MINUTES Thornbury Township Board of Supervisors Meeting Wednesday, November 18, 2015 The Thornbury Township Board of Supervisors held a Work Session Meeting on Wednesday, November 18, 2015, at the Township Administration Building, Township Drive, Cheyney PA. Chairman Raith called the meeting to order at 7:00 p.m. with a salute to the flag. PRESENT:

On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, the Sewer Fund check register in the amount of $5,465.38 for the period November 5, through November 18, 2015, was approved. APPROVAL OF MINUTES On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the Wednesday, November 4, 2015 Public Meeting minutes were approved as presented. Chairman Raith called for public comment. There was no public comment. AGENDA ITEMS On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, advertising The Boards & Commissions Meeting Schedules for 2016, and the Annual Reorganizational and First Public Meeting of the Board of Supervisors for 2016, was approved. Chairman Raith called for public comment. There was no public comment. CR mentioned the combined meetings On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the extensions granted on the following Subdivisions: “53 SWEETWATER ROAD” from 11/26/2015 to 2/24/2016, “WILLS” from 12/1/2015 to 2/29/2016, “BLACKBELL FARM” from 12/8/2015 to 3/7/2016, “CRANE” from 12/29/2015 to 3/28/2016, “LAWLOR” from 12/30/2015 to 3/29/2016 and “BEARD” from 1/4/2016 to 4/3/2016, were accepted. Chairman Raith called for public comment. There was no public comment. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, an escrow reduction for the Sanitary Sewer Infrastructure and Public Improvements for the Romill AUDI Land Development, pursuant to Pennoni’s letter dated 11/17/15, and Catania’s letter dated 11/13/15, in the amount of $779,570.79, leaving a balance of $194,892.70, was approved. Chairman Raith called for public comment. There was no public comment. TOWNSHIP MANAGER'S REPORT- Jeff Seagraves The Manager’s Report was submitted and is attached. Jeff mentioned the budgets have been available for public inspection since Wednesday, November 11, and the Historical Commission has requested approval for the expenditure of $1,200.00 with Interpretive Solutions, for the Oral History Project, On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, authorizing allocation of funds from the Historical Commission’s 2016 Budget, for an additional Oral Histories Video from Interpretive Solutions, at a cost not to exceed $1,200.00, was approved. Chairman Raith called for public comment. There was no public comment. There was a question as to which year’s budget this is to come from. On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, amending the former motion from “2016 Budget” to the “2015 Budget”, was approved. Chairman Raith called for public comment. There was no public comment. Chairman Raith asked Jeff to follow up with Amy Chessock about the Re-Org Meeting. TOWNSHIP ROADMASTER’S REPORT – Lindsey Price The Roadmaster’s Report was submitted and is attached. There was no comment on the roadmaster’s report. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, the purchase of a 2015 CASE 580N T4 Back-Hoe / Loader, from Eagle Power & Equipment, for a total purchase price of $56,675.00, through Costars contract # 4400006022, was approved. Chairman Raith called for public comment. There was no public comment.

TOWNSHIP TREASURER’S REPORT – Amanda Gattuso The Treasurer’s Report was submitted and is attached. There was no comment on the treasurer’s report. On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the Treasurer's Report for October 31, 2015, was accepted as presented. Chairman Raith called for public comment. There was no public comment. Chairman Raith explained the two large expenditures for October, one was for the Road Program and the other was our yearly contributions. Vice Chairman Kelly complemented Amanda on a “nice job”. TOWNSHIP SOLICITOR’S REPORT – Kenneth D. Kynett, Esq.

The Solicitor’s Report was submitted and is attached. Ken explained the road bond agreement being drafted for the pipeline installation and any future road repairs. There was no comment on the solicitor’s report. TOWNSHIP ENGINEER’S REPORT – Michael Ciocco, PE The Engineer’s Report was submitted and is attached. Mike mentioned that the road program with Inconn needed one last punch list item to be completed and additional crack sealing is expected as a result of being under budget. There was no comment on the engineer’s report. TOWNSHIP SEWER ENGINEER - Charles Faulkner, PE

The Township Sewer Engineer’s Report was submitted and is attached. Chuck reported on the chlorine contact tank inspection with Delcora and they continue to work on the assessment reports for the pump stations and wastewater treatment plant. MANAGER’S REPORT

11-18-15

1. We advertised the budgets and they have been available for public inspection since Wednesday November 11, 2015.

2. We have experienced several problems at the Foxbrooke pump station with the emergency backup generator. The generator problems have been addressed. We are still working on phone line issues that we have to the remote dialer.

3. Work was completed on the Grinder pump for Creek Road East pump station on Tuesday November 10, 2015. The work was a more extensive than the original estimate due to the discovery of several parts that needed to be replaced once the equipment was taken apart.

4. We have made some progress with the property located at 5 Derry Drive. We have received multiple complaints regarding the general appearance of the property and have finally made contact with JP Morgan/ Chase representatives.

5. We received a request from the Historical Commission to approve another interview for the Oral History Project. The Historical Commission Chairman, Ric Miller, has requested approval for the expenditure of $1,200.00 with Interpretive Solutions.

6. I have scheduled a meeting with the officers of the Mill Creek HOA to discuss any items that they have with Mill Creek that may be considered as public improvements We continue to work with the Cutler Group on the completion of outstanding items at Mill Creek.

7. I met with Chuck Faulkner and Ted Jacquet to discuss future areas of interest for Public Sewers. I will be in contact with Concord Township to determine their capacity for any addition to the West Side Sewer District.

8. I attended an emergency preparedness meeting at The Glen Mills Schools. They are updating their plan and I am working with them to facilitate a meeting with Cheyney University as a backup location for shelter space and also a meeting with the three fire companies that would respond to any incidents at the school.

9. I am scheduling a meeting with Willard McMullin and others to update our Emergency Management plan. This will be done in conjunction the Hazard Mitigation Plan that Delaware County is working to renew.

10. We inspected the riser rings that were placed in Creek road during the new paving project completed by Penn DOT. Chuck Faulkner is working out the details for final payment to Alan Myers.

THORNBURY TOWNSHIP Public Works Department Report – Week Ending November 13, 2015

1. Routine maintenance performed throughout the Township, including clearing inlets and road edges of leaves.

2. Onsite daily at stormwater pipe replacement project at Andover Development.

3. Removed two down trees from Locksley Road.

4. Marking out Cottage Lane, Elstone Drive, Honeysuckle Court and Sweetbriar Lane for crack sealing before road program is closed out.

5. Accepted 5 loads of salt (116 tons). Will order 4 additional loads before the

end of November.

6. Forwarded Letter of Intent to Eagle Power Equipment for the purchase of a backhoe – see attached. Billing to be January 2016.

and recorded same with Delaware County Recorder of Deeds. Drafted Mortgage Satisfaction for 40 Woodridge Road and recorded same following execution by Township.

2. Right to Know Requests – No RTK requests were forwarded for review.

3. Greenbriar Phase 5 and Preserves at Squire Cheyney – Worked with Township professionals and staff to respond to escrow release requests.

4. Anticipated Pipeline Work - Worked with Township professionals and staff to develop form of road maintenance and bonding agreement to protect Township roads.

REPORT OF THE ENGINEER November Meeting November 18, 2015

Work completed for the period:

Grading and Road Encroachment Permits – Reviewed several plans for grading and road encroachment. Continuing construction inspections of various properties.

Planning Commission – Continued working with members on Pipeline Ordinance and Subdivisions.

Subdivision Plans: Wills - No further submission has been received. Lawler Subdivision - Awaiting revised plans. Crane Property – New review letter issued on revised plans.

Phillips – Lot Line Change – PC recommended approval. Updated plans under review. Sweetwater Road Tract – Amending existing 3 lot subdivision plan to remove pond – issued review letter, PC recommended approval contingent upon satisfaction of review letter. Black Bell Farm – 15 lot subdivision review letter issued. Met with design engineer. Awaiting revised plans. Beard Tract – Lot line change deferred by PC to Chester Heights Borough for review. Daniels Subdivision – 425 Thornton Rd – 2 Lots – Plans received and under review.

Floodplain – Ordinance adopted on August 19th, DCED notified, and information for forwarding to FEMA/DCED for final acceptance forwarded to the subdivision coordinator for final processing. New Floodplain mapping received and under review. No Thornbury properties appear to be affected.

Andover – Concrete restoration sample location has been reviewed and recommended for approval on curbs only with an extended maintenance bond period for those areas. Public Improvement repair work (curb, sidewalk, and roadway) has begun in an effort to prepare for the roadway dedication process. Storm Sewer repair work is ongoing.

Romill Associates(Audi) – Thornbury site improvements complete and final inspection requested and completed. Deficiencies list has been issued. Release of escrow recommended in the amount of $779,570.79, which leaves a new escrow total of $194,892.70 remaining. Mill Creek – Deficiencies list was forwarded to developer by Township. Developer has begun deficiencies repair work. Ongoing discussions with HOA for closeout as well.

Greenbriar V – Dallet Tract – Updated punch list and recommendation on reduction of escrow was issued. Repair work continuing. Coordinating a meeting with Orleans to facilitate completion.

Road Program 2015 – Road work completed and 90% payment complete. Closeout paperwork under preparation.

3 Keswick Drive – Drainage improvement work on Keswick and Slitting Mill Road has been certified by the engineer of record. Inspection during a recent rain event has revealed that some minor ponding still remains. The engineer and owner have been notified to make final adjustments.

90 Station Road – Sketch plan for roadway drainage improvements is with Roadmaster.

Barrett’s Meadow – PA DOT land agreement executed. Awaiting PA DOT plans and permit updates. US Army Corps of Engineers public notice for comment on stream and wetland permitting received and under review for response letter.

Sunoco Logistics – Township response letter sent regarding NPDES permit. Met with Sunoco Roadway Group. Reviewed Roadway Bonding Agreement with Solicitor. NPDES MS-4 - Goose Creek Basin TMDL Plan – Advertised for 30 day public comment on August 26, 2015 with no comments received. Plan being prepared for submission this month. Plan required to be submitted by December 31, 2015. Required compliance within 15 years of permit, currently yields year 2028 to meet reduced phosphorous rates. Plan submitted to PA DEP on October 30, 2015. Malvern School – Owner is working out removal of unauthorized fill in a floodplain with PA DEP and will have any new work permitted with PA DEP and the Township. Lake Road – A.F. Damon Co. notified of a paving deficiency that should be repaired under the maintenance bond from 2014 Road Program. A.F. Damon has completed the repair work. Denise Drive – Met with Chester Water Authority to review water main installation, trench backfill and road restoration. An 8 foot wide, minimum, mill and overlay of Denise Drive was agreed to by CWA. Additional paving to centerline was discussed with Charlestown Paving (CWA contractor) and agreed to be extended at Thornbury Road Program prices. Final paving and sealing is completed.
