DECLARATION OF OPENING /ANNOUNCEMENT OF VISITOR The Shire’s Chief Executive Officer welcomed Councillors and those present and declared the meeting open at 3:12pm. Mrs Joyce McCubbing, Justice of the Peace, conducted the swearing in ceremony of newly elected Councillors Smoker, Meeking, Lynch, Jones and Mouritz with four terms expiring 16 October, 2021 prior to the opening of the meeting. The CEO chaired the meeting and called for nominations for the position of Shire President. Cr Lynch nominated Cr Meeking. Cr Meeking accepted the nomination. Cr Browning nominated Cr Smoker. Cr Smoker accepted the nomination. A secret ballot was held that resulted in 5 votes for Cr Meeking and 4 votes for Cr Smoker. The Shire CEO declared Cr Meeking elected to the position of Shire President for a two year term ending in October, 2019. President Meeking assumed the Chair. The President called for nominations for the position of Deputy Shire President. Cr Meeking nominated Cr Lynch Cr Lynch accepted and there being no further nomination, was elected unopposed as the Deputy Shire President for a two year term until October, 2019. 2. MINUTES OF ORDINARY MEETING HELD AT KONDININ ON 15th NOVEMBER, 2017

1. DECLARATION OF OPENING /ANNOUNCEMENT OF VISITOR

The Shire’s Chief Executive Officer welcomed Councillors and those present and declared the meeting open at 3:12pm. Mrs Joyce McCubbing, Justice of the Peace, conducted the swearing in ceremony of newly elected Councillors Smoker, Meeking, Lynch, Jones and Mouritz with four terms expiring 16 October, 2021 prior to the opening of the meeting. The CEO chaired the meeting and called for nominations for the position of Shire President. Cr Lynch nominated Cr Meeking. Cr Meeking accepted the nomination. Cr Browning nominated Cr Smoker. Cr Smoker accepted the nomination. A secret ballot was held that resulted in 5 votes for Cr Meeking and 4 votes for Cr Smoker. 9.1.4 2016/17 Annual Auditors Report

Applicant: Shire of Kondinin Author: MOF/CEO Date: 9th November, 2017 Disclosure of Interest: Nil SUMMARY/COMMENT: The Shire of Kondinin’s auditors Byfields Business Advisers have prepared the 2016/17 financial year’s Audit Report for Council’s consideration/adoption. Following the official appointment of the Office of Auditor General (OAG) as auditor for Local Government by the Parliament, the Local Government Amendment (Auditing Act) 2017 had also been issued as at 1st September 2017. To this effect, some of the duties and responsibilities of the audit committee stated in the Local Government Operation Guidelines – Audit in Local Government were no longer applicable and require revision. While the new audit committee members are yet to be appointed, the audit committee’s duty to consider and recommend adoption of annual financial report to Council is optional. The Audit Report prompts the conducting of an Annual Meeting of Electors where the Audit Report (amongst other reports) will be presented to electors within 56 days after acceptance of annual report. As no Council meeting held on January, hence this meeting is scheduled to be held after the 20th December 2017 Council meeting to comply with Local Government Act 1995 timeframe requirement. The annual audit demonstrates that administration of the Shire of Kondinin has conducted the Shire’s affairs from a financial management and compliance viewpoint in a sound and efficient manner. It is noted that in the entire financial management and annual financial statement reporting, no adverse comments were made by the auditor. Metal Sculpture Project

Completed (still to be Acquitted) – Received $11,200 and the Funding Agreement in place. Sculptor Len Zuks was engaged to facilitate the project. Workshop was held from 20 – 26th March 2017 at Kondinin Men’s Shed. Life

size sculptures have now being installed adjacent to the Kondinin bowling green within the new landscaped area. Acquittal to be submitted by January

2018.

Grant pre-application preparation is underway including a Cost Benefit Analysis. Most member Councils of the Alliance are in agreement that

application be made to the Federal Government Building Better Regions Fund for the construction of Independent Units. This is as a result of the newly

elected State Government withdrawing previous funding approval. The Building Better Regions Fund round opened on 7th November and closes on 19th December 2017. Shire of Wickepin being the lead agency will prepare the

necessary submission for funding.

Kondinin Community Art

Completed and Acquitted – Application to engage Ashley Collard to run a 3 day art project in Kondinin in July 2017 to create: Noongar 6 season poles in the

community garden; community school centenary mural and rock painting was submitted on 13th January 2017. Re-submitted in April and approved in May

2017. During NAIDOC week the poles in the community garden were painted in the 6 seasons and a BBQ lunch and Noongar games was provided on the

Thursday. Due to standard of original mural Georgina Paterson was engaged to

Community Development Project Summary

Project Status

Kondinin Community Garden IN PROGRESS - Busy Bees being held at the end of each month. New children’s play equipment installed at Community Garden by David Tyson. Recent plantings and tidy up in lead up to school centenary and twilight markets. Currently progressing entry signage, new gate and a money deposit box and have purchased outdoor drums for nature play area.

Wave Rock Improvements IN PROGRESS - Working with Hyden Councillors and Works Manager. Discussions have been made with the Department of Parks and Wildlife who have suggested that the Shire apply for the Lotterywest Trails Grant in two parts. The first part to assist in the funding of a design for new pathway and boardwalk and associated plantings and interpretative signage. The second part would be for the construction itself. Matter to be progressed during the 2017/2018 financial year. MPD attended Trails Seminar on 10th November for guidance on funding options. See separate Agenda Item 9.2.3 of Ordinary Meeting of Council 15th November 2017.

Hyden Streetscape Project for 2022 Centenary

IN PROGRESS - Meeting was held on 20th October 2016 at Coronation Park with some good feedback received to progress project. Some indicative plans / sketches have been drawn up. At the Ordinary Meeting of Council on 15th March 2017 the Council resolved for the Shire’s Administration to prepare a design brief and invite consultants to provide a quote to prepare a concept design for Hyden Streetscapes. A draft copy of the Design Brief was tabled at the Ordinary Meeting on 19th April 2017 for Information. Design Brief was sent to 11 design companies for RFQ on 5th May 2017. Quotations closed on 5th June 2017 and consultants TPG were selected as the preferred consultants at the Ordinary Meeting of Council on the 21st June 2017. Initial site

visit with designer and landscape architect held on the 3rd August 2017 attended by Manager Planning and Development and Manager of Works. Consultants have drafted a plan to be presented to the Council and Hyden Community that was presented on 14th September at the Hyden Community Resource Centre. Consultation on draft plan closes on 12th October 2017. Currently working through final design and implementation plan to be presented to 16th December 2017 Council Meeting.

Karlgarin Streetscape Project for 2020 Centenary

IN PROGRESS - Meeting held with Karlgarin Progress Association secretary on 15th December 2016 to discuss ideas for the centenary, including pioneer wall opposite the former shop and story boards. CEO and Manager of Planning and Development attended Karlgarin Progress Meeting on 22nd February 2017 in which this project was discussed in detail. Various ideas were discussed and it was agreed that a sub-committee be created to progress the matter. Sub-Committee met on 7th September 2017 at Karlgarin gazebo. Productive ideas discussed which are being followed up on. Key ideas: information boards on the gazebo; and artistic centre piece to be installed next to the gazebo. Currently looking at artist to engage to complete this latter idea. The running of the day was also discussed to be held on the long weekend in October 2020. Artist Impressions have been received from Forever Shining for a ‘giant gilgie’. Quotations currently being sourced.

Roe Tourism Website Working with the Executive Officer from Roe Tourism and the CDO from the Shire of Bruce Rock to compile information to Market Creations to create a website for Roe Tourism. Branding and new Logo was completed by Daniela Varone. Project part of surplus funding from WDC from another project undertaken by Roe Tourism several years ago.

New Entrance Signage at Shire Boundaries

Working with Shire’s Works Manager and Cr Butler to complete and install new signage on the Shire’s boundary and remove outdated signage to streamline across Shire. Working with individual communities of Hyden, Karlgarin and Kondinin for personalised entrance signage to towns.

Amendments to Town Planning Scheme No.1

Amendments proposed to Town Planning Scheme No.1, to: 1) re-zone land to enable Whispering Gums development; and 2) Enable grouped dwellings (more than one dwelling) in a rural zone

A report to Council to formally initiate the zoning change for Whispering Gums was presented as a separate Agenda Item of the Council Meeting held on 15th March 2017. Information has been sent to Environmental Protection Authority to assess amendment prior to advertising. Approval from the Environmental Protection Authority has been received and advertising to service providers, public authorities and affected land owners is currently being undertaken and closed on the 21st July 2017. Council approved final stages of amendment at Council Meeting on the 20th September 2017 and documents have been forwarded to the Western Australian Planning Commission for final approval.

Creation of dedicated laneway to the north of Clayton Street, Hyden

To formalise the current rear access to lots on the north of Clayton Street it is proposed that a portion of the private property on Lot 802 is excised for the purpose of a dedicated laneway to be managed by the Shire. Matter has been discussed with the owner of the land who has verbally agreed to provide the land to the Shire for the purpose of a laneway. To be progressed in liaison with the owner during the 2017/2018 financial year.

An application has been received for a change from a former abattoir to a tourist accommodation. The proposal comprises the following elements:

1. The conversion of the former Slaughter House to a ‘Campers Kitchen’ comprising a laundry, kitchen and dining area.

2. The shed structures to the south of the former Slaughter House be tidied up, partially demolished and made good to accommodate a games room and BBQ and Entertainment area; and

3. The re-location of two (2) x four (4) bedroom transportable buildings to the west of the ‘Campers Kitchen’, with one of the transportable buildings to house three (3) bedrooms and an office/storeroom and the second one of the transportable buildings to house three (3) bedrooms, with an opening between two rooms to make a family style room.

The subject lot is predominately vacant with several small buildings located in the south eastern corner of the site which were used for the abattoir and where the applicants are proposing the new development. The subject land is zoned ‘Rural’ under the Shire’s Town Planning Scheme No.1. Under the Shire’s Town Planning Scheme No.1 ‘tourist accommodation’ is permitted in a rural zone, subject to advertising and approval by Council. The subject lot falls within in a Bushfire Prone Area and therefore in accordance with State Planning Policy 3.7 Planning in Bushfire Prone Areas, a Bushfire Attack Level (BAL) Assessment Report has been undertaken, in which the recommendations are to be considered in the determination of this application. The preferred access to the lot expressed by the applicants is from the Hyden-Lake King Road, however written advice from Main Roads has confirmed that access from the Hyden-Lake King Road is not supported and that the recommended access to be from Alymore Road. As the accommodation is proposing four (4) or more sleeping compartments within the complex, a disability unit must be provided. Based on the information provided by the applicant and on completion of the consultation period it is considered that the proposal meets with the necessary requirements of Shire’s Town Planning Scheme No.1 and therefore it is recommended to the Council that the proposal be supported subject to the conditions and advice notes provided. ASSESSMENT Bush Fire Attack Level As per the Bushfire Attack Level (BAL) Assessment Report dated 23rd October 2017, the determined

BAL rating for the proposed development including both the Accommodation and the Campers Kitchen is BAL 12.5. A BAL 12.5 rating is considered to have the lowest risk from bushfire with the main concern from ember attack. Section 5.0 of the report provides a list of recommendations that will ensure that this risk can be managed in an appropriate manner. The recommendations have been listed as conditions of planning approval. Tourist Accommodation Under the Shire’s Town Planning Scheme No.1, the land use in which best describes the proposed development is ‘Tourist Accommodation’ as it comprises both short term accommodation for guests and onsite facilities for guests and is not a Caravan Park. The subject lot is zoned ‘Rural’ and under the Shire’s Town Planning Scheme No.1 the proposed use can be permitted, subject to advertising and approval by Council. In further support of this are two of the three objectives of a Rural Zone under the Shire’s Town Planning Scheme No.1 as listed below:

‘To consider non-rural uses where they can be shown to be of benefit to the district and not detrimental to the natural resources or the environment’ and

‘To allow for facilities for tourists and travellers, and recreational use’ Access As shown on the maps attached to this report and the survey plan, the subject lot is bounded to the east, west and north by a road reservation. The reservations to the east and the west are local road reservations and reservation to the north is a primary road reservation. The latter reservation is part of a main road reservation and therefore under the governance of Main Roads WA, with the former two reservations under the jurisdiction of the local government. The applicant has indicated that their preferred access to the lot being that from the intersection of Lovering and Hyden-Lake King Road and then extending along the eastern boundary of the lot as was the access when the lot operated an abattoir. In 2015 this intersection was upgraded and altered by Main Roads. Given these upgrades and that the proposed access traverses a primary road reserve the matter was referred to Main Roads for their consideration. A letter dated dated 8th November 2017 was received from Main Roads WA stating their following position on the matter: “Main Roads does not support the proposal for the lot to access Hyden-Lake King Road on the south side of the intersection with Lovering Road. Main Roads Driveways Policy Section 3.3.3 Location details that driveways should be located as far as practical from intersections to minimise points of conflict and confusion and to improve safety. Locating driveways opposite the terminating road of a T-junction should be avoided. Western Australian Planning Commission (WAPC) Planning Policy No. DC 5.1 Regional Roads (Vehicular Access) Clause 3.3.2 states “Where alternative access is or could be made available from side or rear streets or rights of way, no access shall be permitted to the regional road.” Lot 2952 has access via Aylmore Road currently and Main Roads recommendation is that the development application include access to this Lot via Aylmore Road.” In light of the above, the Shire’s administration will be conditioning that the primary access to the lot be from Alymore Road. Main Road has advised verbally that they are happy to work with the applicants to ensure adequate signage from Alymore Road to assist in directing tourists to the lot. Environmental Health and Building Matters The matter has been discussed with the Shire’s Environmental Health Officer and the Shire’s Building Surveyor and a site visit undertaken. Matters to be considered in relation to Environmental Health and Building have been listed as conditions of planning approval, however key points to note are as follows: A Building Permit for all works including plans for both the work and fit outs to the existing buildings and the transportable buildings shall be submitted comprising but not limited to include:

All works must comply with Part 8 of the Shires Health Local Laws 2016 and any other relevant requirements relating to Environmental Health; 5. An application to install an apparatus for the treatment of sewage in accordance with the Health (Treatment of Sewage and Disposal of Effluent and Liquid Waste) Regulations 1974 is required to be submitted to the Shire of Kondinin for an approval to install the septic tank/s as required prior to the issuing of a Building Licence; and 6. The location of the proposed freestanding 1m x 1.5m advertising signage to be confirmed and approved through liaison with Main Roads WA and the Shire of Kondinin prior to occupation of the development. Advice Notes 1. The development shall be substantially commenced within two (2) years from the date of this approval. If the development is not substantially commenced within this period the approval will lapse and be of no further effect. Where an approval has lapsed, no development shall be carried out without the further planning approval of the Shire of Kondinin having first been sought and obtained; 2. Failure to comply with any of the conditions of this planning approval constitutes an offence under the provisions of the Planning and Development Act 2005 and the Shire of Kondinin Town Planning Scheme No.1 and may result in legal action being initiated by the local government.

Following the consultation period a summary of the submissions was presented to the Ordinary Meeting of Council on the 15th July 2015 for information. At the Ordinary Meeting of Council on the August 2015, Council endorsed the a Wave Rock Improvement Plan 2015 – 2018, as a working document which details the improvements, a proposed timeline and indicative budget for the period between 2015 – 2018. On endorsement of the Wave Rock Improvement Plan the Council has continued to allocate $50,000 per year to improvements to Wave Rock. Now that we are in 2017, it seems a good time to present the Wave Rock Improvement Plan to Council with an update on what has been implemented over the last few years and items that still require action. The purpose of this report is to endorse the amended version and resolve that a new Wave Rock Improvement Plan 2018 – 2022 be presented to Council by early 2018 to guide future development in the lead up the Hyden’s Centenary in 2022 and to inform budget considerations from 2018/2019 onwards. At this same meeting the Council also endorsed the Shire of Kondinin’s submission of two grant applications for the extension to the Kondinin Community Recreation Centre to the Department of Sport and Recreation (CSRFF Forward Plan) and to the Wheatbelt Development Commission (Regional Development Grant). This latter agenda item also endorsed Council’s support of $250,000 towards the project in the 2016/2017

budget to be utilised in the 2017/2018 financial year, and also to support the project funding and external grant applications by covering any funding shortfall in the event that one grant funding source is not successful in conjunction with possible shortfall funding assistance from the Kondinin Community and Recreation Council. The Shire’s Administration in close collaboration with the Kondinin Community Recreation Council applied and was successful in receiving grant money from the Department of Sport and Recreation ($100,000) and the Wheatbelt Development Commission ($185,000) to supplement the confirmed cash contributions from the Shire of Kondinin ($250,000) and the Kondinin Community Recreational Council ($150,000) to cover the costs of the proposed development. The monies requested were based on the Quantity Surveyor Report by Davson Ward dated 1 August 2016 which estimated the total project cost at $770,000. The full amount was not received from the Department of Sport and Recreation leaving a resulted shortfall of $85,000. The Council increased the contribution to the project from $250,000 to $385,000 which was adopted in the 2017/2018 budget to cover the short fall by not receiving the full amount from the Department of Sport and Recreation and to enable to include the northern canopy as an option in the tender so as to complete the project. The Shire and the Kondinin Community Recreation Council have been working closely with Rosalie Pech Eva Architects and the associated engineering consultancies to finalise the construction plans for the proposed development. The most recent correspondence with the architect confirmed that the expected date to receive the final plans is the 14th December 2017. The purpose of this report is to authorise the Shire’s Administration to call for tenders for the extensions and alterations to the Kondinin Community Recreation on receipt of the completed construction plans and associated documentation from Rosalie Pech Eva Architects. 10.3.1 2017 Local Government Election Outcome

Applicant: Shire of Kondinin Author: CEO Date: 8th November, 2017 Disclosure of Interest: Nil SUMMARY / COMMENT: Congratulations to the following successfully elected Councillors in the 2017 Council election, with four year terms expiring on 16 October 2021: Councillor Allen Smoker; Councillor Steve Jones; Councillor Sue Meeking; Councillor Gerard Lynch and Councillor Kent Mouritz. The election resulted in a 70.34% of total electors voting, which is considered very high. The high turnout of voting, particularly from the Hyden area, can be attributed to the campaign lead by Brian Mayfield encouraging Hyden electors to vote and to vote for Hyden candidates. This campaign was to a large extent lead by the belief that representation on Council has not been equitable. With the result of this election, it can be considered that Council representation is entirely equitable with four Councillors representing Hyden, four from Kondinin and one from the Karlgarin area. What is more important is continuing to achieve a united and cohesive Council that genuinely looks after the best interests of the whole of the Shire and not Councillors just serving the best interests of their own town. Over the next twelve months I suggest Council given consideration towards whether establishing a Ward system is desirable towards achieving a long term solution that ensures fair town/elector representation of Council members. A three Ward system comprising four Councillors from the Hyden Ward, four Councillors from the Kondinin Ward and one Councillor from the Karlgarin Ward would seem to be a fair representation spread, which is the current situation. The Shire of Kondinin, up until this recent divisive action, (the extent of support of which is currently unclear within Council), has enjoyed a very stable Council for many years with its administration delivering sound grant funded community projects, excellent audit reports, a stable workforce and the Shire being in a strong sustainable financial position. The next election in 2019 will be all important in ensuring that equal and fair representation occurs across the Shire and the Shire’s stability and good record continues. The Department of Local Government makes no secret of the fact that it has a Council watch list of those considered vulnerable, at risk and problematic. Special challenges do exist in a local government that has two or more towns within its boundaries, with the main concern being that each town gets its fair share of facilities and amenities. Author: CEO Declaration of Interest: Nil Date: 8 November, 2017 BACKGROUND / COMMENT: Discussions have been held between the CEO and Manager of Works regarding identifying and pursuing future opportunities for the Shire of Kondinin in respect of obtaining additional road maintenance and road construction contracts/works that are within our capability to undertake and achieve a financial/economic benefit to the Shire of Kondinin. Possible areas identified include undertaking:

Current and future WANDRRA road reinstatement construction works for neighboring Shires.

Regional Road Group road construction works for neighboring Shires.

Kidman Resources’ Lithium mine site and Lacour Energy solar and wind farm project site works construction and access road construction contract works.

Lendlease, who have been successful in obtaining the substantial Main Roads WA contract for the Wheatbelt region, have indicated that they would be keen for the Shire of Kondinin to undertake road maintenance as well as certain road construction works under their newly awarded MRWA contract. This (main) road maintenance and construction work is likely to extend beyond our Shire boundaries and in certain cases may be carried out in joint collaboration with the Shire of Kulin’s road construction workforce. Construction work may also include the realignment of Brookton Highway near Sloan Road, Kondinin and other works associated with Brookton Highway. Lendlease is keen to enter into this service arrangement with the Shire of Kondinin and has presented the Shire with its Services Contract Agreement.

Additional Regional Road Group and Roads To Recovery grant funded road projects within the Shire of Kondinin. Opportunities to obtain more grant funding in these areas is to be aggressively explored (Commodity Freight Routes, Black Spot funding, etc.)

In respect of the Kidman Resources Lithium project, we are advised that the company will be carting ore from the mine site at Mt Holland south along the Marvel Loch Forrestania Road to the crossroads and then east along the Hyden Norseman Road to its Lake Johnstone processing facility. Once processed, the ore will be transported from Lake Johnston on the Hyden Norseman Road to the crossroads and then south via the Marvel Loch Forrestania Road, Carstairs Road and Brookton Highway to Esperance Port or via the Kalgoorlie Esperance Highway to Esperance Port. Commodity Route funding may be available to assist the Shire as a result of this activity, as well as financial grant assistance from Kidman Resources possibly in the form of a negotiated annual financial contribution to cover the cost of the Shire maintaining the roads in good order from wear and tear caused by this non-ratepayer activity on our road network . These revenue streams will be in addition to potential contract private works undertaken by the Shire’s road construction crew for Kidman Resources. Advanced discussions are currently underway with the Shire of Lake Grace with a view to the Shire of Kondinin undertaking its current 2017/18 Regional Road Group program to the value of $609,000. Discussions also extend to the Shire of Kondinin undertaking part of their $11million WANDRRA AGRN 743 reinstatement works program either directly or under sub contract to contracting companies awarded the tender(s), although the Shire of Kondinin undertaking any WANDRRA works in the 2017/18 year is considered very unlikely as we are fully committed if we are successful in carrying out Lake Grace’s 2017/18 RRG program. The Shire of lake Graces’ Regional Road Program that we are proposing to undertake is:

grants program where the Shire is required to expend certain Own Resource monies on our road program annually. What we are aiming to achieve is a desirable balance between undertaking our normal road maintenance and construction programs from grant (RRG & R2R) funding and own resources to maintain a high standard of our roads within the Shire of Kondinin as well as gain the financial benefits to the Shire in undertaking strategic contract works. This fine balance will minimise own resource spending in road construction and boost revenue derived from road maintenance and construction contractual work, thus making more Shire revenue available for other community projects, which funds can be leveraged to obtain greater state and federal grant monies towards future community projects. SUMMARY / COMMENT: Achieving state and federal government agreement to fund the sealing of the entire length of the Hyden Norseman Road is certainly a strong future Shire of Kondinin objective, which amenity would have a significant positive impact on tourist, as well as significant transport/freight industry traffic, numbers passing through our towns. Because the status of the road would lift to become a second main interstate highway between Western Australia and South Australia, Federal Government grant funding appropriately would apply, more so than state government grant funding. Accessing such funding would be challenging and would certainly require lobbying our federal government politicians for support. Such politicians may be conflicted where their electorate covers a greater population who would oppose such a new highway diverting interstate traffic away from their towns adversely affecting businesses. I believe this proposal appropriately needs to involve and have the support of numerous other local governments including those neighbouring us, as well as many others in the south west region, to have the desired impact to achieve project approval and funding success. An important part of the strategy in achieving this objective is to gain the support of all local governments in the south west region of WA that would benefit from the increased tourist and other traffic that the sealed Hyden Norseman Road would no doubt generate. It would not be unreasonable to expect a financial contribution from these local governments towards the cost of engaging a high calibre consultant to prepare a detailed report supporting the need and incorporating a cost benefit analysis to this region as well as the economic benefits to all road users including the freight/transport industry. However, as a prerequisite to approaching other local governments for support, it is considered that Council first needs to carefully consider this challenging project and establish a benefits analysis to the Shire of Kondinin and a well-planned way forward. One of the challenges in achieving this objective is to have the state and federal government’s agreement to upgrade the status of the Hyden Norseman Road to highway or secondary highway status (in becoming a major interstate access road) in the absence of suitable daily traffic count number justification. The required traffic count numbers will not be realized until the road is sealed. This aspect would need to be covered by the consultant’s report and be convincingly evidence based, taking into account current and projected future interstate traffic volumes entering and egressing Western Australia via Norseman. The Shire of Kondinin would be very well placed to contribute substantially in engaging its road construction crew towards the (pre sealing) road construction works of the Hyden Norseman Road bitumen sealing project. STATUTORY ENVIRONMENT Nil POLICY IMPLICATION There are no direct policy implications in relation to this item. FINANCIAL IMPLICATIONS This project is beyond the financial capacity of the Shire of Kondinin and would be totally reliant on significant federal government and possibly some state government grant funding. 10.3.4 Support for Kondinin Events Program

SUBJECT: Kondinin Events Program Proposal ATTACHMENTS: Nil DATE OF REPORT: 9th November 2017 AUTHOR: Stephen Boxall/ DCEO DISCLOSURE OF INTEREST: Nil SUMMARY/BACKGROUND Following is a copy of an email received from Stephen Boxall a Kondinin ratepayer/resident seeking Council support for a group of local people who are interested in establishing 2 local events which would, if successful, bring visitors to Kondinin which in turn would benefit businesses and other community based groups. “I am presenting this document to obtain initial and ongoing support from the council to support a

group of local people who are interested in establishing 2 local events, 1 car based & 1styled on an

ironman/true grit/ mud run.

My previous experience involved being chairperson & combined chairperson / burnout coordinator

every year excepting the last 2 years Kondinin Hoonavation ran. This event was built up to a peak of

80 + entrants (crowd no 500-700) making it not only the 2nd biggest country event but also ranked in

the top 2 to attend. Over the last few years I have been judging at 2 annual events, Wagin &

Kattanning, at every other event i attend(6-8) annually I am constantly asked when is Kondinin going

to fire up again.

We also have been asked to look into establishing a mud run or similar event. Other towns have

entrants in these events spending 2-3 days exploring their regions which is our aim as well.

I believe local people willing to commit time & effort should be assisted & encouraged as much as

possible.

With a change of name promoting Kondinin prominatly , events people can participate in, will outside

numbers & income to local businesses. Those I have contacted are fully behind such ideas. The

structure of these events has changed , local entities like schools & hospitals use them as fundraisers ,

I would hope Kondinin's would grasp these opportunities .

I have heard previously comments that insurance was a concern . I was personally responsible for

obtaining insurance for Hoonavation every year I was involved, it was readily available & reasonably

priced. The committee that ran the last 2 years pulled the event on the basid of no insurance. This was

checked by myself & other outside event coordinators & found to be totally false . This was passed on

but for reasons only know to them Kondinin chose to ignore these facts.

The first event proposed is the resurrection of the now defunct “Hoonavation” which has not been run now for a number of years. The “Hoonavation” was basically a burnout competition which brought a large number of competitors and spectators into town who competed on a purpose built burnout pad adjacent to the Kondinin sporting precinct. This pad is still in existence however would need some work to the surrounds to make it functional again. This event previously resulted in a lot of noise, smoke and the smell of burning rubber wafting over town. The second event proposed is a “Mud Run” type of event which is basically an obstacle type course incorporating mud and is aimed towards the outdoor adventurer come ironman/woman type. This type of event is increasing in popularity with events being held throughout Australia. In Western Australia alone there are 4 events being held prior to 31 December 2017. The location of the local event has not been proposed as yet. At this stage Mr Boxall is seeking initial Council support for the events. However, as these are very much in the planning stage it is believed that much more investigation is needed, in the case of the “Hoonavation” style event the impact on the town residents caused by noise, smoke etc. and perceived benefits to the various community groups and businesses.

In the case of the mud run type of event the proposed location and the infrastructure involved. There is also the matter of how much funding is required to upgrade the existing burnout pad facilities and the setup of the mud run. It is commendable that these ideas to increase visitors to the town with the associated flow on to accommodation, business and community groups has been put forward. There is much more research to be done however and it is recommended that administration liaise with Mr Boxall regarding the putting forward of a more detailed proposal. STATUTORY ENVIRONMENT Nil POLICY IMPLICATIONS Nil PUBLIC CONSULTATION Given the possible impact on the residents of Kondinin town site caused by the car based event it is suggested that some form of community consultation form part of the future proposal. FINANCIAL IMPLICATIONS None at present. STRATEGIC IMPLICATIONS Supports the following section of the Shire’s Strategic Community Plan 2016 – 2026 “2.4 Encourage, promote and support tourism experiences and businesses in the Shire of Kondinin

10.3.5 CEO’s General and Project Status Report

1) Staff Matters Gary Valenta continues on Workers Compensation. It is not known when he will be cleared fit for work. In the interim Mark Burgess, Manager of Works, has engaged a very experienced final trim grader operator who is doing a great job. Apart from this the Shire enjoys a very stable workforce. 2) The Humps Standpipe Upgrade (nee King Rocks Dam Upgrade) – Department of Water June 2017 – The DCEO had a teleconference with the Manager Rural Water Planning from the DoW and Ken Pearce from the Water Corporation on 9th June regarding the Humps dam. Mr Pearce advised that the dam capacity was 40ML not 70ML as previously advised to us by DoW. It was also advised that the Water Corporation will still require the dam for quite a few years to come. They stated however that they would be prepared to provide a license to the Shire for the use of water from the dam and that we would have full use of the water via the current standpipe arrangement. The license will in essence be the same as was recently provided for the use of the Karlgarin town dam. At present the standpipe and tanks are fed direct from the main line to Hyden. At times of water shortages in Hyden access to the tanks is turned off by the Water Corporation. The new proposal would involve the provision of a dedicated line being installed from the dam to the tanks and a separate pump being put in to fill the tanks. It will also be recommended that a larger tank/tanks be installed at the standpipe. This would ensure continuity of supply for farmers etc. Mr Pearce advised that a ballpark cost would be around $50,000 for the required works. When asked by

the DCEO who was going to pay for it, it was proffered by the DoW that they would cover the cost once the necessary authorities were worked out. They see this as a far better option than spending in excess of $500,000 on King Rocks dam. Though the outcome did not provide a solution to the King Rocks dam situation it will provide an assured long term alternative source of water for farmers albeit further to collect than King Rocks should King Rocks dam be compromised in the future. It is apparent that there will be no funding coming forth for the repairs to the King Rocks dam wall given the current state of the economy and the mindset of the current government. July 2017 – A further teleconference was held on 10th July with the Water Corporation, Dept. of Water And Environmental Regulation (DoWER) to discuss the progress of utilizing the Humps dam and increasing the capacity of the nearby standpipe. The Water Corporation is commencing immediately the preparation of the license to use the water which will take approximately one month. The location of the new pipeline and tanks were discussed and agreed upon with the former to be clarified due to the indigenous heritage value of the area though the pipeline is proposed to be laid down an existing firebreak. An additional 250,000 litre tank will be installed next to the existing tanks and all 3 will be linked to the new standpipe. Once the license is signed quotes will be sought for the infrastructure. DoWER will be funding all the proposed works. August 2017 – the process has started with quotes being received for the proposed new tank, standpipe controller, pipeline and pump. September 2017 – All quotes for work have now been received and are with the Water Corp/DoWER for their consideration and approval. October 2017 – The funding for the project has been approved and we are waiting on the official notification and funding details so that we can commence the project. The draft Licence Agreement has been prepared and we are waiting on the final document. November 2017 – The licence agreement has been executed by all parties and the draft Deed of Agreement for the funding has been prepared. All being well the project should commence by the beginning of December. 3) Aged Housing June, 2017 – There is doubt currently with the change of state government as to whether the Wheatbelt South Aged Accommodation Alliance’s ‘approved’ funding for independent living units will be available. This puts in doubt the construction of the two units at Hyden (Whispering Gums) and two at Kondinin (Westcourt). In respect of the extension of Yeerakine Lodge, tenders are currently being called and will be reported to Council following the closing and assessment of tenders received. July, 2017 – We are still awaiting the decision of the new state government regarding the Wheatbelt South Aged Accommodation Alliance’s ‘approved’ funding for independent living units. Tenders are currently being considered for the construction of Yeerakine Lodge extension. August 2017 – The tender for the extension to Yeerakine Lodge was awarded to A Corp Construction Pty Ltd. The sand pad has been constructed and construction is due to commence within the next 2 weeks. We are still awaiting the decision of the new state government regarding the Wheatbelt South Aged Accommodation Alliance’s ‘approved’ funding for independent living units. September 2017 – Some delay occurred in constructing/compacting the pad mainly due to rain which has now been remedied. A Corp has engaged KBS to lay the concrete pad and building construction will follow. The concrete pad has been completed and the timber wall frames are currently under construction in Perth. By the time of this meeting erection of the frames should have commenced. Based on the construction schedule construction is approximately 1 week ahead of schedule despite the initial holdups with the pad preparation. Expected project completion is June, 2018.

October 2017 – A Corp is making excellent progress in the construction of Yeerakine Lodge extension project. Brickwork is complete. Roofing construction has commenced. First progress payment has been made. November 2017 – the roof has been completed and plumbing work has commenced. The electrical prelay is next closely followed by the installation of the gyprock walls. A problem has surfaced with the installation of the hot water ring main as the plans show that the existing ring main was of a larger size than was actually originally installed. This problem has been addressed by the hydraulic engineer with appropriate action being taken to solve the problem. This may result in a slight variation to cost. The second progress payment has been paid. 4) Staff Housing Construction– Repacholi Parade, Kondinin February, 2017 - The Shire has completed the site sand pad and Kondinin Building Services (KBS) has commenced marking out the lot and security fencing it ready for construction commencement. March, 2017 – Progress by KBS over the past month has been very little and slow due to KBS undertaking long overdue work at Kondinin IGA. April, 2017 – Kondinin Building Services (KBS) have laid the concrete pad for the residence. May, 2017 – KBS have commenced erecting the upright timber frames to the concrete pad. June, 2017 – KBS have completed the window and door frames. July, 2017 – KBS have completed brickwork. Progress is satisfactory although a late start has caused the whole program to be approximately 8 weeks behind. August, 2017 – Good progress is being made by KBS with roof timbers installation almost complete. Doug Davey has advised that as he has accepted a full time MOW’s position with Meekatharra Shire he cannot act as Project Manager for this project. The CEO has been monitoring and project managing this project in Doug’s absence and will continue to do so until project completion. September, 2017 – Roof timber construction is almost complete and we now await the colour bond roof installation. October, 2017 – Slow progress has been made over the past three months. Still waiting on roof / ceiling timber construction completion. According to the work schedule, work is 30% - 40% complete currently, after some nine months since commencement. November, 2017 – Good progress (51% complete) has been made in the last month with roof cover and internal wall lining and insulation completed, moving into undertaking internal fixing, joinery and cabinets.

Name of Applicant: Shire of Kondinin Author: CEO Declaration of Interest: Nil Date: 14 November, 2017 BACKGROUND / COMMENT: The Manager of Works (MOW) vehicle, (Subaru), is due shortly for changeover. It is considered more appropriate that his vehicle be upgraded to a larger 4WD such as a Toyota Prado/Holden Trailblazer given the nature of his work in travelling on rain affected roads, in gravel pits, etc. The MOW’s also undertakes substantial travel in his day to day work. This is expected to increase further with pending Shire contract works. In the current budget, while we have made provision for the changeover of the MOW’s Subaru vehicle, no provision has been made for a larger 4WD vehicle for the MOW. However in the current budget we have savings of some $42,000 in the purchase of a roller and small trucks. It is estimated that a new Prado type vehicle will cost in the region of $58,000 less trade in of the Subaru, funded from these budget savings. STATUTORY ENVIRONMENT Nil POLICY IMPLICATION There are no direct policy implications in relation to this item. FINANCIAL IMPLICATIONS 2017/18 Budget savings are able to cover the extra cost of purchasing the upgraded MOW’s vehicle. 9.4.1 GENERAL

Construction Crew We have recently completed WANDRAA flood damage work for Scrivener Road and Lake Karlgarin Road. We have also completed works on the Notting Karlgarin Road from Roe Road T-junction heading east for approx. 2.5km. This section was quite dangerous when wet. These works were completed whilst the East Hyden Bin Rd was being prepared for bitumen. We have now completed the East Hyden Bin Road with the bitumen being laid on Sunday the 5th of November, all guide posts and signs have since been erected. We have now started the Mt Walker Road across the salt flats, this will entail widening of the shoulders, overlay with gravel and cement stabilisation due to the salt content. We will also upgrade and extend two culverts. Works are expected to be completed early December. From there I’m hoping we will be able to make a start on the drainage in town. As per the CEO’s report if Council wish to carry out works for the Shire of Lake Grace, I would anticipate that we could carry out these works in February or March next year. Kondinin and Hyden Town Sites We now have the design for Kondinin so work will be able to start on Kondinin Town prior to Christmas I hope. There is some location work still required so the drainage design doesn’t conflict with the utilities. Plant Repairs

KN 2107 – Weld Mudguard As Council is aware we have in our plant replacement program for this year to replace the float with a second hand one. I have obtained a couple of quotes and for an extra $700 above budget we can actually have a new one built for $90,700.00 which I think we should have made if we don’t go new. I have attached the quote and design for council to review. Maintenance Grading Roads are now receiving patch grading around the shire, with the start of harvest if Councillors have received any complaints from the public please let me know and we will do our best to respond ASAP. Maintenance Some sign and guide post maintenance has been carried out. Fogging is ongoing and carried out when the weather permits. Slashing is still going on as well. Parks and Gardens Ovals at Hyden and Kondinin have had the yearly maintenance program completed which included, Verti cutting and aerating. Kondinin hockey field has been levelled with the grass being stripped right back to the root system, top dressed with watering to encourage new growth, at this stage everything is looking good. General The CEO and I met with MainRoads on a few issues relating to the Main Street of Kondinin in which I will give you a brief update during the council meeting. MainRoads have also recently provided us with a concept plan for the improvement works proposed where the Brookton Highway was cut back in February. Again I can give Council a quick brief on their proposal, which I am sure you will all be happy with what MainRoads are proposing. A copy of the plan is available in the Council Chambers. Staff

Gary Valenta is presently on Workers Comp, he has a Doctors Certificate until early December. I would like to take this opportunity to welcome Warren Sarginson on board. Warren comes with a wealth of experience both in operational matters and interpreting engineering plans. 10.7 SWIMMING POOL REPORT

Wayne from Hyden Pool reports that for October the maintenance program is almost finished for the upcoming pool season. He has been informed that the east side fence near cricket pitch will be replaced shortly to stop trespassing during the season. Apart from that he is ready to open and did so on the 4th November. Water samples are all ok and he has replaced the auto dosing system and the pools are sparkling. He hopes to see you all on the pool deck. The Kondinin Aquatic Centre opened on the 1st November. The Plant room continues to run in excellent order. Water meter: 9055 Water Test: good Attendance: (126)1/11/17 - 5/11/17 During the off season, the wet deck was stripped back to concrete and the water proofing re-applied to the affected areas under warranty. Unfortunately upon recently inspecting the pool, there appears to be some rust spots on the pool tiles from the grinding discs. This is not complicated or difficult to fix but will take some time to rectify as it is a time consuming process. The monitor for the security cameras had failed, I suspect this was due to a power surge during a storm around the 20th October. The monitor was replaced with a good working 2nd hand unit on November 2nd. I have organized a surge protected power board to help protect the sensitive equipment in the kiosk. The Dolphin pool cleaner handle broke while retrieving from the pool, I'm unsure as to how or why. I have ordered the part and it should arrive here soon. New equipment: Part of the Royalties For Regions swimming pool program was allocated to a new PA system for the centre, which I installed over the off season. It has exceeded my expectations in terms of cost, sound quality, and performance. This consists of : 4× 200 watt RMS 8ohm outdoor all weather speakers 1x 4 channel 880 watt total RMS into 8ohm power amplifier. 1x 6 channel mixer 1x push to talk microphone 1x 2 wireless microphone set Various audio and speaker cables I also managed to score a bargain for shelving for the store room during the off season which happened to be on special at the time, and managed to buy extra shelving with the budget allocated. 9x 1200mm 5 tier shelving The concrete pad for the pool blankets was also completed during the off season by Richard. I have been in touch with Richard in regards to some work which needs completing at the centre and have been assured this will be rectified soon.

Also as part of the Royalties for Regions program there was some money allocated to swimming aids, this will give the new junior swim club a great start. Swim gear: 20 swim goggles 5 junior snorkel flipper set 2 adult snorkel flipper set 6 noodles A big thanks to Tory, Rachel, Tammy, and the many others for volunteering to run the junior swim club program. We're still working out the finer details of the program and what we can offer but already it's looking to be a great opportunity for the kids to get involved in something very worthwhile. Early morning lap swimming and amateur water aerobics will commence on Wednesday 15th November. Steph will be at it again rain, hail, or shine for the ladies water aerobics. Looking forward to the enthusiasm and fun this brings to the wee hours of Wednesday and Friday Mornings. Again with the excellent numbers that the movie nights attract to the centre, I am hoping to hold another 3-4 movie nights throughout the season starting around January as there is a lot happening throughout November and December. Vacswim has been confirmed and will commence on 16th December through to 22nd December. I am hoping to have a BBQ for the final day. I have been in touch with Jolene in regards to performing various emergency drills with the ambulance crew. Among the various aims is to familiarize the crew with the layout of the centre, inform, discuss and rectify any foreseeable problems during an emergency. I recently spoke to Simon Paton in regards to holding the swim carnival at the Kondinin pool and he is very supportive and has given some names for me to contact. It's shaping up to be another great season with much happening around the area. It was great to be a part of the Twilight Markets and with all things considered was a complete success! Seeing the caravan park overflowing with tourists at times is evidence that things are moving forward for Kondinin and great to hear about the prospect of the massive wind and solar project that may happen in the future. It's great to be back. Ann, Mia and myself are looking forward to another great season here in Kondinin and we're looking forward to seeing everyone at the Kondinin Aquatic Centre!

10.8 RANGER ACTIVITY AND BUILDING MAINTENANCE REPORT – OCTOBER 2017

Ranger Activities

Warning Notices were written to a Jones Street resident after their dog was reported wandering. Two of the Notices were to be replaced with Infringements if not complied with. I have spent some time with this client over the past Month or so trying to arrange a positive outcome. The client has received two $200 infringements for failing to comply with warnings regarding registration and microchipping. A third infringement was issued for the dog being untethered again in a public place. Despite all the work and effort that has been put into trying to get a Local resident to comply with the dog Act and have his dog registered and Microchipped he has Failed to do so with the dog constantly roaming the Streets . I have had many discussions with CEO/DCEO regarding this issue and it has now come time to deal with it on the next level . I have requested that Letters be drawn up to send to the Client that he have 7 days to show cause as to why this Dog should not be classed as a Nuisance Dog Under Section 38 of the Dog Act 1976.

A verbal request to pick up a large amount of rubbish blowing out of a Local Business in Kondinin was ignored and when I returned I collected the rubbish myself and issued a $200 Infringement for Littering that was not well received by the Client but may I again stress that they were asked to pick it up before hand and failed to do so.
