Thank you for your email of 2 Aug requesting the following information:

·~ copy of Part 2.2 and 2.5 of the Service Inquiry into the accident involving Tornado GR4 ZD743 and Tornado GR4 ZD812 over the Moray Firth on 3 Jul2012."

I am treating your correspondence as a request for information under the Freedom of Information Act 2000 (FOIA). I apologise for the delay in sending this response to you.

A search for the information has now been completed within the Ministry of Defence (MOD) , and I can confirm that all the information in scope of your request is held.

The information you have requested can be found enclosed, but some of the information falls entirely within the scope of the absolute exemptions provided for at sections 32 (Court Records) and 40 (Personal Data) and the qualified exemption provided for at section 26 (Defence) of the FOIA and has been redacted. ·

Section 32 has .. been applied to information which is held or created only for the purpose of the Service lnqui, . Section 32 is an absolute exemption and there is therefore no requirement to consider the public interest in making a decision to withhold the information.

Section 40(2) has been applied to some of the.information in order to protect personal information as governed by the Data Protection Act 1998. Section 40 is an absolute exemption and there is therefore no requirement to consider the public interest in making a decision to withhold the information.

Section 26 is a qualified exemption and is subject to public interest testing which means that the information requested can only be withheld if the public interest in doing so outweighs the public interest in disclosure.

Section 26(1 )(a) has been applied to some of the information because it contains details of the holdings of hardcopy classified material. The balance of public interest was found to be in favour of withhold ing the information given that, overall , the public interest is best served in not releasing any details of where and how the MOD secures classified material , as this would prejudice the security of UK personnel and establishments. Withholding these details does not compromise the

substantive information contained within the document provided. For these reasons I have set the level of prejudice against release of the exempted information at the lower level of "would be likely to" rather than "would".
