sax" k' ina7mam Konek Overviewed the meeting highlights with yisaxwkwina7mam. During the Commission' s recent retreat •there was discussion of how the WFN New HousingConstruction Grant would be administered. Previouslythere was thought that the grant would be administered

by the Commission, however following discussion at theretreat, the Commission was supportive of the grant

being administered by WFN' s Housing Administrator.

Staff Entered: J. Mocilac, G. Dimmick, J. Riley and D. Corning enteredthe meeting at 9: 15 a. m.

J. Mocilac In response to saxwkewina?mam Alexander clarified that 8

houses were constructed during the period of timedeemed to be eligible for the grant in accordance with the

WFN New Housing Construction Grant Policy.

During consultation, there was a relatively large show ofsupport for the construction of a waterpark as an

alternative recreational amenity to the staff proposedrecreational amenity. Following further review, staffdetermined that the identified lot for the amenity wouldnot support a waterpark. Staff recommend that awaterpark be considered in future.

the current budget, a waterpark would likely cost anadditional $ 220, 000. 00 prior to considering developingappropriate draining for the amenity. This amount wouldsupport the development of a small waterpark. A

waterpark would further only provide seasonal access forthe Community.

sax" k' ina?mam Derickson We need to look at the community demographics and thelong term use of a waterpark. There is a question of thelong term feasibility with the declining birth rate in ourCommunity as well as the long term costs associated withthe maintenance and operation of a waterpark.

D. Corning The proposed park would support a variety of ages andprovide a sporting facility that could offer services on along term basis for the Community. The development of awaterpark on a lot this size, and at this cost, would not

support a substantial amount of activities.

K. Kingston In response to saxwk'wina?mam Konek, clarified that

concerning the potential for liabilities associated with therecreational amenity, the proponent who would constructthe amenity will be required to meet a certainconstruction threshold. Signing would also be placedaround the amenity to ensure user awareness of anypotential hazards. This action would be similar to steps

taken by other local government operations.

A traffic study will be conducted by the developerto review the impact of the increased residential

density to the Community and surrounding areas;The developer has conducted a shadow study toreview the possible impact of the proposed

development on neighbouring communities;There will be exterior and underground parkingdeveloped for the residents to lessen the impact

on the proposed site and limit traffic within the

area; and

As part of this process a traffic study will beconducted in collaboration with the Ministry ofTransportation and Infrastructure (" MOTI") who

maintain ownership of Carrington Road. Ideallyany required road improvements will be addressedby the developer.

the development plans and provide an opportunity fordocumented feedback.

MOTI has agreed to conduct a traffic review for the ElkRoad and Carrington Road intersection, however cost-

sharing has not been agreed to at this time. Staff willcontinue to work with MOTI' s traffic engineer to address

traffic concerns in this area.

G. Dimmick In response to saxwk'wina?mam Derickson further clarified

that the traffic study will review other intersections in thesurrounding area that are likely to be affected such as theButt Road and Carrington Road intersection.

sax" k' ina7rnam Derickson There is an increase in pedestrian traffic in these areas as

well that we will need to be mindful of when consideringfuture development. Further consideration will need to be

given to the impact of delivery vehicles within residentialareas as well as has been seen with the increase in online

shopping and home delivery.

G. Dimmick WFN Laws do address concerns related to deliveryvehicles and establish requirements for developers with

this consideration in mind.

P. Fosbery During the initial development, there was a light basedintersection proposed to address the concerns we are

currently experiencing however this did not receiveapproval. We could look to reopen discussion with MOTI

on this matter and review the concerns we are currently

experiencing.

G. Dimmick In response to saxwk'wina?mam Alexander clarified that

WFN Law currently establishes that the maximum numberof storeys for developments is eight.

1. Kelowna Airport DisplayCouncillor Alexander overviewed a recent meeting held with the Director of the KelownaAirport, Sam Saaddar. During the meeting there was discussion relating to opportunities forWFN informational and cultural displays at the airport. Further discussion was also had on

potential opportunities to promote aboriginal tourism on WFN lands. The Committee

determined to further discuss this opportunity at their next meeting.

2. Consultation on Agreement 2016- 03 Public Art Committee (" PAC") Terms of

Reference

The Committee overviewed the policy and provided feedback. During the review of the policythe Committee discussed the PAC' s composition, the creation of additional seats for the PAC,

the use of public spaces for art installations and meeting procedures.

3. Homelessness Report

The Committee discussed, and provided support for, the development of a proposed

Homelessness Working Group. The Working Group would consist of WFN staff members, WFNCommunity lived experience members and interested volunteers and would focus onidentifying ways to address homelessness on WFN lands and provide support services toassist those identified as homeless.

4. Next MeetingThe next Chief Saskatoon Berry Committee meeting is scheduled for spagtan ( January) 23,

2018 at 10: 00 a. m. in the Council Chambers of the WFN Government Building.

1. Formation of a Sustainability CommitteeThe Committee is going to establish a sustainability committee to spearhead the sustainabilityinitiative. It is envisioned that the committee will consist of a number of staff, Members, and

community members who have a passion for seeing sustainability measures implemented onWFN lands. Development Services staff will be creating a preliminary questionnaire to go outto staff and Members to get an idea of what the current awareness and knowledge level is,

and what kinds of sustainable practices are already happening. The questionnaire should be

ready to go out by the end of spagtan ( January) with follow- up engagement taking place insknir'mn ( February). It is envisioned that the information obtained will assist in giving thesuccessful proponent of the Request for Proposals for the Creation of a Sustainability Charteran idea of a baseline for the community.

2. Next MeetingThe next Committee meeting will be scheduled in snir'mn ( February) with the focus of themeeting being a review of the provisional budget as it relates to Chief Bitterroot line items. .

RE: Allotment Commission Council Representative

Following the last letter written by Chair Phaidra Jenner, in conjunction with, and on behalf of,the Allotment Commission, and the subsequent follow up Commission meeting where weaddressed our disappointment with the participation and representation from Councillor Konek,we agreed as a team that we would move forward together to achieve our common goal of

creating homeownership opportunities for our community members. In order to accomplish ourgoal, the Allotment Commission requires the voice of each member around the table. Our nextscheduled meeting was our weekend long retreat, with a start time of 5pm Friday.Unfortunately, the Commission was not informed until 9pm Friday evening that Councillor Konekwould not be attending any part of our meetings for the weekend due to a week- long illness.This was only communicated after attempts to contact Councillor Konek were unsuccessful. Dueto the lack of notice, the Commission was unable to make other arrangements for the AlternateCouncil member to attend, thereby wasting not only Allotment Commission funds but theAllotment Commissioners', and support staff's time, along with other WFN staff who took timeout of their Saturday to attend the retreat and discuss certain matters with the Commission.

The Allotment Commission uses these retreats as an opportunity to plan for the coming year,work through large tasks, and build camaraderie. It's quite unfortunate that Councillor Konek

was unable to attend as camaraderie is sorely needed. Likewise, Councillor Konek was not inattendance last fall for the Friday session of the retreat, again without notice of his absence orany apparent remorse for that absence. Heeding the teachings of Chief Spring Salmon, theAllotment Commissioners in attendance worked diligently through this last weekend retreat,understanding that, despite the challenges life throws our direction, we must persevere for ourcommunity and the future of the Allotment Commission.

The Allotment Commission Strategic Plan outlines our goals and how we intend to meet them.

The retreat was used to review and update our plan. We noted two goals that are particularlyrelevant to this letter.

Goal # 3 - The Commission has a good working relationship with Chief and Council.

Goal # 4 - The Commission works together as an effective decision- making team.

As we note In our strategic plan, Chief Saskatoon Berry reminds us that building a strong,healthy and vibrant team with support of our partners is crucial to our success. Currently, theAllotment Commission feels that our relationship with Chief and Council has been tarnished. Wefeel that we do not have informed and engaged representation around the Council table.

Additionally, we do not feel that Councillor Konek is participating as a part of the AllotmentCommission to contribute to our ability to be an effective team which is a critical component toachieve the goals we have set out.

Chief Black Bear teaches us that leaders are always the first to sacrifice for the good of others,and that the actions of leaders are generational in their scope and effect. We strive to operate ina professional, transparent, and respectful manner as a result of Chief Black Bear's teachings.

However, we argue that Councillor Konek has not afforded the Allotment Commission the same

professional courtesy and has instead proven that he does not want to, nor does he intend to,be a contributing or positive member of this Commission. When Councillor Konek took to officein 2016 he took an oath of office to " undertake his duties to the best of his abilities". We feel

that Councillor Konek Is purposefully stalling the Allotment Commission with his lack ofj understanding, unwillingness to listen, and plans to move towards an Allotment Commission- free

housing program. We do not feel that Councillor Konek wants to be a contributing or positivemember of the Allotment Commission.

In closing, the Allotment Commission would like to request a written statement from CouncillorKonek of his intentions and commitment to be a part of the Commission; or alternatively,request a letter of resignation addressed to the Commission outlining why he is unable to carryout his duties. We would also like to request that the Alternate Council Representative attendAllotment Meetings henceforth to ensure that the Allotment Commission has proper

representation around the Council table regardless of Councillor Konek's decisions movingforward.

breakfast, attended band office, and conducted patrols for prolific offenders.

2017- Nov- 24 FNPS conducted a school bus enforcement, School zone enforcement, attended

2017- Nov- 27 FNPS conducted patrols and hunter check stops at Gallaghers canyon. FNPS

conducted pan handler patrol, school bus enforcement, and 4 way stop signenforcement.

2017- Nov- 28 FNPS conducted surveillance on Ferry Wharf Road, panhandler patrol, 4 way stopenforcement, school zone enforcement, patrol for violent prolific offender.

2017- Nov- 29 FNPS conducted panhandler patrol, school zone enforcement, and prepare for

firearms course.

2017- Nov- 30 FNPS conducted surveillance on Ferry Wharf Road, pan handler patrol, speed

enforcement on Sneena Road, FNPS took over investigation of a marihuana grow

operation on Westbank First Nation.

iii) Describe efforts made for Recruiting

Aboriginal Policing in British Columbia is constantly interested in recruiting males andfemales whom are looking for a career in Law Enforcement. Those interested in the RCMP

Summer Student Program and Aboriginal Youth Training Programs for British Columbia are

encouraged to contact the West Kelowna First Nations Policing Unit or visit: www. rcmp- grc.

gc. ca website. A student recruiting poster has been attached to the Westbank First Nation

community news letter.

OTHER:

1. FNPS and other RCMP resources will have in numerous times during the year will have an ongoing projects on Westbank First Nation reserve. Due to the sensitivity and integrity of theinvestigations, the details cannot be divulged until charges are laid then more information

can be revealed. Currently there may have an operation being conducted on reserve.

2. Police continue to conduct drug initiatives on WFN lands through enforcement and

education. The unit may have ongoing investigations and projects. Due tc the sensitivity and

integrity of the investigations, the details cannot be divulge. Once charges are laid, moreinformation can be revealed.

3. FNPS continue to maintain and excellent relationship with WFN Law Enforcement Officers inday to day functions whether it be calls for service or general sharing of intelligence.

Note: One FNP member is off duty for the month of November.

WESTBANK FIRST NATION LAW ENFORCEMENT NARRATIVE REPORT

PART 1

This report will cover the month of November, 2017. Over this reporting period the

Law Enforcement Officers generated a total of 33 files with 15 of those files

related to WFN Members; this represents approximately 45% of the total reported

files.

WESTBANK FIRST NATION SUMMARY OF FILES AND PROJECTS

OFFICER RICHARD JOHNS

I. On November 8, 2017 Johns participated as an Honor Guard for Aboriginal

Veterans Day Ceremonies.

II. On November 16, 2017 Johns attended the residence of a sick Elder.

III. On November 18, 2017 Johns attended a meeting where a donation of$ 775. 00was received from the Okanagan Cat Coalition to assist WFN in addressing catconcerns on WFN lands.

IV. On November 22, 2017 Johns assisted an Elder with several errands.

V. On November 23, 2017 Johns provided traffic control assistance at a traffic

accident.

VI. On November 23, 2017 Johns attended Community Services to provideassistance related to a distraught woman present at the building.

VII. On November 25, 2017 Johns attended the Crown Town Home Owners

Association and provided a presentation on WFN Laws and Law Enforcement

to residents.

VIII. On November 29 and 30, 2017 Johns attended a Police Vehicle Approach

Safety Course at Squamish Nation. After the first day of training as he and twoof the Squamish Nation Peace Officers were leaving for supper, they providedassistance to a cyclist who had suffered serious injuries after being struck bya vehicle. Johns and the two other officers took care of things until help arrived.The Manager of the Squamish Nation Community Safety and Justice sent aletter of recognition to Johns' Supervisor for the assistance.

OFFICER WAYNE MURDOCK

I. On November 20, 2017, Murdock received information from WFN Public Works

that a transient camp had been observed on the north side of Sneena Roadnear the rock pile. Murdock attended the above location and after some time

searching the area the tent was located. The male inside the tent stated thathe thought he was on Crown land and apologized for the mistake. The male

advised that he would clean up all his belongings and vacate the area within20 minutes.

II. On November 28, 2017 Murdock received a voice message that had been left

1. Review of Allotment Commission Retreat

The Commission reviewed the notes from the Allotment Commission strategic

planning retreat held in katc'ac'a4tan ( November) 2017 for the benefit ofCommissioners who were unable to attend the retreat.

One of the main items discussed during this review was the implementation of Policy2015- 86 WFN Member New Housing Construction Grant. The Commission is lookingat having Housing administer the grants on the Commission' s behalf which, accordingto the xatus xwstcutan ( Council Secretariat/ Legal Counsel), would be allowed by thepolicy. There is some difference of opinion on the part of Commissioners, however,regarding what the amount of the grant should be. Commissioners agreed to defer a

decision on the amount until spagtan ( January) when the Manager of Engineering andPublic Works and Property Superintendent are able to attend an AllotmentCommission meeting to present to all Commissioners the information they presentedat the Allotment Commission retreat.

The Commission adopted the revisions to the Allotment Commission Strategic Planand the Allotment Commission annual schedule that were proposed at the Allotment

Commission strategic planning retreat held on katc'ac' a4tan ( November) 17 to 19,2017 at Summerland Waterfront Resort.

2. Allotment Commission Annual Lunch with Council / Annual Report to Council

In accordance with the mutual agreement of the Allotment Commission and Council

to meet for lunch on a semi- annual basis, the Allotment Commission requests that

Council consider scheduling this luncheon on spagtan ( January) 29, 2018. As per

section 28. 2 of the Allotment Law, the Commission is obligated to present an annual

report to Council of the Commission' s activities over the last year. The report is to be

presented by the end of February. The Commission suggests that this presentationbe scheduled on the same day as the luncheon with Council.

BACKGROUND*

Throughout September and October 2016, WFN members and residents were asked " what type of outdoorrecreation opportunities would you like to see developed in the WFN Community Core?" Display boardswere located at the Community Services, Lindley and Russel buildings, the AGM, and the Oct. MembershipMeeting. The WFN Youth Council was involved directly engaging members at other community events, andthere were also opportunities online to provide feedback via Facebook, Twitter, and Instagram.

In total, 145 responses were received. The results of the consultation included:

1. Court Sports (29%)- Basketball, hockey, ice rink, lacrosse, tennis2. Skate Park( 18%)

3. Swimming Pool/ Water Park( 18%)4. Other( 27 remaining concepts)

In November 2017 staff held a workshop to review a concept plan( attached site plan) and receiveadditional feedback. This feedback was added to the previous 145 responses and the updated results areshown below:

1. Court Sports (33%)2. Skate Park( 16%)

3. Swimming Pool/ Water Park( 16%)7. Other( 27 remaining concepts, 25% of which could be accommodated with a sports court)

The budget of$ 700,000 and space beside the Youth Centre will not accommodate all of the requested

programs. A concept that includes a sports court, skate park and a paved pump track has been developedas it could more easily realize most of the desired program elements with less compromise than a splashpark/pool. Considerations that were involved in this design are;

The proposed sports court, pump track and skate elements integrate well with the site and Youth Centreprograms. The intent of the multi use park is to be inclusive of all ages and reflective of the consultation.

A water park with a recirculating water system was estimated to be $ 500,000 and annual maintenance andoperations is estimated at$ 15k.

A water park with a drain to waste system could be included instead of a skate park for approximately220,000 however a drain to waste system does not conform to sustainability principals supported by the

Community plan. (This budget would provide a 2000sqft area with 2-3 toys and 3-5 ground sprays, forcontext west bank center spray park is 4000sqft and City Park is 12000sgft).

If the daycare is relocated to the community core in the future, a water spray park and other toddler playequipment would integrate well with that site.

Staff would like Council input and support for a design option.

Council provide initial consideration of the amendment to the Land Use Designation and zoning and initiatethe consultation process, and that Council amend the consultation period from 20 to 60 days, on the basisthat the applicant work with staff to hold an open house to inform the public of the development plans andprovide an opportunity for documented feedback.

BACKGROUND*

The property has a current Land Use Designation of Low Density Residential and is zoned Multi Family Lowdensity. The property's land use and zoning was amended in March of 2015 to accommodate a proposed54 unit duplex development. The current applicant is seeking to develop an approximate 350 unit multifamily development. The required amendment of the Land Use designation would allow for the increase indensity from the current Low Density Residential, allowing for 30 units/ hectare to the High DensityResidential which allows for 120 units/ hectare. A concurrent rezoning from MF- L to MF-H is required tosupport the multi family building type and height.

The applicant has supplied the following requirements for the Amendment application:1. Site Layout sketch

2. Building massing illustration3. Shadow study4. Landscape Plan

5. Conceptual Servicing drawing and engineering brief

As part of the approval process, the applicant will be required to complete a Traffic Impact Assessment.The developer, through its site plan and conceptual building massing, has considered impacts to theneighbouring Low Density residential development( Sonoma Pines) through the following siteconsiderations:

1. Buildings

a. The larger scale, 5 story buildings are located away from Mesa Vista Court and adjacent to CarringtonRoad

b. The building located closest to Mesa Vista Court, and the low density residential development, is 2stories and significantly set back from the property line,c. Buildings step down in elevation( from 5 to 3 stories and 3 to 2 stories) at the ends closer to the low

density residential developmentd. The shadow study illustrates that building shadows have minimal or no impact on the neighbouringhomes and their associated outdoor spaces.

e. Building orientation has been maximized to allow for views, yet to retain privacy of neighbouringdevelopments.

f. The internal road, amenity building and other onsite amenities add to the setback between the buildingsand the low density residential development.g. Parking is primarily located underground.h. Building massing illustrations show a building architecture that breaks up the monotony of long continuouslines of a large multi family building.

2. Landscapinga. The landscape plan includes a significant buffering between the existing and proposed residentialdevelopment.

Traffic Impact

As part of the approval process, a MOTI supported, Traffic Impact Assessment( TIA) will be required.

WFN has been working on traffic improvements on the Carrington Road/ Butt Road intersection for sometime and this development will have a significant impact on traffic. The TIA is intended to define the impactof the development on road infrastructure. The developer will be required to contribute to the intersection

improvements as well as remediate any negative impacts this development creates. There is the potentialthat should this development proceed, intersection improvements would benefit both this development and

Sonoma Pines.

Consultation

Staff recommend that should Council provide initial consideration, the consultation period be extended from

the minimum of 20 days to 60. During this time the applicant is to work with staff to hold an open house toinform the public of the development plans and provide an opportunity for documented feedback.

Community Plan

The WFN Community Plan, Chief Bitterroot, Land sections supports" Smart Growth" principals through theincrease of density in residential development. Through review of the initial application submission, stafffeel that the proposed development supports many of the Community Plan Principals as outlined in Section3.2 Planning and Development, specifically:

Growth Management

3.2. 1 a) Prioritize development to support compact and complete communities.

3.2. 1 d) Consider the establishment of smaller residential lots within single family developments.3.2. 1 f) Encourage multiple unit residential developments such as duplexes, triplexes, four-plexes,townhouses and apartment buildings.

Form and Character

3.2. 1 a) Ensure that new building designs integrate the character of the surrounding area, provide acompatible dynamic between adjoining sites, and create a relationship with the street.3.2. 1 b) Strive to keep neighbourhoods as compact as possible to allow people to walk or bicycle to andfrom common destinations and thereby reduce reliance on cars.3.2. 1 f) Ensure that the size, scale, massing and design features of development are harmonious and incharacter with existing development in the area, while also supporting creativity in design.

Transportation and Servicing

3.2. 1 b) Give priority to development in areas where major infrastructure services, transportation systemsand public amenities are already present and can effectively meet additional demand created bydevelopment, or where those services or systems can be provided in a timely and cost-effective manner.

The proposed development will more efficiently utilize existing infrastructure, add to the variety and numberof housing units in the region and an increase in population will support local commercial (existing andfuture) and transit development.

BACKGROUND*

in 2007 the subject property was rezoned to a Planned Unit Development zone (PUD) to permit for thedevelopment of 2 towers, 1 a proposed 4 story hotel and the second a proposed 8 story residentialdevelopment. During the approval process the applicant explored the impacts of placing the onsite Creekinto a culvert to improve the buildable space on the property. The initial report identified the level of impactculverting the creek would have and offered some compensation in the form of offsite creek restoration.The development project did not proceed. The owner of the property has listed the property for sale andnoted that its developablility is hampered by the impact and extent of the riparian area on the site.

The land owner has again retained a Biologist to assess the impact of culverting a portion of WestbankCreek. A Development Permit application has been received with the intention of proceeding with theculvert project.

The 2017 report( attached) indicates that the portion of creek reviewed has a low fish habitat value due tosignificant alteration of upstream areas. Downstream fish barriers also contribute to the low rating. No fishwere found during a fish sampling of the creek.

Cuiverting the portion of creek would result in a 100% loss of the low valued fish habitat. Downstreamimpacts to fish values are considered low as downstream fish habitat and presence area also considered tobe low.

The report notes there may be opportunities to enhance and restore some of the fish habitat in the lowerreaches of the creek.

Should Council provide initial consideration for the application, staff recommend that;1. The application be referred to a Qualified Environmental Professional( QEP) for review and comment,a. Current and previously suggested compensation possibilities to be reviewed in current context,2. should the QEP referral support the work, or recommend modifications, the applicant proceed with

detailed engineering,3. proceed with a geotechnical investigation,

4. any approved work be conduction under the supervision of a QEP.

1. Introduction

Wildrock Environmental has been retained to evaluate a proposal to culvert Westbank

Creek through their property. The property is held by a lease( locatee) by RC Leasing.Westbank Creek roughly bisects the subject property.

The owner had a proposal to develop the property as a hotel site which did not come tofruition. Subsequent to this failed proposal, the property was offered for sale. Theproperty has been listed for approximately six years but has been difficult to sell, largelydue to the constraints of Westbank Creek bisecting the property. The owner feels thatculverting the creek will allow the sale and subsequent development of the lot to moveforward.

1. 1. Description of the Property

The property is located along Highway 97 and is bordered on the east side by CarringtonRoad and on the west side by Bering Rd. It is approximately 1. 28 ha. in size and islocated opposite the Westbank Shopping Center as shown in Figure 1. The creek isincised within the property approximately 7. 5 meters resulting in a significant amount ofproperty being affected by any associated setback from the " top of bank" of WestbankCreek( side slope approximately 2: 1 or 50%).

The lands have previously housed two residences, both of which have been removed.

The subject property is located within the Westbank First Nations Reserve No.9 and iscurrently comprised of five legal lots. Legal descriptions of the lots are as follows

1. 2. Proposed Works

The proposed works ( see figure 2) consists of culverting and subsequent infilling of

approximately 80 m of Westbank Creek just upstream of the confluence with Smith

Creek. The creek is to be placed in a 1600 mm CMP. The site will be rough graded in

preparation for future construction. Appropriate sediment and erosion works will be

installed to maintain downstream water quality.

2. Westbank Creek

Westbank Creek, a tributary of Smith Creek, is approximately 2. 1 km long. It joins SmithCreek just below Carrington Road at an existing man- made pond approximately 0. 8 kms.from Smith Creeks confluence with Okanagan Lake ( see Figure 3). Westbank Creek is

spring-fed and provides year-round base flows to Smith Creek, contributing flow to anydownstream fisheries values; however, it has been highly modified; with 43% of thestream occurring within culverts, 42% ditched, 7% modified, and only 8% described asnatural.

Westbank Creek' s tributaries account for 0. 95 km of stream and are 100% modified,

with 19% culverted and 81% ditched. Westbank Creek and its tributaries account for

about 3 km of stream, 1. 4 km or 46% of which occurs within culverts within the West

Kelowna town centre.

Downstream of Highway 97 below the confluence with Westbank Creek, Smith Creek issubject to high flow rates and severe erosion potential. The increases in impervious

surfaces and high runoff rates compared to natural conditions have resulted in erosive

conditions and severe down cutting of the stream banks within this section of the creek.

In terms of water quality parameters, there was also a notable decline in water qualityas the flow travels from the upper watersheds through the areas of urban influence and

ultimately into Okanagan Lake ( RSB Engineering, 2011). The nitrate levels within SmithCreek were very high due to the current and past agricultural activities which contributeto enriched algae growth around the mouth of the creek. Chloride concentrations were

generally found to increase in the downstream reaches, particularly below the influenceof Highway 97. E Coli concentrations varied widely along the creek and were found to beextremely high in samples obtained near Bering Road.

2.1. Fish Presence

Fish sampling( electroshocking) of Westbank Creek through the subject property was

conducted by Wildrock Environmental September 25th, 2017. The entire reach of thestream throughout the subject property was sampled with no fish found. Search ofProvincial databases did not reveal the presence of fish within the subject stream reach

nor is there any recorded fish observation in Westbank Creek itself.

Downstream of the subject property, below the confluence with Smith Creek adfluvialfish presence is limited by a culvert barrier to approximately 150 m upstream of theconfluence of Smith Creek and Okanagan Lake. Resident rainbow trout have been

documented further upstream, however no fish were sampled in Westbank Creek

within the subject property as noted above. Kokanee have been observed to spawnwithin the lower reaches of Smith Creek downstream of the barrier to fish passage.

2.2. Fish Habitat

Overall fish habitat values with Westbank Creek can be described as low. WestbankCreek has an average stream gradient of 2.2%, with a minimum of 1% and maximum of

4%. Mean bank full width for Westbank Creek was approximately 1m.

The following is an excerpt from the RSB Master Drainage Report( RSB Engineering,2011) prepared for the District Of West Kelowna.

Westbank Creek was recorded as having 0% cover over 29% of the 2.1 km watercourse,while 71% of the stream was recorded as having 100% instream cover. Instream

vegetation was the only type of cover recorded for this stream and only allocated over440 m. Given that Westbank Creek is largely comprised ofculvert and ditch, it is notknown whether the 100% cover was allocated to stream segments occurring within

culverts, or if the remaining 1045 m of cover was also instream vegetation. Tributaries toWestbank Creek were similar to the main channel, with 17% of the 947 m of stream

length exhibiting 0% cover, and 83% of the streams recorded as having 100%cover.

Cover type was primarily instream vegetation."

Ecoscape ( in RSB Engineering, 2011) established a Level of Impact Rating for eachstream segment, as well as an overall Habitat Condition score for the watercourse.

Overall Smith Creek received a weighted scores equaled 2.03 (out of 6). Due to its

relatively low habitat scores, Westbank Creek received an overall rating of just 0.26( outof 6). All three tributaries to Westbank Creek received a score of 0, illustrating theextreme degree of impact of the Westbank Creek sub- basin. As comparison, Tomat

Creek, another tributary to Smith Creek, received an overall score of 1. 6

Habitat within the subject lot can be described as low with a low abundance of suitable

spawning habitat and low rearing potential. Although in a relatively natural state withlimited anthropogenic impacts, fisheries habitat potential within the subject propertyare thought to be limited due to extreme alteration of upstream areas. There are 4

known or potential barriers that exist upstream of the subject property. Due todownstream fish barriers the potential for fish to inhabit Westbank Creek is considered

to be low to nil.

2.3. Water Quality

In terms of water quality parameters, there was a notable decline in water quality as theflow travels from the upper watersheds through the areas of urban influence and

3. Discussion

3. 1. Impact to Immediate Fish Habitat

Placing Westbank Creek in a culvert through the subject will result in a 100% loss of the

associated low value fish habitat. However, as there are no fish within the subject

property or any recorded observation of fish within any portion of Westbank Creekitself, the overall impact to immediate fish habitat is considered to be low.

3. 2. Impact to Downstream Fish Values

The impact to downstream fish values is considered to be low as there is limited fish

presence downstream with limited habitat value( currently restricted to approx 150 mupstream from Okanagan Lake. However, there is some unquantified impact to

downstream habitat as a result of culverting Westbank Creek due to the potential lossof nutrients from insect fall and litter drop. This impact can be addressed bycompensation/ mitigation elsewhere. There may be an opportunity to enhance/ restoresome of the fish habitat associated with the lower reaches( Smith and Cassidy, 2007).Other opportunities should also be explored.

3. 3. Site Concerns

Potential site concerns related to this proposal include:

Streamfiow control before and during installationStormwater and erosion control during and after installation

3.4. Work Required

Detailed engineering( including geotechnical investigation) design will be required toimplement this proposal. The engineering design will investigate an overland flowrouting design redundancy to safely convey the offsite major system flows in the eventof failure or blockage of the design culvert( True Consulting Group, 2007). Legalconcerns( title, easements etc.) associated with the proposal will also have be

addressed.

This scope of this work should also include a detailed workplan to conduct all work" in

the dry" to minimize any downstream effects. The work should also be carried outunder the supervision of a Qualified Environmental Professional.

It is also acknowledged that there may be other works required as stipulated by theWestbank First Nation or others.

4. Conclusion and Certification

The culverting of Westbank Creek through the subject property will have no effects onthe fish values associated with Westbank Creek and negligible effects on the .

downstream reaches of Smith Creek. There are no fish values worth preserving withinWestbank Creek and no real opportunities to enhance or restore fish values. The cost

associated with providing access to Westbank Creek from Okanagan Lake is prohibitiveand not defensible based on the above. Any downstream effect from this project whileconsidered to be minor can be compensated/ mitigated for elsewhere.

4.1. Certification

It is the opinion of the undersigned that if the described development is implemented

as proposed, there will be no significant alteration, disruption or destruction of natural

features, functions and conditions that support fish life processes. This opinion has been

arrived at based on field sampling and observation, review of all available informationand knowledge of local conditions.
