any of the said Ordinances, shall subject to anything which islawfully done under this Ordinance, continue notwithstanding thecommencement of this Ordinance.

Definitions. 5. In this Ordinance, unless the contrary intention appears" Bird " includes- the dead body of a bird;" Export " means export or remove from the Territory of

Central Australia, whether to places outside Australiaor to any place in Australia not' being in the Territoryof Central Australia ;

" Protected Bird " meañs a bird wholly protected under thisOrdinance and includes . a bird, not wholly protected,during any period during which the bird is protected ;

" Skin " includes any portion of the skin.

6. The Government Resident may appoint any person to bean Inspector of Birds.

7. Every member of the Police Force of Central Australiashall ex o fficio be an Inspector of Birds.

8. Any Inspector of Birds may(a) enter any land, house, shop, building, vessel, boat or

place where any protected birds, or any skins,feathers or eggs of protected birds, are suspected byhim to be ; and

(b ) seize any protected birds or any skins, feathers or eggsof protected birds together with any cage, box orother enclosure in which any protected birds arefound.

Birds protected. 9. Subject to this Ordinance(a) the .

birds included in the Second Schedule to thisOrdinance shall be protected during the whole of theyear;

(b) the birds included in the Third Schedule to thisOrdinance shall be protected during the close season;

(c) the birds included in the Fourth Schedule to thisOrdinance are not protected.

10. (1.) The close season shall be the periods mentioned inthe Third Schedule or such other periods as the GovernmentResident, from time to time, by notice published in the Gazette,determines.

(2.) In making any determination under this section theGovernment Resident may, if he thinks fit, fix different periodsfor different parts of the Territory of Central Australia.

11. The Government Resident may from time to time(a) by notice published in the Gazette transfer a bird from

one Schedule to this Ordinance to another Scheduleto this Ordinance and thereupon the birds sotransferred shall be deemed to be included in theSchedule to which it has been transferred;

(b) by notice published in the Gazette determine the closeseason for birds ;

(e) by notice published in the Gazette . declare that anyportion of Crown Lands, or any reserved or dedicated .lands, or the sea shore or any part thereof, and atthe request of the owner, any private lands, shall bea Bird Protection District, and . thereupon all birdswithin the . District, except birds not protected underthis Ordinance, shall be deemed . _for the periodmentioned in the notice to be wholly protected.

12. The Government Resident . may grant, sùbj ect to suchconditions as he thinks fit, a permit to any person to collect forscientific purposes from any Crown, reserved or .dedicated lands,not included in a Bird Protection District, . or from any privateland with the consent of the owner, any protected bird or the eggsof any protected Bird. .

13. The Government Resident may grant, subject to such áits.conditions as he thinks fit, a permit to any person to collect fromany Crown, reserved or dedicated lands, not included in a BirdProtection District, or from any private land with the consent ofthe owner, any protected birds for domestic pets and to keeppossession of those birds for that purpose.

14. The Government Resident may grant, subject to such rtt to

conditions as he thinks fit, a permit to, export protected birds, or protected birdsthe eggs of protected birds, in cases where he is satisfied that thebirds or eggs, as the case may be, have been collected for scientificpurposes in pursuance of section twelve of this Ordinance.

15. (1.) Any person who(a) kills, wounds, destroys, catches or takes ; or(b) has in his possession or control ; or(e) sells or offers for sale,

any protected bird shall be guilty of an offence.Penalty : Twenty -five pounds.

(2.) It shall be a good defence to a prosecution for an offenceagainst the provisions of paragraph (b) of sub - section (1.) of thissection if the defendant proves that the bird was killed or takenoutside the Territory of Central Australia or at a time when itwas not a protected bird.

16. (1.) Any person who(a) takes out of or destroys in the nest; or(b) has in his possession or control; or(e) sells or offers for sale,

the eggs of any protected bird shall be guilty of an offence.Penalty : Twenty -five pounds.(2.) It shall be a good defence to a prosecution for an offence

against the provisions of paragraph (b) of sub - section (1.) of thissection if the defendant proves that the eggs were taken, or thathe obtained possession of the eggs, at a time when the bird wasnot a protected bird.

(b) a person who has . in his possession any bird which waslawfully in his possession prior io the commencementof this Ordinance.;

(e) a person, being the owner or occupier of any garden,vineyard, or field of corn or other cultivated crop,killing or taking therein any bird mentioned in theSecond Schedule to this Ordinance ; or

(d) a person to whom a permit has been granted undersections twelve, thirteen or fourteen of this Ordi-nance, whilst acting in pursuance of the permit.

20. (1.) Any person who, without a permit, exports or entersat the Customs for export, or puts on any vessel or brings to anywharf, pier, or place for the purpose of export

(a) any protected bird; or(b) the skin of any protected bird ; or(c) the eggs of any protected bird,

shall be guilty of an offence.Penalty : Ten pounds.(2.) In any prosecution for an offence against this or the last

preceding section proof that the defendant was acting in pursuanceof a permit shall lie upon him.

21. (1.) Any person who enters on any land for the purposeof committing any offence against this Ordinance shall be guiltyof an offence.

Penalty : Ten pounds.(2.) Any person trespassing on any private land and unlaw-

fully having in his possession any protected bird or the eggs of anyprotected bird shall, on demand by the owner of the land, deliverto him those birds or eggs.

Penalty : Ten pounds.

22. (1.) Every person who uses, carries or has in his posses-sion any illicit sporting gun shall be guilty of an offence.

Penalty : Twenty pounds.(2.) The following shall be illicit sporting guns

(a) every swivel gun;(b) every punt gun ;(e) every gun which has a barrel longer than forty -two

inches ;(d) every gun which has a single barrel exceeding eight

pounds avoirdupois in weight, or double barrelsexceeding fourteen pounds avoirdupois in weight ;

(e) every gun which has a weight exceeding fifteen poundsavoirdupois ;

(f) every gun the bore of which is greater than No. 8.

23. Any person who aids, abets, counsels, or procures, or is inany way knowingly directly or indirectly concerned in the com-mission of any offence against this Ordinance shall be deemed tohave committed that offence and shall be punishable accordingly.

24. (1.) Subject to this Ordinance, all protected birds andall skins, feathers, and eggs of protected birds which are unlawfullyexported or entered at the Customs for export or put on any vesselor brought to any wharf, pier, or place for the purpose of export,or which are killed, taken, or in the possession of any person con-trary to the provisions of this Ordinance, and .every illicit sportinggun, shall be forfeited to the King, and may be seized by anyofficer of the Customs of the Commonwealth or by any member ofthe Police Force of the Territory of Central Australia.

(2.) A conviction for an offence against this Ordinance shalloperate as a forfeiture of the birds, skins, eggs or illicit sportinggun in respect of which the conviction is made.

25... Offences . against this Ordinance shall be punishable onsummary conviction by a magistrate or any two justices of thepeace sitting as a Court of summary jurisdiction.

Where, in pursuance of the last precedingsection, the Chief Health Officer causes any work . to be per -formed or any act or thing to be done, and where theperformance of that work or the doing of that act or thinginvolves the removal or demolition of anything, the ChiefHealth Officer may cause the thing which has been removedor demolished to be sold.

(2.) Any moneys received from the sale of anything whichhas been sold, in pusuance of the powers given by the lastpreceding sub - section, shall be applied in payment of theexpenses incurred by the removal or demolition of the thingwhich has been sold, and the balance (if any) shall be paidon demand to the owner of the thing which has been re-moved or demolished. 18. Any person who sells, offers, or hawks for sale the skin orfeathers of any protected bird shall be guilty of an offence.

Penalty : Twenty -five pounds.

19. The provisions of this Ordinance relating to the killing,wounding, catching, or unlawful possession of a protected bird, orthe taking or unlawful possession of the eggs of a protected bird,shall not apply

(a) to an aboriginal native killing birds or taking eggs onCrown land (not being a Bird Protection District)for food for himself or his family ;

(b) a person who has in his possession any bird which waslawfully in his possession prior to the commencementof this Ordinance ;

(c) a person, being the owner or occupier of any garden,vineyard, or field of corn or other cultivated crop,killing or taking therein any bird mentioned in theSecond Schedule to this Ordinance ; or.

(2.) A conviction for an offence against this Ordinance shalloperate as a forfeiture of the birds, skins, eggs or illicit sportinggun in respect of which the conviction was made.

25. Offences against this Ordinance shall be punishable on a summarysummary conviction . by a magistrate or any two justices of the áff ent of

peace sitting as a Court of summary jurisdiction.

AN ORDINANCE.To amend the Health Ordinance 1915 -1924.

BE it ordained by the Governor General of the Commonwealthof Australia, with the advice of the Federal Executive

Council, in pursuance of the powers conferred by the NorthernAustralia Act 1926, as follows :---

1 (1.) This -Ordinance may be cited as the Health Ordinance1928.

(2..) The Health Ordinance 1915 -1924 of the Northern Territoryin its application to North Australia, is in this Ordinance referredto as the Principal Ordinance.

(3.) The Principal Ordinance, as amended by this Ordinance,may be cited as the Health Ordinance 1915 -1928.

2. After section twenty -five of the Principal Ordinance thefollowing section is inserted :

" 25A.---(1.) Where, in pursuance of the last precedingsection, the Chief Health Officer causes any work to be per-formed or any act or thing to be done, and where the perform-ance of that work or the doing of that act or thing involvesthe removal or demolition of anything the Chief Health Officermay cause the thing which has been removed or demolishedto be sold.

(2.) Any moneys received .from the sale of anything whichhas been sold, in pursuance of the powers given by the lastpreceding sub- section, shall be applied in payment of theexpenses incurred by the removal or demolition of the thingwhich has been sold, and,the balance (if any) shall be paid ondemand to the owner of the thing which has been removed ordemolished.".

APPOINTMENT OF ASSISTANT PLANT PATHOLOGIST.

PPLICATIONS are invited for appointment to the posi-tion of Assistant Plant Pathologist to carry out inves-

tigations on virus and fungous diseases of plants. Applicantsshould possess a University degree or its equivalent, andshould preferably have had post graduate experience.in researchwork. The investigations will be carried out at the WaiteAgricultural Research Institute (University of Adelaide ),Glen 05iuond, South Australia. Initial salary, £300 to £400per annum, according to training and experience. The suc-cessful applicant will be appointed initially on probation fora period of twelve months. Thereafter he may be appointedas an officer under section 14A of the Science and IndustryResearch Act 1920 -26, in which case he would be eligible to

1 ARGET PRACTICE will be carried out in the abovevicinity on the 3rd and 5th March, 1928, between the

hours of 9 a.m. and 6 p.m. on each date.Location of Proclaimed Area. All that land or water con-

tained within the following boundaries : Commencing at apoint being the intersection of Geelong and Portarlingtonroads ; thence in a northerly direction six (6) miles toMannerin- street Leonards road; thence by that road in aneast and north - easterly direction to the coast at St. Leonards;thence on a line bearing due east 1f miles; thence on a linebearing due south 4f miles ; thence on a line due west 3.kmiles to the northern point of Swan Island; thence by thewest coast of Swan Island to its south extremity ; thence bya line bearing south -west to the foreshore of Swan Bay; thenceby a line bearing west mile to the point of commencement.

Direction of Fire. North- easterly. Fort Queenscliff will flya red flag from the masthead of the flagstaff whilst practiceis "carried out. Occupants of buildings in the vicinity shouldopen doors and windows during period of practice.

NoTE. Section 72 of the Defence Act 1903 -1918, reads:"No ships, boats, or person shall come or remain.-within theprescribed distance of any ship, battery, gun or person en-gaged in artillery or rifle practice, or . shall remain in . anyposition so as to obstruct such practice. Penalty 150."

PROMOTIONS- SECTION 50 AND REGULATION 109.

THE following promotions are provisional and subject to appeal by officers to the Public Service Board of Commissioners and, whereconsequent upon another provisional promotion, shall be dependent upon the latter being confirmed. Appeals should be forwarded

to the Public Service Inspector, in the State in which the promotion is to be made to reach him within fourteen days of the date of thenotification, and the ground of appeal must be as prescribed in section 50 of the Common ealth Public Service Act, viz.:

(a) Superior efficiency ; or(b) equal efficiency combined with seniority.

Officers stationed in remote districts may forward appeals by telegraph. An appellant shall without delay forward a copy of hisappeal to the Chief Officer of the Department in which the vacancy exists.

The range of salary indicates the classified value of a posi-tion, but appointments may be made at any salary within suchrange.

Successful applicants must comply with the provisions ofthe Superannuation Act 1922 -1924.

At offices where quarters are shown, a deduction at the rateof 10 per cent. of the minimum salary of the position will bemade, unless otherwise stated. Particulars of existing quartersare furnished merely for the information of officers. It is notincumbent on Departments to provide quarters, which, if pro-vided, may be wholly or partially withdrawn at any time.

Officers of the Commonwealth Public Service, who may betransferred without promotion, as the result of an applicationfor an advertised vacancy, will be .required- to pay their ownexpenses of removal unless the transfer comes within the con-ditions prescribed' in Publie Service Regulation No. 119.

Fares to locality of appointment of appointees who are notpermanent officers of the Commonwealth Public Service willnot be paid by the Commonwealth unless such fares (includ-ing, if the applicant is married, those of his wife and family )exceed. £3, when such allowance as the circumstances justifymay be granted.
