Meetings for the next month were decided to be held on 5 th , 6 th and 7 th January 2011. Deliberations: 1. Case No. 582/2010 – Shri Kailash Jain Chouradiya HIG- 11, Deendayalpuram, Civil lines, Balaghat (M.P) – For TOR Dulhapur Dolomite Mine at Khsra no. 15/1 ,16/1, 16/2, 17/1, 17/2, 18/2, 12/1, 12/2, 13/1, 15/2, 11/1, 11/2, 11/3, 13/2, 13/7 at village Dulahapur, Tehsil- Katangi Dist. 1. Opening Remarks of the Chairman

The Chairman welcomed all the members of the Committee and thereafter agenda items were taken up for deliberations.

2. Consideration of the Projects08 Cases (for TOR / EIA deliberations) were invited. Only 05 proposals were presented before the committee. Request from the proponents of 02 cases was received for considering their cases in the meeting scheduled for 14/12/2010.

3. Meetings for the next month were decided to be held on 5th, 6th and 7th January2011.

Deliberations:

1. Case No. 582/2010 – Shri Kailash Jain Chouradiya HIG- 11, Deendayalpuram, Civil lines, Balaghat (M.P) – For TOR Dulhapur Dolomite Mine at Khsra no. 15/1 ,16/1, 16/2, 17/1, 17/2, 18/2, 12/1, 12/2, 13/1, 15/2, 11/1, 11/2, 11/3, 13/2, 13/7 at village Dulahapur, Tehsil- Katangi Dist. Balaghat (M.P) total area 15/.08 Ha, production capacity- 15000 MT/Year. Env Consultant- Not disclosed. 1(a) of schedule under ‘B’ Category of EIA Notification, 2006 and is to be appraised by SEAC. Mining lease is valid from 2004 to 2024. Public hearing was conducted on 10.09.2010, and no adverse report was registered. The applicant presented the EIA of the project. No national parks and sanctuary is reported in 10 km radius around the site. Nearest Highway is Maihar-Kymore road - 2.5km. Nearest Village is Amgar - 1.0km. Hardua Reserve Forest is in South at 7.0kmand Karreha Reserve Forest is at 8.5km from the site. Chakdahi Nalla is reported at 3.75km and Kalindhar nalla is at 0.1km. River Tons is in - NW– 7km.

This existing mine presently closed. The mine is reported to be operating without obtaining prior environmental clearance under the provisions of Environment (Protection) Act 1986. Necessary action against the mine owner may be initiated by the competent authority for such violation in accordance to the Office Memorandum of MoEF dated 16th November 2010. Opencast/ manual Mining is proposed. Pits & Quarries (Existing) in 0.01 Ha. Ultimate Depth of Mining shall be 6mbgl (94mRL). Ground water table in monsoon period is reported to be 12mbgl (88mRL), thus mining is not going to intersect the ground water table. Area to be reclaimed at the end of lease period is reported to be 10hect of which area to be covered under plantation by Lease Period shall be 6.0ha and area covered under pit in Lease Period shall be 14.25Ha

1. Executive Summary of EIA/EMP in not more than 10 pages has to be submitted.

2. Activity wise budget break-up for CSR activities to be submitted along with a written commitment for the above.

This being a mining project with lease area between 50 ha to 5 ha is listed at S.N. 1(a) of schedule under ‘B’ Category of EIA Notification, 2006 and is to be appraised by SEAC. Mining lease is valid from 30.01.2009 upto 29.01.2029. Public hearing was conducted on 21.07.2010, and no adverse report was registered. The applicant presented the EIA of the project.

This is a case of a new mine. The mine is reported to be operating without obtaining prior environmental clearance under the provisions of Environment (Protection) Act 1986. Necessary action against the mine owner may be initiated by the competent authority for such violation in accordance to the Office Memorandum of MoEF dated 16th November 2010. Open-cast other than fully mechanized mining has been proposed, mining shall not intersect the GW table. No national parks and sanctuary is reported in 10 km radius around the site. Ground water table is reported to vary between 5-10mbgl (409-404m AMSL) and ultimate working depth shall be 2mbgl (412m AMSL), hence mining is not going to intersect the ground water table. Nearest Village reported is Bagraji at 0.75 km in NNE direction from the site. Reserve Forest reported are Kathi RF-4.5km-S, Bijhat RF-3.5km-EES and Chiulapani RF-10.0km – SW. Near by water bodies are Ametha water Tank in West at 750 meters and a Canal in East at 400 meters from the site. PP has submitted NOC from forest department and Gram Sabha.

Jabalpur (M.P.) Area- 10.31 ha. Capacity- 5000 TPA Env. Consultant: Creative Enviro Service, Bhopal. (SN-29) For ToR

This being a mining project with lease area between 50 ha to 5 ha is listed at S.N. 1(a) of schedule under ‘B’ Category of EIA Notification, 2006 and is to be appraised by SEAC. This is a case of a new mine yet to open. The case has been submitted for TOR approval. The salient features of the project were presented by the PP and his consultant before the committee which reveals following: Nearest Highway is Jabalpur-Jaipur NH-12 at 4.0 km and nearest Village is Bagrai- at 1.2 km in SW. Historical Place Bherhaghat is 5.0km from the site. River/Nalla reported are - Narmada River -600 meters in West and a Seasonal Nalla- 0.15km in South-West. After deliberations it was observed that the proposed site is very close to the River Narmada and natural tourist spot Bhedaghat, hence committee

This is a proposed Commercial project located at Khasra No. 538, 539, 540, 541, 542, 543/2, 547 at Bairagadh Chichli Kolar Road Bhopal, Madhya Pradesh. The nearest railway station is Habibganj at a distance of approx. 11 km. Bhopal Airport is about 18 Km away. Bhopal Main City is about 8 km from the proposed project site. Deliberations revealed following details on the salient features of the project:

Documents submitted by the PP: Building Permission by Nagar Palika Kolar in name of Khaneja Proper6ties (P) Ltd. and Water supply intent letter from Nagar Palika Kolar. The case was presented by the PP and his consultant before the committee. During presentation Copies of land ownership documents submitted by the PP revealed that the papers were in name of M/s Khaneja Properties, whereas the application for EC was filed by M/s SVS Buildcon (P) Ltd. It was explained by the PP that the project is owned by M/s Khaneja Properties but has been launched as SVS Buildcon (P) Ltd. Committee has asked the PP to re-submit the case clarifying the ownership of the project along with the reply to the following queries: 1. Revised application from the actual proponent of the project.2. Development Plan duly approved by the Town & Country Planning

Department.3. Design of STP has to be reviewed and detailed drawing & design has to be

submitted.4. Conceptual Plan showing the locations of STP, water harvesting system,

green areas and other features has to be submitted.5. Management & Disposal of MSW to be submitted.6. Details of power conservation through use of solar energy and other

efforts.7. Commitment for adopting green building concept.8. Details of the amenities planned in the proposed commercial complex.9. Scheme for plantation in at least 33% of total plot area.

7. Case No. 602/2010 M/s Krishna Phoschem Ltd. Shri Manohar Raghuwanshi,Manager, 127, Rachna Nagar,Bhopal (M.P.) Single Super Phosphate (SSP) Plant- Production capacity : SSP powder- 1,20,000 MT/Year and Granulated SSP – 90,000 MT/Year at MPAKVN Industrial Area Plot No.118-B,119,120 Meghnagar,Teh.-Jhabua Distt.-Jhabua (M.P.) 1.0 Env. Consultant: Creative Enviro Service, Bhopal. (SN-29) For ToR.

This projects pertains to production of Single Super Phosphate (SSP) and is listed at S.N 5(a) of EIA Notification 2006 as amended in the notification dated 01/12/2009, hence is required to be appraised by SEAC (under B category). The case was presented before the committee by the PP and his consultant. During presentation it was observed by the committee that application submitted by the PP mentioned following products- SSP powder- 1, 20,000 MT/Year and Granulated SSP/NPK – 90,000 MT/Year. In view of production of NPK along with SSP Committee pointed out that this would be a ‘A’ Category project. It was clarified by the PP that only SSP shall be manufactured in powdered as well as granulated forms and no additional product is proposed. The case was considered by the committee based on the PP’s commitment. The project is proposed in an existing Rock Phosphate Beneficiation Plant of capacity 1.0 Lac MT/Year. The proposed plant shall be installed in the same premises without acquiring additional land. Cost of the project is reported to be 30.0 Crore. Following raw material is proposed to used- Rock Phosphate (Slurry) and Sulphuric Acid (98%). No sulphuric acid plant shall be erected at site. Additional water requirement shall be 60 m3 /day, which shall be supplied by the AKVN. The plant is located in Notified Industrial Area of AKVN at State highway, the Gujrat-MP interstate border is reported to be more than 40 Km from the plant. The plant being proposed in notified industrial area no public hearing is required. Nearest railway line is 2.5 Km. After deliberations committee has decided to issue TOR for carrying out EIA / EMP with inclusion of following points:

1. An Affidavit has to be submitted with EIA stating that only SSP shall be manufactured in the proposed plant.

2. Compliance of the conditions of EC / Air-water Consents with respect to

existing unit has to be submitted.3. Justification for the land available for expansion to be included.4. Details of the Source of Air Pollution from different sections such as raw

material storage, processing, maturation section etc. and control measures proposed for each.

5. Composition of raw material (mineral and beneficiated rock phosphate).6. Percentage of Fluorine in raw material and the Material balance

incorporating the fluorine contents.7. Details of ETP showing the details of ‘Zero discharge’ from the unit.8. Detail chapter on Occupational Health & Safety has to be incorporated in

the EIA/EMP.9. Hydro-geological study of the area has to be carried out in view of

possible ground water contamination.10. Map showing details of surrounding industries with product to be

PP has submitted satisfactory reply to the raised queries along with the supporting documents hence committee has decided to recommend the case for grant of prior EC. Discussion on miscellaneous cases1. Case No. 481/2009 M/s

Birla Corporation Limited (Cement Division) P.O. Birla Vikas Satna-485 005 (Meeting dated – 01/06/2010) Proposed Captive Thermal Power Plant 35 MW (Cement Division) Project at, P.O. -Birla Vikas, District-Satna (M.P.)

The site is in proximity to the satna city and industry proposes to use coal with ash content of more than 34%, hence to ensure the safe distance of proposed plant from the city committee visited the site physically. The report (Annexure-1) of the visit was placed before the SEAC and it was concluded that TOR may be issued to the PP with inclusion of terms as suggested by the committee in the said report. However it was also decided that the TOR should be issued only after ensuring that the distance of the site is in accordance to the guidelines laid in the fly-ash notification / CREP charter.

PP has submitted reply with supporting documents for the queries raised by the members of the sub-committee during the visit. Guidelines of the fly-ash Notification have also been consulted. Based on the above TOR may issued to the PP for carrying out EIA/EMP.

Oct 2010Examination of the Public Hearing proceedings revealed that there were no adverse comments from the public butCollector Morena has pointed out that the proposed site is in proximity of village Mahatoli and earlier complaints regarding damages due to blasting have been received during visit of the area, owing to the same Collector has recommended that the mine should not be accorded environmental clearance.After deliberations it was found that this project is similar to the projects discussed as case no. 397 & 398 and also the project area adjoins the area of other two projects hence committee decided to defer the case till submission of enquiry report from Collector Morena in this context.

Office Order for nomination of a member from SEAC has been received for decision. Committee decided to forward the said office order to SEIAA for necessary directions in the matter. However, if required a sub-committee from SEAC shall visit the site.

6. Case No. 545/2010 M/s Smt Shakuntala Kasal Ward No. 13, Rain Road Wara seoni, Distt-Balaghat-M.P. Manganese ore mine 6.985 at village Hathoda, Teh- Katangi, Distt- Balaghat-M.P.

The case presented before the committee for issue of TOR to carry out EIA. It was decided by the committee to keep the TOR pending till PP submits Mining Plan. PP has submitted the mining plan and requested to release the TOR so that EIA can be initiated. The approved mining plan shall be submitted with EIA.

Committee decided to release the TOR, subject to submission of approved mining plan with EIA.
