Under items from staff, Nancy Pfeffer, COG Executive Director, asked for a final show of hands for an alternative day for the January Board of Directors Meeting (the meeting falls on January 1, 2020). There were 10 responses; insufficient for a quorum of the Board. She asked for a show of hands for a quorum for the Executive Committee. The votes were also insufficient to support a quorum. President DuBois said the next Board of Directors or Executive Committee meeting will be held February 5, 2020.

For the next item, COG Executive Director Nancy Pfeffer pointed out two older GOG letters affirming the COG’s transportation project priorities for Measures R and M. She passed out these letters as a reference for past actions and a reference for an agenda item. The next letter distributed was the COG’s formal request to the MTA for the allocation of Subregional Equity Funds.

The next item was a map that previews AB 101 LEAP grants; state funding for housing production. This is one-time funding and is available by a non-competitive application. Gateway Cities’ jurisdictions are eligible for $5.87 million. The applications are due next year. Pfeffer announced that she would be requesting that each city give 1% of their allocated funds to the COG to support additional hours in support of the COG’s planning effort. She then outlined some of the work that would be funded with this additional money.

Herlinda Chico, representing LA County Supervisor Janice Hahn’s office, went over $41 million made available to the Rivers and Mountains Conservancy (RMC). These funds were refunded to LA County by the federal government who contributed $150 million under AB 1147. The Los Angeles County Department of Public Works considers the funding surplus. Supervisors Hahn and Solis authored a County Board of Supervisors

Motion that requested allocating these funds to the LA Rivers Lower Reach (South of Downtown Los Angeles to Long Beach). A friendly amendment was made to the Motion to expand the use of funds to all river reaches but with an emphasis on disadvantaged communities. The Motion to return the money to the County was approved by the LA County Board of Supervisors. Chico read off the details of the Motion and indicated that LA County staff would return with a report and recommendations.

President DuBois asked for a vote on the Consent Calendar which was approved as presented.

President DuBois introduced Annie Nam from the Southern California Association of Governments (SCAG), who provided an overview of the SCAG long range transportation plan. This plan is known as the SCAG Regional Transportation Plan/Sustainable Community Strategy (RTP/SCS). The plan is guided by overarching goals; improving air quality, maximizing regional housing goals, balancing future mobility needs with economic, environmental, and public health goals.

The plan also has to comply with federal requirements and meet the GHG reduction requirement of SB 375. Nam went over the planning process and hit upon key milestones leading up to the release of the Draft document. The plan is to go to the SCAG Board for approval in April of 2020.

She proceeded to go over some of the regional housing statistics including figures on the number of renters and how much they pay as a percentage of their income. She went over maps with population densities and identified where housing availability is the most scarce. She discussed transit and low-income transit users then went on to focus on future mobility needs of an aging population.

Nam went on to present some of the recommended strategies: including complete streets for safety and the support of sustainable development. She cited projects such as express lanes, Transportation Systems Management and other tech to move traffic more fluidly. She cited the importance of system preservation and resilience, a “fix it first” policy. She spoke on regional investments for clean goods movement, including first and last mile delivery. She went over the cost of financing the plan; a total of $638 billion over a period of 20 years, identifying a gap of over $300 million. Federal law requires the plan be revenue balanced and she went over potential revenue sources such as gas tax increases, mileage fees, EIFDs, VMT charges and other financing mechanisms. She went over potential jobs generated and the reduction of delay. The plan uses jobs/housing balance and proximity to transit as its elements. The comment period for the plan ends January 24. She highlighted the link to the plan. Past President Fernando Dutra asked about outreach to individual cities who may be revising their general plans; Nam replied that they did reach out to individual cities to coordinate planning efforts. Metro Board Member/Long Beach Mayor - Robert Garcia gave an update on the third Gateway Cities Transit Summit focused on Micro-transit. He said it was a great learning experience and that the public and private sector presented some difficult but interesting topics. He went over the new “A” Line (formerly the Blue Line) and acknowledged there have been some difficulties with system reliability and technical glitches. The new line is structured to shave 10-15 minutes off the running time from Long Beach to downtown LA. He indicated that the interim express bus shuttle which is very popular is remaining in service due to efforts by his office and Supervisor Hahn.

Lastly, Mayor Garcia highlighted the $1 million Transit Oriented Development Strategic Implementation Plan (TODSIP) planning funding that will be available to corridor cities for planning and development work.

President DuBois asked Exec. Dir. Pfeffer to discuss the West Santa Branch Light Rail Corridor City Manager’s Technical Advisory Committee (TAC). She asked for concurrence on establishing a TAC to better disseminate information to the corridor cities. She talked about the other COG TACs and how they function within the COG. She indicated that Metro staff is supportive of forming this TAC. There were 15 potential jurisdictions of which two have opted not to participate. She indicated that depending upon the topic it may be more appropriate to send a public works director or city engineer to the meetings. Potential topics for discussion include the 3% local contribution, the 3P process, grade crossings, the Master Cooperative Agreement as well as TODSIP implementation funding. The information flow will be from the TAC directly to the Metro Board informing and advising the COG Board and the Eco-Rapid Transit JPA Board. This TAC will take the place of the previously recommended Board level subcommittee. Funding for this activity is anticipated to come from the MTA. President DuBois asked for a Motion to approve the report recommendation, the motion passed.

President DuBois introduced Jerry Caton, GCCOG Economic Development consultant, who discussed the work done with the governor’s discussion of different methods of financing additional housing. Caton described the Economic Development Working Group’s proposal to have the State financially incentivize those Gateway Cities that choose to rezone underperforming office, industrial and commercial sites into new housing development sites.

The proposal is to redevelop underperforming retail spaces into housing and retain the property tax from the residential development, Property tax would pass as a surrogate for sales tax to redevelop underutilized retail properties. The city retaining all of the property tax would help the city to cover expenses associated with additional residential use. The proposal is to do a trial for increasing housing in this manner. Past President Fernando Dutra asked about parking to which Caton replied that all would be addressed through the local community codes. Brent Tercero, City of Pico Rivera, asked about the provision of services, parks, policing; these are local issues that need resolution.

The Board passed a motion to approve the recommendation to authorize the COG staff to develop legislative implementation of the proposal.

GCCOG Transportation Analyst Karen Heit gave a report requesting the COG Board approve sending a letter to Metro requesting that the COG Board execute the draft letter in support of the I-5 Corridor project funding.

The I-5 project has $20 million in PAED (environmental analysis funds) to complete an environmental review of the I-5 project from the current terminus at the I-605 to the I-710. This portion of the I-5 Corridor project is scheduled for 2036 and has an allocation of $1.1 billion - $1 billion of which is Measure M revenue. The MTA entered into an agreement with Caltrans to finish the I-5 environmental review. The difference with this effort is Metro is considering requesting the I-5 JPA participate financially in any cost overruns – cost overruns could potentially run as high as 10% which would be $2 million. To the best of our knowledge no local agency has been asked to contribute to overruns before; neither transit nor highway initiative. The I-5 JPA is asking for the COG’s support in rejecting this request. A motion was made, seconded and approved to send the draft letter to Metro. Exec. Dir. Pfeffer gave an update on the planning efforts for the upcoming COG Board retreat. She asked for volunteers for the retreat planning effort. Brent Tercero, Pico Rivera, Angie Jimenez, Montebello, and Lisseth Flores, Bell Gardens, volunteered.

Pfeffer went on to discuss the Rivers and Mountains Conservancy (RMC) request for an additional nominee; this time for a non-COG Board member. At the last meeting COG staff only requested one nominee. Exec. Dir., Pfeffer asked that names be submitted to COG staff for recommendation by the Board. Potential nominees can be submitted at a later time. Emma Sharif, Compton, volunteered to be nominated.

Karen Heit gave a report on a Metro item concerning the Measure R Ordinance Preliminary 10-Year Review and Potential Amendments. She began by explaining that the Measure R Ordinance permits the Metro Board to amend the Ordinance once every ten years beginning next year. This allows the Board to transfer funds between the highway and transit sub-funds. The Measure R ten-year review report presented in this item examines staff findings and sales tax revenue status. The report was a receive and file however, Supervisors Hahn and Solis requested the item be brought back in January for a more in-depth presentation and to allow sufficient time for review by the COGs. Other COGs are in the process of transferring funds from the highway program to transit; The SR-91/I-605/I-405 and I-710 Corridor Technical Advisory Committees (TACs) each also made motions to not transfer project funds to/from their specific allocation during the 10-year transfer.

Revenues received for the Measure R sales tax are less than initially anticipated. Measure R transit and highway capital sub-funds receive 35% and 20% respectively of the sales tax revenue to fund the capital projects listed on the Expenditure Plan. One of the capital projects is a Capital Project Contingency. Per the Ordinance, the Contingency is to be used, among other things, to pay interest on debt. The amount available for Contingency is currently estimated to be significantly lower than identified in the Expenditure Plan. Contingency fund estimates have decreased as follows: transit - from $3.3 billion to $694 million and highway - from $2.6 billion to $1.1 billion. Given the amounts allocated to capital projects in the Expenditure Plan (other than the Contingency) there is insufficient future sales tax revenue to pay the transit interest, including planned future transit debt. This may require a transfer of funds from the highway to transit capital sub-fund. Currently there is no highway debt, not surprising as highway projects move at a much slower pace than transit. She went on to explain that the report noted that at this time, a future $500 million transfer is estimated to be needed from highway to transit. However, the transfer is not needed immediately, as there are sufficient Measure R sales tax receipts and debt capacity to fund the transit capital projects on schedule over the next 10 years without the transfer. There is no current plan to transfer this funding, however, the potential exists. The report is silent on whether the contingency transfer would be borrowed or lost to the highway program, something to keep on mind. Heit went on to discuss potential project surpluses. One of those projects is the I-5 from the I-605 to the Orange County Line. There is an estimated $122.9 million potential available in after 2029 that is to be transferred to the WSAB. Before the funds transferred can be contemplated, the COG and the I-5 JPA should ensure that the $122.9 million be closely analyzed to meet project close-out needs in the final construction phase including construction mitigations. It is anticipated that the I-5 cities will need approximately $40 million to repair and return these streets to their prior condition (without betterments) so that the project can adequately be closed out and mitigations completed. After this need is satisfied, the funding should be transferred to the West Santa Ana Branch/Eco-Rapid Transit Project per the Ordinance footnote. The recommended action here is for the Gateway COG Board to express its support for the I-5 JPA to retain project close-out funding and support the position of both TACs to retain Measure R highway funding as currently allocated. A motion to support that position was moved, seconded and approved.

Background

In 2017 the County Board of Supervisors allocated $2 million from County Homeless Initiative Provisional funds for homelessness planning grants for cities and regional coordination services by councils of governments (COGs). In FY 18/19 the COG was allocated $143,000 for Regional Coordination. For FY 20/21 the County has allocated $202,853 for the Regional Coordination effort. The distribution of these funds is being administered by the County Chief Executive Office’s Homeless Initiative staff.

Issue

In September 2019 the County of Los Angeles Board of Supervisors directed the CEO’s Office Homeless Initiative to report to the board in 45 days with a framework to provide $6.0 million in available Measure H carryover funds from FY 2018-19 to Councils of Government (COGs) to support activities that 1) align with the board-approved, Homeless Initiative Action Plan to Prevent and Combat Homelessness; and 2) are consistent with Priority Areas 1 and 2 outlined in the recent Request for Proposals (RFP) to support implementation of city homelessness plans. Priority 1 – focusing on increasing the supply of permanent and interim housing for people experiencing homelessness and Priority 2 – focusing on enhancing County service systems for those experiencing and/or at-risk of homelessness.

In October 2019 the Board of Supervisors allocated $6,000,000 “innovation funds” to the COGs, $2,057,235 was allocated to the Gateway Cities COG region. The funds allocated to the COGs will further support the two priority areas set forth in the cities’ Homelessness Implementation Plan.

The COG’s Homelessness TAC is working on a plan and process to present and seek approval by the Committee on Homelessness. The Committee will then seek approval by the Board of Directors. The COG must report back to the County with a plan on the use of the innovation funds within 90 days of execution of contract.

The delay between the previous fiscal year’s Regional Coordination agreement and the current is due to the County Supervisors request to extend additional funding to the COGs in the region and modifying the existing agreement to do so.

Recommended Action

Approve Agreement No. AO-20-603 with the County for Regional Coordination Services and Innovation Funds.

Corridors: Telegraph Road, Alondra Boulevard, Slauson Avenue, Long Beach Boulevard, and Imperial Hwy

Background The Gateway Cities Strategic Transportation Plan (STP) includes a Master Plan for Arterial Highways chapter which incorporates the “Complete Streets” concept, under which streets are designed to maximize efficiency not only for automobile, truck, and bus traffic, but also for bicycle and pedestrian traffic. Included is the idea of “First Mile and Last Mile” by which strategies are developed to encourage non-motorized access to and from transit facilities. The COG staff has already completed “Complete Streets” plans for two previous arterial highways: Artesia Boulevard (2017) and Lakewood/Rosemead (2019). These were the highest priority corridors in the Strategic Transportation Plan, according to the cities. Issue Several years back the COG received a Federal Transportation earmark of $774,167.89. In order to access those funds Metro agreed to swap them for local funds, deduct a 3% processing/administrative fee, and convert the funds to individual grant funding agreements to contribute to the study of five additional arterials within the Gateway Cities COG region. The dollar amount per Corridor is based on the total linear miles within each Corridor. According to the priorities established through the STP, the five arterial corridors and their grant total are the following: FTIP #LA0G1715 Imperial Hwy $160,000 FTIP #LA0G1716 Telegraph Road $135,000 FTIP #LA0G1717 Alondra Boulevard $163,414 FTIP #LA0G1718 Slauson Avenue $135,000 FTIP #LA0G1719 Long Beach Blvd $157,530 COG staff will meet with the staffs of these cities along these corridors to discuss advancing the study of these corridors as “complete streets”, subject to local conditions and preferences, but with the idea of developing a plan that would put the corridor in line for construction funding opportunities that individual cities or a consortium of cities along the corridor could pursue. These funding agreements (FAs) do not fully fund the Corridor Studies. The FA’s fund a majority of the study, with jurisdictional contributions still necessary to fully fund each Study. The intent is for the GCCOG to subsidize the highest priority Corridors, approved by the STP TAC and included in the 25 deficient arterial Corridors documented within the STP. This will allow for more Corridors to participate at a reduced cost than to fully fund a lesser number of corridors.
