1 Minutes of the 86 th meeting of State Environment Impact Assessment Authority held on. 12.01.2016, under the Chairmanship Sh. Bharat Bhushan IAS (Retd.), Chairman, SEIAA held in the meeting room of office of SEIAA Haryana, Sector-2 Panchkula, regarding Environmental Clearance under EIA Notification dated 14.9.2006. The full Authority is present. The Cases recommended by SEAC for Environmental Clearance or otherwise as listed in the Agenda item circulated vide letter No. 2-4 dated 08.01.2016 were discussed. Following decisions were taken:- Item No. [1] Environmental Clearance in respect of IT Compelx at Plot No. 287-288, Udyog Vihar, Phase- II, Gurgaon by M/s PCI Ltd. The recommendation of SEAC to accord environmental clearance to the project was considered in the today’s meeting. The Authority observed that: 1. The project proponent on 26.11.2012 submitted application for seeking environment clearance for the project. The project proposal was taken up by SEAC in its 78 th , 85 th , 89 th , & 106 th meetings held on 26.03.2013, 24.06.2013, 27.08.2013 & 17.06.2014. The SEAC observed that the project proponent has started the construction without obtaining prior environment clearance thus violated the provision of EIA Notification. The project proponent also submitted certified true copy of resolution dated 26.06.2013 admitting that the mistake for starting construction without obtaining prior environment clearance and also ensuring that the violation shall not be repeated in future; as per the requirement of MoEF&CC, GoI, OM no. J-11013/41/2006-1AII(I) dated 12.12.2012. The SEAC recommended initiating legal action against the project proponent. 2. The recommendation of SEAC was considered in the 73 rd meeting held on 18.07.2014. The SEIAA decided to refer this case to Principal Secretary Environment for initiating legal action against the project proponent as per prescribed procedure. The SEIAA vide letter no. SEIAA/HR/2014/1078 dated 06.08.2014 requested Principal Secretary Environment to initiate legal action against the project proponent under Environment (Protection) Act, 1986 and send credible action taken report. 3. The project proponent filed an application in the Hon’ble Punjab & Haryana High Court “CRM-M-30394 of 2013” during hearing this case on 09.10.2015. The SEIAA came to know that legal action has already been initiated by RO, HSPCB prior to submission of application by the project proponent for environment clearance but intimation to the same was not given to SEIAA. 4. The Hon’ble Punjab & Haryana High Court on 09.10.2015 passed directions to decide the application of the project proponent within 3 months. The case was referred to SEAC for appraisal. The SEAC considered this case in its 121 st

    Minutes of the 86th meeting of State Environment Impact Assessment Authority

    held on. 12.01.2016, under the Chairmanship Sh. Bharat Bhushan IAS (Retd.),

    Chairman, SEIAA held in the meeting room of office of SEIAA Haryana, Sector-2

    Panchkula, regarding Environmental Clearance under EIA Notification dated

    14.9.2006.

    The full Authority is present. The Cases recommended by SEAC for

    Environmental Clearance or otherwise as listed in the Agenda item circulated vide letter

    No. 2-4 dated 08.01.2016 were discussed. Following decisions were taken:-

    Item No. [1] Environmental Clearance in respect of IT Compelx at Plot No. 287-288,

    Udyog Vihar, Phase- II, Gurgaon by M/s PCI Ltd.

    The recommendation of SEAC to accord environmental clearance to the project

    was considered in the today’s meeting. The Authority observed that:

    1. The project proponent on 26.11.2012 submitted application for seeking

    environment clearance for the project. The project proposal was taken up by

    SEAC in its 78th, 85th, 89th, & 106th meetings held on 26.03.2013, 24.06.2013,

    27.08.2013 & 17.06.2014. The SEAC observed that the project proponent has

    started the construction without obtaining prior environment clearance thus

    violated the provision of EIA Notification. The project proponent also submitted

    certified true copy of resolution dated 26.06.2013 admitting that the mistake for

    starting construction without obtaining prior environment clearance and also

    ensuring that the violation shall not be repeated in future; as per the requirement of

    MoEF&CC, GoI, OM no. J-11013/41/2006-1AII(I) dated 12.12.2012. The SEAC

    recommended initiating legal action against the project proponent.

    2. The recommendation of SEAC was considered in the 73rd meeting held on

    18.07.2014. The SEIAA decided to refer this case to Principal Secretary

    Environment for initiating legal action against the project proponent as per

    prescribed procedure. The SEIAA vide letter no. SEIAA/HR/2014/1078 dated

    06.08.2014 requested Principal Secretary Environment to initiate legal action

    against the project proponent under Environment (Protection) Act, 1986 and send

    credible action taken report.

    3. The project proponent filed an application in the Hon’ble Punjab & Haryana High

    Court “CRM-M-30394 of 2013” during hearing this case on 09.10.2015. The

    SEIAA came to know that legal action has already been initiated by RO, HSPCB

    prior to submission of application by the project proponent for environment

    clearance but intimation to the same was not given to SEIAA.

    4. The Hon’ble Punjab & Haryana High Court on 09.10.2015 passed directions to

    decide the application of the project proponent within 3 months. The case was

    referred to SEAC for appraisal. The SEAC considered this case in its 121st

    meeting held on 19.11.2015 and recommended this case for environmental

    clearance.

    5. The SEIAA vide letter no. SEIAA/HR/15/634 dated 28.12.2015 has already

    sought clarification from MoEF&CC, GoI regarding change in procedure if any in

    violation cases keeping in view the quashing of OM dated 12.12.2012 by Hon’ble

    NGT but no response from the MOEF & CC, GOI has been received.

    6. It was also observed that Hon’ble Supreme Court of India on 24.09.2015 in CA

    No. 7191-7192/2015 in the matter of “M/s Dugar Housing Ltd V/s

    S.P.Muthuraman & Ors has stayed the operation of impugned judgment (s) and

    order (s) passed by Hon’ble NGT.

    In view of the above observations it was decided to defer the case to the next

    meeting with the decision that:

    i. Giving reference of Hon’ble Supreme Court orders and the earlier

    communication dated 28.12.2015 of this office, the MOEF & CC, GOI may

    again be requested to send necessary clarification in the matter so as to enable

    the SEIAA to take appropriate action in violation cases well within the

    stipulated period as prescribed in the Notification/guidelines, in order to avoid

    any litigation.

    ii. The Hon’ble Punjab & Haryana High Court may be apprised of the factual

    position of this case. A request may also be made to extend the deadline of

    three months period (09.01.2016) for further two months in view of the

    explained circumstances.

    Item No. [2] Environmental Clearance for Group Housing Colony located at

    Revenue Estate of Village Nuna Majra, Sector-37, Bahadurgarh,

    Haryana by M/s HL Promoters Pvt Ltd.

    The SEAC has recommended this project for Environmental Clearance subject to

    stipulation stated therein. The Project Proponent has proposed the construction of Group

    Housing Colony located at Revenue Estate of Village Nuna Majra, Sector-37,

    Bahadurgarh, Haryana on a total plot area of 66494.8 sqm (16.43). The total built up area

    shall be 140796.597 sqm. The proposed Project shall comprise 07 Blocks, Block-1 (4

    Towers + GF + Stilt + 14 Floors), Block-2 (3 Tower + GF + Stilt + 14 Floors), Block-3

    (2 Towers + GF + Stilt +14 Floors), Block-4 (1 Tower + Stilt + 6 Floors), Block-5 (1

    Tower + GF+ Stilt + 14 Floors), Block-6 (3 Towers + GF + Stilt + 14 floors), Block-7 (2

    Tower + GF + 7 Floors), Community building, Nursery Schools & Primary School etc.

    The proposed project shall have 1352 Dwelling Units. The maximum height of the

    building shall be 51 meter. The total water requirement shall be 1000 KLD. The fresh

    water requirement shall be 617 KLD. The waste water generation shall be 740 KLD,

    which will be treated in the 2 STPs of 675 KLD & 200 KLD capacity. The total power

    requirement shall be 12067 KVA which will be supplied by UHBVN. The Project

    Proponent has proposed to develop green belt on 30% of project area (25% tree

    plantation + 5% landscaping). The Project Proponent proposed to construct 16 rain water

    harvesting pits. The solid waste generation will be 3315.3 kg/day. The bio-degradable

    waste will be treated in the project area by installation of OWC (organic waste

    converter). The area required for OWC will be 3M x 4M. The total parking spaces

    proposed are 1653 ECS.

    The above recommendation of SEAC was taken up for consideration. Detailed

    discussions were held regarding revenue rasta, HT Line, water requirement, quality of

    water, green belt development plan, Ambient Air Quality, recycle and reuse of water,

    parking plan, traffic circulation etc. It was found that the project proponent submitted the

    assurance of HUDA for supply of water and NOC from AAI regarding height clearance.

    It was noticed that the project proponent has proposed parking in the ROW reserved for

    HT line. The project proponent submitted revised parking plan showing no

    parking/proposed construction in the ROW reserved for HT Line. It was observed that the

    project proponent has earmarked the space for solid waste management site on the plan

    for collection, segregation and treatment of bio-degradable waste.

    In view of the above discussions, the Authority decided to agree with the

    recommendations of SEAC to accord Environment Clearance to this project by imposing

    the following condition in addition to the usual conditions in practice.

    [1] The project proponent shall provide green area on 30% of the project area.

    [2] The project proponent shall essentially provide two numbers of STPs preferably

    equivalent to 50% of total capacity or depending upon the initial occupancy as the

    case may be.

    [3] The project proponent shall not raise any construction activity in the ROW

    reserved/acquired for High Tension Wire passing through the project area and

    shall maintain horizontal and vertical ROW as required under Indian Electricity

    Rules, 1956/DHBVN latest instructions.

    [4] The project proponent shall ensure that no construction activity is undertaken

    either on surface or below or above surface of revenue rasta passing through the

    project area.

    [5] The project proponent shall indicate the width and length of revenue rasta passing

    through the project area on sign board and shall display the same at both the ends

    of revenue rasta stretch, for awareness of public. Sign board shall also display the

    message that this is a public rasta/road and any citizen can use it. There shall not

    be any gate with or without guards on revenue rasta further project proponent shall

    not encroach revenue rasta and shall not cross internal roads over revenue rasta.

    Item No. [3] Environmental Clearance for Expansion of Group Housing Colony

    located at Village Lakkarpur, Sector-39, Faridabad-Ballabgarh

    Complex, Haryana by M/s Ajay Enterprises Pvt. Ltd.

    The SEAC has forwarded this case with the recommendation to seek clarification

    from MOEF & CC, GOI regarding applicability of EIA Notification in the existing

    project of project proponent. The recommendation of SEAC was taken up for

    consideration in the today’s meeting and it was observed that:

    1. The project proponent submitted application for expansion of Group Housing

    Colony for construction of Group Housing on the additional license of 2.667 acres.

    The license to the existing Group Housing Colony was granted in the year 1984

    and 1995 measuring 30.35 Acres. The drawing/building plan of 30.35 acre was

    sanction/approved in the year 1985.

    2. The SEAC considered the exemption letter dated 13.01.2011 of RO, MOEF & CC,

    GOI submitted by the project proponent mentioning that more than 45% of built

    up area of the colony was completed and 9.36% of the total built up area was

    above the plinth level prior to issuance of Notification dated 07.7.2004 and

    therefore, the said colony neither attracts the provisions of 07.07.2004 nor EIA

    Notification dated 14.09.2006 and no environmental clearance is required from

    MOEF & CC, GOI/SEIAA for the existing colony. The SEAC was of the view

    that only 45% of built up area was completed and 9.36% of total built up area was

    above plinth level prior to Notification dated 07.07.2004. This means that

    remaining built up area might have been completed after 13.01.2011 without

    obtaining environment clearance.

    3. The project proponent vide letter dated 06.12.2015 has requested for with-drawl

    of present application. The project proponent has informed that he will submit

    separate online application for additional 2.662 acres. The project proponent has

    informed to develop independent group housing on 2.662 acres of land and shall

    provide separate services in the unit.

    4. The date of start of construction, date of completion of structure up to plinth level

    and date of completion of project was not available in the records with

    authenticated proof for ascertaining the applicability of EIA Notification dated

    14.09.2006 in the existing project.

    In view of the above observations it was decided that to defer the case to the next

    meeting with the decision that the project proponent may be asked to furnish below

    mentioned information within 10 days or before the next meeting of SEIAA.

    [1] The project proponent shall submit the date of start of construction, date of

    completion of structure up to plinth level and date of completion of project with

    authenticated proof for ascertaining the applicability of EIA Notification dated

    14.09.2006 in the existing project.

    Item No. [4] Environmental Clearance for proposed expansion (Phase II) of “SRM

    University” situated at Plot No. 39, Rajiv Gandhi Education City,

    Sonipat, Haryana by SRM Institute of Science & Technology.

    The SEAC has examined the proposal in the light of amended Notification dated

    22.12.2014 issued by MoEF&CC, GoI and recommended to exempt this project proposal

    from obtaining environmental clearance under EIA Notification dated 14.09.2006.

    Subject to compliance of sustainable environment management as per guidelines issued

    by MoEF & CC, GoI F.No. 19-2/2013-IA.III dated 09.06.2015.

    The above recommendation of SEAC was taken up for consideration in the

    today’s meeting. The Authority agreed with the recommendation of SEAC and decided to

    grant exemption to the project proposal from obtaining environmental clearance subject

    to compliance to guidelines issue by MoEF&CC, GoI dated 09.06.2015 by the project

    proponent.

    Item No. [5] Environmental Clearance for the service/Maintenance and Training

    Facility for customers from Defence Forces and DRDO labs including

    inspection, calibration and maintenance services project in the

    industrial estate of plot no. 916, Sector-68, IMT, Faridabad, Haryana

    by M/s Tata Power Company Ltd.

    The SEAC has examined the proposal in the light of amended Notification dated

    22.12.2014 issued by MoEF&CC, GoI and recommended to exempt this project proposal

    from obtaining environmental clearance under EIA Notification dated 14.09.2006.

    Subject to compliance of sustainable environment management as per guidelines issued

    by MoEF & CC, GoI F.No. 19-2/2013-IA.III dated 09.06.2015.

    The above recommendation of SEAC was taken up for consideration in the

    today’s meeting. The Authority agreed with the recommendation of SEAC and decided to

    grant exemption to the project proposal from obtaining environmental clearance subject

    to compliance to guidelines issue by MoEF&CC, GoI dated 09.06.2015 by the project

    proponent.

    Item No. [6] Environmental Clearance for construction of STP/CETP Project at

    Village Narkatari, Tehsil: Thaneshwar, Distt Kurukshetra, Haryana

    by Public Health Engineering Division.

    The SEAC has forwarded the case with the request to write a letter to HSPCB to

    conduct comprehensive study of discharge in sewer and the drain to ascertain whether

    this case is of STP or CETP. The case was considered in the today’s meeting. The

    Authority observed that:

    1. The project proponent on 26.02.2015 submitted application for seeking clearance

    for the project under item no. 7(h) of schedule of EIA Notification dated

    14.09.2006 for setting up of CETP. The project proponent has submitted

    application in compliance to the Hon’ble NGT.

    2. The project proponent claims that they intend to set up STP to treat sewage. This

    activity is not covered under EIA Notification dated 14.09.2006 and

    environmental clearance is not required. However the SEAC is of the opinion that

    to ascertain whether this case is of STP or CETP a comprehensive study of

    discharge in sewer and drain be got connected from HSPCB.

    3. The Hon’ble NGT in application no. 124 of 2013 in the matter of “Kehar Singh

    V/s State of Haryana” has clearly passed directions to the applicant. The relevant

    part of directions (para 48 of order dated 12.09.2013) is reproduced as under:

    “We direct the respondent to seek EC from SEIAA at the earliest and in any

    case not later than one month from today. We further direct SEIAA to process the

    application and complete the entire exercise of granting clearance conditional or

    otherwise-or refusing the same within two months thereafter. In the

    circumstances of the case, we would not direct removal of the plant to the extent

    to which it has already been constructed at the site as all acts done so far and

    that may be done hereafter would be subject to the grant of EC to the projects in

    question by the competent authority.”

    The project proponents in compliance to the Hon’ble NGT order vide letter

    no. 14658 dated 04.10.2013 submitted application for environmental clearance.

    The SEIAA vide letter no. 1187 dated 07.11.2013 returned the application as the

    same was found in-complete. Now the applicant has submitted application under

    item no. 7(h) of schedule of EIA Notification dated 14.09.2006.

    4. The SEIAA cannot ask HSPCB to conduct study as opined by SEAC. It is

    responsibility of the project proponent and their consultant to get the study

    conducted.

    In view of the above observations the Authority decided to refer back this case to

    SEAC with the advice to appraise this project under item no. 7(h) as submitted by the

    applicant and send clear cut recommendation to the SEIAA within stipulated period as

    prescribed in the Notification dated 14.09.2006.

    Item No. [7] Environmental Clearance for Institutional Project located at Village

    Bhupani, Faridabad, Haryana by Satyug Darshan Trust.

    The SEAC has examined the proposal in the light of amended Notification dated

    22.12.2014 issued by MoEF&CC, GoI and recommended to exempt this project proposal

    from obtaining environmental clearance under EIA Notification dated 14.09.2006.

    Subject to compliance of sustainable environment management as per guidelines issued

    by MoEF & CC, GoI F.No. 19-2/2013-IA.III dated 09.06.2015.

    The above recommendation of SEAC was taken up for consideration in the

    today’s meeting. The Authority agreed with the recommendation of SEAC and decided to

    grant exemption to the project proposal from obtaining environmental clearance subject

    to compliance to guidelines issue by MoEF&CC, GoI dated 09.06.2015 by the project

    proponent.

    Item No. [8] Environmental Clearance for Construction of Commercial Complex at

    Village-Pawala Khusrupur, Sector-109, Gurgaon, Haryana by M/s

    Citra Properties Ltd. The SEAC has recommended this project for Environmental Clearance subject to

    stipulation stated therein. The Project Proponent has proposed the construction of

    Commercial Complex at Village-Pawala Khusrupur, Sector-109, Gurgaon, Haryana on a

    total plot area of 23876.42 sqm (5.90 acre). The total built up area shall be 85458.21 sqm.

    The proposed Project shall comprise of 3 basements + GF + maximum 20 floors. The

    maximum height of the building shall be 90.9 meter. The total water requirement shall be

    398 KLD. The fresh water requirement shall be 225 KLD. The waste water generation

    shall be 216 KLD, which will be treated in the STP of 250 KLD capacity. The total

    power requirement shall be 5850 KVA which will be supplied by DHBVN. The Project

    Proponent has proposed to develop green belt on 5052.27 sqmt (25.47%) of project area

    (1797.09 sqmt tree plantation + 702.21 sqmt avenue plantation + 2552.97 sqmt lawn

    area). The Project Proponent proposed to construct 06 rain water harvesting pits. The

    solid waste generation will be 1465 kg/day. The bio-degradable waste will be treated in

    the project area by installation of OWC (organic waste converter). The area required for

    OWC will be 3M x4M. The total parking spaces proposed are 1063 ECS.

    The above recommendation of SEAC was taken up for consideration. Detailed

    discussions were held regarding revenue rasta, water requirement, quality of water, green

    belt development plan, Ambient Air Quality, NOC regarding non-involvement of

    Aravalli Notification dated 07.05.1992, recycle and reuse of water, parking plan, traffic

    circulation etc. It was found that the project proponent submitted the assurance of HUDA

    for supply of water along with copies of EDC/IDC paid to HUDA for the services for

    supply of water, sewerage connection and drainage system, NOC from DC Gurgaon

    regarding non applicability of Aravalli Notification and NOC from AAI regarding height

    clearance. It was also noticed that the project proponent has earmarked the space for solid

    waste management site on the plan for collection, segregation and treatment of bio-

    degradable waste. It was found that the project proponent has obtained structural stability

    certificate issued by BMSF Design Consultants Pvt. Ltd dully signed by certified

    registered structural engineer.

    After detailed deliberations, the Authority decided to agree with the

    recommendations of SEAC to accord Environment Clearance to this project by imposing

    the following condition in addition to the usual conditions in practice.

    [1] Vertical fenestration shall not exceed 25.47% of total wall area.

    [2] The project proponent shall provide green area on terrace and roof top.

    [3] The project proponent shall not use fresh water for HVAC and DG cooling. Air

    based HVAC system should be adopted and only treated water shall be used by

    project proponent for cooling, if it is at all needed.

    [4] The project proponent shall install solar panel for energy conservation.

    [5] The project proponent shall ensure that the plinth level of the building block

    to be 1.5 meter above 100 years flood level of the said Najafgarh Jheel.

    [6] The project proponent shall obtain NOC from HUDA as well as Irrigation

    Department before the start of construction, regarding possible adverse effect

    of project proposal on the said Najafgarh Jheel.

    [7] The project proponent shall ensure that no construction activity is undertaken

    either on surface or below or above surface of revenue rasta passing through the

    project area.

    [8] The project proponent shall indicate the width and length of revenue rasta passing

    through the project area on sign board and shall display the same at both the ends

    of revenue rasta stretch, for awareness of public. Sign board shall also display the

    message that this is a public rasta/road and any citizen can use it. There shall not

    be any gate with or without guards on revenue rasta further project proponent shall

    not encroach revenue rasta and shall not cross internal roads over revenue rasta.

    Item No. [9] Environmental Clearance for Construction of Group Housing Colony

    located at Village Atmadpur, Sector-31, Faridabad, Haryana by M/s Ozone

    GSP Infratech.

    The SEAC has recommended this project for Environmental Clearance subject to

    stipulation stated therein. The Project Proponent has proposed the construction of Group

    Housing Colony located at Village Atmadpur, Sector-31, Faridabad, Haryana on a total

    plot area of 7057.71 sqm (1.744 acre). The total built up area shall be 20734.9 sqm. The

    Group Housing project shall have 3 towers with 2 basements + GF + maximum 15

    Floors, EWS units, Servant units, Convenient shopping/Commercial and community

    center. The Group Housing project shall have 816 Dwelling Units. The maximum height

    of the building shall be 49.90 meter. The total water requirement shall be 81 KLD. The

    fresh water requirement shall be 47 KLD. The waste water generation shall be 58 KLD,

    which will be treated in the STP of 70 KLD capacity. The total power requirement shall

    be 1014.43 KW which will be supplied by HVPNL. The Project Proponent has proposed

    to develop green belt on 2052.91 sqmt (29.08%) of project area (485.48 sqmt tree

    plantation + 321.35 sqmt avenue plantation + 62.73 sqmt shrubs plantation + 33.50 sqmt

    hedge/ground cover + 1149.85 sqmt lawn area). The Project Proponent proposed to

    construct 02 rain water harvesting pits. The solid waste generation will be 257 kg/day.

    The bio-degradable waste will be treated in the project area by installation of OWC

    (organic waste converter). The area required for OWC will be 3M x4M. The total parking

    spaces proposed are 212 ECS.

    In the today’s meeting the recommendation of SEAC and the project details were

    taken up for consideration. Detailed discussions were held regarding water requirement,

    quality of water, green belt development plan, Ambient Air Quality, NOC regarding non-

    involvement of Forest land, recycle and reuse of water, parking plan, traffic circulation etc.

    The representative of the project proponent submitted copy of EDC/IDC paid to HUDA

    for the services for supply of water, sewerage connection and drainage system, NOC of

    airport Authority regarding height clearance and NOC from DFO regarding Non

    involvement of Forest land. It was also noticed that the project proponent has earmarked

    the space for solid waste management site on the plan for collection, segregation and

    treatment of bio-degradable waste.

    In view of the above discussions, the Authority decided to agree with the

    recommendations of SEAC to accord Environment Clearance to this project by imposing

    the following condition in addition to the usual conditions in practice.

    [1] The project proponent shall provide green area on 29.08% of the project area.

    [2] The project proponent shall install solar panel for energy conservation.

    [3] The project proponent shall essentially provide two numbers of STPs preferably

    equivalent to 50% of total capacity or depending upon the initial occupancy as the

    case may be.

    Item No. [10] Environmental Clearance for Construction for an Affordable Group

    Housing located at Village Badha, Sector-86, Gurgaon, Haryana by

    M/s Pyramid Infratech Pvt. Ltd.

    The SEAC has recommended this project for Environmental Clearance subject to

    stipulation stated therein. The Project Proponent has proposed the construction of

    Affordable Group Housing located at Village Badha, Sector-86, Gurgaon, Haryana on a

    total plot area of 21397.72 sqm (5.2875 acres). The total built up area shall be 50004.508

    sqm. The proposed Project shall comprise 10 Towers, Tower 1 to 7 (Basement + Stilt +

    GF + 13 Floors in each tower), Tower 8 to 10 (Basement + Stilt +GF + 3 Floors in each

    tower), Commercial Building, Aganwadi etc. The maximum height of the building shall

    be 45 meter. The total water requirement shall be 660 KLD. The fresh water requirement

    shall be 459 KLD. The waste water generation shall be 553 KLD, which will be treated in

    the STP of 670 KLD capacity. The total power requirement shall be 3800.14 KVA which

    will be supplied by DHBVN. The Project Proponent has proposed to develop green belt

    on 4714.684 sqmt (22.03%) of project area (3152.146 sqmt tree plantation + 1562.538

    sqmt landscaping). The Project Proponent proposed to construct 06 rain water harvesting

    pits. The solid waste generation will be 2388 kg/day. The bio-degradable waste will be

    treated in the project area by installation of OWC (organic waste converter). The area

    required for OWC will be 3M x4M. The total parking spaces proposed are 485 ECS.

    The above recommendation of SEAC was taken up for consideration. Detailed

    discussions were held regarding water requirement, quality of water, green belt

    development plan, Ambient Air Quality, NOC regarding non-involvement of Aravalli

    Notification dated 07.05.1992, recycle and reuse of water, parking plan, traffic circulation

    etc. It was found that the project proponent submitted the assurance of HUDA for supply

    of water along with copies of EDC/IDC paid to HUDA for the services for supply of

    water, sewerage connection and drainage system, NOC from DC Gurgaon regarding non

    applicability of Aravalli Notification and NOC from AAI regarding height clearance. It

    was also noticed that the project proponent has earmarked the space for solid waste

    management site on the plan for collection, segregation and treatment of bio-degradable

    waste.

    In view of the above discussions, the Authority decided to agree with the

    recommendations of SEAC to accord Environment Clearance to this project by imposing

    the following condition in addition to the usual conditions in practice.

    [1] The project proponent shall provide green area on 22.03% of the project area.

    [2] The project proponent shall install solar panel for energy conservation.

    [3] The project proponent shall essentially provide two numbers of STPs preferably

    equivalent to 50% of total capacity or depending upon the initial occupancy as the

    case may be.

    Item No. [11] Environmental Clearance for construction of Group Housing Colony

    (2.5625 acre) located in the Revenue Estate of Village Gurgaon, Sector-

    3, Gurgaon, Haryana by M/s Santur Realtor Pvt. Ltd.

    The SEIAA in its 83rd meeting held on 28.09.2015 decided to refer back this case

    to the SEAC for re-appraisal. The SEAC in its 123rd meeting held on 10.12.2015

    considered the reply dated 23.11.2015 submitted by the project proponent on the

    observations as raised by SEIAA as under:-

    (i) The SEAC should examine the revise traffic circulation plan submitted by project

    proponent vide letter dated 09.03.2015.

    (ii) The project proponent shall obtain clarification from the competent authority of

    electricity department and shall submit the same to SEAC.

    (iii)The SEAC shall ensure that the solid waste generation calculation and parking

    calculation is as per latest prescribed norms and shall also ensure that the project

    proponent has furnished details of appropriate technology to be adopted for

    treatment of bio-degradable waste.

    (iv) The SEAC shall ensure that Khasra no. indicated in the NOC regarding non

    applicability of Aravalli Notification issued by DC conform that of Khasra no.

    indicated the license.

    The SEAC has again recommended this case for environmental clearance. The

    recommendation of SEAC was taken up for consideration in the today’s meeting. The

    reply submitted by project proponent and considered by SEAC was found in order.

    After detailed deliberation, the Authority decided to agree with the

    recommendations of SEAC to accord Environment Clearance to this project by imposing

    the following condition in addition to the usual conditions in practice.

    [1] The project proponent shall provide green area on 30.17% of the project area.

    [2] The project proponent shall install solar panel for energy conservation.

    [3] The project proponent shall essentially provide two numbers of STPs preferably

    equivalent to 50% of total capacity or depending upon the initial occupancy as the

    case may be.

    Item No. [12] Environmental Clearance for Group Housing Complex namely “Ansal

    Heights” at Sector-92, Village- Wazirpur, Tehsil & Distt. Gurgaon,

    Haryana by M/S Ansal Housing & Construction Ltd.

    The SEIAA in its 83rd meeting held on 28.09.2015 decided to refer back this case

    to the SEAC for re-appraisal. The SEAC in its 123rd meeting held on 10.12.2015

    considered the reply dated 20.10.2015 submitted by the project proponent on the

    observations as raised by SEIAA as under:-

    (i) The project proponent shall obtain permission of competent authority for use of

    revenue rasta and shall submit the same to SEAC.

    (ii) The SEAC shall ensure that the solid waste generation calculation and parking

    calculation is as per latest prescribed norms and shall also ensure that the project

    proponent has furnished details of appropriate technology to be adopted for

    treatment of bio-degradable waste.

    (iii) The SEAC shall ensure that Khasra no. indicated in the NOC regarding non

    applicability of Aravalli Notification issued by DC conform that of Khasra no.

    indicated the license.

    The SEAC has again recommended this case for environmental clearance. The

    recommendation of SEAC was taken up for consideration in the today’s meeting. The

    reply submitted by project proponent and considered by SEAC was found in order.

    After detailed deliberation, the Authority decided to agree with the

    recommendations of SEAC to accord Environment Clearance to this project by imposing

    the following condition in addition to the usual conditions in practice.

    [1] The project proponent shall provide green area on 30% of the project area.

    [2] The project proponent shall install solar panel for energy conservation.

    [3] The project proponent shall essentially provide two numbers of STPs preferably

    equivalent to 50% of total capacity or depending upon the initial occupancy as the

    case may be.

    [4] The project proponent shall submit NOC from Chief Wild Life Warden stating

    that the project area does not fall in the area notified as eco-sensitive zone around

    Sultanpur National Park Gurgaon before the start of construction.

    [5] The project proponent shall ensure that no construction activity is undertaken

    either on surface or below or above surface of revenue rasta passing through the

    project area.

    [6] The project proponent shall indicate the width and length of revenue rasta passing

    through the project area on sign board and shall display the same at both the ends

    of revenue rasta stretch, for awareness of public. Sign board shall also display the

    message that this is a public rasta/road and any citizen can use it. There shall not

    be any gate with or without guards on revenue rasta further project proponent shall

    not encroach revenue rasta and shall not cross internal roads over revenue rasta.

    Item No. [13] Environmental Clearance for expansion of Hotel Project at Sector-60,

    Gurgaon by M/s Toucan Real Estates Pvt. Ltd.

    The SEIAA in its 83rd meeting held on 28.09.2015 decided to refer back this case

    to the SEAC for re-appraisal. The SEAC in its 123rd meeting held on 10.12.2015

    considered the reply dated 20.10.2015 submitted by the project proponent on the

    observations as raised by SEIAA as under:-

    (i) The project proponent has not obtained the assurance for water supply from

    competent authority. The project proponent shall obtain the same and submit to

    the SEAC.

    (ii) The project proponent shall submit proof of having deposited up to date

    EDC/IDC paid to the concerned department to the SEAC.

    (iii) The SEAC shall ensure that Khasra no. indicated in the NOC regarding non

    applicability of Aravalli Notification issued by DC conform that of Khasra

    number indicated the license.

    (iv) The SEAC shall ensure that the solid waste generation calculation and parking

    calculation is as per latest prescribed norms and shall also ensure that the

    project proponent has furnished details of appropriate technology to be adopted

    for treatment of bio-degradable waste.

    The SEAC has again recommended this case for environmental clearance. The

    recommendation of SEAC was taken up for consideration in the today’s meeting. The

    reply submitted by project proponent and considered by SEAC was found in order.

    After detailed deliberation, the Authority decided to agree with the

    recommendations of SEAC to accord Environment Clearance to this project by imposing

    the following condition in addition to the usual conditions in practice.

    [1] The project proponent shall provide green area on 20% of the project area.

    [2] The project proponent shall install solar panel for energy conservation.

    [3] The project proponent shall meet the emission standards for Hotel Industry

    prescribed by CPCB under schedule-I of rule 3 of Environment (Protection)

    Rules, 1986.

    Item No. [14] Environmental Clearance for Affordable group hosing colony (10

    acres) in the revenue estate of village Hayatpur, Sector -90, Gurgaon,

    Haryana by M/s Aster Infrahome Pvt. Ltd.

    The SEIAA in its 83rd meeting held on 28.09.2015 decided to refer back this case

    to the SEAC for re-appraisal. The SEAC in its 123rd meeting held on 10.12.2015

    considered the reply dated 03.11.2015 submitted by the project proponent on the

    observations as raised by SEIAA as under:-

    (i) The SEAC shall ensure that Khasra no. indicated in the NOC regarding non

    applicability of Aravalli Notification issued by DC conform that of Khasra

    number indicated the license

    (ii) The SEAC shall ensure that the solid waste generation calculation and parking

    calculation is as per latest prescribed norms and shall also ensure that the

    project proponent has furnished details of appropriate technology to be adopted

    for collection of solid waste and treatment of bio-degradable waste.

    (iii) The project proponent shall ensure the applicability of standards and codes for

    fire and safety.

    The SEAC has again recommended this case for environmental clearance. The

    recommendation of SEAC was taken up for consideration in the today’s meeting. The

    reply submitted by project proponent and considered by SEAC was found in order.

    After detailed deliberation, the Authority decided to agree with the

    recommendations of SEAC to accord Environment Clearance to this project by imposing

    the following condition in addition to the usual conditions in practice.

    [1] The project proponent shall provide green area on 21.54% of the project area.

    [2] The project proponent shall install solar panel for energy conservation.

    Item No. [15] Environmental Clearance for construction of Affordable Group

    Housing Colony project at Village Kherki Majra Dhankot, Sector-99,

    Distt Gurgaon, Haryana by M/s Pivotal Infrastructure Pvt. Ltd.

    The SEAC in its 118th meeting held on 04.03.2015 recommended this project for

    environmental clearance. In compliance to the Hon’ble NGT order the MoEF&CC, GoI

    perused the recommendations of SEAC and raised certain observations. The MoEF&CC,

    GoI vide letter dated 14.09.2015 requested to re-appraise the project in term of the

    deficiencies as stated in the letter as per the requirement contained in the EIA

    Notification 2006. The case was referred to the SEAC to re-appraise the case in terms of

    deficiencies as under:-

    (i) Out of the total water requirement of 713 kld, 455 kld would be fresh water and

    258 kld recycled treated water. The fresh water requirement is to be met through

    HUDA municipal supply. However there in no firm commitment of HUDA in

    this regard. A letter of commitment be obtained from HUDA.

    (ii) The project site falls in un-sewered area. The project proponent and SEAC have

    mentioned about an arrangement of zero discharge, but how the same will be

    achieved in rainy season, has not been clarified.

    (iii) One of the specific conditions in recommendations of SEAC, the project

    proponent to comply is read as under:-

    “Fly ash should be used for building material in the construction as per the

    provisions of Fly Ash Notification of September, 1999 and as amended on 22nd

    August, 2003”

    There is no implementation mechanism proposed by the project proponent in this

    regard.

    (iv) The project proponent has other projects under implementation in the State, as is

    evident from the SEAC minutes of the meeting held on 16th April, 2014.

    Compliance status of EC conditions in those projects be filed for further action.

    The SEAC in its 123rd meeting held on 10.12.2015 considered the reply dated

    21.10.2015 submitted by the project proponent on the above observations and again

    recommended this case for environmental clearance.

    The recommendation of SEAC along with reply dated 21.10.2015 submitted by

    the project proponent was considered in the today’s meeting. It was found that the project

    proponent has submitted proof of submission of 6 monthly compliance report but failed

    to submit the certified copies of compliance of in respect of (i) Affordable Group

    Housing, Sector-84, Gurgaon. (ii) DD Township Group Housing Sector-70 Faridabad.

    (iii) Apex Build Well; Group Housing Project, Sector-37C Gurgaon. The project

    proponent is required to submit certified copy of compliance report from RO,

    MoEF&CC, GoI Chandigarh in respect of the above three projects.

    After detailed deliberation, the Authority decided to agree with the

    recommendations of SEAC to accord Environment Clearance to this project by imposing

    the following condition in addition to the usual conditions in practice.

    [1] The project proponent shall provide green area on 16.14% of the project area.

    [2] The project proponent shall install solar panel for energy conservation.

    [3] The project proponent shall essentially provide two numbers of STPs preferably

    equivalent to 50% of total capacity or depending upon the initial occupancy as the

    case may be.

    [4] The project proponent shall submit certified copy of compliance report from RO,

    MoEF&CC, GoI, Chandigarh in respect of (i) Affordable Group Housing, Sector-

    84, Gurgaon. (ii) DD Township Group Housing Sector-70 Faridabad. (iii)Apex

    Build Well; Group Housing Project, Sector-37C Gurgaon within three months

    period falling which the EC granted shall stand withdrawn without further

    intimation.

    [5] The project proponent shall not raise any construction activity in the ROW

    reserved/acquired for High Tension Wire passing through the project area and

    shall maintain horizontal and vertical ROW as required under Indian Electricity

    Rules, 1956/DHBVN latest instructions.

    Item No. [16] Environmental Clearance for the proposed “Gateway Tower, IT

    Park” Project measuring 8.50 acres at Sector-37, Village- Anangpur,

    Faridabad, Haryana being developed by M/s Dove Infrastructure Pvt.

    Ltd.

    The SEAC in its 123rd meeting held on 11.12.2015 recommended this case for

    environmental clearance. The SEAC in its recommendations has stated that before

    granting EC clarification from MoEF&CC, GoI the obtained as to whether the OM dated

    12.12.2012 is applicable or not in view of the stay granted by Hon’ble Supreme Court of

    India. The recommendation of SEAC was taken up for consideration in the today’s

    meeting and the Authority observed that:

    1. The project proponent on 30.04.2014 submitted application for environment

    clearance for the project as indicated in the subject. On the recommendation of

    SEAC the SEIAA vide letter dated 06.08.2014 requested Principal Secretary

    Environment to initiate legal action against the project proponent under EPA 1986

    as the project proponent had started the construction without obtaining prior

    environmental clearance. A request was also made to send credible action taken

    report. The Principal Secretary environment vide letter dated 11.03.2015 provided

    the evidence of credible action taken against the project proponent.

    2. Due to the lapse term of SEIAA/SEAC the case could not be appraised and

    transferred to MoEF&CC, GoI. No action taken by MoEF&CC, GoI and the case

    was returned to SEIAA after its reconstitution.

    3. The SEIAA vide letter SEIAA/HR/2015/634 dated 28.12.2015 has already

    requested Joint Secretary MoEF&CC, GoI to provide necessary clarification in the

    matter so as to enable the SEIAA to take appropriate action in violation cases.

    In view of the above observations it was decided to defer the case to the next

    meeting with the decision that:

    (i) Giving reference of Hon’ble Supreme Court orders and the earlier

    communication dated 28.12.2015 of this office, the MOEF & CC, GOI may

    again be requested to send necessary clarification in the matter so as to enable

    the SEIAA to take appropriate action in violation cases well within the

    stipulated period as prescribed in the Notification/guidelines, in order to avoid

    any litigation.

    The above recommendation of SEAC was taken up for consideration. Detailed

    discussions were held regarding water requirement, quality of water, green belt

    development plan, Ambient Air Quality, NOC regarding non-involvement of Aravalli

    Notification dated 07.05.1992, recycle and reuse of water, parking plan, traffic circulation

    and status of compliance of conditions imposed in the EC letter. It was also noticed that

    the project proponent has proposed to dispose of Bio-degradable waste to MSW site. The project

    proponent is required to submit assurance for the same. It was also noticed that the license

    granted by Town and Country Planning Department has lapsed on 07.11.2015 and the project

    proponent is required to submit copy of validated license.

    After detailed deliberations, the Authority decided to agree with the

    recommendations of SEAC to accord Environment Clearance to this project by imposing

    the following condition in addition to the usual conditions in practice. It was also decided

    that the EC shall be issued only after the submission of copy of validated license and

    assurance of competent Authority for disposal of MSW at the designated site.

    [1] Vertical fenestration shall not exceed 27% of total wall area.

    [2] The project proponent shall provide green area on terrace and roof top.

    [3] The project proponent shall not use fresh water for HVAC and DG cooling. Air

    based HVAC system should be adopted and only treated water shall be used by

    project proponent for cooling, if it is at all needed.

    [4] The project proponent shall install solar panel for energy conservation.

    [5] The project proponent shall submit copy of validated license and assurance of

    competent Authority for disposal of MSW at the designated site.

    Item No. [18] Environmental Clearance for construction of Affordable Group

    Housing at Sector-99A, Gurgaon Manesar Urban Complex, Gurgaon,

    Haryana by M/s Prime Infradevelopers Pvt. Ltd.

    The SEAC has recommended this project for Environmental Clearance subject to

    stipulation stated therein. The Project Proponent has proposed the construction of

    “Affordable Group Housing” at Sector-99A, Gurgaon Manesar Urban Complex,

    Gurgaon, Haryana on a total plot area of 24104 sqm. The total built up area shall be

    52104.76 sqm. The proposed Project shall have 03 Blocks, Stilt + maximum 12 floors.

    The proposed project shall have 816 Dwelling Units. The maximum height of the

    building shall be 38.950 meter. The total water requirement shall be 582 KLD. The fresh

    water requirement shall be 379 KLD. The waste water generation shall be 494 KLD,

    which will be treated in the STP of 595 KLD capacity. The total power requirement shall

    be 4500 KW which will be supplied by DHBVN. The Project Proponent has proposed to

    develop green belt on 9222.14 sqmt of project area (5981.93 sqmt tree plantation +

    3240.210 sqmt landscaping). The Project Proponent proposed to construct 05 rain water

    harvesting pits. The solid waste generation will be 2.16 Ton/day. The bio-degradable

    waste will be treated in the project area by installation of OWC (organic waste

    converter). The area required for OWC will be 100 sqm. The total parking spaces

    proposed are 409 ECS.

    The above recommendation of SEAC was taken up for consideration. Detailed

    discussions were held regarding water requirement, quality of water, green belt

    development plan, Ambient Air Quality, NOC regarding non-involvement of Aravalli

    Notification dated 07.05.1992, recycle and reuse of water, parking plan, traffic circulation

    etc. It was found that the project proponent submitted the assurance of HUDA for supply

    of water along with copies of EDC/IDC paid to HUDA for the services for supply of

    water, sewerage connection and drainage system, NOC from DC Gurgaon regarding non

    applicability of Aravalli Notification and NOC from AAI regarding height clearance. It

    was also noticed that the project proponent has earmarked the space for solid waste

    recommendations of SEAC to accord Environment Clearance to this project by imposing

    the following condition in addition to the usual conditions in practice.

    [1] The project proponent shall provide green area on 9222.14 sqmt of the project

    area.

    [2] The project proponent shall install solar panel for energy conservation.

    case may be.

    Item No. [19] Environmental Clearance for construction of Group Housing Project

    (10 acres) allot ed by HUDA, Faridabad at Rojka Meo Industrial

    Estate, District Mewat, Haryana by M/s MMTC PAMP India Pvt. Ltd.

    The SEAC has recommended this project for Environmental Clearance subject to

    stipulation stated therein. The Project Proponent has proposed the construction of Group

    Housing Project (10 acres) allotted by HUDA, Faridabad at Rojka Meo Industrial Estate,

    District Mewat, Haryana on a total plot area of 40480 sqm. The total built up area shall

    be 28920 sqm. The proposed Project shall have 14 Blocks, GF + Maximum 08 Floors,

    157 DU. The maximum height of the building shall be 29 meter. The total water

    requirement shall be 210 KLD. The fresh water requirement shall be 108 KLD. The

    waste water generation shall be 129 KLD, which will be treated in the STP of 155 KLD

    capacity. The total power requirement shall be 874 KW which will be supplied by

    DHBVN. The Project Proponent has proposed to develop green belt on 39% of project

    area (20% tree plantation + 19% landscaping). The Project Proponent proposed to

    construct 10 rain water harvesting pits. The solid waste generation will be 0.56 Ton/day.

    The bio-degradable waste will be treated in the project area by installation of Bio-

    Mechanical Composting. The area required for Bio-Mechanical Composting will be 3M x

    4M. The total parking spaces proposed are 5723.298 sqmt.

    The above recommendation of SEAC was taken up for consideration. Detailed

    discussions were held regarding water requirement, quality of water, green belt

    development plan, Ambient Air Quality, NOC regarding non-involvement of Forest land,

    recycle and reuse of water, parking plan, traffic circulation etc. It was found that the

    project proponent submitted the assurance of HUDA for supply of water and NOC from

    Forest Department regarding non involvement of Forest land. It was observed that the

    project proponent has not earmarked the space for solid waste management site on the

    plan for collection, segregation and treatment of bio-degradable waste.

    In view of the above discussions, the Authority decided to agree with the

    recommendations of SEAC to accord Environment Clearance to this project by imposing

    the following condition in addition to the usual conditions in practice..

    [1] The project proponent shall provide green area on 39% of the project area.

    [2] The project proponent shall essentially provide two numbers of STPs preferably

    equivalent to 50% of total capacity or depending upon the initial occupancy as the

    case may be.

    [3] The project proponent shall obtain assurance of power supply as per prevailing

    rules/norms.

    Item No. [20] Environmental Clearance for proposed Affordable Group Housing

    Colony Project at Village Dhorka, Sector-95, District-Gurgaon,

    Haryana by M/s Ramsons Organics Ltd.

    The SEAC has recommended this project for Environmental Clearance subject to

    stipulation stated therein. The Project Proponent has proposed the construction of

    Affordable Group Housing Colony Project at Village Dhorka, Sector-95, District-

    Gurgaon, Haryana on a total plot area of 19600.96641 sqm (4.8435 acres). The total built

    up area shall be 45975.331 sqm. The proposed Project shall comprise 7 Block (A-G)

    Residential and Commercial building. The maximum height of the building shall be

    48.15 meter. The total water requirement shall be 567 KLD. The fresh water requirement

    shall be 363 KLD. The waste water generation shall be 479 KLD, which will be treated in

    the STP of 575 KLD capacity. The total power requirement shall be 7000 KVA which

    will be supplied by DHBVN. The Project Proponent has proposed to develop green belt

    on 21.5% of project area (15% plantation + 6.5% landscaping). The Project Proponent

    proposed to construct 05 rain water harvesting pits. The solid waste generation will be

    2137.49 kg/day. The bio-degradable waste will be treated in the project area by adopting

    appropriate technology. The total parking spaces proposed are 504 ECS.

    The above recommendation of SEAC was taken up for consideration. Detailed

    discussions were held regarding water requirement, quality of water, green belt

    development plan, Ambient Air Quality, NOC regarding non-involvement of Aravalli

    Notification dated 07.05.1992, recycle and reuse of water, parking plan, traffic circulation

    etc. It was found that the project proponent submitted the assurance of HUDA for supply

    of water along with copies of EDC/IDC paid to HUDA for the services for supply of

    water, sewerage connection and drainage system, NOC from DC Gurgaon regarding non

    applicability of Aravalli Notification and NOC from AAI regarding height clearance. It

    was also noticed that the project proponent has earmarked the space for solid waste

    management site on the plan for collection, segregation and treatment of bio-degradable

    waste but the detail of technology for treatment of bio-degradable waste are not discussed

    and dimensions of the reserved area not given.

    In view of the above discussions, the Authority decided to agree with the

    recommendations of SEAC to accord Environment Clearance to this project by imposing

    the following condition in addition to the usual conditions in practice. The EC shall be

    submitted subject to the submission of details of technology to be adopted for treatment

    of bio-degradable waste in the project area along with the dimensions of area earmarked

    for management of solid waste within 15 days.

    [1] The project proponent shall provide green area on 21.5% of the project area.

    [2] The project proponent shall install solar panel for energy conservation.

    [3] The project proponent shall essentially provide two numbers of STPs preferably

    equivalent to 50% of total capacity or depending upon the initial occupancy as the

    case may be.

    [4] The project proponent shall submit detail of technology for treatment of bio-

    degradable waste and dimensions of the area reserved for management of solid

    waste.

    Item No. [21] Environmental Clearance for proposed Affordable Group Housing

    Colony project at Village Naurangpur, Sector-79, 79B, Distt Gurgaon,

    Haryana by M/s Revital Reality Pvt. Ltd.

    The SEAC has recommended this project for Environmental Clearance subject to

    stipulation stated therein. The Project Proponent has proposed the construction of

    Affordable Group Housing Colony Project at Village Naurangpur, Sector-79, 79B, Distt.

    Gurgaon, Haryana on a total plot area of 48967.01 sqm (12.10 acres). The total built up

    area shall be 146757.47 sqm. The proposed Project shall comprise 15 Towers +

    Basement + GF + maximum 17 Floors, Commercial (Mumty +Water tank),

    Anganwadi/Community. The maximum height of the building shall be 55.285 meter. The

    total water requirement shall be 1424 KLD. The fresh water requirement shall be 903

    KLD. The waste water generation shall be 1237 KLD, which will be treated in the 2 STPs

    of 1180 KLD & 307 KLD capacity. The total power requirement shall be 7015 KW

    which will be supplied by DHBVN. The Project Proponent has proposed to develop

    green belt on 10277.354 sqm (20.99%) of project area (7345.05 sqm plantation + 2932.3

    sqm landscaping). The Project Proponent proposed to construct 12 rain water harvesting

    pits. The solid waste generation will be 5331.977 kg/day. The bio-degradable waste will

    be treated in the project area by installation of OWC (organic waste converter). The area

    required for OWC will be 3M x4M. The total parking spaces proposed are 1093 ECS.

    The above recommendation of SEAC was taken up for consideration. Detailed

    discussions were held regarding revenue rasta, water requirement, quality of water, green

    belt development plan, Ambient Air Quality, NOC regarding non-involvement of

    Aravalli Notification dated 07.05.1992, recycle and reuse of water, parking plan, traffic

    circulation etc. It was found that the project proponent submitted the assurance of HUDA

    [1] The project proponent shall provide green area on 20.99% of the project area.

    [2] The project proponent shall install solar panel for energy conservation.

    [3] The project proponent shall essentially provide two numbers of STPs preferably

    equivalent to 50% of total capacity or depending upon the initial occupancy as the

    case may be.

    [4] The project proponent shall ensure that no construction activity is undertaken

    either on surface or below or above surface of revenue rasta passing through the

    project area.

    [5] The project proponent shall indicate the width and length of revenue rasta passing

    through the project area on sign board and shall display the same at both the ends

    of revenue rasta stretch, for awareness of public. Sign board shall also display the

    message that this is a public rasta/road and any citizen can use it. There shall not

    be any gate with or without guards on revenue rasta further project proponent shall

    not encroach revenue rasta and shall not cross internal roads over revenue rasta.

    Item No. [22] Environmental Clearance for proposed Group Housing Project at

    Sector-2, Tehsil-Sohna & District Gurgaon, Haryana by M/s Ashiana

    Dwellings Pvt. Ltd. (Formerly M/s PSL Infratech Pvt. Ltd)

    The SEAC has recommended this project for Environmental Clearance subject to

    stipulation stated therein. The Project Proponent has proposed the construction of Group

    Housing Colony located at Revenue Estate of Village Nuna Majra, Sector-37,

    Bahadurgarh, Haryana on a total plot area of 41480.27 sqm (10.25 acre). The net planned

    area is 35279.28 sqm (8.717 acre). The total built up area shall be 118863 sqm. The

    proposed Project shall have 10 Residential Towers, 01 EWS Tower, 01 Commercial

    Block, Community Building and Educational Building. The project will have 660 MDU,

    117 EWS and 70 Servant units. The maximum number of floors shall be Basement + GF

    + 18 Floors. The maximum height of the building shall be 65 meter. The total water

    requirement shall be 698 KLD. The fresh water requirement shall be 414 KLD. The

    waste water generation shall be 540 KLD, which will be treated in the STP of 620 KLD

    capacity. The total power requirement shall be 5537 KW which will be supplied by

    DHBVN. The Project Proponent has proposed to develop green belt on 30.29% of project

    area (20.28% tree plantation + 10.01% landscaping). The Project Proponent proposed to

    construct 10 rain water harvesting pits. The solid waste generation will be 2261.37

    kg/day. The bio-degradable waste will be treated in the project area by installation of

    OWC (organic waste converter). The area required for OWC will be 100 sqm. The total

    parking spaces proposed are 1266 ECS.

    The above recommendation of SEAC was taken up for consideration. Detailed

    discussions were held regarding water requirement, quality of water, green belt

    development plan, Ambient Air Quality, recycle and reuse of water, parking plan, traffic

    circulation etc. It was found that the project proponent submitted the assurance of HUDA

    for supply of water and NOC from AAI regarding height clearance. It was observed that

    the project proponent has earmarked the space for solid waste management site on the

    plan for collection, segregation and treatment of bio-degradable waste. It was found that

    the project proponent has obtained structural stability certificate issued by TPC Technical

    Projects Consultants (P) Ltd. dully signed by registered structural engineer.

    In view of the above discussions, the Authority decided to agree with the

    recommendations of SEAC to accord Environment Clearance to this project by imposing

    the following condition in addition to the usual conditions in practice.

    [1] The project proponent shall provide green area on 30.29% of the project area.

    [2] The project proponent shall essentially provide two numbers of STPs preferably

    equivalent to 50% of total capacity or depending upon the initial occupancy as the

    case may be.

    Item No. [23] Application for extension of validity period of Environment Clearance

    for Group Housing and Colony for construction of group housing

    colony project at Sector-5 Dharuhera Dist. Rewari, Haryana by M/s

    Elite Homes Pvt. Ltd.

    The application of project proponent seeking extension of validity of

    environmental clearance letter along with representation submitted by the project

    proponent was considered in the today’s meeting. The Authority observed that:

    1. The MoEF&CC, GoI on 08.01.2008 granted environmental clearance to the

    project proponent. The project proponent has submitted application for extension

    of validity on 29.12.2014/25.02.2015. No action was taken due to lapse of term of

    SEIAA. The case was transferred to MoEF&CC, GoI no action was taken and the

    same was returned to SEIAA after its reconstitution.

    2. The MoEF&CC, GoI vide letter dated 05.10.2015 has advised the project

    proponent to seek fresh Environmental Clearance as the case is time bar.

    3. The project proponent on 24.11.2015 and 08.12.2015 submitted representation to

    considered grant extension of validity of EC keeping in view the amendment to

    the Principal Notification dated 29.04.2015, wherein the validity of EC had been

    extended from 5 to 7 year and also clarified that the MoEF&CC, GoI while issuing

    the letter dated 05.10.2015 has not taken in to consideration the amended

    notification extending validity period from 5 years to 7 years.

    4. This office of SEIAA vide letter dated 18.12.2015 forwarded the representation of

    project proponent and sought clarification from MoEF&CC, GoI whether project

    proposal qualifies for consideration in view of amendment to the notification or

    not. Again on 31.12.2015 a reminder was issued but clarification from

    MoEF&CC, GoI is still awaited.

    5. In the similar case, Regional office Ministry of Environment Forest & Climate

    Change, Chandigarh vide letter no. F.No. 4-625/2009-RO(NZ) dated 17.07.2015

    has extended the validity of environment clearance granted to M/s Energetic

    Construction Pvt. Ltd. by SEIAA, Haryana vide letter no. DEH/08/SEAC-15/6-8

    dated 23.01.2009 from 5 years to 7 years i.e. up to 22.01.2016.

    6. The environmental clearance to the project proponent was granted by MoEF&CC,

    GoI vide F.No. 21-409/2007-IA.III dated 08.01.2008. The validity of EC as per

    amended notification dated 29.04.2015 was up to 07.01.2015. The project

    proponent on 25.02.2015 submitted the complete application for extension of

    validity of EC. The project proponent has completed about 60% of the

    construction.

    7. The Director of the company also submitted an undertaking on 24.11.2015 that no

    construction after the expiry of the validity of EC has been raised.

    In view of the above observations the Authority decided to grant extension of

    validity of environmental clearance for further 7 years with effect from 07.01.2015

    subject to compliance of the conditions imposed in the environmental clearance letter

    issued by MoEF&CC, GoI dated 08.01.2008.
