It is decided to hold the 66 th meeting on 30 th September 2010. Deliberations: 1. Case no. 294/2009 Shri K.C. TOR for carrying out EIA / EMP was issued vide letter no. 395 dt 12/06/2009 and public hearing was conducted on 13/05/2010. PP and his consultant presented the EIA / EMP before the committee. The public hearing issues were discussed in detail. During deliberations it was reported that, the Lease Period is valid up to - 26.03.2015.The type of Land is Govt. Revenue land. Ground water table is reported to be 17-20 mbgl (363-360m AMSL). Ultimate working depth shall be 15 mt (365 m AMSL). Nearest Highway is Jukehi- Kymore Road - 600 meters and nearest Village is Amehta – 500 meters - North direction. No national parks and sanctuary or historical monument within 10km radius has been reported.Nearest forest is Surma Reserve Forest - 4.0 km. 1. 57Opening Remarks of the Chairman

The Chairman welcomed all the members of the Committee (Annexure-1) and thereafter agenda items were taken up for deliberations. The list of participants present during meeting is annexed as Annexure-2.

2. Consideration of the Projects09 Cases (for TOR / EIA deliberations) were invited. Out of these proposals only 05 proposals were presented before the committee. Proponent of case no. 579/2010 was called for the meeting scheduled for 30th September 2010 was also allowed to present the case before the committee for TOR approval on his request. It is decided to hold the 66th meeting on 30th September 2010.

Deliberations: 1. Case no. 294/2009 Shri K.C. Bagaria Sons Station Road Katni (M.P)

Limestone & Dolomite deposit mining 7.52 Ha at village Ametha, Khasra No.- 183, 230/1 Tehsil- Vijayraghogarh Distt- Katni (M.P) Capacity: 33,660 TPA. Env. Consultant: Creative Enviro Service, Bhopal. (SN-29). EIA Presentation

This being a mining project with lease area between 50 ha to 5 ha is listed at

S.N. 1(a) of schedule under ‘B’ Category of EIA Notification, 2006 and is to be

appraised by SEAC. TOR for carrying out EIA / EMP was issued vide letter no.

395 dt 12/06/2009 and public hearing was conducted on 13/05/2010. PP and his

consultant presented the EIA / EMP before the committee. The public hearing

issues were discussed in detail. During deliberations it was reported that, the

Lease Period is valid up to - 26.03.2015.The type of Land is Govt. Revenue land.

Ground water table is reported to be 17-20 mbgl (363-360m AMSL). Ultimate

working depth shall be 15 mt (365 m AMSL). Nearest Highway is Jukehi-

Kymore Road - 600 meters and nearest Village is Amehta – 500 meters - North

direction. No national parks and sanctuary or historical monument within 10km

radius has been reported.Nearest forest is Surma Reserve Forest - 4.0 km. Nearest

River/ Nalla reported are Koilari Nadi- SE- 6.0km, Tones River- NW- 6.0km and

Jhapawan Nalla- 6.0km Type of Mine is Open Cast/ Semi-mechanized, with

blasting. It is an existing mine presently closed. Existing Pits & Quarries were

reported in 2.185Ha and dumps are reported in 1.17ha. Area to be covered under

dumps by lease period is reported to be 1.17ha and area covered under pit shall be

3.85ha. No reclamation is proposed after the mining. Area to be covered under

plantation by lease period shall be 2.5 ha. Present quantity of overburden is

reported to be 20000cum and by end of the mining it would be 80000cum. Pond

in 2.185ha is reported which would cover about 3.85ha by end of mining. Water

Consumption (Avg.): Dust Suppression – 3 kl per day, Domestic activity – 2.0 kl

per day and Green Belt - 2.0 kl per day Source of water is Hand Pump/ Mine Pits.

After deliberations SEAC has asked the PP for submission of the following

information with supporting documents at the earliest:

1. Copy of mining lease and approved mining plan.

2. NOC from Forest department in prescribed formate.

3. NOC from Gram Sabha.

4. Map showing micro-level features in 2 Km radius around the mining site.

5. Details of air-modeling with predicted pollutants level.

6. All water bodies (ponds) existing or proposed should be developed

aesthetically with due safety arrangements, accordingly proposal with

schematic drawings to be furnished.

7. Environmental monitoring reports in original format to be furnished.

8. Lay out map of the site showing plantation in 33% of the lease area to be

provided.

2. 178/2008 M/s BLA Power (P) Ltd - 2X70 MW TPP, at Village Niwari Tehsil-Gadarwara Distt. Narsinghpur (M.P) EMP Presentation. PP has requested for amendment in EC for establishment of 3x45 MW (135 MW) in place of 1x70MW (70MW) capacity units.

The case was earlier recommended by the SEAC for production of power to the

tune of (2X70MW) in its meeting dated 10/12/2008. Based on the

recommendations of SEAC, Environmental Clearance was granted by SEIAA

vide letter dated 21.04.2009 for 140 MW TPP, with condition that 70 MW unit

may be set up on the available land of 77. 31 acres and remaining unit of 70 MW

will be allowed only after possession of remaining land. PP has submitted an

application for grant of EC for change in configuration from 2X70 MW (Total

140 MW) to 3X45 MW (Total 135 MW) because of unavailability of the 70 MW

units readily. It was submitted by the PP that the industry may be allowed to put

up 2X45 MW units in the available land (77.31 acres) and 1X45 MW unit may be

allowed after procurement of remaining land. The presentation made by the PP

reveals following:

3X190 TPH (Total 570 TPH) Boilers with pressure of 110 Kg/cm2 are

proposed instead of 4X150 TPH (Total 600 TPH) boilers (pressure 102

Kg/cm2).

Coal requirement shall be reduced from 2772 MT /day to 2730 MT/day

accordingly, total ash generation will be reduced by 20 TPD.

Ash Pond Size is reported to be 15.3 Acres (62,000 M²) which is same

submitted earlier.

Dense Phase Pneumatic Ash Conveying System has been proposed for ash

transportation.

No. of stacks shall be 02 in three boilers, with height of 120 meters, which

will be as per the norms of CPCB.

Emission level of 50 mg/ Nm3 shall be maintained.

Water requirement will be reduced from 13537 KLD to 11224 KLD;

accordingly waste water shall be reduced by 409 KLD.

Source of water is River Narmada for which permission from WRD has

been obtained.

ETP shall be followed by RO plant and the treated effluent will be re-

cycled in the process. The RO reject will be used as quenching of ash &

coal, remaining water shall be used for dust suppression.

STP of 100 KLD will be installed.

ESP for Boiler Exhaust gases and Dust Extraction & Dust Suppression

system for coal handling plant shall be installed along with low NOx

emission combustion system for air pollution control.

Green belt is proposed in 40 Acres out of 120 Acres.

After deliberations committee has recommended the case for grant of prior

environmental clearance for the Change in configuration from 2X70 MW

(140MW) to 3X45 MW (135 MW).

12/2,RNT Marg, Indore(M.P.)-452001 –. Enhancement of production Capacity from 16500 TPA to 66000 TPA in Mini Cement Plant at Badnawar Road ,Sardarpur, Distt.- Dhar (M.P.). ToR issued vide letter no. 1080dt. 19/11/09. Env. Consultant: Creative Enviro Service, Bhopal. (SN-29). EIA Presentation

Cement plants with <1.0 million tonnes/annum production capacity are

listed at SN 3 (b) of the schedule of EIA Notification 2006, hence required to be

appraised by the SEAC. This is a case for enhancement of production capacity

from 16500 TPA to 66000 TPA in Mini Cement Plant at Badnawar Road, Sardarpur,

Distt.- Dhar (M.P.). TOR was issued letter dated 19/11/09 and public hearing was

conducted on 15/07/2010. The EIA was presented before the committee by the PP

and his consultant. The public hearing issues were discussed in detail. The submitted

document and presentation of the case revealed following:

Nearest National Highways is Ahemadabad Highway 1.5km away from factory and

nearest City is Sardarpur 1.5 km. No Wildlife Sanctuary and National Park in the 15

Km radius of the project Site has been reported. Distance of historical places viz.

Mandu and Bagh caves are reported to be more than 10 Km. Total land available is

3.2 Ha no additional land shall be acquired for the proposed expansion. Plantation is

proposed in 1.2 ha which is more than 33% of the total area. Presently there is one

kiln of 50 TPD and three more kilns of 50 TPD each are proposed to be installed.

After deliberations committee has asked the PP to submit following information

along with supporting documents:

Compliance of Air /Water consent conditions.

Stack and Ambient air quality monitoring report in original format from

approved laboratory.

Ensured source for uninterrupted supply of raw material has to be furnished

with supporting documents.

Proposal for maintaining the emissions below 50 mg/Nm3 has to be

submitted as per the CPCB guidelines.

Measures proposed to control the air pollution during packing, loading,

unloading and transportation has to be furnished.

Detail transportation route to be furnished.

NOC from Gram Sabha and forest department has to be submitted.

Detail CSR activities with budgetary provisions to be submitted.

Prediction of pollutants after expansion to be submitted with details of

CPCB’s approved models.

Lay out map showing details of existing and proposed units and the green belt

to be furnished.

7. Case No. 576/2010 – Shri Bhupatlal Kuderia, PO- Kupi, Distt. Chhatarpur(M.P) –Banki Girauli White Clay Mine Area- 12.840 Ha with Prod. Cap- 2000 MTA at Khasra No. 234/1, Village – Banki Girauli, Tehsil- Bijawar Distt. Chhatarpur (M.P) Consultant – Creative Enviro Service, Bhopal. (SN-29). For TOR

This being a mining project with lease area between 50 ha to 5 ha is listed

at S.N. 1(a) of schedule under ‘B’ Category of EIA Notification, 2006 and is to be

appraised by SEAC. The case has been submitted for issue / approval of TOR for

carrying out EIA studies. PP and his consultant presented the salient features of

the project before the committee. Following are the features revealed from the

submission of the PP:

This is existing mine presently closed. Open cast manual mining is

proposed. Lease period is valid up to 31/01/2014. The nearest village is Banki

Girauli at 1.6 Km from the site. Nearest river is R. Barana about 04 Km from the

site. No human settlement is reported within 1 Km radius around the site.

Plantation is proposed in 33% area of the total lease area. After deliberations

committee has approved the TOR with inclusion of following: Duly attested & certified Mining Plan approved by competent authority has to

be submitted along with the copy of current lease deed and lease letter. Monitoring has to taken up as per the norms using appropriate air/water

quality modeling, based on meteorological data (wind-rose) of the region. All chemical analyses report from approved laboratory in original format. The

chemical analyses should incorporate method of analyses, instruments used and the details of standards used. The date and time of sampling should also be mentioned in the report.

All monitoring has to be conducted as per the notification dated 16/11/2009. Total area for which afforestation has been proposed – plan stating how much

plantation shall be taken up yearly, has to be submitted. Plantation of local species along with Sheesham, Neem, Tendu, Kachnar & various fire-wood trees should be taken up. Map showing green belt to be submitted.

Plantation in at least 33% of the total area has to be ensured with the lease period; accordingly plan with map depictions has to be submitted with EIA.

PFR should include cost benefit analyses considering- social cost, environment cost and pre-occupational cost.

For welfare of the mine-workers various activities such as regular health checkups, first-aid, shelter for rest and meals, drinking water etc. has to be taken up. Nearby mine owners may form a society and funds for welfare of mine-workers may be created from various govt. schemes and other sources. This aspect has to be covered in the EMP.

Management of OB solid waste generated during mining has to be addressed through incorporation of a concrete plan for the same. The OB area should be as away as possible from the water bodies in vicinity of the site.

Water-shed management plan to be submitted, in view of the damages caused in the catchment-area of rivers falling in the prescribed study area of mining region & to support the ground-water recharging.

In land use map, details regarding the agricultural crops pattern around the mining area should also be added.

Map depictions: coloured maps depicting land use of the region showing sensitive / fragile features and detailed lay-out of the site clearly showing green-belt (existing & planned)

Species proposed in the green belt development should be notified. Satellite Image of the location of mine should be submitted with demarcation

of other proposed/in operation mines in nearby area. Exact distances of nearby features have to be reported using advanced technique.

Location is also to be shown in Tehsil map procured from revenue department.

The EIA should be prepared based on model TOR for appraisal of mining projects issued by MoEF, Delhi

NOC from Gram Sabha for mining as well for supply of water from the village sources.

NOC from forest department mentioning the distances of lease area from reserve forest, wild life sanctuaries, national parks etc.

All distances have to be reported along with GPS co-ordinates. EMP should address the measures planned to protect the water bodies in

vicinity of the project site. EIA has to be conducted by NABET approved consultant only. Notifications, Rules and Guidelines issued by MoEF and CPCB from time to

time have to be followed strictly while executing the project. Accordingly, provisions have to be made in the EIA/EMP.

8. Case No. 09/2008 M/s. K. I. Agarwal, Khomarha White Clay, Ochre & Latrite Mine, Village-Khomarha Khasra No. - 751, 752, 753, 754, 755, 756, 757, 758, 759, 760, 762, 763, 764 Tehsil-Amarpatan, District- Satna: -Area is 15.30 ha and production will be 14,000 MT /annum. Env. Consultant: Creative Enviro Service, Bhopal. (SN-29). EIA Presentation

This being a mining project with lease area between 50 ha to 5 ha is listed

at S.N. 1(a) of schedule under ‘B’ Category of EIA Notification, 2006 and is to be

appraised by SEAC. TOR for carrying out EIA / EMP was issued vide letter dated

04/06/2008 and public hearing was conducted on 04/09/2010. PP and his

consultant presented the EIA / EMP before the committee. The public hearing

issues were discussed in detail. There was no adverse public hearing issue. Lease

Period is valid up to 20/07/2018. Nearest Village is Khomarha at1.25km in SW.

No national parks, sanctuary and historical place are reported in 10 km radius.

Nearest Reserve Forest is Govindgarh RF at 4km in North. Bansagar Dam is

reported in SE at 6.6km from the site. River Son is 8 Km from the site. Ultimate

Depth of Mining in lease period shall be 14.5mbgl (327.5mRL). Ground water

table in the region is 20 m bgl (322mRL). Mining shall not intersect the GW

table. After deliberation committee has sought following information from the PP

with supporting documents:

1) NOC from Forest department in prescribed formate.

10. Case No. 579/2010 M/S Shri Sandesh W.Thool, Plot No.4 Gopal Nagar, Nagpur(MH), 440022. Kamathi Opencast Manganese Ore Mines (17.558hect) at village- Kamethi Teh: Lalbara Distt- Balaghat (MP) production capacity- 858TPA.Env. Consultant: Creative Enviro Service, Bhopal. (SN-29). For TOR.

This being a mining project with lease area between 50 ha to 5 ha is listed

at S.N. 1(a) of schedule under ‘B’ Category of EIA Notification, 2006 and is to be

This is case of existing mine presently closed. Open-cast / semi-

mechanized mining is proposed. The nearest highway is Katangi-Lalbara PWD

Raod at 1.5km and Waraseoni–Lalbara PWD Road at 2.0km from the site.

Nearest Village is Kamathi Tola at 300 meter in East from the site. Nearest

Reserve Forest is Sonewani RF at 3.5km and nearest water body is Kamathi Talab

at 200 meters in West. After deliberation committee has decided to visit the site in

view of proximity of the site to water body and habitat before issuing TOR.

Following justifications were discussed in favour of the request for exemption of public hearing: The project shall have positive impact with respect to

protection of Archeological monuments located along the Urvai Gate through reduction in the vehicular emissions.

The project has strategic considerations such as protection to foreign tourists and VIPs’.

Overall the project has positive Socio-environmental impacts.

Despite of above points in favour of the project committee

found that there is no provision for exemption in public

hearing for such cases. Hence Committee can not grant
