The Chairman called to order Hearing #2016-032, Too Mart, Inc. for alleged violations of LSA-R.S. 32:1270.11.(1)(e) and

Louisiana Administrative Code Title 46. Part V. Subpart 1. Chapter 5 Motor Vehicle Salesmen; Dealers; Distributors §513. A.

License Prior to Shipment. No one from Tool Mart, Inc. attended the hearing. A court reporter was brought in to record the

transcript of the hearing, which will be made a permanent part of the Commission’s files. The following Judgment was rendered.

JUDGMENT

This cause came to be heard on Monday, November 14, 2016 before the Louisiana Motor vehicle Commission (the

“Commission”). Tool Mart, Inc., 134 Second Street, Belmont, MS 38847, did not appear at the time of the hearing, even though

properly noticed via certified mail receipt return to its President, Oneal W ood.

And after hearing the testimony adduced at trial, the receipt of documentary evidence into the record, and for reasons orally

assigned, the Commissioners of the Louisiana Motor Vehicle Commission (“the Commission”) make the following findings of fact

and conclusion of law:

Findings of Fact: Tool Mart, Inc. on and/or around October 7, 2015, sold and shipped one (1) new Tao Tao ATV

to an unlicensed Louisiana recreational product dealer, W estern Auto, LLC, 620 Bolton Avenue,

Alexandria, Louisiana; and

Tool Mart, Inc.does not have a recreational product distributor to sell said product.

Conclusions of Law: By selling and shipping one (1) new Tao Tao ATV to an unlicensed Louisiana recreational

product dealer, W estern Auto, LLC, without first being licensed by the Commission as a

recreational product distributor, Tool Mart, Inc. violated LSA-R.S. 32:1270.11.(1)(e) and

Louisiana Administrative Code Title 46. Part V. Subpart 1. Chapter 5 Motor Vehicle Salesmen;

Dealers; Distributors §513. A. License Prior to Shipment.

Considering the forgoing and pursuant to the authority vested in the Louisiana Motor Vehicle Commission set

forth in LSA-R.S. 32:1251, et seq.:

IT IS ORDERED, ADJUDGED AND DECREED that Tool Mart, Inc.be and is hereby assessed a fine in the amount of FIVE

THOUSAND AND NO/100 ($5,000.00) DOLLARS.

IT IS FURTHER ORDERED, ADJUDGED AND DECREED that Tool Mart, Inc. pay the cost of the full board hearing to the

Commission in the amount of ONE THOUSAND FIVE HUNDRED AND FORTY-EIGHT DOLLARS AND FORTY-FOUR CENTS

($1,548.44), in addition to the FIVE THOUSAND DOLLARS ($5,000.00) fine assessed herein.

The Chairman called to order Hearing #2016-043, Redneck Yacht Rentals LLC. for alleged violations of LSA-R.S. 32:1254. A.(10)

and LSA-R.S. 32:1261. A.(3)(c). No one from Redneck Yacht Rentals LLC attended the hearing. A court reporter was brought

in to record the transcript of the hearing, which will be made a permanent part of the Commission’s files. After calling witnesses

and heard their testimonies, Counselor Reggie made a motion to continue this hearing and re-service Redneck Yacht Rentals

LLC in person.

The Executive Director reported to the Commission Members regarding Harbor Freight Tools USA, Inc. (“Harbor Freight”)

advertising the term “Lowest Prices” on the sign on the front of the Gonzales store. Nonetheless, Tammy Stafford, Associate

General Counsel of Harbor Freight responded that the sign is to indicate that Harbor Freight sells “Quality Toos for the Lowest

Prices”. At this time, the Executive Director turned it to Counselor LaPeyronnie fr further reporting on his research. Counselor

LaPeyronnie stated that Harbor Freight is licensed by the Commission to sell Haul Master boat and utility trailer. This make of

trailer is sold by Harbor Freight only. After a brief discussion, Commissioner Corley made a motion to harbor Freight’s term of

“Lowest Prices” does not violate our law and rule. Commissioner Lane seconded this motion.

The Executive Director presented to the Commission Members the Comprehensive Projected Budget for 2017- 2018. After a brief

discussion regarding the budget, Commissioner Corley made a motion to adopt the following resolution:

“To adopt the Louisiana Motor Vehicle Commission Comprehensive Projected Budget for 2017 - 2018, for

submission to the Office of the Legislative Auditor.

WHEREAS, the Louisiana Motor Vehicle Commission has reviewed the Comprehensive Projected Budget for

2017 - 2018 and find same to be a complete financial plan for the ensuing year.

THEREFORE, BE IT RESOLVED, by the Louisiana Motor Vehicle Commission, that the Comprehensive

Projected for 2017 - 2018 be adopted.”

Commissioner Hightower seconded this motion and it was unanimously approved.

Commission Counsel, LaPeyronnie reported to the Commission Members regarding Case Number 16-CA-281, Kelley Blue Book

Co., Inc. DBA KBB.com versus the Louisiana Motor Vehicle Commission in the Louisiana Fifth Circuit Court of Appeals. A hearing

was held on October 26, 2016 and the Louisiana Fifth Circuit Court upheld the Commission’s decision. However, the Court has

not issued the decision.

Commission Counsel, LaPeyronnie continue reported to the Commission Members regarding his research on the Louisiana Public

Bid Law that the 2014 enactment of La. R.S. 39:1554(B) has an effect of removing “any department, office, division, commission,

council, board, bureau, committee, institution, agency, government corporation, or other establishment or official of the executive

branch of state government” from the reach of La. R.S. 39:2182. As such, these listed entities of the executive branch may accept

bids and purchase motor vehicles from dealers who do not possess a dealer’s license from the Louisiana Motor Vehicle

Commission.

After a brief discussion, Chairman Brandt stated that the Commission shall continue to enforce the law to unlicensed

manufacturers and dealers who sold to the State of Louisiana without licenses,. W e should not waive the law for the above

changes.

At this time the Executive Director reminded the Commission Members the deadline to take the mandatory courses, ethics and

preventing sexual harassment, is December 31, 2016.

After considering the entire record in these matters and the interest of the parties in amicably resolving them, the parties

have consented to a judgment in faor of the Louisiana Motor Vehicle Commission based upon alleged violations by W . L. Doggett,

LLC DBA Doggett Machinery Services of LSA-R.S. 32:1254.A.(18) and LSA-R.S. 32:1261.A.(2)(d). Therefore, based on the

parties’ mutual consent;

IT IS HEREBY AGREED by and between W . L. Doggett, LLC DBA Doggett Machinery Services and the Louisiana Motor

Vehicle Commission that respondent waives:

A. Any further procedural rights or remedies afforded under the law;

B. The requirement that the Commission's judgment recites statement of a findings of fact and conclusions

of law; and

C. All rights to seek judicial review or otherwise to challenge or contest the validity of the judgment entered

pursuant to this agreement.

IT IS HEREBY FURTHER AGREED the Notice of Hearing may be used in construing the terms of the judgment. No

agreement, understanding, representation or interpretation not contained in the judgment or the agreement may be used to vary

or contradict the terms of the judgment.

pay the cost of the pre-hearing conference to the Louisiana Motor Vehicle Commission in the amount of FOUR HUNDRED

($400.00) DOLLARS.

dismisses each of the captioned matters, with prejudice.
