Purpose:Toprovideanoverviewofhowtemporarypandemicpaymentswillbeimplementedacrossthelong-termcaresector.
Introduction
• OnApril25th,2020,thegovernmentannouncedtemporaryPandemicPaymeasuresinresponsetotheongoingCOVID-19outbreak.
• Thegoalsofthistemporarypayistoprovideadditionalsupportandrelieftofrontlineworkers,encouragestafftocontinueworking,attractprospectiveemployeesandhelpmaintainsafestaffinglevelsandtheoperationofcriticalfrontlineservices.
• Thetemporarypaymeasuresconsistof:
1. Hourlypayofanadditional$4perhourforallhoursworked;and
2. Lumpsumpaymentsof$250,conditionalon100hoursormoreworkedduringadesignated4-
weekperiod,foratotalofupto$1,000over16weeks.

Eligibility

ü Allnon-managementstaffwhoareworkingon-siteinanlong-termcare(LTC)home,includingclinicalcarestaffandsupportstaff(full-time,part-timeandcasualworkers).
• Individualsemployedinamanagementcapacityarenoteligiblefortemporarypay.Thisincludesindividualsemployedinamanagementcapacityandredeployedtoanotherwiseeligibleposition.
ü Third-partyagencystafforothercontractedstaffwhoarehiredbyorotherwiseworkforaLTChomeandareworkingon-siteinaLTChome,butwhoarenotadirectemployeeofthehome
ü Staffwhoarepaidthroughprovincialfunding.• However,temporarypandemicpayisnotpayableforanyhoursworkedtoprovidecare
servicesthatwereprivatelypurchased.
WhoiseligiblefortemporaryPandemicPay?
FundingApproachAlleligiblestaffwillretroactivelyreceive:

• Hourlyincreaseof$4perhourworkedfromApril24,2020uptoandincludingAugust13,2020.Thispayisprovidedinadditiontotheirexistinghourlywages,regardlessofhowmuchthatpersonispaid;and
• Lumpsumpaymentsof$250for100hoursormoreworkedduringeachofthefollowingdesignated4-weekperiods:

• Eligiblestaffmayworktheir100hoursormorewithasingleeligibleemployerorcumulativelywithmultipleeligibleemployers.
• Whereanindividualworksformultipleeligibleemployersforacombinedtotalof100hoursormoreduringadesignated4-weekperiod,theindividualmustcompletetheTemporaryPandemicPayAttestation:MultipleEmployersform, whichwillbemadeavailableinthepolicydocument.
• Theindividualshouldsubmittheformtotheemployerwheretheyhaveworkedthemost hoursduringthedesignated4-weekperiod.
• Anemployeemaybeeligibletoreceivealumpsumpaymentforonedesignated4-weekperiodifhavingworked100hours,whiletheymaynotbeeligibleforthesubsequent4-weekperiodifhavingworkedlessthan100hours.

FundingApproachContinuedStatutoryEntitlementsandBenefits• TheMinistryofLong-TermCarewillfundtheLTChomelicensee’sshareofstatutoryentitlementsand
contributions.Theyapplyasfollows:• PandemicHourlyPayandLumpSumPayments:
• Statutoryentitlementssuchas:vacationpay;publicholidaypay;overtime• Employercontributionssuchas:CanadaPensionPlan(CPP);EmploymentInsurance(EI);
EmployerHealthTax(EHT)• Increasesinanemployer’sWSIBinsurableearningsduetotemporarypay
• Salary-relatedbenefits– suchaslifeinsurancecoverageandlong-termincomeprotection– willnotbeimpactedbythetemporarypandemicpay.
• Thetemporarypaydoesnotimpactpension(withtheexceptionofCPP),benefits,orbasesalaries.• Thetemporarypaywillnotbeprovidedforthetimeemployeeswerenotintheworkplaceforany
reason,including:• Vacation• Anyauthorizedpaidleave,includingsickleave• TimeandbenefitsawardedundertheWorkplaceSafetyandInsuranceAct,1997

• EachLTChomelicenseewillreceiveanestimatedallocationofupto$996.29perbedforeach4-weekperiodtosupportthetemporarypayforeligiblestaff.Thisincludespandemichourlypay,pandemiclumpsumpaymentandstatutoryentitlementsandcontributions.
• ForeachLTChomewith96bedsorfewer,LTChomelicenseeswillreceiveanadditionalallocationofupto$10,000foreach4-weekperiod.
• PaymentstoLTChomelicenseeswillbeprovidedintwoinstallments:• June2020:Thefirstestimatedinstallmentwillequal75%oftheLTChome’stotal16-week
allocationandwillbeprovidedasanunscheduledpayment.• July2020:Thesecondestimatedinstallmentwillbeprovidedinthescheduledmonthlypayment
andwillequaltheremainingbalance(or25%oftheLTChome’stotal16-weekallocation).

EachLTChomelicenseewillreceiveanestimatedallocationofupto$996.29perbedforeach4-weekperiodtosupportthetemporarypayforeligiblestaff.Thisincludespandemichourlypay,pandemiclumpsumpaymentandapplicableemployerstatutoryentitlementsandcontributions.
ThirdPartyAgencies• WhereLTChomelicenseesengageathird-partyserviceproviderthatemployseligiblestafftoworkfortheLTChome:
• TheprovincewillprovidetemporarypandemicpayfundstotheLTChomelicensee.
• TheLTClicenseeswillthendisbursethefundstothethird-partyserviceproviderunderanagreementthatrequiresthethird-partyserviceproviderto:
• Paytemporarypandemicpaytoeligiblestaffaccordingtothepaycalculations;
• Usetemporarypandemicpayfundsonlyforthepurposesofpayingeligiblestaff;
• Notusetemporarypayfundsforadministrativecosts,etc.;and
• Commitinwritingthatthecontractedstaffisreceivingtheappropriatetemporarypayamounts.

RedeployedStaff
• Redeployedfromaneligibleworkplace(e.g.hospitalsorotherBroaderPublicSectororganization)toworkon-siteinanLTChome:• Eligiblefortemporarypandemicpay.• Temporarypaypaidby theirhomeemployer.
• Redeployedfromanineligibleworkplacetoworkon-siteinanLTChome:• Eligiblefortemporarypandemicpay.• TemporarypaypaidbytheirhomeemployerthroughanarrangementwiththeLTChome.
• Inbothscenarios,managementstaffareineligible.

Staffredeployedfromschoolboard/university/otherBPSsectortoanLTChome:• E.g.,AjanitorisredeployedfromtheschoolboardtoworkinanLTChome.
• Theschoolboard/university/BPS(thehomeemployer)willpaythestaffpandemicpay• Theschoolboard/university/BPS(thehomeemployer)willbereimbursedfrombytheMinistryofEducationforpandemicpay
StaffredeployedfromanineligibleemployertoanLTChome:• E.g.,AdieticianredeployedfromaFamilyHealthOrganization(FHO)– primarycaresettingtoanLTChome.
• TheFHO(i.e.,thehomeemployer)willpaythestaffpandemicpay(andtheirregularwages)• TheFHOwillbereimbursedbytheLTChomethroughanagreementbetweentheFHOandLTChomewiththepandemicpayfundsprovidedfromMLTC
• Thisissimilartotheagreementwithanexternalthirdpartyagency12
ReportingTimelinesWhatinformationisexpectedfromLTChomelicensees?

• LTChomelicenseesshallsubmittworeports(Mid-TermandFinalReport)totheMinistryofLong-TermCare.• TheMid-TermReport:Two4-weekperiodsfromApril24,2020uptoandincludingJune18,2020.LTChomeswillbeaskedtosubmitthereportinJuly2020.
• TheFinalreport:Two4-weekperiodsfromJune19,2020uptoandincludingAugust13,2020.LTChomeswillbeaskedtosubmitthereportinSeptember2020.
• DetailsofthereportingprocessanddateswillbecommunicatedtoLTChomesatalaterdate.Licenseeswillsubmitreportsandattestationsthroughtheministry’sHSIMIportal.
• LTChomelicenseesshallcreateandmaintainrecordsthatdocument:• Numberofworkerhourseligibleforhourlytemporarypay,trackedpermid-termandfinalreportingperiods;
• Grossamountofhourlytemporarypaypaidouttoeligibleworkers;• Grossamountoftemporarypaylumpsumpaidouttoeligibleworkers;• Amountofstatutorycontributionspaidbyemployersduetopandemicpaytoeligibleworkers;• Amountpaidbythelicenseetoaddressstatutoryorcollectiveagreemententitlementsasaresultofprovidingpandemicpay;and
• Completedattestationsforlumpsumpayments.
Reconciliation

• Ifnecessary,theministrywillreconcile,adjustand/orrecovertheestimatedallocationpayments(includingstatutoryentitlementsanddeductions),basedontheLTChome’sMid-termandFinalReports.
• TheministrywilladjustthepaymentsaftertheFinalReporthasbeensubmittedandreviewed.
• AllfundingprovidedtoLTChomelicenseesfortemporarypandemicpaywillbereconciledthroughaseparatelineinSectionIPartAoftheLTCHAnnualReconciliationReport(ARR)attheendoftheapplicableyear.

1. Istemporarypandemicpayapplicabletoovertimehours?
Thiswilldependonthecollectiveagreement.HourlypandemicpaywillbecalculatedinaccordancewiththeEmploymentStandardsActand/ortheapplicablecollectiveagreement.Eachovertimehourworkedmayhaveanextracostontopofthe$4perhourdependingonthecollectiveagreement.
Ingeneral,overtimeisnotcalculatedonalumpsumamount,howeverlocalcollectiveagreemententitlementsmayvary.
Allhoursworkedbyeligibleworkersinaneligibleworkplacecounttowardsthecalculationofthe100hours.Fordeterminingeligibilityintermsofhoursworkedforthepandemiclumpsumpayment,allhours(includingovertimehours)arecalculatedasstraighttime.
2.Willpandemicpayimpactanyexistingbenefits?Salaryrelatedbenefitssuchaslifeinsurancecoverageandlong-termincomeprotectionwillnotbeimpactedbythetemporarypay.
Thetemporarypaydoesnotimpactpension(withtheexceptionofCPPcontributions),benefitplanspaidbyemployers,orbasesalaries.
3.Doespandemicpayapplytovacationtimeandotherpaidleave?Thetemporarypaydoesnotapplytotimewheneligiblestaffarenotintheworkplaceforanyreason.Thisincludesvacation,anyauthorizedpaidleave(includingsickleave),andtimeandbenefitsawardedundertheWorkplaceSafetyandInsuranceAct,1997.
4.Arethereplanstoexpandeligibilityforpandemicpay?Thereisalimittotheamountoffundingprovidedbythefederalgovernmentthroughoursharedagreementandaftercarefulconsideration,thegovernmentwillnotbeexpandingthepandemicpayprogrambeyondthosealreadydeemedeligible.17

5.Whyhasthistakensolongsincepandemicpaywasannounced?Pandemicpayisasignificant,complexinitiativethatwillreachover375,000employeesacross2,000employers.ThisprogramisthelargestofitskindinCanadaanditisunprecedentedinourprovince’shistory.
6.Doesthiscompensationincreaseapplytonon-unionizedemployees?Eligibleworkerswillreceivetemporarypandemicpayregardlessofwhetherthestaffaremembersofaunionoroftheirincome.
7.Someemployershavealreadybegunofferingadditionalcompensationinordertoaddressrecruitmentandretentionandtomaintainservicedelivery.Wouldemployeesreceivepandemicpayontopofthis?Eligibleemployeeswillreceivetemporarypandemicpayregardlessoftheirincome.Asaprovince,wehavelistenedandareinstitutingacommon,temporaryhourlypandemicpayforeligiblefrontlineworkers,aswellasmonthlylumpsumpaymentsforthoseworkingatleast100hoursinadesignated4-weekperiod.
