MINUTES OF THE CITY OF LITHGOW COUNCIL MEETING HELD AT THE CIVIC CENTRE, LITHGOW ON 28th MARCH 2011

Meeting Commenced 7.01pm Public Forum: 30 PRESENT His Worship the Mayor Councillor Neville Castle Councillor H K Fisher Councillor R Thompson Councillor G Danaher Councillor J J McGinnes Councillor W Marshall Councillor C Hunter Councillor M F Ticehurst APOLOGIES An apology was received from and leave of absence granted to from Councillor W McAndrew who is out of the City on business. 11-100 RESOLVED Also in attendance Mr Roger Bailey, General Manager Miss Casey Clarke, Personal Assistant to General Manager / Mayor and Minutes Secretary Mr Andrew Muir, Group Manager Regional Services Ms Suzanne Lollback, Group Manager Community and Corporate Services Mr Iain Stewart, Group Manager Operation Services Mrs Carol Farnsworth, Internal Services Manager CONFIRMATION OF MINUTES Confirmation of the Minutes of the Ordinary Meeting of Council held on the 7TH March 2011 were taken as read and confirmed by Councillors H K Fisher and G Danaher 11-101 RESOLVED DECLARATION OF INTEREST His Worship the Mayor called for Declarations of Interest on any matter before the Meeting. QUESTIONS FROM THE PUBLIC FORUM At 7.03pm Members of public gallery were invited to participate in the Public Forum Session. PF - 28/03/11 - Tom Fitzgerald Mr Fitzgerald asked about Council visiting various roads in Portland. The Mayor advised that he, the General Manager and the Group Manager Operations undertook inspections prior to the last Council Meeting. PF - 28/03/11 - Kim Phillips Kim Phillips said that she had requested at the last Council Meeting if the staff would come and have a look at the driveway of her mother’s house in Roxborough Street, Portland. This has not happened. Mr Stewart advised that the area had been inspected and any necessary remedial action will be programmed. PF - 28/03/11 - Sue Graves 1. Mrs Graves raised concerns on the pre-poll area for the recent election which was located near the rear of the Library. This was a dangerous site to be used for such an event as cars use this area at all times. Can you please ensure that this site is not used in the future? The Mayor agreed that this site was unsatisfactory. The Group Manager Community and Corporate advised that the Electoral Office made this arrangement themselves. Council were advised at the very last minute of the venue to be used and have now advised the Electoral Commission that this site is not to be used in the future. 2. Mrs Graves advised that the area near the pre-poll was very dirty and in an untidy state. Can the Council please speak to the property owners to have this area cleaned up? The Mayor advised that Council has spoken to the property owners in the past and will ensure that his area is cleaned up in the near future.

3. Made a statement in relation to the cycle track along Farmers Creek. Mrs Graves advised that the Lithgow Tidy Towns is pleased to see the track going ahead. Lithgow Tidy Towns will be happy to continue to be involved in this matter in the future. 4. Made a statement in relation to the branding and advised that the Lithgow Tidy Towns are in favour of the new branding and wish to draw attention to the Visitor Information Guide where the branding has already been used and as to how good it looks. The present logo is a logo rather than a brand. There needs to be something to attract people to want to read about this area, the branding which is underway here is very striking and will help to move Lithgow forward. PF - 28/03/11 - Ron Murray Can Council please advise as to when the draft LEP will be back from the State Government? The Group Manager Community and Corporate Services advised that Council had received the document from the Department and a few corrections are needed to be made to the document, it will then be forwarded back to the Department. It is expected that the LUS will be available for public consultation in a couple of weeks.

LOCAL GOVERNMENT - A ROLE FOR COUNCILS 11-102 RESOLVED THAT Council:

1. declare its support for financial recognition of local government in the Australian Constitution so that the Federal Government has the power to fund local government directly and

2. for inclusion of local government in any new preamble to the Constitution if one is proposed

3. to support a referendum by 2013 to change the Constitution to achieve this recognition

ITEM: 7 NOTICE OF MOTION - 28/03/11 - TOWN CLOCK MAIN STREET LITHGOW, COUNCILLOR M F TICEHURST

11-110 RESOLVED

THAT the General Manager and Council Officers provide the Council, Councillors and ratepayers with an urgent report to Council on the current status of the repairs to the inoperative western side of the Town Clock in Main Street, Lithgow; particularly given that the original repairs only carried a 12 months warranty and the repairs and installation were undertaken on the 9 May 2010. The report is also to provide information about how this vandalism may be occurring.

ITEM:8 GM - 28/03/11 - PORTLAND GOLF CLUB MOTION

THAT Council under provide financial assistance in 2010/11 in to the Portland Golf Club of up to $10,000 in in-kind works to generally assist with the maintenance of areas of the Portland golf course and car parking areas.

ITEM: 9 REG - 28/03/11 - WATER REPORT 11-112 RESOLVED

THAT the information in relation to water management issues be noted. MOVED: Councillor G Danaher SECONDED: Councillor R Thompson. ITEM: 10 REG - 28/03/11 - RAIWATER TANK SUBSIDIES 11-113 RESOLVED THAT:

1. The information on rainwater tank subsidies be received. 2. The program be altered to provide a rebate of $150 for tanks between 2,000

and 4,999 litres and $300 for tanks over 5,000 litres. 3. The $800 rebate for tanks connected to garden taps, toilets, and washing

machines be discontinued. 4. The changes take effect for any tanks purchased after 1 April 2011.

ITEM: 12 REG - 28/03/11 - FISH WATER SUPPLY SCHEME - REVIEW OF WATER

SHARING ARRANGEMENTS 11-115 RESOLVED THAT:

1. The information in relation to the review of the Fish River Water Supply Scheme Review of Water Sharing Arrangements be received.

2. A submission be made to the Minister for Water vigorously opposing the loss of water from Lithgow City Council as well as indicating Council’s concerns in relation to the re-instatement of part of its existing allocation should the need arise and re-consideration of zero access to the scheme in the event of level 8 restrictions.

ITEM: 13 REG - 28/03/11 - FEASIBILITY OF PROVIDING RETICULATED WATER AND SEWERAGE SERVICES - DOCTORS GAP

11-116 RESOLVED THAT:

1. The report on the Doctors Gap Water & Wastewater Supply – Assessment be received.

2. A meeting be arranged with the Doctors Gap Landholders Association to discuss the findings of the report; options to proceed with the project; and cost sharing.

3. Correspondence be provided to the Sydney Catchment Authority to ascertain the possibility of providing funding to offset the capital costs of a Sewer Reticulation Project to the Doctors Gap area.

1. Council approve DA 060-08 in accordance with the conditions outlined in the attached Section 79C report.

2. A DIVISION be called in accordance with the provisions of Section 375(3) of the Local Government Act 1993.
